The judgement reinforces the principle that once a settlement is formally recorded by a competent court and granted the status of an enforceable executive instrument, it attains finality and is no request the court to record their agreement, neither party can subsequently challenge that settlement before the Court of Appeal or the Court of Cassation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same legal principle, the court observed, also applies to settlements concluded before the Court of Appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling underscores that the judicial recording of a settlement is intended to bring litigation to a definitive end, preventing either party from reopening issues that have already been resolved by mutual class=\"wp-block-paragraph\">The husband approached the Court of First Instance seeking formal recognition of a divorce that he claimed had been pronounced through an email sent on June 28, 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The wife contested his version, asserting that she had never received the email and only became aware of the divorce on September 3, 2025.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She consequently filed a counterclaim seeking various financial entitlements, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Spousal maintenance;<\/li>\n\n\n\n<li>Deferred dowry;<\/li>\n\n\n\n<li>Compensation arising from the marriage;<\/li>\n\n\n\n<li>Claims relating to a proposed jointly owned business;<\/li>\n\n\n\n<li>Medical insurance expenses;<\/li>\n\n\n\n<li>Travel expenses; and<\/li>\n\n\n\n<li>Interim monthly maintenance.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-financial-claims-raised-by-the-wife\" class=\"wp-block-paragraph\">During the proceedings before the Court of First Instance, both spouses appeared personally and chose to resolve all outstanding disputes through negotiation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement provided for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Official recording of the divorce;<\/li>\n\n\n\n<li>Payment of <strong>AED 125,000<\/strong> by the husband;<\/li>\n\n\n\n<li>Full and final settlement of every financial claim arising from the marriage and separation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The agreed amount covered:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Deferred dowry;<\/li>\n\n\n\n<li>Waiting-period (Iddah) maintenance;<\/li>\n\n\n\n<li>Compensation;<\/li>\n\n\n\n<li>Spousal maintenance;<\/li>\n\n\n\n<li>Company-related claims;<\/li>\n\n\n\n<li>Medical insurance obligations; and<\/li>\n\n\n\n<li>Other ancillary financial rights.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The husband was permitted to discharge the amount through instalments until the entire settlement sum was paid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On <strong>15 October 2025<\/strong>, the Court of First Instance formally recorded the settlement and granted it the status of an enforceable consented to the agreement before the trial court, the husband subsequently attempted to challenge it before the Court of Appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the appeal was declared inadmissible on <strong>18 December 2025<\/strong>, he approached the Dubai Court of Cassation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His principal arguments were:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The settlement agreement had been drafted in English;<\/li>\n\n\n\n<li>He allegedly did not understand English;<\/li>\n\n\n\n<li>No interpreter had been present during the proceedings, and<\/li>\n\n\n\n<li>He had been compelled to accept the obligation to pay AED 125,000.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-court-of-cassation-rejects-the-challenge\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Court_of_Cassation_Rejects_the_Challenge\"><\/span>Court of Cassation Rejects the Challenge<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Dubai Court of Cassation rejected each of the husband&#8217;s arguments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Referring to <strong>Article 81 of the UAE Civil Procedure Law<\/strong>, the court observed that parties are free, at any stage of litigation, to request the court to record any lawful settlement reached between them, provided it does not violate UAE law, public order or public morality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court explained that once such a settlement is entered into the official court record, the hearing minutes become an official legal document unless successfully challenged on grounds such as forgery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, both the hearing minutes and the attached settlement agreement acquire the legal force of an executive instrument capable of direct enforcement.<\/p>\n\n\n\n<h3 id=\"h-legal-principles-highlighted-by-the-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Principles_Highlighted_by_the_Court\"><\/span>Legal between a judicial decision and the recording of a settlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court of Cassation explained that when a judge records a settlement voluntarily reached by the parties, the judge is not adjudicating the dispute or deciding competing legal claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the judge merely authenticates the agreement reached by the parties while exercising an administrative function.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the court is not issuing a judicial determination on the merits, the recording of the settlement does not constitute an appeal-able judgement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, such an order cannot be challenged either before the Court of Appeal or before the proceedings was also rejected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court found that the official hearing record clearly showed the presence of a certified legal translator who translated the proceedings and fulfilled all procedural requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since the official court record contradicted the husband&#8217;s allegation, the argument was dismissed.<\/p>\n\n\n\n<h2 id=\"h-final-outcome\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Final_Outcome\"><\/span>Final Outcome<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Dubai Court of Cassation ultimately dismissed the husband&#8217;s challenge in its entirety.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to rejecting the appeal, the court:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ordered the husband to bear the legal costs; and<\/li>\n\n\n\n<li>Directed that the court deposit be forfeited.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement therefore remains fully valid and enforceable.<\/p>\n\n\n\n<h3
