It is obtained through clinical examinations, diagnostic tests, laboratory investigations, imaging studies, post-mortem examinations, medical records, and expert testimony. Under <strong>Section 39(1) of the Bharatiya Sakshya Adhiniyam, 2023<\/strong>, corresponding to <strong>Section 45 of the erstwhile Indian Evidence Act, 1872<\/strong>, the opinion of an expert is relevant when the court has to form an opinion on a point of science, including medical science.<\/p><div id=\"ez-toc-container\" class=\"ez-toc-v2_0_86 counter-hierarchy ez-toc-counter ez-toc-grey conditions.<\/li>\n\n\n\n<li><strong>Determining Causation:<\/strong> Assists courts in personal-injury, medical-negligence, and criminal cases in assessing the relationship between an alleged act or omission and the resulting injury or condition.<\/li>\n\n\n\n<li><strong>Assessing Damages:<\/strong> Assists civil courts in evaluating medical expenses, pain and suffering, loss of earning capacity, and permanent or temporary disability.<\/li>\n\n\n\n<li><strong>Corroborating or Testing Credibility:<\/strong> Medical findings may corroborate, contradict, or otherwise assist in evaluating accounts given by witnesses, victims, or accused persons.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-role-of-doctors-as-expert-witnesses\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" serve as <strong>independent experts assisting the court<\/strong>, rather than as advocates for either party. Their principal responsibility is to explain technical terminology, clinical findings, mechanisms of injury, and other matters within their specialised knowledge in an objective and scientifically reasoned manner. Their ultimate duty is to assist the court in the proper appreciation of medical facts and the discovery of truth.<\/p>\n\n\n\n<h2 id=\"h-conviction-based-solely-on-medical-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conviction_Based_Solely_on_Medical_Evidence\"><\/span>Conviction Based Solely on Medical Evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As a general rule, a conviction is not ordinarily based solely on medical evidence. Medical evidence may assist in determining the nature, mechanism, timing, or possible weapon involved in causing an injury, but it does not ordinarily establish the identity of the offender, motive, or mens rea by itself. Although generally corroborative rather than conclusive, its ability to provide objectively documented medical findings and scientifically reasoned expert interpretation can significantly assist courts in determining disputed facts. Its evidentiary weight depends upon its reliability, relevance, methodological soundness, consistency with the surrounding circumstances, and relationship with the other evidence on record.
