These matters require a careful understanding of the UAE&#8217;s procedural and commercial laws governing jurisdiction, dispute resolution, and enforcement mechanisms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recognising the growing importance of international commerce, the UAE has introduced substantial legal reforms in recent years to strengthen investor confidence and streamline commercial dispute resolution. These reforms have enhanced legal certainty, improved procedural efficiency, and reinforced the country&#8217;s reputation as a reliable venue for resolving international commercial disputes. This article examines the principal legal principles governing jurisdiction, recognition of foreign judgements, and international commercial arbitration under the UAE legal framework.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h1 id=\"h-judicial-jurisdiction-of-uae-courts-over-foreign-defendants\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judicial_Jurisdiction_of_UAE_Courts_over_Foreign_Defendants\"><\/span>Judicial Jurisdiction of UAE Courts over Foreign Defendants<span class=\"ez-toc-section-end\"><\/span><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">One of the first issues in any international commercial dispute is determining whether the courts of a particular country have the authority to hear the case. An important exception exists for disputes concerning immovable property situated outside the UAE, which generally fall outside the jurisdiction of UAE courts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law also extends jurisdiction to certain disputes involving foreign defendants who neither reside nor maintain a domicile in the UAE. Such circumstances include cases where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The foreign defendant has elected a legal domicile within the UAE<\/li>\n\n\n\n<li>The dispute concerns property situated in the UAE<\/li>\n\n\n\n<li>The matter relates to succession or an estate administered within the UAE;<\/li>\n\n\n\n<li>the contractual obligation arose, was performed, or was intended to be performed within the UAE;<\/li>\n\n\n\n<li>The contract is one that requires authentication in the UAE<\/li>\n\n\n\n<li>the cause of action or wrongful act occurred within the UAE; or<\/li>\n\n\n\n<li>The dispute relates to bankruptcy proceedings declared by a UAE court.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These statutory connecting factors ensure that commercial disputes possessing a genuine nexus with the UAE may be adjudicated by UAE courts, even where one of the parties is a foreign entity with no permanent presence in the country. This approach reflects internationally accepted jurisdictional principles while protecting legitimate commercial interests within the UAE.<\/p>\n\n\n\n<h3 id=\"h-incidental-claims-and-interim-relief\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Incidental_Claims_and_Interim_Relief\"><\/span>Incidental Claims and Interim Relief<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Procedure Law further empowers UAE courts to entertain incidental claims and related legal issues arising from the principal dispute. Such powers are particularly valuable in commercial disputes where immediate action may be required to preserve assets or protect contractual rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where a defendant fails to appear before the court, the law imposes an independent duty upon the court to examine whether it possesses jurisdiction. If jurisdiction is absent, the court must declare so on its own motion. Witnesses, litigants, and other participants may give evidence through qualified interpreters who have taken the prescribed legal oath.
