>Conclusion

A scientifically accurate laboratory result may nevertheless be challenged if the prosecution cannot satisfactorily demonstrate that the exhibit examined in the laboratory is the same exhibit collected from the scene and that its integrity was preserved throughout its journey.

The chain of custody therefore provides the documentary and procedural foundation connecting the crime scene to the forensic laboratory and, ultimately, to the courtroom.

It should establish four essential elements:

Identity → Continuity → Integrity → Accountability

Core Questions the Chain of Custody Must Answer

A properly maintained chain of custody should enable the court to answer four fundamental questions:

Collection

Who collected or seized the evidence, when, where, and under what circumstances?

Custody

Who possessed, handled, transferred, stored, or examined the evidence at every subsequent stage?

Integrity

Was the evidence adequately protected against contamination, deterioration, alteration, loss, or unauthorised access?

Identity

Can the exhibit produced before the court be reliably identified as the same item that was originally collected?

The stronger the documentation addressing these questions, the easier it is for the court to assess the reliability and evidentiary weight of the forensic material.

Key Operational memory.

Every movement of an exhibit should be documented contemporaneously in the appropriate official records, including the case diary, property/malkhana register, forwarding documentation, laboratory receipt, and other prescribed records.

Rule of Specificity

Avoid vague entries such as:

“Evidence handed over to Malkhana.”

Instead, record relevant particulars such as:

<ul where required; and

place of storage or other relevant identification details.

The objective is to make the movement of the exhibit reconstructable without relying upon oral memory alone.

Transit Documentation

Whenever an exhibit is dispatched to a forensic laboratory, the relevant documentation should identify:

date and time of dispatch;

exhibit numbers;

condition and Acknowledgement

The investigating agency should preserve the laboratory’s acknowledgement of receipt and, where recorded, the condition of the package and seals upon arrival.

Any discrepancy—such as a broken, damaged, or unidentified seal—should be documented and appropriately investigated rather than ignored.

Biological Evidence: Preservation and Temperature Control

Biological evidence—including blood, semen, saliva, tissue, and other biological material—is particularly vulnerable to degradation, microbial growth, and contamination.

Preservation requirements should therefore be determined according to the type of specimen, the applicable forensic protocol, and the receiving laboratory’s instructions.

Air-Dry Wet Biological Evidence

Where appropriate, blood- or body-fluid-stained clothing and other wet biological exhibits should be air-dried in a clean, protected environment before packaging.

Wet biological material sealed in an unsuitable container can retain moisture and encourage microbial growth, potentially compromising the evidentiary material.

Appropriate Storage

Biological specimens should be stored and transported under the temperature and environmental conditions specified for that particular specimen and applicable forensic protocol.

It is therefore unsafe to adopt a universal rule that every biological exhibit must simply be placed on ice or refrigerated. Some specimens require refrigeration, some require freezing, and others should be maintained under controlled dry conditions.

The guiding principle is:

Preserve the specimen according to its nature and the validated requirements of the laboratory or forensic protocol.

Packaging and Waterproofing

Packaging should protect the specimen from moisture, physical damage, leakage, and external contamination.

Where cooling is used, the packaging system should ensure that condensation or melted ice does not come into direct contact with the evidence, labels, or seals.

Eliminate Unexplained Gaps

An unexplained period during which an exhibit cannot be accounted for may generate questions concerning contamination, substitution, unauthorised access, deterioration, or tampering.

This does not mean that every documentation error automatically destroys the evidentiary value of a sample. The court will generally consider the nature and significance of the particular irregularity and whether the identity and integrity of the exhibit can nevertheless be established.

Investigators should therefore minimise unexplained gaps through the following safeguards.

Secure Sealing

Each exhibit should be packaged and sealed in accordance with applicable forensic and institutional procedures.

The package should carry:

an appropriate exhibit identification;

necessary case particulars;

the required signatures or identifying marks; and

a seal capable of demonstrating whether the package has been opened or interfered with.

The seal used should be properly documented in the forwarding and laboratory records.

Separation and Protection

Different categories of evidence should be appropriately segregated to reduce the risk of:

cross-contamination;

chemical interaction;

physical damage;

leakage; State of Punjab (1956), the Supreme Court ruled that unexplained delays in dispatching seized exhibits to the forensic laboratory, or the failure to prove that seals remained intact throughout transit, render the scientific report unsafe to rely upon. Such lapses open the door to the possibility of tampering or substitution of evidence.

This principle was reaffirmed in Valsala v. State of Kerala (1993). The court acquitted the accused because of an unrecorded three-month gap between seizure and delivery to the laboratory. It held that the prosecution must affirmatively establish that the exact item seized was the one analysed and that it remained in tamper-proof custody with no possibility of interference.

More recently, in Prakash Nishad v. State of Maharashtra (2023), the Supreme Court emphasised that any missing link in the chain of custody—such as the failure to record transit details or to prove proper seal verification upon receipt by the laboratory—breaks the evidentiary link. Even strong DNA or chemical reports are thereby neutralised, and the accused is entitled to the benefit of the doubt.

U.S. Jurisprudence on Chain-of-Custody Integrity

In the United States, physical evidence authentication in federal courts is governed primarily by Federal Rule of Evidence 901(a), requiring proof that an item is what its proponent claims it to be.

In Gallego v. United States (1960), the Ninth Circuit held that physical evidence is admissible when the circumstances establish a reasonable probability that the article has not been changed in important respects, establishing that the prosecution is not required to account for every individual who may have come near the evidence.

Similarly, in United States v. Howard-Arias (1982), the Fourth Circuit affirmed that a missing link in the chain of custody does not automatically require exclusion. The court noted that missing links generally go to the weight of the evidence rather than its admissibility, provided the overall record establishes that the item was not materially altered or substituted.

In Melendez-Diaz v. Massachusetts (2009), the U.S. Supreme Court addressed the Sixth Amendment Confrontation Clause, holding that forensic analysts who prepare testimonial reports must generally be available for cross-examination. However, the Court clarified that this requirement does not mean every individual who handled, transported, or stored evidence must testify, distinguishing constitutional confrontation rights from standard chain-of-custody security challenges.

Thus, U.S. courts treat chain of custody as a flexible standard of authentication and reliability rather than an absolute rule requiring a flawless paper trail. Minor omissions affect the weight given to the evidence by the jury, while severe deficiencies that undermine identity or integrity result in exclusion.

Crucial Reminder

A chain-of-custody defect should not automatically be described as resulting in acquittal or rendering evidence legally useless. The legal consequence depends upon the nature of the defect, the applicable law, and whether the prosecution can nevertheless establish the identity and integrity of the evidence to the standard.

The correct forensic principle is therefore:

A strong scientific result requires a strong evidentiary chain.

The laboratory can determine what is present in a sample. The chain of custody helps establish how that sample reached the laboratory and whether the exhibit examined can reliably be connected to the material collected during the investigation.

In medical jurisprudence, evidence management is therefore not a clerical afterthought. It is an integral component of forensic reliability.

Track the evidence with the same precision with which you investigate the crime.

Conclusion

The chain of custody is essential to preserving the identity, integrity, and reliability of forensic evidence from the crime scene to the courtroom. Proper collection, sealing, documentation, storage, transportation, and laboratory receipt ensure that the evidence examined is the same evidence collected and has not been compromised. Although a procedural irregularity does not automatically invalidate evidence, unexplained gaps may affect its evidentiary weight. Ultimately, sound forensic science requires an equally sound chain of custody.

Online Gaming Bill, 2025: Regulation, Challenges and Market Impact

Forensic Exhibit Dispatch: Protocol and Procedure for Forwarding Evidence

Securing Digital Exhibits at Source: Preventing Remote Alteration and Navigating Electronic Evidence Certification under Section 63 BSA

Forensic Laboratories: The Role and Functions of Central and State Institutions

Wildlife Forensics: Investigation and Exhibit Dispatch under the Wildlife (Protection) Act, 1972

Introduction In medical jurisprudence and forensic investigation, the evidentiary value of a forensic sample depends not only on the quality of the scientific examination but also on how the evidence was collected, identified, sealed, documented, stored, transported, and received.
