In the controversy involving students of the National Academy of Legal Studies and Research (NALSAR), Hyderabad, Chief Justice of India Surya Kant expressed strong disapproval of the intervention by the Bar Council of India (BCI) against students who had protested over the proposed participation of the CJI in the university\u2019s convocation.<\/p><div id=\"ez-toc-container\" For a fresh law graduate, enrollment represents the gateway to professional legal practice. Any attempt to delay or prevent enrollment can have immediate consequences for a young lawyer&#8217;s career.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What made the matter even more concerning was the apparent impact on the entire graduating batch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A fundamental principle of law is that individual responsibility cannot ordinarily be replaced by collective punishment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If particular individuals were alleged to have committed professional or legal misconduct, the obvious question was<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On what legal basis could an entire graduating class face an impediment to enrollment?<\/p>\n\n\n\n<h2 id=\"h-bci-subsequently-withdrew-its-direction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"BCI_Subsequently_Withdrew_Its_Direction\"><\/span>BCI Subsequently Withdrew Its Direction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The BCI subsequently withdrew its earlier direction concerning the enrollment of the NALSAR 2026 graduates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reports indicate that the BCI clarified that the students could seek enrollment with State Bar Councils and subsequently closed the proceedings concerning the controversy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the withdrawal did not make the constitutional issue insignificant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court was called upon to consider whether the BCI ought to have entered into what was essentially a disagreement between students and the CJI in the first place.<\/p>\n\n\n\n<h2 id=\"h-cji-surya-kant-students-have-a-right-to-protest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"CJI_Surya_Kant_Students_Have_A_Right_To_Protest\"><\/span>CJI Surya Kant: Students Have A Right To Protest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">During the hearing, CJI Surya Kant expressed clear displeasure over the BCI&#8217;s intervention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Chief Justice reportedly observed that the matter was essentially a dialogue between the students and him and questioned why the Bar Council had intervened. The Court emphasized that students have a lawful right to protest peacefully.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most important aspects of the observation was the recognition that even if the students&#8217; view were assumed to be incorrect, that alone would not extinguish their right to express it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The principle is fundamental to constitutional democracy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A democracy does not protect only opinions with which the authorities agree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It protects the right to disagree.<\/p>\n\n\n\n<h2 id=\"h-the-supreme-court-s-interim-protection\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Courts_Interim_Protection\"><\/span>The Supreme Court\u2019s Interim Protection<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Court passed an interim order staying punitive action against NALSAR students and faculty members at the instance of the Bar Council.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court also sought a response from the BCI regarding the circulars issued in the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This interim protection is extremely important because a student&#8217;s career cannot reasonably be placed in jeopardy merely because he or she has exercised a constitutionally protected form of dissent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s intervention therefore serves two immediate purposes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Protection of the students from punitive consequences;<\/li>\n\n\n\n<li>Judicial examination of the BCI&#8217;s authority to intervene in the controversy.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-constitutional-foundation-of-the-right-to-protest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Constitutional_Foundation_Of_The_Right_To_Protest\"><\/span>Constitutional Foundation Of The Right To Protest<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The right to protest is not an isolated constitutional right expressly mentioned in one provision of the Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It flows primarily from the guarantees of freedom of speech and expression under Article 19(1)(a) and the right to assemble peacefully and without arms under Article 19(1)(b).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These freedoms are, however, subject to reasonable restrictions under Article 19(2) and Article 19(3).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the constitutional position is not that every protest is automatically protected irrespective of its nature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction is between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>peaceful and lawful dissent, on the one hand, and<\/li>\n\n\n\n<li>violent, unlawful, or otherwise prohibited conduct, on the other.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The NALSAR controversy, as presented before the Supreme Court, raises precisely this distinction.<\/p>\n\n\n\n<h2 id=\"h-peaceful-dissent-is-the-lifeblood-of-democracy\" class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As a lawyer practising for decades, I consider the Court&#8217;s observations particularly significant for another reason.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Law students are not merely students preparing for examinations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are future members of the legal
