It is conducted to find out whether a witness can correctly identify a suspect or property connected with an offence. A TIP helps the investigating agency verify the accuracy of a witness&#8217;s memory and supports the investigation. It is only a corroborative piece of evidence that supports the identification made by the witness during the trial before the court. The Supreme Court has affirmed this principle in <em>Amit Singh Bhikamsingh Thakur v. State of <\/em>Maharashtra (2007) 2 SCC 310.<\/p>\n\n\n\n<h2 id=\"h-meaning-and-purpose-of-a-test-identification-parade\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Meaning_and_Purpose_of_a_Test_Identification_Parade\"><\/span>Meaning and Purpose of a Test Identification Parade<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has explained that a TIP is conducted to enable witnesses to identify the persons involved in the offence or the property connected with the crime during the investigation (<strong>AIR 1955 SC 104<\/strong>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The main objectives of a TIP are to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Test the memory and observation of the witness.<\/li>\n\n\n\n<li>Verify whether the witness can correctly identify the suspect without any assistance.<\/li>\n\n\n\n<li>Give confidence to the investigating agency that the investigation is proceeding in the right direction.<\/li>\n\n\n\n<li>Reduce the chances of mistaken identity and false implication.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The parade is conducted by placing the accused among several persons of similar appearance and asking the witness to identify the offender. This tests the witness&#8217;s ability to recognise the accused based solely on what was seen during the commission of the offence (<strong>Kanan v. State of Kerala, 1979 Cri LJ 919<\/strong>).<\/p>\n\n\n\n<h2 id=\"h-when-is-a-tip-necessary\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_Is_a_TIP_Necessary\"><\/span>When Is a TIP Necessary?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A TIP is generally required when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The accused was <strong>not previously known<\/strong> to the witness.<\/li>\n\n\n\n<li>The witness had only a brief or limited opportunity to see the offender during the crime.<\/li>\n\n\n\n<li>The identity of the accused is in dispute.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A TIP is generally <strong>not necessary<\/strong> if the witness already knew the accused before the occurrence (<strong>Mahabir v. State of Delhi, AIR 2008 SC 2343<\/strong>).<\/p>\n\n\n\n<h2 id=\"h-evidentiary-value-of-a-test-identification-parade\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Evidentiary_Value_of_a_Test_Identification_Parade\"><\/span>Evidentiary Value of a Test Identification Parade<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although a TIP is valuable during investigation, it cannot by itself form the basis of conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The settled legal position is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A TIP is <strong>not substantive evidence<\/strong>.<\/li>\n\n\n\n<li>The real evidence is the identification of the accused in court.<\/li>\n\n\n\n<li>A TIP only corroborates the witness&#8217;s testimony during trial.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If a witness identifies the accused in a TIP but fails to identify the accused in court, the conviction cannot ordinarily be based only on the TIP (<strong>Ramadhar v. State of Bihar, 1988 Cri LJ 264 (Pat)<\/strong>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, when the accused was previously unknown to the witness, identification for the first time in court without a prior TIP is generally treated as weak evidence unless supported by other reliable evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <strong><em>P. Sasikumar v. State<\/em>, Rep. by Inspector of Police (2024 INSC 474, 8 July 2024)<\/strong>, the Supreme Court clarified that when the accused is unknown to the eyewitnesses, a Test Identification Parade (TIP) should ordinarily be conducted. Identification of the accused for the first time in court (dock identification), without a prior TIP, is a weak piece of evidence and must be supported by strong corroborative evidence. The Court held that non-conduct of TIP in such cases is a fatal flaw in the investigation, rendering the dock identification doubtful, as reiterated in precedents like <em>Jayan v. State of Kerala<\/em> (2021) 20 SCC 38.<\/p>\n\n\n\n<h2 id=\"h-effect-of-failure-to-identify-the-accused\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Effect_of_Failure_to_Identify_the_Accused\"><\/span>Effect of Failure to Identify the Accused<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Failure of a witness to identify the accused during a TIP may weaken the prosecution case and, in some cases, may even prove fatal (<strong>Bindeshri v. Emperor, AIR 1927 All 163<\/strong>).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the effect depends on the facts of each case. For example, in a motor accident case where the driver fled immediately after the accident, the failure of some passengers to identify the driver was held not to be fatal to the prosecution (<strong>Mandya Rural Police v. Ravi, 1997 AEHC 3627 (Kant)<\/strong>).<\/p>\n\n\n\n<h2 id=\"h-identification-of-property-and-other-objects\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Identification_of_Property_and_Other_Objects\"><\/span>Identification of Property and Other Objects<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A test identification parade is not limited to identifying accused persons. It may also be conducted for identifying:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Stolen or recovered property<\/li>\n\n\n\n<li>Deceased or missing persons<\/li>\n\n\n\n<li>Firearms<\/li>\n\n\n\n<li>Photographs<\/li>\n\n\n\n<li>Handwriting<\/li>\n\n\n\n<li>Fingerprints<\/li>\n\n\n\n<li>Footprints<\/li>\n\n\n\n<li>Other material objects connected with the offence<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Although mainly used in criminal investigations, identification proceedings may also be relevant in certain civil cases.<\/p>\n\n\n\n<h2 id=\"h-legal-position-under-the-bnss\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Legal_Position_Under_the_BNSS\"><\/span>Legal Position Under the BNSS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is <strong>no specific provision<\/strong> governing Test Identification Parades under the <strong>Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)<\/strong> or the earlier <strong>Code of Criminal Procedure, 1973 (CrPC)<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The procedure has developed through judicial decisions and established investigative practice. Courts have consistently recognised TIP as an important safeguard against mistaken identity and wrongful implication of innocent persons.<\/p>\n\n\n\n<h2 id=\"h-essential-principles-governing-a-test-identification-parade\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Essential_Principles_Governing_a_Test_Identification_Parade\"><\/span>Essential Principles Governing a Test Identification Parade<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The following principles should be followed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A TIP is part of the investigation and not part of the trial.<\/li>\n\n\n\n<li>It should be conducted as soon as possible after the arrest of the accused.<\/li>\n\n\n\n<li>The accused should preferably remain in judicial custody before the parade so that witnesses do not see the accused beforehand.<\/li>\n\n\n\n<li>The Investigating Officer should request the jurisdictional judicial magistrate to conduct the TIP.<\/li>\n\n\n\n<li>The magistrate should be provided with all necessary information required for conducting the parade.<\/li>\n\n\n\n<li>The parade should be conducted by a judicial magistrate, preferably without the presence of police and prison officers.<\/li>\n\n\n\n<li>The Investigating Officer may produce the witnesses before the Magistrate but should not remain present during the proceedings.<\/li>\n\n\n\n<li>A TIP conducted after prolonged police custody generally has little evidentiary value.<\/li>\n\n\n\n<li>Any delay in holding the TIP should be properly explained in the case diary.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-precautions-to-be-taken-by-the-magistrate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Precautions_to_Be_Taken_by_the_Magistrate\"><\/span>Precautions to Be Taken by the Magistrate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To ensure fairness and reliability, the magistrate should observe the following precautions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Conduct the parade in privacy.<\/li>\n\n\n\n<li>Ensure that no police officer is present during the identification.<\/li>\n\n\n\n<li>If held in prison, prison officials should remain absent unless their presence is absolutely necessary.<\/li>\n\n\n\n<li>Mix the accused with a sufficient number of persons of similar age, height, complexion, physique, and appearance.<\/li>\n\n\n\n<li>Remove or conceal any distinctive dress, ornaments, or marks that may make the accused easily identifiable.<\/li>\n\n\n\n<li>Give the accused an opportunity to raise objections regarding the persons included in the parade.<\/li>\n\n\n\n<li>Keep all witnesses separate from one another before identification.<\/li>\n\n\n\n<li>Call each witness separately.<\/li>\n\n\n\n<li>Prevent witnesses from communicating with one another after identification.<\/li>\n\n\n\n<li>Ask each witness whether he or she had any previous acquaintance with the accused.<\/li>\n\n\n\n<li>Carefully record every relevant fact, including objections, precautions taken, successful or unsuccessful identifications, and the entire (TIP) should ordinarily be conducted before the accused is taken into police custody or after the accused has been kept in judicial custody without being exposed to the witnesses. If the TIP is held after the accused has been taken on police remand, its evidentiary value is greatly reduced because there is a possibility that the witnesses may have seen the accused during police custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such exposure defeats the very purpose of a TIP, which is to test the independent memory and observation of the witness. Therefore, courts generally attach little or no evidentiary value to a TIP conducted after the accused has remained in police remand, unless exceptional circumstances satisfactorily explain the delay and establish that the witness had no opportunity to see the accused.<\/p>\n\n\n\n<h2 id=\"h-judicial-position-on-test-identification-parade-tip\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Judicial_Position_on_Test_Identification_Parade_TIP\"><\/span>Judicial Position on Test Identification Parade (TIP)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The contemporary judicial approach under Section 54 of the Bharatiya Nagarik Suraksha Sanhita, 2023, reaffirms that a Test Identification Parade (TIP) is a corroborative investigative tool rather than substantive evidence; the primary evidence remains the identification of the accused before the trial court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <strong><em>Venkatesha &amp; Ors. v. State of Karnataka<\/em> (2025)<\/strong>, the Supreme Court acquitted the accused after holding that the prosecution&#8217;s failure to conduct a TIP rendered the subsequent delayed dock identification unreliable. This principle was reiterated in <strong><em>Manikanta @ Mani v. State of Karnataka<\/em> (2026)<\/strong>, where the absence of a TIP, coupled with the eyewitnesses&#8217; inability to identify the accused during trial, proved fatal to the prosecution&#8217;s case and resulted in the conviction under Section 397 IPC being set aside.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, the Chhattisgarh High Court in <strong><em>Raj Kumar &amp; Ors. v. State of Chhattisgarh<\/em> (2026)<\/strong> emphasised that the prosecution bears the burden of establishing that the TIP was conducted fairly, promptly, and under proper judicial supervision. The Court further held that any prior exposure of the accused or their photograph to witnesses vitiates the evidentiary value of the identification exercise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Taken together, these decisions reaffirm that while a TIP is not substantive evidence, it remains an indispensable safeguard in criminal investigations, enhancing the reliability of eyewitness identification, ensuring procedural fairness, and protecting the constitutional guarantee of a fair trial under Article 21 against the risk of wrongful conviction.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>Test Identification Parade (TIP)<\/strong> is an important investigative tool that helps determine whether a witness can correctly identify an unknown offender or property connected with a crime. He has attended Indian government sponsored specialized training in police and management matters in SVPNPA, Hyderabad, IIM, Ahmedabad and Singapore. He is the author of the books 'Police Investigation &amp; Allied Matters' and 'Alternative Dispute Resolution: Evolving Trends and Innovations' demonstrating his commitment to knowledge sharing within the law enforcement field. As an observer for the Election Commission of India, he has gained firsthand experience in conducting assembly elections and bye-elections in Uttar Pradesh, Rajasthan, Assam, Bihar, and Tripura (twice).
