Although the <strong>Constitution of India<\/strong> and the <strong>Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)<\/strong> do not define the term, arrest generally means the lawful deprivation of a person&#8217;s liberty by a competent authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A valid arrest involves three essential elements:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Lawful authority and intention<\/strong> to arrest;<\/li>\n\n\n\n<li><strong>Actual or constructive detention<\/strong> of the person; and<\/li>\n\n\n\n<li><strong>Communication or awareness<\/strong> that the person has been placed under arrest.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In its ordinary legal sense, arrest signifies the <strong>lawful restraint of a person&#8217;s freedom of movement<\/strong> by an authorized authority for purposes recognized by law.<\/p>\n\n\n\n<h2 id=\"h-object-of-arrest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Object_of_Arrest\"><\/span>Object of Arrest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The primary objectives of arrest are<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To secure the presence of the accused before the court.<\/li>\n\n\n\n<li>To prevent the commission or continuation of offenses.<\/li>\n\n\n\n<li>To ensure a fair and effective investigation.<\/li>\n\n\n\n<li>To prevent absconding or tampering with evidence.<\/li>\n\n\n\n<li>To maintain public order and safety.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-powers-of-arrest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Powers_of_Arrest\"><\/span>Powers of Arrest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The BNSS authorizes arrests by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Police officers;<\/li>\n\n\n\n<li>Magistrates;<\/li>\n\n\n\n<li>Private persons in limited circumstances; and<\/li>\n\n\n\n<li>Certain statutory authorities empowered under special laws.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Arrests may be:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Type of Arrest<\/th><th>Meaning<\/th><\/tr><\/thead><tbody><tr><td><strong>With a warrant<\/strong><\/td><td>Issued by a competent court.<\/td><\/tr><tr><td><strong>Without a warrant<\/strong><\/td><td>Made in circumstances specifically authorized by the BNSS.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-arrest-without-warrant\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Arrest_Without_Warrant\"><\/span>Arrest Without Warrant<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A police officer may arrest without a warrant in cases involving cognizable offenses where statutory conditions are satisfied. Offensive weapons and incriminating articles may be seized, documented, and preserved following proper chain of custody procedures.<\/p>\n\n\n\n<h2 id=\"h-medical-examination\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Medical_Examination\"><\/span>Medical Examination<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Medical examination serves both investigative and protective purposes. Where necessary, a registered medical practitioner may examine the arrested person to obtain evidence relating to the offense.
