class=\"wp-block-paragraph\">That single sentence can either close an important dispute or create the next one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should never refuse to return jewellery merely because the marriage has failed. Streedhan belonging to the wife must be returned. But equally, a husband should not sign an unverified list, admit possession of articles he never received, agree to undefined quantities of gold or rely upon a verbal understanding that \u201ceverything has been settled&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Return what belongs to her. Do not admit what was never entrusted to you. And document every single item that changes hands.<\/strong> That distinction can decide whether a settlement actually ends litigation or merely finances the next round of it.<\/p>\n\n\n\n<h2 id=\"h-what-exactly-is-streedhan\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Exactly_Is_Streedhan\"><\/span>What Exactly Is Streedhan?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has consistently recognised that property constituting a woman\u2019s strength remains her absolute property. Marriage does not automatically transfer its ownership to the husband or his family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Pratibha Rani v. Suraj Kumar, (1985) 2 SCC 370<\/em>, the Supreme Court explained that a woman remains the absolute owner of her streedhan. Mere custody of such property with the husband or matrimonial family does not turn it into joint matrimonial property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court stated:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cShe is the absolute owner of such property and can deal with it in any manner she likes.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That principle remains fundamental.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court reiterated it in the case of <em>Rashmi Kumar v. Mahesh Kumar Bhada (1997) 2 SCC 397<\/em>. At the same time, the Court made another point extremely important for husbands facing a criminal allegation: where criminal breach of trust is alleged, entrustment or dominion over the property and dishonest misappropriation must still be established on the facts.<\/p>\n\n\n\n<h3 id=\"h-ownership-and-possession-are-different-questions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ownership_and_Possession_Are_Different_Questions\"><\/span>Ownership and Possession Are Different Questions<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">So two propositions must not be confused:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The wife may own the jewellery.<\/li>\n\n\n\n<li>That does not automatically prove that the husband possessed, retained or dishonestly misappropriated every item she subsequently claims.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction should control the entire settlement exercise.<\/p>\n\n\n\n<h2 id=\"h-why-she-has-no-jewellery-bills-is-not-a-safe-defence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_%E2%80%9CShe_Has_No_Jewellery_Bills%E2%80%9D_Is_Not_A_Safe_Defence\"><\/span>Why \u201cShe Has No Jewellery Bills\u201d Is Not A Safe Defence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most common mistakes I see in matrimonial disputes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband receives a long list containing gold, diamond sets, cash gifts, silver articles and household items and immediately says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cAsk her to produce bills for everything.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Bills matter. But absence of bills does not automatically destroy a strength claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of <em>Maya Gopinathan v. Anoop S.B., 2024 INSC 334<\/em>, the Supreme Court held, in the context of a civil claim for recovery, that there was no absolute rule requiring a woman to prove the precise mode and manner by which every item of streedhan was acquired. The Court applied the civil standard of <strong>preponderance of probabilities<\/strong>, and the surrounding evidence was relevant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judgement is particularly important because the husband\u2019s review petition was dismissed on 1 August 2024, and his curative petition was subsequently dismissed on 28 October 2025. The 2024 judgement therefore continues to stand.<\/p>\n\n\n\n<h3 id=\"h-evidence-that-may-support-a-streedhan-claim\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Evidence_That_May_Support_A_Streedhan_Claim\"><\/span>Evidence That May Support A Streedhan Claim<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A strength claim can therefore involve evidence such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wedding photographs<\/li>\n\n\n\n<li>Videos<\/li>\n\n\n\n<li>Admissions<\/li>\n\n\n\n<li>Messages<\/li>\n\n\n\n<li>Witness testimony<\/li>\n\n\n\n<li>Gift lists<\/li>\n\n\n\n<li>Valuation records<\/li>\n\n\n\n<li>Surrounding circumstances<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For a husband, the correct strategy is not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cNo bill, no strength.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cIdentify the article, establish ownership, establish who received or possessed it, and document what has already been returned.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-current-criminal-law-section-316-bns\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Current_Criminal_Law_Section_316_BNS\"><\/span>Current Criminal Law: Section 316 BNS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For relevant conduct governed by the <em>Bharatiya Nyaya Sanhita, 2023<\/em>, allegations of dishonest retention or misappropriation may attract <strong>Section 316 BNS<\/strong>, criminal breach of trust.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 316 requires entrustment with property, or dominion over property, followed by dishonest misappropriation, conversion, use or disposal in violation of law or the relevant legal arrangement. The general offence under <strong>Section 316(2)<\/strong> is punishable with imprisonment which may extend to five years, or a fine, or both.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Older matrimonial cases may still refer to <strong>Sections 405 and 406 IPC<\/strong>, depending upon when the alleged conduct occurred and the statutory savings applicable after the new criminal laws came into force.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is precisely why a husband should never casually sign a settlement saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cAll jewellery mentioned by the wife was entrusted to me and my family.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If that is factually incorrect, such language may create an admission far wider than the evidence itself.<\/p>\n\n\n\n<h2 id=\"h-the-domestic-violence-act-also-covers-streedhan\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Domestic_Violence_Act_Also_Covers_Streedhan\"><\/span>The Domestic Violence Act Also Covers Streedhan<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The issue is not confined to criminal breach of trust.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <em>Protection of Women from Domestic Violence Act, 2005,<\/em> expressly treats deprivation of financial resources, including streedhan, and disposal of assets, including streedhan, as forms of economic abuse in the circumstances contemplated by the Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More importantly, <strong>Section 19(8)<\/strong> permits a magistrate to direct the respondent to return possession of the aggrieved woman\u2019s streedhan or other property or valuable security to which she is entitled.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of <em>Krishna Bhattacharjee v. Sarathi Choudhury, (2016) 2 SCC 705<\/em>, the Supreme Court dealt with deprivation of streedhan in the context of the DV Act and rejected an attempt to defeat the claim merely on limitation grounds in the circumstances before it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, an incomplete settlement of jewellery can survive as a problem even after the parties believe the \u201cmain matrimonial case\u201d is over.<\/p>\n\n\n\n<h2 id=\"h-before-negotiating-divide-the-property-into-four-categories\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Before_Negotiating_Divide_the_Property_Into_Four_Categories\"><\/span>Before Negotiating, Divide the Property Into Four Categories<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Do not start settlement negotiations with one giant list titled \u201cwife articles&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Separate the property first.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Category<\/th><th>Description<\/th><th>Recommended Treatment<\/th><\/tr><\/thead><tbody><tr><td><strong>Category 1: Admitted Streedhan<\/strong><\/td><td>Articles admittedly belonging exclusively to the wife and admittedly lying with the husband or his family.<\/td><td>These should ordinarily be returned and properly acknowledged.<\/td><\/tr><tr><td><strong>Category 2: Disputed Streedhan Claims<\/strong><\/td><td>Articles whose existence, quantity, description, value, entrustment or present possession is disputed.<\/td><td>These must be expressly identified as disputed rather than accidentally admitted through careless settlement language.<\/td><\/tr><tr><td><strong>Category 3: Husband\u2019s Exclusive Property<\/strong><\/td><td>His jewellery, personal gifts, documents, electronics, inherited articles or other property.<\/td><td>These should not automatically be included merely because they were present in the matrimonial home.<\/td><\/tr><tr><td><strong>Category 4: Jointly Owned Property<\/strong><\/td><td>Property genuinely belonging jointly to both spouses.<\/td><td>Do not confuse this with streedhan.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Do not confuse &#8216;streedhan&#8217; with property genuinely belonging jointly to both spouses. In Hindu matrimonial proceedings, Section 27 of the Hindu Marriage Act separately enables the court to make provisions concerning property presented at or about the time of marriage which may belong jointly to the husband and wife.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Streedhan and jointly owned matrimonial property are not the same thing.<\/p>\n\n\n\n<h2 id=\"h-husband-s-essential-streedhan-return-checklist\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Husbands_Essential_Streedhan_Return_Checklist\"><\/span>Husband\u2019s Essential Streedhan Return Checklist<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-do-not-accept-an-open-ended-jewellery-list\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Do_Not_Accept_An_Open-Ended_Jewellery_List\"><\/span>Do Not Accept An Open-Ended Jewellery List<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Obtain the final list before signing the settlement.<\/li>\n\n\n\n<li>Number every article separately.<\/li>\n\n\n\n<li>Do not accept phrases such as \u201call jewellery as per list supplied from time to time&#8221;.<\/li>\n\n\n\n<li>Annex the agreed list to the settlement itself.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A settlement must close claims, not leave their contents capable of expansion later.<\/p>\n\n\n\n<h3 id=\"h-record-whether-each-item-is-admitted-or-disputed\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Record_Whether_Each_Item_Is_Admitted_Or_Disputed\"><\/span>Record Whether Each Item Is Admitted Or Disputed<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Against every item, specify:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Admitted and available for return<\/li>\n\n\n\n<li>Already in wife\u2019s possession<\/li>\n\n\n\n<li>Returned earlier<\/li>\n\n\n\n<li>Disputed as never received<\/li>\n\n\n\n<li>Disputed as to quantity\/weight<\/li>\n\n\n\n<li>Being settled by agreed monetary value<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A husband can acknowledge one necklace without admitting five other necklaces on the same list.<\/p>\n\n\n\n<h3 id=\"h-ask-for-identifying-particulars\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ask_For_Identifying_Particulars\"><\/span>Ask For Identifying Particulars<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For disputed jewellery, obtain whatever particulars are genuinely available:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Description<\/li>\n\n\n\n<li>Approximate weight<\/li>\n\n\n\n<li>Purity<\/li>\n\n\n\n<li>Stone\/diamond details<\/li>\n\n\n\n<li>Identifying design<\/li>\n\n\n\n<li>Photograph\/video<\/li>\n\n\n\n<li>Invoice, if available<\/li>\n\n\n\n<li>Identity of giver<\/li>\n\n\n\n<li>Occasion on which it was given<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is not because an invoice is legally mandatory in every recovery case. <em>Maya Gopinathan<\/em> makes that assumption unsafe. The objective is to identify the property sufficiently so that the same article cannot later be described differently.<\/p>\n\n\n\n<h2 id=\"h-check-the-original-wedding-gift-list\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Check_the_Original_Wedding_Gift_List\"><\/span>Check the Original Wedding Gift List<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The <em>Dowry Prohibition (Maintenance of Lists of Presents to the Bride and Bridegroom) Rules, 1985,<\/em> provide for separate lists of presents made to the bride and bridegroom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rules contemplate a written list containing a description of each present, an approximate value, the giver\u2019s name and relationship, with signatures of both the bride and the bridegroom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If such contemporaneous lists exist, compare them with the settlement claim.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A list prepared years after matrimonial litigation begins should not automatically be treated as equivalent to a contemporaneous wedding record.<\/p>\n\n\n\n<h2 id=\"h-never-admit-possession-merely-to-finish-the-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Never_Admit_Possession_Merely_To_%E2%80%9CFinish_The_Case%E2%80%9D\"><\/span>Never Admit Possession Merely To \u201cFinish The Case\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This sentence can be disastrous:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cYes, yes, everything was with us. We will settle it somehow.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Ownership and possession are separate facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the case of <em>Rashmi Kumar (Smt.) v. Mahesh Kumar Bhada, (1997) 2 SCC 397<\/em>, the Supreme Court reiterated that Streedhan remains the wife\u2019s absolute property. Where criminal breach of trust is alleged, entrustment or dominion over the property and subsequent dishonest misappropriation\/refusal to return it are material ingredients. A mere relationship with the wife does not automatically establish that a particular article was entrusted to a particular person.<\/p>\n\n\n\n<h2 id=\"h-photograph-and-video-of-the-actual-handover\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Photograph_and_Video_of_the_Actual_Handover\"><\/span>Photograph and Video of the Actual Handover<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before delivery:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Photograph every major item.<\/li>\n\n\n\n<li>Make a continuous video of the inventory where practical.<\/li>\n\n\n\n<li>Record packaging.<\/li>\n\n\n\n<li>Match items with serial numbers in the settlement annexure.<\/li>\n\n\n\n<li>Record weight\/purity where it is relevant and genuinely disputed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For valuable gold or diamond jewellery, obtaining a contemporaneous jeweller\u2019s weight\/description may prevent an allegation later that a completely different or lighter article was returned.<\/p>\n\n\n\n<h2 id=\"h-do-not-use-cash-as-a-substitute-without-written-terms\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Do_Not_Use_Cash_As_A_Substitute_Without_Written_Terms\"><\/span>Do Not Use Cash As A Substitute Without Written Terms<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes an article is unavailable and parties agree upon money instead.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That can be settled. But specify:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Which exact item is being monetarily settled<\/li>\n\n\n\n<li>Agreed valuation<\/li>\n\n\n\n<li>Amount being paid<\/li>\n\n\n\n<li>Mode of payment<\/li>\n\n\n\n<li>Date<\/li>\n\n\n\n<li>Whether payment constitutes complete satisfaction of that identified claim<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Never simply write:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201c\u20b910 lakh paid against jewellery.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Which jewellery? What weight? What items remain? Does the payment settle all jewellery or only some articles?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ambiguity is litigation waiting to happen.<\/p>\n\n\n\n<h2 id=\"h-use-traceable-payment-channels\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Use_Traceable_Payment_Channels\"><\/span>Use Traceable Payment Channels<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where money substitutes an agreed property claim:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Bank transfer<\/li>\n\n\n\n<li>Demand draft<\/li>\n\n\n\n<li>Court-recorded payment<\/li>\n\n\n\n<li>Another verifiable banking instrument<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Record the transaction number in the settlement acknowledgement wherever practical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Large unrecorded cash payments create unnecessary evidentiary disputes.<\/p>\n\n\n\n<h2 id=\"h-get-an-item-wise-signed-acknowledgement\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Get_an_item-wise_signed_acknowledgement\"><\/span>Get an item-wise signed acknowledgement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A simple statement saying \u201carticles received\u201d is weaker than an inventory-linked acknowledgement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The receiving document should identify:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Date<\/li>\n\n\n\n<li>Place<\/li>\n\n\n\n<li>Parties present<\/li>\n\n\n\n<li>Serial numbers of items<\/li>\n\n\n\n<li>Condition, where material<\/li>\n\n\n\n<li>Monetary substitutions, if any<\/li>\n\n\n\n<li>Balance disputed items, if any<\/li>\n\n\n\n<li>Signatures on every page<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If 40 articles are returned, there should be evidence showing <strong>which 40 articles<\/strong> were returned.<\/p>\n\n\n\n<h2 id=\"h-do-not-sign-all-streedhan-received-before-actual-delivery\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Do_Not_Sign_%E2%80%9CAll_Streedhan_Received%E2%80%9D_Before_Actual_Delivery\"><\/span>Do Not Sign \u201cAll Streedhan Received\u201d Before Actual Delivery<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Settlement and performance are two different events.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If jewellery is to be returned at first motion, second motion, quashing or another milestone, say precisely that.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not make the wife acknowledge receipt today for property that is scheduled to be delivered three months later.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Equally, once actual delivery takes place, obtain the agreed acknowledgement immediately.<\/p>\n\n\n\n<h2 id=\"h-link-return-of-articles-with-the-settlement-timeline\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Link_Return_Of_Articles_With_The_Settlement_Timeline\"><\/span>Link Return Of Articles With The Settlement Timeline<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Matrimonial settlements often involve several acts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>First motion<\/li>\n\n\n\n<li>Second motion<\/li>\n\n\n\n<li>Settlement payment<\/li>\n\n\n\n<li>Return of jewellery<\/li>\n\n\n\n<li>Withdrawal of maintenance proceedings<\/li>\n\n\n\n<li>Quashing of FIR\/complaint<\/li>\n\n\n\n<li>Final divorce decree<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These should be coordinated, rather than one side completing every obligation at the beginning while the other side\u2019s obligations remain indefinite.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your own website\u2019s settlement guidance follows this practical milestone-based approach rather than treating the entire settlement as one uncontrolled upfront transaction.<\/p>\n\n\n\n<h2 id=\"h-put-streedhan-terms-inside-the-written-settlement\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Put_Streedhan_Terms_Inside_The_Written_Settlement\"><\/span>Put Streedhan Terms Inside The Written Settlement<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Never leave jewellery to a verbal promise such as:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cFamily people will sort it later.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Ruchi Agarwal v. Amit Kumar Agrawal, (2005) 3 SCC 299<\/em>, the Supreme Court dealt with a compromise in which the wife recorded receipt of her streedhan and lump-sum maintenance; the compromise contained annexures identifying articles returned, and matrimonial relief had been acted upon. Identify possession. Where is the annexure? Is possession admitted?<\/td><\/tr><tr><td>\u201cHusband and his family have retained the wife\u2019s entire strength.&#8221;<\/td><td>Do not make a collective admission unless it is factually correct.<\/td><\/tr><tr><td>&#8220;The value of missing gold shall be paid at the prevailing market rate.\u201d<\/td><td>Weight? Purity? Valuation date? Which rate? Which missing articles?<\/td><\/tr><tr><td>\u201cThe wife acknowledges receipt of all streedhan.\u201d<\/td><td>Not before the physical handover actually takes place.<\/td><\/tr><tr><td>\u201cAll matrimonial disputes stand settled.\u201d<\/td><td>That phrase alone is too vague when multiple proceedings, property claims, streedhan, maintenance, custody and criminal complaints exist. Name the disputes and obligations clearly.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-what-may-count-as-evidence-in-a-streedhan-dispute\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_May_Count_As_Evidence_In_A_Streedhan_Dispute\"><\/span>What May Count As Evidence In A Streedhan Dispute?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is no single magic document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the facts, courts may have to consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wedding photographs and video<\/li>\n\n\n\n<li>Original gift lists<\/li>\n\n\n\n<li>Invoices<\/li>\n\n\n\n<li>Bank withdrawals<\/li>\n\n\n\n<li>Jewellery valuations<\/li>\n\n\n\n<li>Messages<\/li>\n\n\n\n<li>Admissions<\/li>\n\n\n\n<li>Locker records<\/li>\n\n\n\n<li>Witness evidence<\/li>\n\n\n\n<li>Pleadings<\/li>\n\n\n\n<li>Earlier statements<\/li>\n\n\n\n<li>Receipts<\/li>\n\n\n\n<li>Surrounding probabilities<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is another reason why husbands should stop treating matrimonial settlements as emotional negotiations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A settlement is an evidence-management exercise.<\/strong><\/p>\n\n\n\n<h2 id=\"h-streedhan-is-not-the-same-as-dowry\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Streedhan_Is_Not_The_Same_As_Dowry\"><\/span>Streedhan Is Not The Same As Dowry<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These expressions are often mixed casually, but they should not be treated as identical legal concepts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Dowry Prohibition Act regulates dowry and also recognises the statutory framework concerning marriage presents, while the 1985 Rules prescribe maintenance of lists of presents to the bride and bridegroom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A genuine voluntary gift to a woman can form part of her property even though it is not an unlawful dowry demand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why a husband\u2019s defence should never be reduced to:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe never demanded a dowry; therefore, she has no strength.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Those are different legal questions.<\/p>\n\n\n\n<h2 id=\"h-the-most-important-rule-for-husbands\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Most_Important_Rule_For_Husbands\"><\/span>The Most Important Rule For Husbands<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Men often make one of two mistakes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first husband becomes angry and says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cI will not return a single thing.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That can create serious legal consequences if the property genuinely belongs to the wife and is being retained.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second husband becomes desperate and says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWrite whatever you want. I just want the divorce.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That can be equally dangerous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct position lies between the two:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Return admitted stream promptly.<\/li>\n\n\n\n<li>Contest fabricated or inflated claims through evidence.<\/li>\n\n\n\n<li>Never confuse ownership with possession.<\/li>\n\n\n\n<li>Never admit entrustment that did not occur.<\/li>\n\n\n\n<li>Never make undocumented returns.<\/li>\n\n\n\n<li>Never leave jewellery outside the final settlement.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A fair settlement should protect both parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A woman should receive property that genuinely belongs to her. A husband should not remain exposed to a second claim for property already returned or for articles never entrusted to him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is what proper documentation and due process are supposed to achieve.<\/p>\n\n\n\n<h2 id=\"h-final-husband-s-check-before-signing\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Final_Husbands_Check_Before_Signing\"><\/span>Final Husband\u2019s Check Before Signing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before putting your signature on the settlement, ask yourself:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is the complete jewellery list annexed?<\/li>\n\n\n\n<li>Have admitted and disputed items been separated?<\/li>\n\n\n\n<li>Does the document accurately record who possessed each disputed article?<\/li>\n\n\n\n<li>Is every returned article identifiable?<\/li>\n\n\n\n<li>Is there photographic\/video evidence where required?<\/li>\n\n\n\n<li>Will the wife sign an item-wise receipt?<\/li>\n\n\n\n<li>Are cash substitutions linked to specific items?<\/li>\n\n\n\n<li>Are bank payments traceable?<\/li>\n\n\n\n<li>Are locker-related issues closed?<\/li>\n\n\n\n<li>Are remaining disputes expressly identified?<\/li>\n\n\n\n<li>Is the settlement linked to divorce and case-withdrawal milestones?<\/li>\n\n\n\n<li>Are streedhan and alimony treated distinctly unless the agreement expressly combines them?<\/li>\n\n\n\n<li>Will the same terms be placed before the appropriate court\/mediation forum where required?<\/li>\n\n\n\n<li>Are all annexures signed?<\/li>\n\n\n\n<li>Have you retained a complete evidence set?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If even three or four of these answers are \u201cno\u201d, do not treat the jewellery issue as closed merely because somebody has typed \u201cfull and final settlement\u201d at the bottom of the document.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Streedhan law is not complicated on the basic principle: what legally belongs to the wife must be returned to her. But a settlement should not become a shortcut for converting every disputed jewellery claim into an automatic admission against the husband and his family.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband should neither unlawfully retain genuine strength nor surrender to vague, inflated or undocumented claims merely to obtain a quick settlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The safest approach is simple:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Identify the articles.<\/li>\n\n\n\n<li>Verify the claim.<\/li>\n\n\n\n<li>Separate admitted items from disputed ones.<\/li>\n\n\n\n<li>Return genuine strength against a detailed acknowledgement.<\/li>\n\n\n\n<li>Record every payment and every handover.<\/li>\n\n\n\n<li>Preserve the evidence permanently.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">A matrimonial settlement is supposed to end litigation, not create another dispute over whether jewellery was returned, what was returned, or whether the same articles can be claimed again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Return what is genuinely hers. Admit only what is factually correct. Document everything.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because in matrimonial litigation, a verbal understanding may be forgotten.
