Concerns have frequently arisen where demolitions appeared to follow criminal allegations against occupants or owners, leading to accusations that demolition was being used as a form of punishment without trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recognising the seriousness of the issue, the Supreme Court of India has emphatically reiterated that no person can be deprived of property or shelter except through due process of law. Any demolition action that is arbitrary, discriminatory, selective, or motivated by extraneous considerations may violate Article 14.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has consistently held that arbitrariness is the very antithesis of the rule of law.<\/p>\n\n\n\n<h3 id=\"h-article-21-right-to-life-and-shelter\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_21_Right_to_Life_and_Shelter\"><\/span>Article 21: Right to Life and Shelter<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 21 guarantees that no person shall be deprived of life or personal liberty except according to procedures established by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Judicial interpretation has expanded the scope of Article 21 to include the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Right to live with dignity<\/li>\n\n\n\n<li>Right to livelihood<\/li>\n\n\n\n<li>Right to privacy<\/li>\n\n\n\n<li>Right to shelter<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A home is not merely a structure made of bricks and cement. It provides security, dignity, privacy, emotional stability, and social identity. Consequently, any action resulting in deprivation of shelter must satisfy the requirements of fairness, reasonableness, proportionality, and legality.<\/p>\n\n\n\n<h3 id=\"h-article-300a-right-to-property\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_300A_Right_to_Property\"><\/span>Article 300A: Right to Property<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Although the right to property ceased to be a fundamental right after the 44th Constitutional Amendment, Article 300A provides that no person shall be deprived of property save by authority of law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This constitutional protection means that property cannot be taken away merely through executive discretion.
