What physical acts would constitute a penal act of sexual assault, in each of the two categories, is detailed.<\/p>\n\n\n\n<h3 id=\"h-ground-realities-of-adolescent-intimacy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ground_Realities_Of_Adolescent_Intimacy\"><\/span>Ground Realities Of Adolescent Intimacy<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The ground realities, however, are different. Adolescents naturally seek intimacy and exploration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Law, however, imposes a rigid threshold of 18 years, ignoring biological and social realities.<\/p>\n\n\n\n<h3 id=\"h-social-acceptance-vs-criminalisation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Social_Acceptance_vs_Criminalisation\"><\/span>Social Acceptance vs. Criminalisation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In elite and urban societies, adolescent dating, intimacy, and even sexual experimentation are normalised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet, legally, these acts are criminalised as sexual assault, creating a clash between lived reality and statutory law.<\/p>\n\n\n\n<h3 id=\"h-consent-contradiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consent_Contradiction\"><\/span>Consent Contradiction<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Adolescents may be fully capable of giving informed consent in practice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But under POCSO, their consent is void ab initio. Thus, consensual intimacy is equated with assault, which dilutes the gravity of actual abuse cases.<\/p>\n\n\n\n<h3 id=\"h-fundamental-rights-vs-statutory-restrictions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fundamental_Rights_vs_Statutory_Restrictions\"><\/span>Fundamental Rights vs. Statutory Restrictions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution guarantees personal liberty, privacy, and autonomy (recognised in Puttaswamy v. Many cases involve consensual adolescent relationships, yet the boy is prosecuted under POCSO.<\/p>\n\n\n\n<h3 id=\"h-law-commission-debates\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Law_Commission_Debates\"><\/span>Law Commission Debates<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There have been calls to lower the age of consent to 16, aligning with global norms (UK, Canada, Australia, etc.), but concerns about child protection and exploitation stall reform.<\/p>\n\n\n\n<h3 id=\"h-practical-fallout\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Practical_Fallout\"><\/span>Practical Fallout<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The law often criminalises young men in consensual relationships, while the girl\u2019s family uses POCSO to control or punish relationships they disapprove of.<\/p>\n\n\n\n<h2 id=\"h-the-core-contradiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Core_Contradiction\"><\/span>The Core Contradiction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Act was designed to shield children from abuse, but by equating consensual adolescent intimacy with assault, it:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Dilutes focus on genuine abuse cases.<\/li>\n\n\n\n<li>Criminalises natural, socially accepted behaviour.<\/li>\n\n\n\n<li>Creates a paradox where the law intended to protect ends up punishing the very group it seeks to safeguard.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In short, the paradox lies in the collision of biology, society, and law: while adolescents are biologically and socially engaging in consensual intimacy, the law treats them as incapable of consent, thereby criminalising their natural behaviour. But since the consent by the adolescent girl child is no consent in law, the act is inherently an offence on the part of the boy. Since the girl solicited and actively encouraged it, does it not amount to the offence of abetting? Please elaborate and substantiate it.<\/p>\n\n\n\n<h2 id=\"h-consent-and-abetment-under-pocso\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consent_and_Abetment_Under_POCSO\"><\/span>Consent and Abetment Under POCSO<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is a very incisive question, because it touches on the juridical paradox of \u201cconsent\u201d and \u201cabetment\u201d under POCSO. Let\u2019s break it down carefully:<\/p>\n\n\n\n<h3 id=\"h-consent-and-its-legal-void\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Consent_And_Its_Legal_Void\"><\/span>Consent And Its Legal Void<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Under the POCSO Act, 2012, consent of a person below 18 years is legally irrelevant. Even if the adolescent girl actively seeks intimacy, her \u201cconsent\u201d is void ab initio.<\/li>\n\n\n\n<li>Thus, the boy\u2019s participation in penetrative or non-penetrative sexual activity is treated as sexual assault, regardless of mutuality.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-abetment-in-criminal-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Abetment_in_Criminal_Law\"><\/span>Abetment in Criminal Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Section 16 of POCSO defines abetment broadly: instigating, engaging in conspiracy, or intentionally aiding the commission of an offence.<\/li>\n\n\n\n<li>In theory, if the girl \u201cencourages\u201d or \u201csolicits\u201d the act, it could be construed as instigation.<\/li>\n\n\n\n<li>However, Section 29 presumes guilt of the accused (usually the boy) once sexual assault is alleged, and the girl remains legally classified as a \u201cchild victim.\u201d \u2192 This creates a structural asymmetry: the law does not envisage the child victim as an abettor.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-why-the-girl-is-not-treated-as-an-abettor\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_The_Girl_Is_Not_Treated_As_An_Abettor\"><\/span>Why The Girl Is Not Treated As An Abettor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Protective Intent Of POCSO:<\/strong> The Act is designed to shield children from exploitation, not criminalise them. Her actions are interpreted as vulnerability, not culpability.<\/li>\n\n\n\n<li><strong>Judicial Practice:<\/strong> Courts consistently refuse to prosecute adolescent girls as abettors in consensual relationships. Instead, they treat them as victims, even when evidence shows active participation.<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-the-contradiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Contradiction\"><\/span>The Contradiction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Reality:<\/strong> Both adolescents mutually attract, seek, and encourage intimacy. It is not a unilateral act by the boy.<\/li>\n\n\n\n<li><strong>Law:<\/strong> The boy is criminalised as the sole offender; the girl is legally incapable of abetment.<\/li>\n\n\n\n<li><strong>Paradox:<\/strong> The same act is simultaneously consensual (biological\/social reality) and criminal (legal fiction). Yet, the boy is prosecuted under POCSO, while the girl is treated as a victim.<\/p>\n\n\n\n<h3 id=\"h-comparative-perspective\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Comparative_Perspective\"><\/span>Comparative Perspective<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In many jurisdictions (e.g., the UK, Canada), laws distinguish consensual adolescent relationships from exploitative ones, recognising mutuality and avoiding criminalisation of peers.<\/p>\n\n\n\n<h3 id=\"h-policy-critique\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Policy_Critique\"><\/span>Policy Critique<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">By refusing to recognise adolescent agency, POCSO inadvertently creates injustice\u2014criminalising boys while infantilising girls, despite both being equally participatory.<\/p>\n\n\n\n<h2 id=\"h-conclusion-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion-2\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Legally, the adolescent girl cannot be held guilty of abetment under POCSO, because her consent and instigation are void in law. But the paradox is glaring: the law denies her agency while punishing the boy for a mutual act.
