Tarun Choudhury<\/a><\/li><\/ul><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n\n\n\n\n<h2 id=\"h-introduction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Introduction\"><\/span>Introduction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As a lawyer practising before the Supreme Court, I have always believed that institutions become stronger not when we refuse to question them, but when we subject them to reasoned scrutiny and ask whether they can be made better.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s electoral system deserves precisely that kind of examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The debate over electronic voting machines (VVPAT) and paper ballots has, unfortunately, become heavily polarized. One side often argues that EVMs are the future and that questioning them amounts to questioning the electoral process itself. The other side demands a return to paper ballots, sometimes as though the paper-ballot system of the past had no serious weaknesses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>I do not subscribe to either extreme.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My concern is not to establish that Indian EVMs are fraudulent. The Supreme Court has not made such a finding, and I would be legally and intellectually irresponsible if I made such a claim without evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My question is different:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Can we design an electoral system in which the voter-created physical ballot remains the ultimate legal evidence of the vote, while technology is used to make counting faster and statistical auditing stronger?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">I believe we can.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After examining the strengths and weaknesses of electronic voting, traditional paper ballots, VVPAT, election auditing, chain-of-custody safeguards, and international approaches, I would propose that India seriously study a third model.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I call that model:<\/p>\n\n\n\n<h1 id=\"h-vista-verifiable-india-secure-tabulation-amp-audit\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"VISTA%E2%80%94Verifiable_India_Secure_Tabulation_Audit\"><\/span>VISTA\u2014Verifiable India Secure Tabulation &amp; Audit<span class=\"ez-toc-section-end\"><\/span><\/h1>\n\n\n\n<p class=\"wp-block-paragraph\">This is <strong>my proposed architecture for discussion and testing<\/strong>, not an assertion that the system is already ready for nationwide implementation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its philosophy can be expressed in one sentence:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>The computer may count the ballots, but the computer should never own the ballots.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The physical ballot created by the voter should remain the ultimate evidence.<\/p>\n\n\n\n<h2 id=\"h-1-why-i-am-not-advocating-a-simple-return-to-paper-ballots\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Why_I_Am_Not_Advocating_a_Simple_Return_to_Paper_Ballots\"><\/span>1. Why I Am Not Advocating a Simple Return to Paper Ballots<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Let me make my position clear at the outset.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Should India simply go back to the old paper-ballot system?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">My answer would be <strong>no<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I say this not because paper ballots are inherently unreliable, but because India&#8217;s experience with traditional paper elections demonstrated that paper alone does not guarantee electoral integrity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Historically, paper elections were vulnerable to problems such as<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>booth capturing<\/li>\n\n\n\n<li>ballot-box stuffing;<\/li>\n\n\n\n<li>pre-marked ballots;<\/li>\n\n\n\n<li>invalid ballots;<\/li>\n\n\n\n<li>incorrect marking;<\/li>\n\n\n\n<li>manual counting errors; and<\/li>\n\n\n\n<li>lengthy counting processes.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Technology was introduced into the electoral process for reasons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if we are going to discuss replacing or substantially modifying the existing system, I would not recommend going backwards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would recommend going <strong>forward<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What I have in mind is neither the old paper ballot nor an EVM-centric system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a <strong>modern paper-first electoral architecture<\/strong>.<\/p>\n\n\n\n<h2 id=\"h-2-the-real-question-is-not-whether-evms-are-good-or-bad\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_The_Real_Question_Is_Not_Whether_EVMs_Are_%E2%80%9CGood%E2%80%9D_or_%E2%80%9CBad%E2%80%9D\"><\/span>2. The Real Question Is Not Whether EVMs Are &#8220;Good&#8221; or &#8220;Bad&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I believe the public debate has been framed incorrectly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We repeatedly hear:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>EVM versus ballot paper.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But that is not the question that lawyers, election administrators, and constitutional policymakers should be asking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more important question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>What electoral architecture provides the best combination of secrecy, accuracy, accessibility, speed, transparency, auditability, and public confidence?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much more meaningful question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s 26 April 2024 judgment dealing with EVMs and VVPAT did not find evidence establishing that Indian EVMs were being manipulated. The Court upheld the existing framework and rejected demands for a wholesale return to paper ballots and for 100% VVPAT verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That judgment must be acknowledged honestly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would therefore never build my argument around the proposition:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;The Supreme Court has found EVMs fraudulent.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It has not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor would I argue that EVMs have been proved to be incapable of conducting free and fair elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That proposition has not been established either.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My argument is much more modest\u2014and, in my view, much more constructive:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Even where an existing system is constitutionally acceptable, India is entitled to examine whether an even more independently verifiable system can be developed for the future.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the reform conversation I am proposing.<\/p>\n\n\n\n<h2 id=\"h-3-my-basic-idea-create-a-third-way\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_My_Basic_Idea_Create_a_Third_Way\"><\/span>3. My Basic Idea: Create a Third Way<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In my considered view, India should examine a third electoral model built around four simple propositions.<\/p>\n\n\n\n<h3 id=\"h-first\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First\"><\/span>First<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The voter should create a physical ballot.<\/p>\n\n\n\n<h3 id=\"h-second\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Second\"><\/span>Second<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The voter should be able to see and verify that ballot.<\/p>\n\n\n\n<h3 id=\"h-third\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Third\"><\/span>Third<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Technology should be used to count the ballots quickly.<\/p>\n\n\n\n<h3 id=\"h-fourth\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fourth\"><\/span>Fourth<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Technology should never be the final authority because the physical ballots should remain available for independent statistical and human verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In other words:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Paper provides the evidence. Technology provides the speed. Statistics provide the audit. Human counting provides the ultimate safeguard.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That, in essence, is VISTA.<\/p>\n\n\n\n<h2 id=\"h-4-what-would-vista-actually-look-like\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_What_Would_VISTA_Actually_Look_Like\"><\/span>4. What Would VISTA Actually Look Like?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Let me explain the proposal in practical terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A voter would receive a standardized paper ballot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ballot would contain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>candidate number;<\/li>\n\n\n\n<li>candidate name;<\/li>\n\n\n\n<li>party symbol;<\/li>\n\n\n\n<li>clearly defined marking areas; and<\/li>\n\n\n\n<li>appropriate accessibility instructions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The voter would physically mark the ballot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The crucial point is that <strong>the voter&#8217;s physical act creates the primary electoral record<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There would be no need to treat an electronic record as the original expression of the voter&#8217;s choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The physical ballot would be the primary evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the fundamental departure from an EVM-centric architecture.<\/p>\n\n\n\n<h2 id=\"h-5-the-voter-must-be-able-to-see-the-vote\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_The_Voter_Must_Be_Able_to_See_the_Vote\"><\/span>5. The Voter Must Be Able to See the Vote<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I consider this principle extremely important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before the ballot is deposited, the voter should have an opportunity to examine the completed paper.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The voter should be able to satisfy himself or herself:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;This is the vote I have cast.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is fundamentally different from asking a voter to trust that an electronic system has internally recorded the intended choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The voter-created ballot becomes an independently preserved physical record.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And this is precisely where I see a conceptual strength in a paper-first system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ballot does not have to be generated by the machine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The voter creates it.<\/strong><\/p>\n\n\n\n<h2 id=\"h-6-then-why-use-a-machine-at-all\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Then_Why_Use_a_Machine_at_All\"><\/span>6. Then Why Use a Machine at All?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the obvious question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If I am advocating a paper-first system, why introduce a scanner?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because I am not advocating a return to nineteenth-century election administration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs speed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs accuracy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs scalable election administration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India cannot realistically require election officials to manually count hundreds of millions of ballots before a result can be declared.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would use an <strong>offline optical scanner<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But\u2014and this is the critical qualification\u2014the scanner would not become the ultimate authority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its job would principally be<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>to count quickly.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>to own the election result.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-7-the-scanner-should-have-a-limited-function\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_The_Scanner_Should_Have_a_Limited_Function\"><\/span>7. The Scanner Should Have a Limited Function<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The scanner could determine whether:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The ballot is readable<\/li>\n\n\n\n<li>One candidate has been marked;<\/li>\n\n\n\n<li>multiple candidates appear to have been marked; or<\/li>\n\n\n\n<li>The ballot contains an ambiguous marking.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It could communicate something as simple as<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Accepted<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">or<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Please Review Ballot<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The system should not unnecessarily disclose the voter&#8217;s selection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would help preserve secrecy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More importantly, the scanner&#8217;s interpretation would remain subject to subsequent audit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the distinction I consider central to VISTA:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>The machine produces a preliminary count. The paper remains the independent evidence.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-8-what-if-somebody-manipulates-the-scanner\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_What_If_Somebody_Manipulates_the_Scanner\"><\/span>8. What If Somebody Manipulates the Scanner?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where I believe the proposed architecture becomes particularly interesting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let us assume, for argument&#8217;s sake, that a scanner has been compromised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the scanner reports:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Candidate A\u201440,000<\/strong><br><strong>Candidate B\u201460,000<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the physical ballots actually show:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Candidate A\u201455,000<\/strong><br><strong>Candidate B\u201445,000<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The electronic preliminary result would obviously be wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the election itself would not become incapable of verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Why?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the physical ballots remain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The discrepancy can be detected through auditing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The system can then escalate to a larger audit or a complete manual count.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is an important change in security philosophy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am not proposing that we build a machine that can never fail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am proposing that we build an election system in which <strong>a failure of the machine cannot silently become the final electoral truth<\/strong>.<\/p>\n\n\n\n<h2 id=\"h-9-this-is-where-risk-limiting-audits-become-important\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_This_Is_Where_Risk-Limiting_Audits_Become_Important\"><\/span>9. I Would Introduce Three Audit Levels<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would propose three broad levels of verification.<\/p>\n\n\n\n<h3 id=\"h-level-one-statistical-audit\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Level_One_%E2%80%94_Statistical_Audit\"><\/span>Level One \u2014 Statistical Audit<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A predetermined statistical algorithm would randomly select ballots or batches for manual examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statistical risk limit should be determined in advance and independently validated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For discussion, a risk limit of <strong>1% or lower<\/strong> could be considered, although the precise figure should be settled only after proper statistical modelling and testing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important principle is that the rules must be known <strong>before the election<\/strong>, not invented after seeing the result.<\/p>\n\n\n\n<h3 id=\"h-level-two-expanded-audit\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Level_Two_%E2%80%94_Expanded_Audit\"><\/span>Level Two \u2014 Expanded Audit<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The audit would automatically expand where there are objectively defined warning signs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These could include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Scanner\/manual discrepancies;<\/li>\n\n\n\n<li>Ballot-accounting discrepancies;<\/li>\n\n\n\n<li>Chain-of-custody irregularities;<\/li>\n\n\n\n<li>Equipment malfunction;<\/li>\n\n\n\n<li>Legally defined anomalies;<\/li>\n\n\n\n<li>Significant candidate objections; or<\/li>\n\n\n\n<li>An exceptionally narrow margin.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The process should not depend entirely upon political pressure.<\/p>\n\n\n\n<h3 id=\"h-level-three-full-manual-count\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Level_Three_%E2%80%94_Full_Manual_Count\"><\/span>Level Three \u2014 Full Manual Count<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A full hand count should be triggered where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The statistical audit cannot confirm the result;<\/li>\n\n\n\n<li>Material discrepancies remain unexplained;<\/li>\n\n\n\n<li>Chain of custody has been materially compromised; or<\/li>\n\n\n\n<li>A statutory threshold is crossed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The key principle would be<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>When the evidence is insufficient, the system should count more ballots\u2014not ask citizens to trust the machine more.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-11-my-proposal-for-close-elections\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"11_My_Proposal_for_Close_Elections\"><\/span>11. My Proposal for Close Elections<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would go one step further.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the winning margin is exceptionally narrow, I would consider making an enhanced audit automatic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, suppose the result is<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Candidate<\/th><th>Votes<\/th><\/tr><\/thead><tbody><tr><td><strong>Winner<\/strong><\/td><td>500,800<\/td><\/tr><tr><td><strong>Runner-up<\/strong><\/td><td>499,200<\/td><\/tr><tr><td><strong>Difference<\/strong><\/td><td>1,600 Votes<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The difference is only 1,600 votes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under a predefined close-election rule, the system could automatically move to a higher audit level.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No allegation of fraud would be necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No political party would have to demand a recount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No candidate would need to approach the court simply to ask whether the closeness of the contest justifies additional verification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rule would operate automatically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exact threshold\u2014for example, 0.5%\u2014would require proper statistical and legislative examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I strongly favor the principle of <strong>automatic escalation based on objectively predetermined conditions<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-12-why-should-a-candidate-have-to-ask-for-a-recount\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"12_Why_Should_a_Candidate_Have_to_Ask_for_a_Recount\"><\/span>12. Why Should a Candidate Have to Ask for a Recount?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is a question I believe deserves greater attention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A close election should not necessarily become a political dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the system itself knows that a result falls within a predetermined statistical danger zone, why should a candidate have to make an allegation before additional verification takes place?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Why not simply build the safeguard into the system?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the philosophy behind VISTA.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;I Don&#8217;t Trust the Result.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">We should have:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>&#8220;The Result Has Triggered the Statutory Audit Rule. Let Us Follow the Rule.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much healthier democratic mechanism.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-13-the-ballot-must-never-become-traceable-to-the-voter\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"13_The_Ballot_Must_Never_Become_Traceable_to_the_Voter\"><\/span>13. The Ballot Must Never Become Traceable to the Voter<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As a lawyer, I would regard this as an absolute requirement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There must never be a system capable of creating:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Voter Identity \u2192 Ballot Identity \u2192 Candidate Choice.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would undermine the secrecy of the ballot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, ballots could be organized into sealed batches.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Batch 742\u2014200 Ballots<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The audit system could identify the batch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should not be capable of identifying the individual voter who cast a particular ballot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction between <strong>voter identity<\/strong> and <strong>ballot choice<\/strong> must remain structurally protected.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-14-chain-of-custody-must-become-much-more-transparent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"14_Chain_of_Custody_Must_Become_Much_More_Transparent\"><\/span>14. Chain of Custody Must Become Much More Transparent<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A paper-based system creates another important responsibility: securing the physical ballots.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every ballot container should have:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A unique container identifier;<\/li>\n\n\n\n<li>Tamper-evident seals;<\/li>\n\n\n\n<li>Recorded seal numbers;<\/li>\n\n\n\n<li>Two-person custody;<\/li>\n\n\n\n<li>Documented handovers;<\/li>\n\n\n\n<li>Timestamps;<\/li>\n\n\n\n<li>Originating polling station; and<\/li>\n\n\n\n<li>Destination counting center.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Every transfer should be recorded.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But again, the record should identify the movement of the <strong>ballot container<\/strong>, not the identity of individual voters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is to answer a simple question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Can we demonstrate that the ballots counted are the same ballots that left the polling station?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a chain-of-custody question.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-15-i-would-keep-the-voting-equipment-offline\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"15_I_Would_Keep_the_Voting_Equipment_Offline\"><\/span>15. I Would Keep the Voting Equipment Offline<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would not make internet connectivity part of the core voting architecture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The polling-station scanner should ideally have no unnecessary:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Wi-Fi;<\/li>\n\n\n\n<li>Bluetooth;<\/li>\n\n\n\n<li>Cellular connection;<\/li>\n\n\n\n<li>Cloud connection; or<\/li>\n\n\n\n<li>Remote administration.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Why create a network vulnerability where none is necessary?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The machine should perform a limited local task.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The election result should be subject to controlled verification procedures after polling closes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In election security, simplicity can itself be a security feature.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 id=\"h-16-technology-should-be-used-for-speed-not-blind-trust\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"16_Technology_Should_Be_Used_for_Speed_Not_Blind_Trust\"><\/span>16. How can millions of ballots be manually audited?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is precisely why I am not proposing a universal immediate manual count.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer lies in statistical sampling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We do not need to count every ballot at the first stage if a scientifically designed audit can determine whether the reported result is supported by sufficient evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the result is clear and the audit is clean, the process can remain efficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the contest is close or the system detects discrepancies, the audit expands.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where necessary, we count everything.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the point at which statistical science becomes extremely useful to election law.<\/p>\n\n\n\n<h2 id=\"h-18-i-would-make-counting-centers-more-transparent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"18_I_Would_Make_Counting_Centers_More_Transparent\"><\/span>18. I Would Make Counting Centers More Transparent<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The counting center should not be treated as a place where the public simply waits for officials to emerge with a result.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The process should be observable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Appropriate observers, political-party representatives, and accredited media should be able to observe:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>opening of ballot containers;<\/li>\n\n\n\n<li>reconciliation procedures;<\/li>\n\n\n\n<li>audit selection;<\/li>\n\n\n\n<li>manual counting;<\/li>\n\n\n\n<li>recounts;<\/li>\n\n\n\n<li>relevant documentation; and<\/li>\n\n\n\n<li>security procedures.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">CCTV could cover storage and counting areas subject to appropriate safeguards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I would strongly oppose any surveillance inside the voting booth.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Election transparency must never become voter surveillance.<\/p>\n\n\n\n<h2 id=\"h-19-a-national-election-stress-test\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"19_A_National_Election_Stress_Test\"><\/span>19. A National Election Stress Test<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the ideas I would particularly like to see examined is what I would call a<\/p>\n\n\n\n<h3 id=\"h-national-election-stress-test\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"National_Election_Stress_Test\"><\/span><strong>National Election Stress Test<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Before an election, randomly selected scanners should be subjected to controlled and adversarial testing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The exercise should be observable by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>political parties;<\/li>\n\n\n\n<li>election experts;<\/li>\n\n\n\n<li>universities;<\/li>\n\n\n\n<li>cybersecurity researchers;<\/li>\n\n\n\n<li>civil society; and<\/li>\n\n\n\n<li>accredited observers.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The equipment should be tested using difficult but realistic ballot conditions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>faint marks;<\/li>\n\n\n\n<li>smudges;<\/li>\n\n\n\n<li>multiple markings;<\/li>\n\n\n\n<li>damaged paper;<\/li>\n\n\n\n<li>unusual permissible marking instruments;<\/li>\n\n\n\n<li>ambiguous markings; and<\/li>\n\n\n\n<li>other deliberately challenging conditions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Then compare:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Human interpretation versus machine interpretation.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The results should be published.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would much rather see the weaknesses of a system exposed before an election than discover them during a political controversy after an election.<\/p>\n\n\n\n<h2 id=\"h-20-accessibility-cannot-be-an-afterthought\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"20_Accessibility_Cannot_Be_an_Afterthought\"><\/span>20. My 0\u201330 Day Reform Plan<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I were asked to initiate this project, I would begin by establishing an independent <strong>National Paper Election Architecture Committee<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>election administrators;<\/li>\n\n\n\n<li>constitutional lawyers;<\/li>\n\n\n\n<li>statisticians;<\/li>\n\n\n\n<li>cybersecurity experts;<\/li>\n\n\n\n<li>printing specialists;<\/li>\n\n\n\n<li>accessibility experts;<\/li>\n\n\n\n<li>logistics experts;<\/li>\n\n\n\n<li>political-party representatives;<\/li>\n\n\n\n<li>academics; and<\/li>\n\n\n\n<li>civil-society representatives.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The first task should not be procurement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should be architecture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should first determine:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>What exactly are we trying to build?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Only then should we discuss machines.<\/p>\n\n\n\n<h2 id=\"h-34-days-31-90-build-and-attack\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"34_Days_31%E2%80%9390_Build_and_Attack\"><\/span>34. Days 31\u201390: Build and Attack<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The next stage should involve prototypes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The system should be subjected to deliberate attack.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Try to manipulate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>scanners;<\/li>\n\n\n\n<li>ballot accounting;<\/li>\n\n\n\n<li>chain of custody;<\/li>\n\n\n\n<li>audit selection;<\/li>\n\n\n\n<li>ballot interpretation;<\/li>\n\n\n\n<li>data transfer; and<\/li>\n\n\n\n<li>counting procedures.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The objective should be to identify weaknesses before the system reaches an actual election.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>I would rather discover a vulnerability in a laboratory than in a polling station.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-35-six-to-twelve-months-controlled-elections\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"35_Six_to_Twelve_Months_Controlled_Elections\"><\/span>35. Six to Twelve Months: Controlled Elections<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The system should then be tested in controlled electoral environments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The results should be independently evaluated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And I would insist on one principle:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Do not hide the failures.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If the new system fails, we should know.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If it succeeds, we should know why.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If it performs better than EVM\/VVPAT in some respects but worse in others, that too should be reported honestly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Electoral reform should be based upon evidence rather than predetermined conclusions.<\/p>\n\n\n\n<h2 id=\"h-36-the-larger-constitutional-idea\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"36_The_Larger_Constitutional_Idea\"><\/span>36. The Larger Constitutional Idea<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Ultimately, this debate is not really about machines.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is about <strong>constitutional trust<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The vote belongs to the citizen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The electoral authority counts it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The state certifies the result.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The courts provide constitutional oversight.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The political parties participate in the democratic process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Technology is merely an instrument.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should never become more important than the underlying democratic act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why I believe the physical ballot has a special significance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a tangible piece of evidence created by the voter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be preserved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be inspected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be counted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be recounted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can be independently audited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And where necessary, it can be produced to resolve a dispute.<\/p>\n\n\n\n<h2 id=\"h-37-my-final-position\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"37_My_Final_Position\"><\/span>37. My Final Position<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Let me state my position clearly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am <strong>not<\/strong> arguing that Indian EVMs have been proved fraudulent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am <strong>not<\/strong> suggesting that the Supreme Court has ordered or recommended a return to paper ballots.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am <strong>not<\/strong> suggesting that VISTA is already a proven nationwide electoral technology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am proposing something more practical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am suggesting that India should <strong>research, develop, attack, test, and independently evaluate a paper-first, audit-first electoral architecture<\/strong> before deciding whether such a system has any place in future elections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If it fails rigorous testing, we should reject it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If it succeeds, we should have the intellectual honesty to consider it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is how serious institutional reform should happen.<\/p>\n\n\n\n<h2 id=\"h-conclusion-my-vision-for-the-future-of-indian-elections\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion_My_Vision_for_the_Future_of_Indian_Elections\"><\/span>Conclusion: My Vision for the Future of Indian Elections<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In my considered view, India should not remain trapped in the question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>EVM or ballot paper?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is yesterday&#8217;s debate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question for tomorrow should be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>How do we combine the transparency of a voter-created paper ballot, the speed of technology, the mathematical strength of statistical auditing, and the safeguard of human verification?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">My answer is the architecture I have proposed as <strong>VISTA\u2014Verifiable India Secure Tabulation &amp; Audit<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its core structure is simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Voter-created paper ballot<\/strong><br>\u2193<br><strong>Voter verification<\/strong><br>\u2193<br><strong>Secure ballot box<\/strong><br>\u2193<br><strong>Offline optical counting<\/strong><br>\u2193<br><strong>Preliminary result<\/strong><br>\u2193<br><strong>Mandatory risk-limiting audit<\/strong><br>\u2193<br><strong>Automatic escalation where necessary<\/strong><br>\u2193<br><strong>Human count as the ultimate safeguard.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The philosophy behind it is even simpler:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Trust the voter-created evidence. Use machines for speed. Use statistics for verification. Use human beings for the final safeguard.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">As a lawyer, I believe that is the direction in which the discussion should move.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should not design elections around the assumption that any machine is infallible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor should we design elections around the assumption that human beings are infallible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should design them around a more realistic constitutional principle:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Errors may occur. Manipulation may be attempted.
