Liability flows differently depending on the actors involved: sonologists are culpable for sex determination, gynecologists only if collusion is proven, and parents\/family as abettors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sting operations, while effective in exposing PCPNDT violations, cannot alone substantiate female feticide absent proof of pregnancy termination. This modular framework clarifies compliance obligations, evidentiary thresholds, and prosecutorial strategies, balancing women\u2019s reproductive rights with the state\u2019s duty to prevent sex-selective practices.<\/p>\n\n\n\n<h2 id=\"h-relationship-between-the-mtp-act-and-the-pcpndt-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Relationship_Between_the_MTP_Act_and_the_PCPNDT_Act\"><\/span>Relationship Between the MTP Act and the PCPNDT Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Feticide is a crime under the MTP Act. It includes both male and female fetuses. There is no separate provision for female feticide. For the crime of feticide, male or female, a person has to be prosecuted under the MTP Act. The PCPNDT Act was enacted to prevent sex-selected abortions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A woman is, however, entitled to abort an unwanted pregnancy. Since there is a prevalence of selected female feticide under the guise of unwanted pregnancy, the PCPNDT Act was enacted to prevent sex determination, sex selection, and disclosure of the sex of the child, since this enabled selective female feticide.<\/p>\n\n\n\n<h2 id=\"h-feticide-under-the-mtp-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Feticide_Under_the_MTP_Act\"><\/span>Feticide Under the MTP Act<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Since under the MTP Act termination of pregnancy, except for the specified conditions, and in contravention of any of the safety provisions of the MTP Act, the sex-selected female feticide became a special crime under the MTP Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Feticide is not done under the PCPNDT Act.
