Conclusion: From \u201cTouch DNA\u201d to Scientifically Defensible Evidence<\/a><\/li><\/ul><\/nav><\/div>\n\n\n\n\n<p class=\"wp-block-paragraph\">The central problem is not that DNA recovered from an object is necessarily unreliable. Rather, the problem lies in <strong>assuming how, when, and by whom the DNA was deposited merely because a person&#8217;s DNA profile was detected<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Modern forensic genetics recognises that minute quantities of DNA can reach an object through a variety of mechanisms, including direct contact, secondary or indirect transfer, background DNA, and, in some circumstances, contamination. Consequently, the presence of a person&#8217;s DNA on an object does not, by itself, establish that the person recently touched it, nor does it establish when the DNA was deposited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, the expression <strong>\u201ctouch DNA\u201d is potentially misleading when used as if it describes a scientifically established mode of deposition<\/strong>. More neutral terminology\u2014such as <em>trace DNA<\/em>, <em>low-template DNA<\/em>, or, where scientifically appropriate, <em>low-copy-number DNA<\/em>\u2014better reflects the evidentiary limitations.<\/p>\n\n\n\n<h2 id=\"h-2-the-problem-with-the-term-touch-dna\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_The_Problem_with_the_Term_%E2%80%9CTouch_DNA%E2%80%9D\"><\/span>2. The Problem with the Term \u201cTouch DNA\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The expression \u201ctouch DNA\u201d suggests a simple causal sequence:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Person \u2192 Touched Object \u2192 DNA Recovered \u2192 Person Was Therefore Recently in Contact With the Object.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Forensic interpretation is considerably more complicated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">DNA may reach a surface through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>direct contact;<\/li>\n\n\n\n<li>secondary transfer from another person or object;<\/li>\n\n\n\n<li>transfer through clothing, tools, or other intermediaries;<\/li>\n\n\n\n<li>previously deposited background DNA;<\/li>\n\n\n\n<li>airborne or environmental transfer of cellular material; or<\/li>\n\n\n\n<li>contamination introduced during collection, handling, packaging, or laboratory processing.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, finding a DNA profile on an object does not automatically identify the <strong>mechanism of deposition<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction is particularly important when the recovered material is extremely small in quantity. Low-level samples may produce partial or mixed DNA profiles and may be more susceptible to stochastic effects such as <strong>allele drop-out<\/strong>, as well as interpretation difficulties associated with mixtures and potential contamination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evidentiary question should therefore not simply be:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cWhose DNA is this?\u201d<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should also include:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cHow could the DNA have arrived here, when might it have been deposited, and what competing explanations are reasonably possible?\u201d<\/strong><\/p>\n\n\n\n<h2 id=\"h-3-the-more-precise-terminology-trace-dna-and-low-template-dna\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_The_More_Precise_Terminology_Trace_DNA_and_Low-Template_DNA\"><\/span>3. The More Precise Terminology: Trace DNA and Low-Template DNA<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The term <strong>\u201ctrace DNA\u201d<\/strong> is generally preferable when referring to small quantities of DNA recovered from an evidentiary item without presuming the mechanism by which it was deposited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, <strong>\u201clow-template DNA (LtDNA)\u201d<\/strong> describes a sample in which the quantity of DNA available for analysis is particularly limited. <strong>\u201cLow-copy-number (LCN) DNA\u201d<\/strong> has also been used in forensic literature, although terminology and technical definitions vary among laboratories and jurisdictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These terms are preferable because they do not automatically imply that the DNA resulted from touching.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, <strong>\u201ctrace DNA\u201d is not synonymous with \u201cunreliable DNA&#8221;.<\/strong> A trace sample may provide valuable evidence. Its probative value, however, depends upon the quality of the sample, the analytical method used, the possibility of transfer or contamination, the statistical interpretation, and the circumstances of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The scientific principle is therefore one of <strong>caution rather than categorical rejection<\/strong>.<\/p>\n\n\n\n<h2 id=\"h-4-transfer-and-contamination-why-context-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Transfer_and_Contamination_Why_Context_Matters\"><\/span>4. Transfer and Contamination: Why Context Matters<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">DNA is transferable biological material. A person&#8217;s DNA can potentially move from one surface to another without that person directly touching the second surface.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, DNA may be transferred:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>from one person to another during physical contact;<\/li>\n\n\n\n<li>from a person&#8217;s clothing or personal belongings to another object;<\/li>\n\n\n\n<li>through an intermediary object or tool;<\/li>\n\n\n\n<li>through repeated handling of a commonly used surface; or<\/li>\n\n\n\n<li>during evidence collection or laboratory processing if appropriate safeguards are not followed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This phenomenon is particularly important in cases involving objects that have been handled by numerous people.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of DNA can therefore establish an <strong>association<\/strong>, but the strength and meaning of that association must be evaluated in light of the circumstances.<\/p>\n\n\n\n<h2 id=\"h-5-quantity-does-not-automatically-establish-meaning\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Quantity_Does_Not_Automatically_Establish_Meaning\"><\/span>5. Quantity Does Not Automatically Establish Meaning<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The amount of DNA recovered can be relevant to interpretation, but <strong>there is no universal quantity threshold at which DNA suddenly becomes \u201ctouch DNA\u201d or becomes automatically unreliable<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Very small samples can present analytical challenges, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>partial profiles;<\/li>\n\n\n\n<li>allele drop-out;<\/li>\n\n\n\n<li>allele drop-in;<\/li>\n\n\n\n<li>increased stochastic variation;<\/li>\n\n\n\n<li>mixed profiles;<\/li>\n\n\n\n<li>difficulties in determining the number of contributors; and<\/li>\n\n\n\n<li>increased sensitivity to contamination and transfer considerations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently, a statement such as <em>\u201conly 78 picograms were recovered; therefore, the evidence is inadmissible\u201d<\/em> would be too simplistic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The scientifically defensible approach is to examine <strong>the entire evidentiary and analytical context<\/strong>, rather than relying on an arbitrary numerical threshold.<\/p>\n\n\n\n<h2 id=\"h-6-what-should-be-said-in-court\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_What_Should_Be_Said_in_Court\"><\/span>6. What Should Be Said in Court?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cThe defendant&#8217;s touch DNA was found on the gun.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A more scientifically cautious formulation would be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cA low-level trace DNA profile consistent with the defendant was detected on the grip of the firearm. The DNA findings, by themselves, do not establish the mechanism or timing of deposition.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Where the laboratory has reliable quantitative information, the report may additionally state the quantity, analytical method, mixture interpretation, statistical assessment, and relevant limitations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This formulation separates <strong>what the laboratory observed<\/strong> from <strong>what investigators or lawyers might infer from it<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is fundamental to sound forensic evidence.<\/p>\n\n\n\n<h2 id=\"h-7-lessons-from-real-world-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Lessons_from_Real-World_Cases\"><\/span>7. Lessons from Real-World Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-7-1-amanda-knox-investigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"71_Amanda_Knox_Investigation\"><\/span>7.1 Amanda Knox Investigation<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Amanda Knox case is frequently cited in discussions concerning low-level DNA evidence and forensic interpretation. The case illustrates how the interpretation of very small or mixed DNA samples can become highly contentious when the quantity of DNA is limited and the circumstances of collection and transfer are disputed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it is important not to oversimplify the litigation by stating that a particular quantity of DNA was itself the sole reason for the eventual outcome. The case involved numerous evidentiary, procedural, and interpretative issues.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The broader lesson is that <strong>a DNA association must be evaluated within its complete forensic context<\/strong>.<\/p>\n\n\n\n<h3 id=\"h-7-2-the-phantom-of-heilbronn\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"72_The_%E2%80%9CPhantom_of_Heilbronn%E2%80%9D\"><\/span>7.2 The \u201cPhantom of Heilbronn\u201d<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The so-called <strong>\u201cPhantom of Heilbronn\u201d<\/strong> investigation provides an even more striking illustration of contamination risk.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Between 1993 and 2009, the same female DNA profile appeared in evidence associated with numerous criminal investigations across Europe. The investigation eventually revealed that the apparent common perpetrator was not a serial offender at all. The DNA profile had originated from contamination associated with the cotton swabs used to collect evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case demonstrates a fundamental forensic principle:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>A DNA profile is only as meaningful as the integrity of the process through which it was obtained.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-8-dna-evidence-and-indian-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_DNA_Evidence_and_Indian_Law\"><\/span>8. DNA Evidence and Indian Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In India, DNA evidence is generally presented through scientific or expert evidence and must be assessed alongside the circumstances in which the biological material was collected, preserved, transported, examined, and reported.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under <strong>Section 39 of the Bharatiya Sakshya Adhiniyam, 2023<\/strong>, opinions of experts on matters requiring specialised knowledge may be relevant. Expert DNA evidence, however, does not automatically determine the ultimate issue before the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court must consider the reliability of the underlying scientific analysis, the chain of custody, the possibility of contamination or transfer, the quality of the sample, and the totality of the evidence.<\/p>\n\n\n\n<h3 id=\"h-8-1-important-judicial-caution\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"81_Important_Judicial_Caution\"><\/span>8.1 Important Judicial Caution<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Indian courts have repeatedly emphasised that DNA evidence cannot be considered in isolation from the circumstances surrounding its collection and preservation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <strong>Manoj v. State of Madhya Pradesh (2022)<\/strong>, the Supreme Court considered the possibility of contamination where biological material was recovered from an open area.
