However, the exercise of these powers must strictly comply with the procedural safeguards prescribed under the <strong>Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)<\/strong> and the <strong>Bharatiya Sakshya Adhiniyam, 2023 (BSA)<\/strong>. A lawful search followed by a valid seizure, properly documented through a <strong>Seizure List<\/strong> and a <strong>Panchnama<\/strong>, ensures the integrity of the chain of custody and enhances It transfers custody of the property from its possessor to the investigating agency for the purpose of investigation, forensic examination, and production before the court.<\/p>\n\n\n\n<h3 id=\"h-seizure-aims-to\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Seizure_Aims_To\"><\/span>Seizure Aims: To:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preserve evidence.<\/li>\n\n\n\n<li>Prevent destruction, concealment, or tampering.<\/li>\n\n\n\n<li>Facilitate scientific examination.<\/li>\n\n\n\n<li>Maintain an unbroken chain of custody.<\/li>\n\n\n\n<li>Ensure production of evidence before the court.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Under the BNSS, seizure must always be carried out in accordance with the prescribed procedure and properly documented to withstand judicial scrutiny.<\/p>\n\n\n\n<h2 id=\"h-seizure-list\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Seizure_List\"><\/span>Seizure List<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>seizure list<\/strong> (also known as the seizure memo) is the official record prepared by the investigating officer immediately after taking possession of the seized property. The <strong>Panchnama<\/strong> is a narrative record prepared in the presence of independent witnesses that corroborates the fairness and transparency of the search process.
