In India, the world’s largest democracy, the electoral system plays a crucial role in ensuring the representation of citizens’ political will. Election studies in India have evolved through diverse methodological approaches, including survey-based research of 1990, anthropological fieldwork, and media analysis, each contributing to a deeper understanding of voter behaviour and electoral dynamics.

Table of Contents

Toggle

Abstract

Key Focus Areas

1. There are a lot of concerns about the Election Commission of India being unfair, making mistakes and people not trusting it as much as they used to. Article 324 of the Constitution, which grants it superintendence over elections, the ECI has pursued operational enhancements, like the Special Intensive Revision (SIR) of electoral rolls, to ensure voter accuracy and inclusion.

The government even gave the Election Commission of India a budget of Rs 382.22 crore in the 2026 Union Budget, which is 25% more than before.

This paper critically evaluates the institutional efficacy, autonomy, and regulatory performance of the ECI in 2026, a period marked by heightened political polarisation, technological disruption, and increased public scrutiny. The paper also seeks to assess whether India’s electoral governance continues to uphold the principles of transparency, accountability, model code of conduct and democratic legitimacy in the evolving political landscape of 2026.

Additionally, the research evaluates the Commission’s response to emerging challenges such as digital misinformation, social media campaigning, artificial intelligence-driven political communication, and the continued reliance on electronic voting mechanisms.

Key Focus Areas

Area

Focus

Institutional Performance

Autonomy, efficacy, and regulatory performance of the ECI

Constitutional Framework

Article 324 and electoral governance

Electoral Reforms

Special Intensive Revision (SIR) of electoral rolls

Emerging Challenges

Digital misinformation, AI-driven political communication, and social media campaigning

Democratic Values

Transparency, accountability, Model Code of Conduct, and democratic legitimacy

1. The robustness of decision-making and institutional independence are improved by this multi-member organisation. The commissioners are shielded from political meddling by their six-year term, which can only be terminated by parliamentary impeachment. The ECI oversees more than 97 crore registered voters at more than 10 lakh polling places as of 2024.

Technological Advancements

The deployment of Electronic Voting Machines (EVMs) in conjunction with Voter Verifiable Paper Audit Trail (VVPAT) systems is the ECI’s most revolutionary development. By enabling voters to confirm that their votes were cast accurately, VVPAT, an independent printer connected to EVMs, greatly increases public confidence in the electoral process. A total of 873 VVPAT machines have been checked, all of which exactly match EVM counts.12

ECINET, a complete digital platform and portals for voters, officials, and political parties, will be introduced by the ECI in 2025. Challenges and Controversies

The fact that India is the world’s largest democracy is a source of great pride for Indians, particularly its leaders. Since the time of Jawaharlal Nehru, the first prime minister and statesman of India, the country has been greatly respected and admired by the international community due to its unique status. India is not a military or economic superpower, but since it is a free country governed by the rule of law, its opinions matter to the international community. Therefore, it makes sense that India has a lot riding on the success of its democracy.

Since the 1990s, when a number of high-profile scams were exposed, corruption in public life has become a major concern in India. While there have been movements against corruption in public offices in India, none have been able to capture the nation’s imagination like the anti-corruption movement led by Gandhian and social activist Anna Hazare did in 2011.

The future of India’s democracy depends on how effectively and sincerely India addresses these issues.13

Election Commission of India Under Scrutiny (2025–2026)

The Election Commission of India (ECI) faced unprecedented challenges and controversies during 2025 and 2026, with its credibility, independence, and administrative effectiveness under intense scrutiny from opposition parties, civil society, and the judiciary.

The most explosive controversy erupted in August 2025 when Rahul Gandhi, opposition in the Lok Sabha, publicly accused the ECI of systematic electoral fraud, coining the term “vote chori” (vote theft), alleging 11,956 duplicate voters, 40,009 invalid addresses, 10,452 bulk registrations, and 4,132 invalid photos.

He further cited an old woman allegedly registered twice as proof of manipulation in Bangalore Central, where Congress lost despite internal polls predicting a win. In November 2025, Gandhi expanded his allegations to Haryana, claiming 521,000 duplicate voters in the 2024 Assembly elections.

The Commission called his claims “baseless” without legal proof and confirmed after a preliminary enquiry that people had voted only once. Significantly, Chief Election Commissioner Gyanesh Kumar became the first CEC to publicly seek an apology from a senior opposition leader, marking an unusually confrontational stance.

Major Allegations and Claims

Issue

Details

Duplicate voters

11,956

Invalid addresses

40,009

Bulk registrations

10,452

Invalid photos

4,132

Haryana allegation

521,000 duplicate voters in the 2024 Assembly elections

Special Intensive Revision (SIR) of Electoral Rolls

Central to these controversies was the ECI’s Special Intensive Revision (SIR) of electoral rolls, launched in Bihar in 2025 and covering nearly 8 crore voters (about 60% of the electorate), representing the first major update since 2003.

The SIR was conducted from June to July 2025, merely four months before crucial November Assembly polls, raising concerns about haste and political motivation.

Critics argued the exercise placed an undue burden of proof on vulnerable populations, including:

Internal migrants

The homeless

Tribal communities

These groups often lack formal documents for voter verification, risking mass disenfranchisement. The exclusion of widely used IDs like Aadhaar, ration cards, and even existing voter IDs disproportionately impacted underprivileged voters.

Numerous voters reported to the BBC that draft rolls contained incorrect photos and even deceased individuals were still listed as voters.

The Court also criticised the ECI for publishing voter lists as scanned physical documents instead of machine-readable formats, though the Commission noted a 2019 Supreme Court ruling had rejected similar requests.14

Administrative and Operational Concerns

Administrative flaws were further revealed during the 2026 Maharashtra civic elections, when EVM malfunctions throughout Nagpur and Amravati caused major delays and increased mistrust.

Constitutional Concerns Over ECI Independence

Beyond operational shortcomings, the Chief Election Commissioner and Other Election Commissioners Act of 2023, which greatly increased executive influence by substituting the Union Minister of Law and Justice for the Chief Justice of India in the three-member selection committee, presented a fundamental constitutional challenge to the ECI’s independence.

Critics said that this modification violated the fundamental structure of the Constitution by eroding the separation of powers, sparking a heated debate about whether the ECI remained genuinely autonomous or susceptible to political pressure.15

The issue continued through 2025 and 2026, despite the Supreme Court’s 2024 upholding of the 2023 Act.

Key Challenges Ahead

Strengthening transparency in electoral processes.

Introducing stricter safeguards against voter manipulation.

Protecting vulnerable voters from disenfranchisement.

Improving the accuracy and accessibility of electoral rolls.

Implementing structural reforms to safeguard the ECI’s autonomy.

As India moved toward larger elections, these challenges highlighted the urgent need for greater transparency, stricter safeguards against voter manipulation, and structural reforms to protect the ECI’s autonomy.

6. Judicial Oversight and 2026 Precedents/Landmark Cases

Courts have balanced ECI powers, as in 2026 SIR hearings affirming regulated discretion. Through involvement in the Special Intensive Revision (SIR) of electoral records in West Bengal, the Supreme Court of India has demonstrated judicial monitoring over the Election Commission of India in 2026. Invoking an exceptional “trust deficit” between the state government and the ECI that jeopardised election integrity, the Supreme Court ordered the Calcutta High Court to appoint Additional District Judges to supervise the SIR process, invoking Article 142 of the Constitution.

In addition to the appointment of more than 250 judicial officials, the Court authorised the deployment of civil judges from Jharkhand and Odisha to confirm between 5 and 8 million allegations of “logical discrepancies” in voter lists. The Court strengthened constitutional protections under Articles 14, 21, and 32 that ensure natural justice and procedural fairness in electoral processes by ordering the ECI to publish 95% of processed electoral rolls by February 2026.

This judicial activism affirms that electoral integrity and citizens’ right to vote must be upheld despite political differences, highlighting the judiciary’s role as a balancing force when executive collaboration falters.16

Key 2026 ECI Case Developments

Aspect

Details

Case

Special Intensive Revision (SIR) Electoral Case (Ongoing — Judgment Reserved)17

Status

The Supreme Court reserved judgement on January 28, 2026.

Core Issue

Whether ECI’s special intensive revision process for updating electoral rolls oversteps its mandate by venturing into citizenship verification (constitutionally reserved for tribunals/central government).

Scope

SIR began in Bihar (June 2024) and expanded to 12 States/UTs by October 2024.

Key Petition

Association for Democratic Reforms vs. Election Commission of India.18

7. Conclusion

In the context of Indian democracy, the Election Commission of India (ECI) is a vital yet contentious organisation in 2026. This study shows that although the ECI still plays a crucial role in guaranteeing free and fair elections, its operation is being scrutinised more in light of political divisiveness, technical advancements, and more public scrutiny.

ECI Administration and Electoral Reforms

On the one hand, the ECI has proven to be a flexible and capable administrator. Its dedication to efficiency, modernity, and transparency is demonstrated by initiatives like the adoption of digital platforms like ECINET, the use of electronic voting machines with VVPAT, and efforts to increase electoral roll accuracy.

In a nation with a vast and diverse electorate, these advancements have improved voter turnout and streamlined election administration.

Concerns Over Electoral Integrity and Inclusion

But the study also highlights serious issues with the voting process’s legitimacy and inclusion. A rising lack of trust has been exacerbated by disputes over the Special Intensive Revision of electoral records, accusations of voter exclusion, and accusations of political actors’ prejudice.

The problem of institutional autonomy is another crucial one. Concerns regarding the ECI’s independence have been raised by modifications to the Election Commissioners’ appointment procedure. The Commission must continue to be free from political pressure. Election fairness and the legitimacy of democratic governance depend on the ECI’s impartiality.

Judicial Oversight and Constitutional Principles

Maintaining checks and balances has been greatly aided by judicial action. Principles like natural justice, procedural fairness, and accountability in electoral procedures have been highlighted by the courts.

This supervision upholds constitutional principles, but it also shows that the ECI needs more robust internal procedures to resolve conflicts and preserve openness without outside interference.

Technology and Emerging Electoral Challenges

The research also emphasises emerging challenges posed by technology, including misinformation, social media influence, and AI-driven political communication. These factors have the potential to shape voter behaviour in unprecedented ways, making it necessary for the ECI to adopt more robust and forward-looking regulatory strategies.

Key Priorities for Future Reforms

Overall, while the ECI has taken meaningful steps toward reform, there remains a clear need for further improvements.

Priority Area

Focus

Transparency

Strengthening transparency in electoral processes

Voter Participation

Ensuring inclusive voter participation

Grievance Redressal

Enhancing grievance redressal systems

Institutional Independence

Protecting the independence of the Election Commission

Final Observations

In conclusion, the ECI remains fundamental to the survival and strength of Indian democracy. Its future effectiveness will depend not only on its ability to conduct elections efficiently but also on its capacity to rebuild public trust and uphold democratic values in both practice and perception. Endnotes:

Basic Structure Doctrine – en.m.wikipedia.org

Kesavananda Bharati v. class="ez-toc-section-end">

The Election Commission of India (ECI) remains the constitutional authority responsible for conducting free and fair elections under Article 324 of the Constitution of India, making it one of the most important democratic institutions in the country.

2026 has become a defining year for the Election Commission, with increasing public scrutiny over its independence, transparency, electoral reforms, and institutional accountability.

The Special Intensive Revision (SIR) of Electoral Rolls has emerged as one of the most debated electoral exercises, raising questions about voter verification, inclusion, and protection against wrongful deletion of eligible voters.

The article examines how judicial oversight by the Supreme Court continues to shape electoral governance by ensuring natural justice, procedural fairness, and constitutional compliance in election-related matters.

The Election Commission has introduced several technology-driven reforms, including ECINET, enhanced VVPAT verification, digital electoral management, and real-time election monitoring to improve transparency.

The study highlights emerging challenges such as AI-generated political content, misinformation, deepfakes, social media campaigning, and digital election interference, requiring stronger regulatory mechanisms.

Concerns regarding the appointment process of the Chief Election Commissioner and Election Commissioners continue to generate debate over the institutional independence of the Election Commission.

The article evaluates whether the ECI is successfully balancing electoral integrity, voter accessibility, transparency, and democratic legitimacy in an increasingly polarised political environment.

Important constitutional provisions, including Articles 324 to 329, continue to form the legal foundation of India’s electoral governance framework.

The research discusses landmark judicial developments concerning the Special Intensive Revision (SIR) and explains how the Supreme Court has reinforced constitutional safeguards in election administration.

The paper recommends reforms such as Aadhaar-EPIC integration with privacy safeguards, remote voting machines (RVMs), enhanced VVPAT audits, improved grievance redressal, greater electoral transparency, and stronger institutional autonomy.

The future credibility of India’s electoral system depends upon strengthening public trust, independent election administration, technological accountability,
