The Cockroach Janta Party, or CJP, started in May as an online joke aimed at a judge’s offhand remark. In a post on X, he warned that “those who try to harm the future of our youth will not be spared.” Police have already begun acting on that line, and dozens of FIRs have been filed against protesters in Delhi and Mumbai. If you’re wondering what “legal action” actually means here — jail, fines, a court date, or something else — here’s a breakdown.

First, What Actually Happened

The protests turned violent on July 20, when a march toward Parliament was stopped at police barricades. Officers used tear gas and batons; some protesters threw stones and, in one widely shared video, chased and assaulted a paramilitary jawan. Delhi Police say around 118 of their personnel and 60 protesters were hurt, and 15 to 20 government vehicles were damaged.

That single day’s clashes led to 10 FIRs across five police stations in Delhi. Mumbai, where sympathy protests have been running since mid-July, has racked up 13 FIRs against more than 400 people in less than a week.

Key Incidents at a Glance

Incident

Details

Date of Major Clashes

July 20

Location

March towards Parliament, Delhi

Police Personnel Injured

Approximately 118

Protesters Injured

Approximately 60

Government Vehicles Damaged

15–20

Delhi FIRs

10 FIRs across five police stations

Mumbai FIRs

13 FIRs against more than 400 people

The Actual Charges Being Used

Indian police aren’t inventing new laws for this. They’re reaching for the standard toolkit used against any protest that crosses from peaceful assembly into confrontation with police:

Rioting and Unlawful Assembly

Once a gathering is declared unlawful or turns violent, everyone present can be charged under these provisions of the Bharatiya Nyaya Sanhita (BNS), the code that replaced the old Indian Penal Code in 2023. You don’t have to have thrown a stone yourself—simply being part of a group where violence occurred can be enough to attract this charge.

Obstructing or Assaulting a Public Servant

This covers pushing through barricades, snatching a police officer’s helmet or jacket, or physically confronting security personnel—all things Delhi Police have specifically cited in their FIRs.

Vandalism and Damage to Public Property

Damaged vehicles and broken barricades fall here. This charge tends to be applied broadly and can catch people who were near the damage even if they didn’t cause it.

Violating Prohibitory Orders

Many of the Mumbai FIRs cite this. If police have declared an assembly restriction in an area—commonly known by its old IPC number, Section 144—simply showing up to protest there can be a violation, regardless of whether anything turns violent.

Wrongful Restraint

This applies where protesters blocked roads or stopped traffic, which happened at several Mumbai protest sites.

Summary of Alleged Offences

Alleged Offence

Typical Conduct Covered

Rioting and Unlawful Assembly

Participation in a gathering that turns violent

Obstructing or Assaulting Public Servants

Pushing barricades, confronting police personnel

Damage to Public Property

Damaging vehicles or government infrastructure

Violating Prohibitory Orders

Participating in protests despite Section 144 restrictions

Wrongful Restraint

Blocking roads or preventing movement

None of these are new or unusual. Similar sections were used against JNU students during the 2019 fee-hike protests and against AAP leaders during a 2024 march on the BJP headquarters. What makes this round notable is the scale—hundreds of names in Mumbai alone—and Modi’s direct, public warning, which signals the crackdown has political backing at the top.

Could This Escalate Further?

There’s a pattern worth knowing about. In an unrelated Delhi protest earlier this year, police added a charge of “imputations and assertions prejudicial to national integration” — a much more serious national-security-adjacent provision — after protesters raised slogans linked to a banned Maoist group. That’s a reminder that what starts as a rioting or vandalism case can, in theory, be escalated if police decide the conduct crosses into something they consider a threat to public order or the state. So far, there’s no indication that’s happened with the CJP protests, but it shows the ceiling is higher than “just a fine.”

Also Read: File Legal Notice in India: Complete Guide to Drafting, Procedure, Cost & Legal Rights

Possible Legal Consequences

For most protesters booked so far, though, the realistic range is the following:

Being named in an FIR, which starts a police investigation.

Possible arrest and a court appearance, often followed by bail.

If convicted, penalties vary by charge—some carry only fines, and others carry jail time of a few years, depending on how the courts read the specific facts of each case.

How Police Identify Accused Persons

Many FIRs, especially the Delhi ones tied to the July 20 violence, were initially filed against “unidentified persons.” Police then work backward from video footage and crowdsourced photos to identify and add names—which is why organizers have urged people to stay off camera during confrontations with police.

Getting Legal Help Quickly

If you or someone you know gets named in an FIR, the first few hours matter — you generally want advice on whether to seek anticipatory bail, how to respond if police call you in, and what to say (or not say) on record. Finding a lawyer fast isn’t always easy, especially at odd hours or outside your home city.

This is where platforms like Counvo come in. Counvo is a legal-tech app built to connect people with a lawyer in minutes rather than days through in-app chat or a call instead of the usual process of asking around for referrals. For someone who’s just been added to an FIR and needs to understand their options before a court date, that kind of quick access can make a real difference. It’s worth having something like this bookmarked before you need it, not after.

What This Means if You’re a Student Thinking of Joining

Simply standing at Jantar Mantar with a placard isn’t, by itself, a crime. The charges being used target specific acts—breaching barricades, damaging property, assaulting officers, and ignoring a prohibitory order—not peaceful presence. But Indian protest law also makes it possible to be swept into a group charge just for being part of a crowd where violence happened, even without personally doing anything violent. That’s the real risk students are weighing right now, and it’s exactly why CJP leadership announced this week that they’re pulling back from street marches and shifting toward sit-ins, citing safety concerns for their supporters.

Latest Government Response

Modi has also promised fast-track courts to prosecute those responsible for the exam leaks themselves — a separate track aimed at the alleged culprits behind the NEET scandal, not the protesters.
