However, sometimes it becomes much more than that; it becomes a constitutional conversation. The recent protests at Jantar Mantar were not only about examination irregularities or the demand for the resignation of the Education Minister. They raised larger questions about students’ rights, governmental accountability, the right to peaceful protest, and public trust in India’s examination system.
<div References

This article examines the movement through a constitutional and legal lens while also acknowledging the concerns of thousands of young people who believe that their future deserves greater protection and transparency.

Controversial Remarks and Public Reaction

Imagine if a person holding one of the highest judicial offices in the country made a remark like the following:

“There are youngsters like cockroaches who don’t get any employment. Some of them become media persons, some become activists, and they start attacking everyone… parasites of society.”

This remark was reportedly made by the chief justice of India, Surya Kant. He later clarified that his remarks had been misquoted and stated that they were directed at individuals allegedly using fake degrees rather than at the country’s youth.

But these remarks reportedly triggered a massive backlash, particularly among young people. Abhijeet Dipke, a political communication strategist, then formed a satirical political movement called the Cockroach Janta Party (CJP) on 16 May 2026.

Dipke reclaimed the alleged insult by launching the CJP with mock-serious membership criteria:

Being unemployed.

Being lazy.

Being chronically online.

Being able to rant professionally.

In one of his interviews, he stated that it started as a joke but quickly gained support from many young people who identified with the movement and its message.

Why Did Students Protest?

Following the NEET-UG paper leak controversy, many students and members of the public began questioning the government’s handling of public examinations. The CJP publicly supported the protesting students and provided them with a platform to voice their concerns.

The movement first gained popularity on social media before organizing peaceful demonstrations. It was organized by Abhijeet Dipke, and later environmental activist Sonam Wangchuk joined the protest.

The protesters demanded accountability for the alleged examination irregularities and called for those responsible to face appropriate legal consequences. Many protesters also demanded that the education minister accept political responsibility and resign.

Five Major Demands of the Cockroach Janta Party

The five major demands published by the CJP were:

Demand

Objective

Create a new Public Examination Act.

Promote transparency and accountability.

Establish new examination authorities.

Reform the existing examination bodies.

Develop a Students’ Rights Charter.

Strengthen the legal protection of students.

Create a welfare fund for students and their families.

Provide financial and institutional support.

Establish consistent parliamentary oversight.

Ensure accountability of examination authorities.

What Has the Education Minister Said About the Protest?

Education Minister Dharmendra Pradhan criticized the ongoing opposition-led protests, describing them as a political spectacle aimed at disrupting Parliament rather than seeking solutions.

He assured the public that the government would introduce systemic improvements to strengthen the examination system and prevent similar controversies in the future.

In recent developments, Prime Minister Narendra Modi announced the establishment of fast-track courts for paper leak cases. However, the government did not directly address the protesters’ demand for the Education Minister’s resignation.

Constitutional and Legal Issues Raised by the Protests

The controversy, however, extends beyond political disagreement. It raises important constitutional questions about the right to protest, governmental accountability, and the integrity of India’s public examination system.

Right to peaceful protest.

Governmental accountability.

Protection of students’ rights.

Transparency in public examinations.

Public trust in India’s examination system.

The Constitutional and Legal Perspective

Now let’s see which constitutional rights are involved for the protesters and the students.

Article 19(1)(a): Freedom of Speech and Expression

First of all, Article 19(1)(a) of the Constitution of India guarantees all citizens the freedom of speech and expression, allowing them to express their thoughts, ideas, and opinions freely through speech, writing, art, or peaceful protest.

Article 19(1)(b): Right to Peaceful Assembly

Article 19(1)(b) of the Constitution guarantees citizens the fundamental right to assemble peacefully and without arms. This includes the right to hold public meetings, peaceful protests, and processions. In this case, the students were peacefully protesting at Jantar Mantar and in several other parts of India.

Article 14: Equality Before the Law

Article 14 of the Constitution guarantees equality before the law and protects citizens against arbitrary or unfair state action.

Article 21: Right to Life and Personal Liberty

Article 21 of the Constitution guarantees that no person shall be deprived of his or her life or personal liberty except according to the procedure established by law.

Allegations of Police Force During the Protests

During the protests, allegations were made that police used force to remove peaceful protesters. They may also impose restrictions where there is an imminent threat to public order.

When the protesters attempted to march from Jantar Mantar towards Parliament, they reportedly did not have permission from the Delhi Police. The Delhi Police also stated that no NOC had been granted for the march, following which barricades were placed to stop the protesters.

Is Protesting at Jantar Mantar a Legal Right?

Yes. Holding a peaceful protest at designated locations such as Jantar Mantar is generally recognized as a lawful exercise of the right to peaceful assembly. However, this right is not absolute and is subject to reasonable restrictions.

For example, protests should not block public roads, create serious public inconvenience, or become violent. Organizers are generally expected to obtain the necessary permissions from the authorities, and the protest must remain peaceful throughout.

Key Conditions for Lawful Protests

Remain peaceful and non-violent.

Do not block public roads or essential services.

Avoid causing serious public inconvenience.

Obtain the necessary permissions or NOC where required.

Comply with lawful directions issued by the authorities.

Can the Police Restrict a Protest?

Yes. The police can legally restrict or stop a protest, but only under specific circumstances, such as maintaining public order, ensuring public safety, or preventing serious traffic disruption.

Article 19(3) of the Constitution permits the state to impose reasonable restrictions on the right to assemble peacefully in the interests of the sovereignty and integrity of India and public order.

Similarly, Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) (which replaced Section 144 of the Code of Criminal Procedure) empowers an executive magistrate to prohibit public assemblies in urgent situations where there is a threat to public order or public safety.

According to reports, these restrictions were imposed when protesters attempted to march from Jantar Mantar towards Parliament on 20 July 2026.

Grounds for Police Restrictions

Legal Provision

Purpose

Article 19(3) of the Constitution

Allows reasonable restrictions on peaceful assembly in the interests of sovereignty, the integrity of India, and public order.

Section 163, Bharatiya Nagarik Suraksha Sanhita (BNSS)

Empowers an executive magistrate to prohibit public assemblies in urgent situations affecting public order or public safety.

Students Continued the Protests

Despite these restrictions, many students continued protesting because they believed that repeated examination controversies had undermined years of hard work and affected their future. Many protesters also believed that the government’s response had not adequately addressed their concerns.

Section 141 of the Indian Penal Code and Unlawful Assembly

According to reports, Section 141 of the Indian Penal Code was also invoked in relation to unlawful assembly. Section 141 defines an unlawful assembly as a gathering of five or more persons with a common object that falls within the categories specified by law.

Whether the facts of a particular protest satisfy those legal requirements depends upon the evidence and is ultimately a matter for the courts to determine.

Many protesters argued that they were treated as criminals despite claiming that their protest remained peaceful. Whether the police action was legally justified remains a matter of public debate and legal scrutiny.

Constitutional Rights and Legal Provisions at a Glance

Provision

Subject

Relevance to the Protests

Article 19(1)(a)

Freedom of Speech and Expression

Protects the right to express opinions through peaceful protest.

Article 19(1)(b)

Right to Peaceful Assembly

Protects peaceful public meetings and demonstrations.

Article 14

Equality Before the Law

Protects against arbitrary or discriminatory state action.

Article 21

Right to Life and Personal Liberty

Protects life and personal liberty according to law.

Article 19(3)

Reasonable Restrictions

Permits restrictions on peaceful assembly to maintain public order.

Section 163, BNSS

Restriction on Public Assemblies

Allows temporary prohibition of assemblies in urgent situations.

Section 141, Indian Penal Code

Unlawful Assembly

Defines when an assembly may be treated as unlawful under law.

Why Are Examination-Related Controversies So Serious in India?

Examination-related controversies are particularly serious in India because competitive examinations often determine access to higher education, professional careers, and government employment.

Examinations such as NEET and various public recruitment tests serve as gateways for millions of students competing for a limited number of seats and jobs. As a result, any allegation of paper leaks or examination malpractice can seriously affect public confidence in the system.

Many students invest years of hard work, financial resources, and emotional commitment in preparing for these examinations. When controversies arise, many feel that their efforts have been unfairly undermined.

There have also been reports of students experiencing severe mental distress, and in some cases, deaths by suicide have been linked to examination-related pressures. Therefore, maintaining transparency, fairness, and accountability in public examinations is essential for protecting both merit and public trust.

Key Reasons Why Examination Controversies Matter

Competitive examinations determine admission to higher education.

They influence professional careers and government employment.

Paper leaks and malpractice can erode public confidence.

Students invest years of preparation and significant financial resources.

Examination-related stress has been associated with serious mental health concerns.

Transparency and accountability are essential to preserve merit and public trust.

What Legal Responsibilities Does the Government Have?

The government has several important legal responsibilities towards students and citizens, including:

Ensuring fair, transparent, and credible examinations.

Conducting prompt and impartial investigations into examination-related offenses.

Holding those responsible accountable through due process of law.

Strengthening examination authorities through appropriate reforms.

Providing speedy justice in cases involving examination malpractice.

Respecting and protecting citizens’ constitutional right to peaceful protest while maintaining public order.

Summary of Government Responsibilities

Responsibility

Purpose

Fair and transparent examinations

Protect merit and maintain credibility.

Prompt investigations

Address allegations of examination malpractice.

Legal accountability

Ensure offenders are prosecuted through due process.

Institutional reforms

Strengthen examination authorities and systems.

Speedy justice

Resolve examination-related cases without undue delay.

Protection of peaceful protest

Safeguard constitutional rights while maintaining public order.

Broader Questions of Transparency and Accountability

Ultimately, the debate is no longer confined to a single examination or a single protest. It raises broader questions about transparency, institutional accountability, and the confidence that young citizens place in India’s public institutions.

The Jantar Mantar protests are not merely about one examination, one minister, or one political movement. They represent a larger conversation about trust, accountability, and the future of millions of students whose lives are shaped by public examinations. While the Constitution guarantees the right to peaceful protest, it also expects both citizens and the state to act responsibly within the framework of the law.

Whether one agrees with every demand made by the protesters or not, one fact remains undeniable: students deserve an examination system that is fair, transparent, and worthy of their trust. A democracy grows stronger when citizens raise their concerns peacefully and when institutions respond with accountability rather than silence. Ultimately, the true success of any education system is measured not only by the examinations it conducts but also by the confidence it inspires among those who place their future in it.

Key Takeaways

Competitive examinations have a significant impact on students’ futures.

Fairness and transparency are essential to preserve public confidence.

The government has legal obligations to investigate and address examination malpractice.

Institutional accountability strengthens democratic governance.

Peaceful protest is constitutionally protected, subject to the rule of law.

A trustworthy examination system benefits both students and society.

Disclaimer

This article is intended solely for educational and informational purposes.
