Hoarding<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Hoarding:<\/strong> Stocking essential goods (such as potatoes, onions, pulses, edible oils, or medicines) far beyond the permitted limit fixed under any Control Order, with the intention of creating artificial scarcity by keeping them out of the market.<\/p>\n\n\n\n<h3 id=\"h-2-2-black-marketing\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"22_Black_Marketing\"><\/span>2.2. Black Marketing<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Black Marketing:<\/strong> Selling hoarded or controlled goods through unofficial channels at prices significantly higher than the government-mandated or Maximum Retail Price (MRP).<\/p>\n\n\n\n<h3 id=\"h-2-3-profiteering\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"23_Profiteering\"><\/span>2.3. Profiteering<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Profiteering:<\/strong> Making unfair or excessive profit by taking advantage of a crisis (flood, drought, pandemic, war, festival season, etc.) and charging exorbitant prices for essential commodities.<\/p>\n\n\n\n<h2 id=\"h-the-legal-framework\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Legal_Framework\"><\/span>The Legal Framework<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The primary legislation is the Essential Commodities Act, 1955 (ECA). Section 3 empowers the Central Government to issue Control Orders regulating production, supply, distribution, storage, and pricing of essential commodities. Violation of any such order is punishable under Section 7 of the Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Procedural aspects of investigation are now governed by the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), and rules of evidence by the Bharatiya Sakshya Adhiniyam, 2023 (BSA).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Additionally:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Prevention of Blackmarketing and Maintenance of Supplies of Essential Commodities Act, 1980, provides for preventive detention of habitual offenders.<\/li>\n\n\n\n<li>The Consumer Protection Act, 2019, addresses unfair trade practices, including excessive pricing.<\/li>\n\n\n\n<li>Relevant provisions of the Bharatiya Nyaya Sanhita, 2023 (BNS), may apply depending on the facts of the case.<\/li>\n\n\n\n<li>The Industries (Development and Regulation) Act, 1951, has limited residual application in certain regulated industries.<\/li>\n\n\n\n<li>Offences under the Essential Commodities Act are generally cognisable (Section 10A).<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-the-investigation-process-step-by-step\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Investigation_Process_Step-by-Step\"><\/span>The Investigation Process: Step-by-Step<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Investigating these economic offences differs from ordinary theft or assault cases. Success depends on meticulous documentation and following the paper trail.<\/p>\n\n\n\n<h3 id=\"h-4-1-intelligence-and-surveillance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"41_Intelligence_and_Surveillance\"><\/span>4.1. Intelligence and Surveillance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Early indicators usually include a sudden, unexplained rise in market prices despite normal supply conditions. Investigating officers should maintain a market intelligence network comprising:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whistleblowers (godown workers, transporters, disgruntled employees).<\/li>\n\n\n\n<li>Daily monitoring of wholesale versus retail price gaps.<\/li>\n\n\n\n<li>Use of decoy customers (plainclothes officers) to purchase commodities at inflated prices and gather evidence.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-4-2-the-planned-raid\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"42_The_Planned_Raid\"><\/span>4.2. The Planned Raid<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Raids must be conducted by surprise. Advance leakage of information allows traders to shift stock.<\/li>\n\n\n\n<li>Form joint teams comprising the Police, the Food &amp; Civil Supplies Department, and the Weights &amp; Measures Inspector.<\/li>\n\n\n\n<li>Under Section 105 of BNSS, the entire process of search and seizure (including preparation of the seizure list and signatures of witnesses) shall be recorded through audio-video electronic means (preferably mobile phone). The recording must be forwarded without delay to the District Magistrate, Sub-Divisional Magistrate, or Judicial Magistrate of the First Class.<\/li>\n\n\n\n<li>Ensure the presence of independent witnesses and proper preparation of the seizure memo.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-4-3-physical-verification-versus-book-balance\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"43_Physical_Verification_Versus_Book_Balance\"><\/span>4.3. Physical Verification Versus Book Balance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is the core of the investigation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Examine the Stock Register and other statutory records maintained by the licensed trader.<\/li>\n\n\n\n<li>Conduct a physical count of bags, containers, or stock in the godown\/premises.<\/li>\n\n\n\n<li>Any quantity found in excess of the recorded stock (or beyond the permitted stock limit under the relevant Control Order) constitutes hoarded stock.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-4-4-seizure-of-documentary-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"44_Seizure_of_Documentary_Evidence\"><\/span>4.4. Seizure of Documentary Evidence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Documents often prove more valuable than physical stock in court.
