When a design is copied without permission, the original designer may suffer financial losses and damage to their reputation. To prevent such unauthorized copying, intellectual property laws provide legal protection. One of the most important forms of protection is copyright law, which protects the artistic and creative aspects of fashion designs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Copyright law encourages designers to continue creating original work by giving them exclusive rights over their creations.<\/p>\n\n\n\n<h2 id=\"h-meaning-of-copyright\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Meaning_of_Copyright\"><\/span>Meaning of Copyright<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Copyright is a legal right granted to the creator of an original work. Functional Elements<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These are features necessary for the use of the clothing, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Shape of a shirt<\/li>\n\n\n\n<li>Structure of a dress<\/li>\n\n\n\n<li>Sleeves, collars, and pockets<\/li>\n\n\n\n<li>Methods of stitching<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These elements are considered functional and are generally not protected by copyright law.<\/p>\n\n\n\n<h3 id=\"h-2-artistic-elements\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Artistic_Elements\"><\/span>2. Artistic Elements<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These are creative and decorative features added by designers, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Textile prints<\/li>\n\n\n\n<li>Fabric patterns<\/li>\n\n\n\n<li>Embroidery work<\/li>\n\n\n\n<li>Fashion illustrations<\/li>\n\n\n\n<li>Decorative artwork on garments<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These artistic elements can receive copyright protection if they are original.<\/p>\n\n\n\n<h2 id=\"h-fashion-works-protected-by-copyright\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fashion_Works_Protected_by_Copyright\"><\/span>Fashion Works Protected by Copyright<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following fashion-related creations may qualify for copyright protection:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Fashion Creation<\/th><th>Protection Details<\/th><\/tr><\/thead><tbody><tr><td>Original Textile Prints<\/td><td>Unique designs printed on fabrics can be protected.<\/td><\/tr><tr><td>Fabric Patterns<\/td><td>Creative patterns and motifs designed by artists receive protection.<\/td><\/tr><tr><td>Embroidery Designs<\/td><td>Special embroidery arrangements and artistic needlework can be copyrighted.<\/td><\/tr><tr><td>Fashion Sketches and Drawings<\/td><td>Designers&#8217; original drawings and illustrations are protected as artistic works.<\/td><\/tr><tr><td>Graphic Designs on Clothing<\/td><td>Artistic images, logos, and illustrations printed on garments may qualify for protection.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-legal-framework-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Framework_in_India\"><\/span>Legal Framework in India<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-copyright-act-1957\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Copyright_Act_1957\"><\/span>Copyright Act, 1957<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Copyright Act, 1957 provides protection to original artistic works.<\/p>\n\n\n\n<h4 id=\"h-section-13\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_13\"><\/span>Section 13<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Section 13 states that copyright exists in original artistic works, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Paintings<\/li>\n\n\n\n<li>Drawings<\/li>\n\n\n\n<li>Engravings<\/li>\n\n\n\n<li>Artistic craftsmanship<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, fashion sketches, prints, and decorative artwork may receive protection if they are original.<\/p>\n\n\n\n<h3 id=\"h-designs-act-2000\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Designs_Act_2000\"><\/span>Designs Act, 2000<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Fashion designs may also be protected under the Designs Act, 2000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Designs Act protects the visual appearance of products, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Shape<\/li>\n\n\n\n<li>Configuration<\/li>\n\n\n\n<li>Pattern<\/li>\n\n\n\n<li>Ornamentation<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A fashion designer can register a design under this Act to obtain stronger protection against copying.<\/p>\n\n\n\n<h3 id=\"h-section-15-of-the-copyright-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_15_of_the_Copyright_Act\"><\/span>Section 15 of the Copyright Act<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 15 creates a connection between copyright law and design law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Section 15(2):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If a design is capable of being registered under the Designs Act,<\/li>\n\n\n\n<li>And it is reproduced more than 50 times through an industrial process,<\/li>\n\n\n\n<li>Copyright protection will cease unless the design has been registered under the Designs Act.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This provision prevents designers from enjoying perpetual copyright protection for industrial designs.<\/p>\n\n\n\n<h2 id=\"h-important-case-laws\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Important_Case_Laws\"><\/span>Important Case Laws<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-ritika-private-limited-v-biba-apparels-private-limited\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ritika_Private_Limited_v_Biba_Apparels_Private_Limited\"><\/span>Ritika Private Limited v.
