violent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What happened in Shillong on August 19, 2026, during a black-flag motorcycle rally organised by the Khasi Students&#8217; Union (KSU), should concern every person who believes in democracy, indigenous rights and the rule of law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rally, organised amid an ongoing agitation over migration, recruitment, indigenous protection and other issues, reportedly descended into violence, with vehicles damaged or torched, public property vandalised and statues of Swami Vivekananda and Netaji Subhas Chandra Bose allegedly damaged.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The situation moved into a more serious legal phase when Meghalaya Police arrested three senior KSU leaders \u2014 President Raymond Kharjana, General Secretary Reuben Najiar and Vice-President Pynkmenlang Sanmiet \u2014 in connection with the violence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is a danger in reducing the entire episode to a simple headline:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cKSU Protest Becomes Violent.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is only one part of the story.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deeper question is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>How can Meghalaya protect the constitutional and cultural interests of its indigenous people while simultaneously guaranteeing that every law-abiding resident is safe from violence, intimidation and forced displacement?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">After more than 25 years of legal practice, I believe this distinction is fundamental.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution cannot be found in choosing one community over another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It must be found in <strong>law, evidence, institutional accountability and equal protection against violence.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The research underlying this article reaches a similar conclusion: Shillong does not need a system that chooses between indigenous Khasi interests and non-tribal residents; it needs a system that separates rights, responsibilities and enforcement mechanisms.<\/p>\n\n\n\n<h2 id=\"h-what-exactly-is-behind-the-current-shillong-tension\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Exactly_Is_Behind_the_Current_Shillong_Tension\"><\/span>What Exactly Is Behind the Current Shillong Tension?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">It is important not to misunderstand the present agitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current KSU campaign has reportedly involved demands concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>implementation of the Meghalaya Residents Safety and Security Act;<\/li>\n\n\n\n<li>migrant-worker regulation;<\/li>\n\n\n\n<li>recruitment and employment policies;<\/li>\n\n\n\n<li>recruitment at NEIGRIHMS;<\/li>\n\n\n\n<li>the Inner Line Permit issue;<\/li>\n\n\n\n<li>environmental and mining concerns;<\/li>\n\n\n\n<li>the Shree Cement public hearing;<\/li>\n\n\n\n<li>protection of indigenous interests.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The agitation, therefore, cannot responsibly be described as being about only one issue or one community.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction matters enormously.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If every demand is described merely as an \u201cethnic demand\u201d, legitimate questions about jobs, migration, environmental governance and administrative accountability may be ignored.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if every indigenous-security concern is dismissed as \u201ccommunal politics\u201d, the genuine anxieties of Meghalaya&#8217;s indigenous population will also remain unaddressed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both approaches are dangerous.<\/p>\n\n\n\n<h2 id=\"h-the-august-19-violence-protest-is-a-democratic-right-violence-is-not\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">Citizens, students, unions and civil-society organisations have every right to criticise a government, oppose policies, submit demands and organise peaceful demonstrations subject to law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But constitutional democracy contains an equally important principle:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>The Right to Protest Does Not Include a Right to Assault Another Person, Destroy Property, Burn Vehicles or Intimidate Civilians.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The latest reports indicate that the August 19 rally was followed by attacks on vehicles and damage to public property, while statues of Swami Vivekananda and Netaji Subhas Chandra Bose were allegedly vandalised.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These allegations must be investigated individually.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, we should avoid collective blame.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It would be legally and socially irresponsible to say that the actions of particular individuals represent the Khasi community as a whole.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Equally, violence should not be minimised simply because it occurred during a political demonstration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct legal approach is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Identify the Individual Act, Identify the Evidence, Identify the Offender and Apply the Law.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is how a constitutional democracy operates.<\/p>\n\n\n\n<h2 id=\"h-the-arrest-of-three-ksu-leaders-what-does-it-mean-legally\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">The arrest of three senior KSU leaders is an important development, but an arrest is not a conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This principle must be remembered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The criminal justice process requires investigation, evidence, due process and, where appropriate, trial.<\/p>\n\n\n\n<p constitutional history and institutional structure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, Meghalaya has statutory protections concerning tribal land.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <strong>Meghalaya Transfer of Land (Regulation) Act, 1971,<\/strong> exists to regulate land transfers and protect the interests of Scheduled Tribes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These protections have constitutional and historical significance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They should not be casually dismantled in the name of creating a superficially \u201cuniform\u201d system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the existence of special constitutional protection leads to another equally important question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Can Indigenous Protection Become a Justification for may impose lawful employment or recruitment conditions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean a private group can threaten a worker.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government may verify documentation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean verification should become a street-level system of ethnic intimidation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction should become the foundation of Meghalaya&#8217;s response.<\/p>\n\n\n\n<h2 id=\"h-the-dangerous-confusion-non-tribal-does-not-mean-illegal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">A businessman belonging to a non-tribal community is not automatically an unlawful resident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And an undocumented person cannot system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For major government projects and large private projects, publish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>number of jobs;<\/li>\n\n\n\n<li>qualification requirements;<\/li>\n\n\n\n<li>number of applicants;<\/li>\n\n\n\n<li>number of local applicants;<\/li>\n\n\n\n<li>number selected;<\/li>\n\n\n\n<li>applicable reservation category;<\/li>\n\n\n\n<li>apprenticeships;<\/li>\n\n\n\n<li>identified skill shortages.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Then the political argument changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cEven if I am legally present, I can be targeted because of who I am.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">These fears reinforce each other.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The cycle becomes:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Fear \u2192 suspicion \u2192 rumours \u2192 mobilisation \u2192 confrontation \u2192 violence \u2192 greater fear.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A successful policy must break the cycle from both ends.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why I believe a <strong>two-way protection guarantee<\/strong> is more promising than a one-sided law-and-order response.<\/p>\n\n\n\n<h2 id=\"h-the-constitutional-formula-i-would-recommend\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Constitutional_Formula_I_Would_Recommend\"><\/span>The Constitutional Formula I constitutional balance Meghalaya needs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It recognises that equality does not necessarily mean identical treatment in every circumstance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Constitution itself recognises special protections for historically vulnerable communities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But special protection does not mean private individuals acquire the power to punish another person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That power belongs to the State and must be exercised according to law.<\/p>\n\n\n\n<h2 id=\"h-what-i-would-tell-the-meghalaya-government-today\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_I_Would_Tell_the_Meghalaya_Government_Today\"><\/span>What I Would Tell without allowing violence to become the language of politics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, the test of a protest movement is not merely whether it can mobilise thousands of people.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is whether it can maintain discipline when emotions are high.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A democratic movement becomes stronger, not weaker, when it rejects violence.<\/p>\n\n\n\n<h2 id=\"h-conclusion-shillong-needs-security-without-fear\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" land protections must be respected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legitimate concerns about migration, employment and demographic security must receive serious institutional attention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But equally:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A law-abiding non-tribal resident must not live in fear.<\/li>\n\n\n\n<li>A migrant worker must not be assaulted merely because he or she came from another state.<\/li>\n\n\n\n<li>A person with a documentation problem must face the law \u2014 not a mob.<\/li>\n\n\n\n<li>A political leader must be accountable for criminal conduct if evidence establishes it.<\/li>\n\n\n\n<li>And a protest must remain a protest, not become a licence for violence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The latest Shillong violence is therefore more than a law-and-order episode.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a warning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the state responds only after every escalation, the cycle will continue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better strategy is to build an institutional system in which grievances are verified, heard, investigated, decided and remedied before they become street confrontations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The formula I would recommend is simple:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>Protect Meghalaya&#8217;s indigenous character. Protect every lawful resident. Control illegal migration through evidence. Punish violence regardless of who commits it. And move disputes from the street to transparent institutions.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That, in my considered view, offers Shillong the best chance of breaking the cycle of fear and confrontation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And perhaps the most powerful message Meghalaya can send today is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cMeghalaya for its indigenous people.
