At the center of all these activities is the duty officer, who acts as the shift commander and coordinates every important function during the period of duty.

Table of Contents

Toggle

Introduction

Key Highlights

Legal and Administrative Position

Legal Framework Overview

Role and Importance

Core Responsibilities Overview

Duty Officer at a Glance

Key Responsibilities of the Duty Officer

a. Takeaways

The duty officer is generally an assistant sub-Inspector (ASI) or sub-Inspector (SI) entrusted with complete responsibility for the police station during an eight-hour shift. In many police stations, particularly in smaller, rural, or resource-constrained establishments, a head constable may also perform this role, especially during night duty. In some states, the post of Head Constable has been abolished, and constables are now promoted directly to the rank of Assistant Sub-Inspector.

Although the designation “Duty Officer” is widely used across India, it is not specifically defined under any central or state statute. Instead, it is an administrative appointment governed by police regulations, police manuals, standing orders, and departmental instructions issued by the respective state police.

The duty officer works under the overall supervision of the officer-in-charge (OC) or station house officer (SHO). During the shift, however, the duty officer exercises immediate supervisory control over all personnel present at the police station. They communicate the instructions of the OC, ensure their implementation, supervise investigations initiated during the shift, maintain station discipline, and keep senior officers informed of important developments. The Duty Officer is also personally responsible for maintaining the General Diary (Station House Diary), making all entries accurately and chronologically, usually in duplicate as prescribed by police regulations.

As the first police official encountered by members of the public entering the police station, the duty officer represents the image and credibility of the entire police organization. Their conduct, professionalism, fairness, and efficiency significantly influence public confidence in law enforcement.

Key Highlights

The duty officer supervises the day-to-day functioning of the police station during the assigned shift.

The role is generally performed by an Assistant Sub-Inspector (ASI) or Sub-Inspector (SI), and in certain situations by a Head Constable.

The appointment is administrative in nature and governed by police regulations, police manuals, standing orders, and departmental instructions.

The Duty Officer maintains the General Diary (Station House Diary) and supervises police station operations.

The officer serves as the primary public interface of the police station.

Legal and Administrative Position

Although the duty officer is not a statutory office created by legislation, the responsibilities attached to the post derive from various legal provisions governing police administration.

The General Diary (Station House Diary) is maintained under the provisions of the respective State Police Acts and Police Regulations. Every important event occurring in the police station—including receipt of complaints, arrests, departures and arrivals of police personnel, dispatch of patrols, recovery of property, receipt of prisoners, and communication with superior officers—is recorded in this diary.

Similarly, the registration of First Information Reports (FIRs) is governed by Section 173 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (earlier Section 154 of the Code of Criminal Procedure, 1973). The duty officer often performs the practical responsibility of receiving information/complaints regarding cognizable offenses and ensuring their prompt registration in accordance with law after consultation with the officer-in-charge of the police station.

The duty officer must also comply with judicial guidelines issued by the Supreme Court and High Courts concerning arrest procedures, custody management, human rights, and treatment of complainants and accused persons.

Legal Framework Overview

Area

Relevant Provision / Authority

Duty Officer’s Responsibility

General Diary

State Police Acts and Police Regulations

Maintain accurate and chronological Station House Diary entries.

FIR Registration

Section 173, BNSS, 2023 (earlier Section 154 CrPC)

Receive complaints relating to cognizable offenses and facilitate lawful registration of FIRs.

Custody & Arrest

Supreme Court and High Court Guidelines

Ensure compliance with legal safeguards, human rights, and custody procedures.

Police Administration

Police Manuals, Standing Orders, and Departmental Instructions

Perform administrative and supervisory duties during the assigned shift.

Role and Importance

The duty officer occupies a unique position within the police station. Unlike investigating officers who concentrate on individual cases, the duty officer oversees the functioning of the entire police station during the shift. Every activity—administrative, operational, investigative, or emergency-related—passes through or is monitored by the Duty Officer.

Their responsibilities require administrative ability, legal knowledge, leadership, sound judgment, and excellent communication skills. Since police work is unpredictable, the duty officer must constantly prioritize tasks while ensuring that urgent matters receive immediate attention without neglecting routine administrative functions.

The efficiency of the police station during any shift largely depends upon the competence of the duty officer. The Duty Officer shall keep readily accessible the contact numbers of all emergency services, government offices, hospitals, banks, and other institutions within his jurisdiction, along with the mobile numbers of officers with whom regular communication may be required.

Core Responsibilities Overview

Supervise the overall functioning of the police station during the duty shift.

Coordinate administrative, operational, investigative, and emergency activities.

Maintain effective communication with the Officer-in-Charge (OC), Station House Officer (SHO), and superior officers.

Ensure prompt handling of emergencies while maintaining routine police administration.

Maintain updated emergency contact details for government departments, hospitals, banks, emergency services, and other institutions within the jurisdiction.

Duty Officer at a Glance

Aspect

Description

Primary Role

Shift commander of the police station.

Reporting Authority

Officer-in-Charge (OC) / Station House Officer (SHO).

Operational Control

Exercises immediate supervision over all personnel present during the shift.

Key Administrative Duty

Maintenance of the General Diary (Station House Diary).

Public Interaction

Acts as the first point of contact for members of the public visiting the police station.

Essential Skills

Leadership, legal knowledge, communication, administrative ability, and sound judgment.

Key Responsibilities of the Duty Officer

The duty officer performs a wide range of administrative, supervisory, investigative, and public service functions that ensure the smooth functioning of a police station. The following are the principal responsibilities of a duty officer.

a. Receiving Complaints and Registering FIRs

One of the most important functions of the duty officer is to receive complaints from the public. Every person approaching the police station must be treated courteously and without discrimination.

The duty officer examines the nature of the complaint to determine whether it discloses a cognizable or non-cognizable offense. In the case of cognizable offenses, the information must be recorded as an FIR without unnecessary delay. For non-cognizable offenses, the complainant is guided according to the applicable legal procedure.

Apart from criminal complaints, the duty officer also receives petitions relating to:

Missing persons

Lost documents

Domestic disputes

Public grievances

Other matters requiring police attention

Proper acknowledgement, diary entry, and forwarding to the appropriate investigating officer are essential parts of this responsibility.

b. In Lalita Kumari v. Government of Uttar Pradesh (2014), the Supreme Court held that where information discloses the commission of a cognizable offence, the Duty Officer is under a mandatory obligation to register a First Information Report (FIR) under Section 173 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (formerly Section 154 CrPC), leaving virtually no discretion to refuse registration or conduct a preliminary inquiry except in the limited categories specifically recognised by the Court.

In Arnesh Kumar v. State of Bihar (2014), the Supreme Court further directed strict compliance with statutory safeguards governing arrest, including the issuance of a notice of appearance under Section 35(3) read with Section 41A CrPC-equivalent provisions of the BNSS, so as to prevent arbitrary arrests and unnecessary detention.

The Delhi High Court, in Court on Its Own Motion v. CBI (2004), underscored the Duty Officer’s responsibility as the custodian of police station records, emphasising the meticulous maintenance of the General Diary and other statutory registers to ensure transparency and guard against abuse of power.

More recently, in Vikas Kumar v. State of Haryana (Punjab & Haryana High Court, 2025), the Court reiterated that investigating authorities, including the Duty Officer at the stage of recording information, must ensure the fair and impartial documentation of both incriminating and exculpatory material.

Collectively, these judicial pronouncements establish the Duty Officer as the procedural cornerstone of the police station, entrusted with safeguarding the rule of law by ensuring faithful compliance with statutory duties and the constitutional guarantees of life, liberty, and due process under Articles 21 and 22 of the Constitution of India.

Key Judicial Pronouncements at a Glance

Case

Year

Key Principle

Relevance to Duty Officer

Lalita Kumari v. Every complaint received, emergency managed, official record maintained, and police response initiated during the shift passes through their oversight. Their efficiency directly shapes the quality of policing, safeguards the integrity of criminal investigations, and strengthens public confidence in the justice system.

The position demands a rare combination of legal knowledge, administrative competence, leadership, empathy, integrity, and sound judgment. In an era where policing is increasingly measured by professionalism, transparency, and service to the community, the duty officer remains one of the most critical functionaries in the police station. A competent and conscientious duty officer not only ensures the smooth functioning of the police station but also strengthens the rule of law and reinforces public trust in law enforcement.

Key Takeaways

The Duty Officer is the operational nerve center of every police station.

Compliance with the BNSS and constitutional safeguards is a core responsibility.

Judicial precedents require prompt FIR registration, lawful arrests, and transparent record maintenance.

Professionalism, accountability, and fairness are essential attributes of an effective duty officer.

An efficient duty officer enhances public confidence and strengthens the rule of law.

The Duty Officer: Pillar of a Police Station’s Daily Operations

How to File an FIR in a Police Station in India (2026 Guide) | Remedies If Police Refuse Complaint

Copyright Registration Process in India: A Complete Step-by-Step Guide

Electoral Offences at Polling Stations

Why General Diary (GD) Entries Matter: Legal Importance and Practical Benefits for Citizens

Introduction The duty officer is the operational backbone of a police station, ensuring that its day-to-day activities continue smoothly and efficiently around the clock.
