Under this technology, they developed a man-made DNA construct inserted into cotton plants.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2004, Monsanto entered into a sub-license agreement with Nuziveedu Seeds and others, allowing them to develop genetically modified hybrid cotton planting seeds using the patented technology for an initial period of ten years, extendable by mutual consent. The agreement required the licensees to pay a license fee or trait value.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Disputes arose over payment of these fees, especially after government price controls on seeds. Monsanto terminated the agreement on 14 November 2015. They then filed a commercial suit seeking injunctions to stop the defendants from using their registered trademarks and patented technology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defendants argued that their activities were protected under the Protection of Plant Varieties and Farmers\u2019 Rights Act, 2001 (PPVFR Act). They also filed a counterclaim seeking revocation of the patent, claiming it violated Section 3(j) of the Patents Act, 1970, which excludes patents for plants, animals, or essentially biological processes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The single judge, while deciding the interim injunction application under Order 39 Rules 1 and 2 of the Code of Civil Procedure, directed both parties to continue fulfilling their obligations under the sub-license agreement during the pendency of the suit. The termination was held prima facie unjustified due to statutory price restrictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both sides appealed to the Division Bench of the High Court. The Division Bench dismissed Monsanto\u2019s appeal, upheld the defendants\u2019 contention regarding patent exclusion under Section 3(j), and allowed the counterclaim in part. It cited <strong>Alka Gupta v. Narender Kumar Gupta (2010) 10 SCC 141<\/strong> to underline that civil suits must follow proper procedure, including framing of issues and evidence, rather than shortcuts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While acknowledging the technical complexity involving chemical processes, DNA sequences, and plant traits, the Court left all questions of fact and law open for decision in the suit.
