More importantly, the Bench openly questioned the very applicability of the anti-terror law to the allegations arising out of the 2024 Haldwani violence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s pointed query\u2014<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;How is UAPA attracted just because the mob burnt the police station?&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">\u2014is likely to become one of the most discussed judicial observations on the scope of India&#8217;s anti-terror legislation.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-citation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Citation\"><\/span>Citation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><th>Case<\/th><td><strong>State of Uttarakhand v. Abdul Malik<\/strong><\/td><\/tr><tr><th>Case Number<\/th><td>SLP (Criminal) No. 12779 of 2026<\/td><\/tr><tr><th>Court<\/th><td>Supreme Court of India<\/td><\/tr><tr><th>Date of Decision<\/th><td>31 July 2026<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-background-of-the-haldwani-violence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Background_of_the_Haldwani_Violence\"><\/span>Background of the Haldwani Violence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The controversy stems from the Banbhoolpura violence in Haldwani on <strong>8 February 2024<\/strong>, which erupted following an anti-encroachment drive involving demolition of an allegedly unauthorized madrasa and mosque.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the prosecution:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A large mob allegedly attacked police personnel;<\/li>\n\n\n\n<li>Police vehicles were burnt<\/li>\n\n\n\n<li>Petrol bombs were allegedly used<\/li>\n\n\n\n<li>The Banbhoolpura Police Station was set on fire<\/li>\n\n\n\n<li>Several police officers sustained injuries.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Abdul Malik was alleged to be one of the principal conspirators behind the violence. He was subsequently booked under multiple provisions of the IPC, the Arms Act, and the UAPA.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-why-did-the-high-court-grant-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_Did_the_High_Court_Grant_Bail\"><\/span>Why Did the High Court Grant Bail?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Uttarakhand High Court granted bail on <strong>16 April 2026<\/strong> after noting, among other things:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The investigation itself suggested that Abdul Malik was not physically present at the place of occurrence;<\/li>\n\n\n\n<li>Similarly placed co-accused had already obtained bail;<\/li>\n\n\n\n<li>The prosecution material did not conclusively establish conspiracy at the stage of bail.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The State challenged the order before the Supreme Court, arguing that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Malik was the principal conspirator;<\/li>\n\n\n\n<li>Physical presence was unnecessary where conspiracy was alleged;<\/li>\n\n\n\n<li>The High Court had ignored the restrictive bail provisions contained in <strong>Section 43D(5) of UAPA<\/strong>.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-supreme-court-s-central-question-does-every-violent-riot-become-terrorism\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Courts_Central_Question_Does_Every_Violent_Riot_Become_Terrorism\"><\/span>Supreme Court&#8217;s Central Question: Does Every Violent Riot Become Terrorism?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most remarkable aspect of the hearing was not the dismissal of the State&#8217;s appeal but the Court&#8217;s questioning of the legal foundation for invoking UAPA itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During arguments, the State contended that the police station had been attacked using petrol bombs and that such acts justified invocation of UAPA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Joymalya Bagchi, however, posed a fundamental constitutional question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;If a mob goes and burns down a police station, will that per se attract UAPA?&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">When the State attempted to justify the invocation by referring to disturbance of public order, the Court distinguished public order from national security, observing that the two cannot automatically be equated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Bench even remarked that it had <strong>&#8220;serious doubt&#8221;<\/strong> regarding the addition of UAPA charges.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-public-order-is-not-the-same-as-terrorism\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Public_Order_Is_Not_the_Same_as_Terrorism\"><\/span>Public Order Is Not the Same as Terrorism<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The observations reaffirm an important constitutional principle that has consistently emerged from Indian jurisprudence.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Every violent offense is undoubtedly serious.<\/li>\n\n\n\n<li>Every riot deserves prosecution.<\/li>\n\n\n\n<li>Every attack on police personnel deserves strict punishment.<\/li>\n\n\n\n<li>Yet, every criminal act is not terrorism.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction has always been critical because UAPA is not an ordinary criminal statute. It is India&#8217;s principal anti-terror legislation, carrying exceptionally stringent provisions regarding investigation, custody, and bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Merely because public property has been damaged or a police station has been attacked does not automatically transform the incident into an act threatening the sovereignty, integrity, or security of the nation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s oral observations reinforce this doctrinal distinction.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-importance-of-section-43d-5-of-uapa\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Importance_of_Section_43D5_of_UAPA\"><\/span>Importance of Section 43D(5) of UAPA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most controversial provisions under UAPA is <strong>Section 43D(5)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike ordinary criminal law, where bail is generally the rule, Section 43D(5) places a substantial restriction upon the grant of bail if the court finds reasonable grounds for believing that the accusation is prima facie true.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, the very decision to invoke UAPA has enormous consequences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It affects:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>liberty;<\/li>\n\n\n\n<li>duration of incarceration;<\/li>\n\n\n\n<li>evidentiary burden;<\/li>\n\n\n\n<li>investigation;<\/li>\n\n\n\n<li>trial strategy;<\/li>\n\n\n\n<li>possibility of prolonged custody before conviction.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, courts have repeatedly emphasized that UAPA cannot be invoked casually or mechanically.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-liberty-cannot-depend-merely-upon-the-quality-of-judicial-reasoning\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Liberty_Cannot_Depend_Merely_Upon_the_Quality_of_Judicial_Reasoning\"><\/span>Liberty Cannot Depend Merely Upon the Quality of Judicial Reasoning<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another noteworthy aspect of the judgment concerns appellate interference with bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State argued that the High Court&#8217;s order lacked elaborate reasoning and therefore deserved to be set aside.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Bagchi responded with an important observation:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>the inaccuracy&#8221;Liberty does not depend on inaccuracy of a court.
