The absence of an official acknowledgment can create what may be termed an <strong>\u201cunacknowledged complaint\u201d<\/strong>\u2014a situation in which the police may later deny receipt of the information, making it difficult to establish when the State was first put on notice of the alleged offense. It may also create uncertainty regarding subsequent delay, alteration, dilution, or omission of material allegations.<\/p><div id=\"ez-toc-container\" class=\"ez-toc-v2_0_86 counter-hierarchy contemporaneous record assumes considerable procedural importance. Once information discloses a cognizable offense and statutory conditions are satisfied, the police are duty-bound to record the FIR, irrespective of whether the complainant holds a stamped acknowledgment.<\/p>\n\n\n\n<h2 id=\"h-procedural-and-evidentiary-consequences-of-non-acknowledgment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedural_and_Evidentiary_Consequences_of_Non-Acknowledgment\"><\/span>Procedural and Evidentiary Consequences of Non-Acknowledgment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When a complaint is submitted but no acknowledgment is provided, and an FIR is registered only after a substantial interval, questions may subsequently arise regarding the date on which the police first received information and the contents of that information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three principal difficulties may arise:<\/p>\n\n\n\n<h3 id=\"h-first-it-may-obscure-the-chronology-of-police-action\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First_It_May_Obscure_the_Chronology_of_Police_Action\"><\/span>First: It May Obscure the Chronology of Police Action<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An unacknowledged complaint makes it more difficult to establish whether the police received the information on an earlier date and whether any action was taken before formal registration of the FIR.<\/p>\n\n\n\n<h3 id=\"h-second-it-may-create-a-dispute-regarding-the-original-allegations\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Second_It_May_Create_a_Dispute_Regarding_the_Original_Allegations\"><\/span>Second: It May Create a Dispute Regarding the Original Allegations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If material allegations appearing in the original complaint do not find place in the subsequently registered FIR, a contemporaneous copy of the complaint can become important in demonstrating what was originally communicated to the police.<\/p>\n\n\n\n<h3 id=\"h-third-it-may-affect-the-assessment-of-consistency\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Third_It_May_Affect_the_Assessment_of_Consistency\"><\/span>Third: It May Affect the Assessment of Consistency<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The earliest version of an occurrence can assume significance when the court evaluates subsequent statements and allegations. A preserved copy of the original complaint, together with reliable proof of its delivery, can therefore assist in establishing the chronology and contents of the information initially furnished.<\/p>\n\n\n\n<h2 id=\"h-creating-an-independent-proof-of-submission\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Creating_an_Independent_Proof_of_Submission\"><\/span>Creating an Independent Proof of Submission<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where the police station declines to stamp or acknowledge a duplicate copy, the complainant should avoid relying solely upon oral assurances. Where possible, the documentary record should establish not merely dispatch but also delivery.<\/p>\n\n\n\n<h2 id=\"h-statutory-escalation-under-the-bnss\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Statutory_Escalation_Under_the_BNSS\"><\/span>Statutory Escalation Under the BNSS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Where information disclosing a cognizable offense is not properly recorded or an FIR is not registered, the BNSS provides avenues for escalation.<\/p>\n\n\n\n<h3 id=\"h-step-1-approach-the-superintendent-of-police\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Step_1_Approach_the_Superintendent_of_Police\"><\/span>Step 1: Approach the Superintendent of Police.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Section 173(4), BNSS<\/strong> provides a statutory remedy where the officer in charge of a police station refuses to record information relating to a cognizable offense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The substance of the information may be sent in writing to the <strong>Superintendent of Police or other competent superior police authority<\/strong>, preferably through a mode that generates reliable proof of dispatch and delivery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The representation should ordinarily be accompanied by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a copy of the original complaint;<\/li>\n\n\n\n<li>proof of its submission or attempted submission to the police station;<\/li>\n\n\n\n<li>postal or electronic acknowledgment, if available;<\/li>\n\n\n\n<li>relevant supporting documents; and<\/li>\n\n\n\n<li>a concise chronology of the steps already taken.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-step-2-approach-the-competent-magistrate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Step_2_Approach_the_Competent_Magistrate\"><\/span>Step 2: Approach the Competent Magistrate<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Where the statutory police remedy does not result in appropriate action, the complainant may invoke the jurisdiction of the competent magistrate in accordance with <strong>Section 175(3), BNSS<\/strong>, seeking appropriate orders concerning investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The application should clearly disclose the earlier approaches made to the police authorities and should annex the documentary material establishing the chronology of those approaches.<\/p>\n\n\n\n<h3 id=\"h-step-3-preserve-the-complete-chronological-record\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Step_3_Preserve_the_Complete_Chronological_Record\"><\/span>Step 3: Preserve the Complete Chronological Record<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A complainant should maintain a chronological record of every material step.
