Consequently, there is no official government statistic that establishes what proportion of dowry-related prosecutions are fabricated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet, while the exact percentage remains unknown, available judicial records, RTI disclosures, conviction statistics, and observations of the Supreme Court reveal an important reality: a significant number of prosecutions under Section 498A of the Indian Penal Code (now reflected in the Bharatiya Nyaya Sanhita framework) do not ultimately result in conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This raises serious questions about the balance between protecting genuine victims and safeguarding innocent individuals from wrongful prosecution.<\/p>\n\n\n\n<h2 id=\"h-understanding-section-498a-and-its-purpose\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Understanding_Section_498A_and_Its_Purpose\"><\/span>Understanding Section 498A and Its Purpose<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 498A was introduced to combat cruelty and harassment of married women, particularly in cases linked to dowry demands and domestic abuse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The provision was enacted with a noble objective\u2014to provide legal protection to women facing violence and harassment within marriage. While this does not prove that all such cases are false, it highlights the need for a balanced legal approach that protects genuine victims while preventing misuse of criminal law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The challenge for India&#8217;s justice system is not choosing between victims and the accused.
