One such challenge is the <strong>digital memory<\/strong>. The phrase &#8220;digital memory&#8221; would mean that when some news, article, judgment, or information in any other form is published on a digital platform, it does not naturally get erased in any manner. It remains in the digital memory perpetually.<\/p><div id=\"ez-toc-container\" class=\"ez-toc-v2_0_85 counter-hierarchy ez-toc-counter ez-toc-grey ez-toc-container-direction\">\n<div consequences. If the news, article, judgment, or information published on a digital platform relates to an order, judgment, or criminal proceeding, and if the judgment is subsequently reversed by a higher court, or the criminal proceeding is set aside, quashed, or results in an acquittal, then the earlier news, article, judgment, or information may become misleading or defamatory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the perpetual accessibility of digital records becomes a significant burden and, on many occasions, prejudices the rights of the parties concerned. In today&#8217;s digital era, when someone wants to know about another person, the first step is often to search for that person on the internet through search engines and\/or social media platforms. If search engines or social media platforms continue to display outdated records, the reputation of that individual may be severely damaged. Such damage can affect a person&#8217;s life in multiple ways.<\/p>\n\n\n\n<h3 id=\"h-impact-of-digital-memory-on-individuals\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Impact_of_Digital_Memory_on_Individuals\"><\/span>Impact of Digital Memory on Individuals<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Permanent availability of outdated information.<\/li>\n\n\n\n<li>Potential harm to personal and professional reputation.<\/li>\n\n\n\n<li>Misleading portrayal of legal or criminal proceedings.<\/li>\n\n\n\n<li>Negative influence on employment, social standing, and personal relationships.<\/li>\n\n\n\n<li>Difficulty in moving beyond past allegations or proceedings despite favorable legal outcomes.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-key-challenges-created-by-digital-memory\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Challenges_Created_by_Digital_Memory\"><\/span>Key Challenges Created by Digital Memory<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Challenge<\/th><th>Impact<\/th><\/tr><\/thead><tbody><tr><td>Permanent Online Records<\/td><td>Information remains accessible indefinitely.<\/td><\/tr><tr><td>Reversed Judgments<\/td><td>Older reports may continue to misrepresent the legal position.<\/td><\/tr><tr><td>Acquittals or Quashed Proceedings<\/td><td>Search results may still display allegations despite legal relief.<\/td><\/tr><tr><td>Reputational Harm<\/td><td>Individuals may face social and professional consequences.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-the-problem\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Problem\"><\/span>The Problem<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The biggest difficulty is that there is no specific legislative framework, such as a law, Act, rule, or regulation, to deal with such situations. Further, there is no specific administrative framework, such as memorandums, advisories, or similar guidelines, issued by the Government to address this issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although the Government maintains that the existing legal framework is adequately equipped to deal with such situations, practical challenges continue to exist. However, to the great relief of the people of our country, the Hon&#8217;ble Supreme Court has already recognized the <strong>Right to Be Forgotten<\/strong> as a fundamental right guaranteed under the Constitution. Like all other fundamental rights, it is available to every citizen, subject to reasonable restrictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nevertheless, in the absence of a dedicated legal enforcement framework, the implementation and enforcement of the Right to Be Forgotten in the circumstances described above remains extremely difficult.<\/p>\n\n\n\n<h3 id=\"h-legal-and-regulatory-gaps\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_and_Regulatory_Gaps\"><\/span>Legal and Regulatory Gaps<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No dedicated law governing digital memory and outdated online records.<\/li>\n\n\n\n<li>No specific rules or regulations for enforcing the Right to Be Forgotten.<\/li>\n\n\n\n<li>Limited administrative guidance through government advisories or memorandums.<\/li>\n\n\n\n<li>Practical difficulties in removing or de-indexing outdated digital content.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-right-to-be-forgotten-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Right_to_Be_Forgotten_in_India\"><\/span>Right to Be Forgotten in India<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Aspect<\/th><th>Status<\/th><\/tr><\/thead><tbody><tr><td>Recognition by Judiciary<\/td><td>Recognized by the Hon&#8217;ble Supreme Court as a fundamental right.<\/td><\/tr><tr><td>Constitutional Protection<\/td><td>Available to citizens subject to reasonable restrictions.<\/td><\/tr><tr><td>Dedicated Enforcement Mechanism<\/td><td>Currently lacking.<\/td><\/tr><tr><td>Practical Implementation<\/td><td>Remains challenging in the absence of a specific framework.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-the-judicial-proceedings-amp-judgment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Judicial_Proceedings_Judgment\"><\/span>The Judicial Proceedings &amp; Judgment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In the above factual back ground more than 100 writ petitions were filed before the Hon\u2019ble High Court of Delhi invoking the \u2018right to be forgotten\u2019 under different factual background. In some cases, parties have settled their disputes and in some other cases, courts have acquitted\/ discharged the party from criminal cases. Some cases have other factual situations as well. However, all the parties wanted some or other digital imprints removed from internet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hon\u2019ble High Court of Delhi, after analyzing the entire law and to strike balance between the \u2018right to be forgotten\u2019 and concept of \u2018open justice\u2019 vide its Judgment dated May 29, 2026 in batch of Writ Petitions [WP(C) 1021 of 2016 &amp; others] observed as under:-<\/p>\n\n\n\n<h3 id=\"h-de-indexing-and-de-linking\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"De-Indexing_and_De-Linking\"><\/span>De-Indexing and De-Linking<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201c188. De-indexing and de-linking are terms that are used interchangeably in the context of the present proceedings, and this Court uses them to refer to the same relief, that is, the removal of a specific URL or record from the name-based search results generated by a search engine or legal database platform in response to a search query entered in the name of an individual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De-indexing does not erase the judicial record. The judgment or order continues to exist on the court&#8217;s website, on Indian Kanoon, or on whichever platform hosts it. It remains accessible to anyone who knows the case number, the citation, the court, or any other purposeful identifier. The record is preserved in its entirety for institutional, precedential and accountability purposes. What changes is only that the concerned name (whether an individual or an entity) ceases to function as an unlimited retrieval key that instantly and effortlessly surfaces the record for any casual internet user who happens to search that name. In respect to \u2018Indian Kanoon\u2019, disabling of name-based search functionality serves the purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relief of de-indexing, properly understood, is therefore not an interference with open justice. As noticed, \u2018open justice\u2019 requires that judicial records exist, be maintained and be accessible to those with a legitimate interest. De-indexing does not touch any of these requirements\u2026\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">With the above-observation, the Hon\u2019ble Court finds that de-indexing of web records does not interfere with the concept of open justice and still can be effective relief for a person who is aggrieved by some old internet record.
