Union of India &amp; Ors.<\/em>, wherein the Supreme Court directed a progressive reduction of IPS deputation in senior CAPF posts and recognized CAPF Group-A Executive officers as Organized Group &#8216;A&#8217; Services (OGAS) for all cadre-related purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a practitioner before the Supreme Court for over twenty-five years, I believe this litigation is far more than a service dispute. It concerns the constitutional limits of legislative power, judicial independence, separation of powers, equality in public employment, and the rule of law.<\/p>\n\n\n\n<h2 id=\"h-background-of-the-dispute\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Background_of_the_Dispute\"><\/span>Background of the Dispute<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Central Armed Police Forces comprise:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Border Security Force (BSF)<\/li>\n\n\n\n<li>Central Reserve Police Force (CRPF)<\/li>\n\n\n\n<li>Central Industrial Security Force (CISF)<\/li>\n\n\n\n<li>Indo-Tibetan Border Police (ITBP)<\/li>\n\n\n\n<li>Sashastra Seema Bal (SSB)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For decades, senior leadership positions in these organisations have largely been occupied by Indian Police Service (IPS) officers on deputation, despite the existence of dedicated CAPF cadres.<\/p>\n\n\n\n<h3 id=\"h-concerns-raised-by-capf-officers\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Concerns_Raised_by_CAPF_Officers\"><\/span>Concerns Raised by CAPF Officers<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">CAPF officers consistently argued that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They possess comparable operational experience<\/li>\n\n\n\n<li>Promotional opportunities were blocked because senior posts remained reserved for deputationists<\/li>\n\n\n\n<li>Cadre stagnation violated Articles 14 and 16 of the Constitution.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This prolonged litigation culminated in an important Supreme Court judgement in <em>Sanjay Prakash &amp; Ors. v. Union of India &amp; Ors.<\/em>, Civil Appeal No. 13104 of 2024 (decided on 23 May 2025).<\/p>\n\n\n\n<h2 id=\"h-the-2025-supreme-court-judgement\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_2025_Supreme_Court_Judgement\"><\/span>The 2025 Supreme Court Judgement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Bench of Justice Abhay S. Oka and Justice Ujjal Bhuyan delivered what many considered a watershed judgement in service jurisprudence.<\/p>\n\n\n\n<h3 id=\"h-key-findings-of-the-judgement\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Findings_of_the_Judgement\"><\/span>Key Findings of the Judgement<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>CAPF Group-A Executive Cadres are organised under Group &#8216;A&#8217; Services (OGAS) for all purposes;<\/li>\n\n\n\n<li>The government cannot grant OGAS benefits selectively;<\/li>\n\n\n\n<li>IPS deputation to senior CAPF posts should be progressively reduced within two years;<\/li>\n\n\n\n<li>Cadre reviews must be undertaken properly;<\/li>\n\n\n\n<li>Promotional avenues of CAPF officers deserve constitutional protection.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The judgement was viewed as restoring institutional autonomy to CAPFs while ensuring equal promotional opportunities.<\/p>\n\n\n\n<h2 id=\"h-parliament-enacts-the-capf-general-administration-act-2026\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Parliament_Enacts_the_CAPF_General_Administration_Act_2026\"><\/span>Parliament Enacts the CAPF (General Administration) Act, 2026<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of merely modifying recruitment rules, Parliament enacted the Central Armed Police Forces (General Administration) Act, 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation authorises the Central Government to frame rules governing recruitment, promotions and deputation &#8220;notwithstanding any judgement, decree or order of any court.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act further mandates that:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Rank<\/th><th>IPS Deputation Prescribed<\/th><\/tr><\/thead><tbody><tr><td>Inspector General (DG)<\/td><td>100%<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Effectively, Parliament restored extensive IPS deputation despite the earlier judicial directions.<\/p>\n\n\n\n<h2 id=\"h-why-have-capf-officers-challenged-the-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_Have_CAPF_Officers_Challenged_the_Act\"><\/span>Why Have CAPF Officers Challenged the Act?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Thirty-four CAPF officers have now approached the Supreme Court under Article 32 challenging the constitutional validity of the legislation.<\/p>\n\n\n\n<h3 id=\"h-constitutional-provisions-allegedly-violated\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" petition alleges that the Act violates:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Article 14<\/li>\n\n\n\n<li>Article 16<\/li>\n\n\n\n<li>Article 21<\/li>\n\n\n\n<li>Doctrine of Separation of Powers<\/li>\n\n\n\n<li>Basic Structure of the Constitution<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Most importantly, the petition argues that Parliament has attempted an impermissible class=\"wp-block-paragraph\">A bench comprising:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Justice Manoj Misra<\/li>\n\n\n\n<li>Justice Vijay Bishnoi<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">has issued notice to the Union Government seeking its response to the constitutional challenge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No interim stay has presently been granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case is therefore at an important preliminary constitutional stage.<\/p>\n\n\n\n<h2 id=\"h-the-central-constitutional-question\"
