>Conclusion<\/a><\/li><\/ul><\/nav><\/div>\n\n<p>An FIR sets the criminal law in motion and ordinarily initiates investigation; <strong>it does not itself establish guilt, nor does it automatically require the arrest of every person named in it<\/strong>. The power to arrest and the necessity of arrest are distinct questions.<\/p>\n<p>Under the <strong>Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS)<\/strong>, particularly <strong>Section 35<\/strong>, the police possess significant powers of arrest without warrant. But those powers are accompanied by important conditions and safeguards. The Supreme Court has recently reiterated that, under Section 35(1), the power of arrest is <strong>discretionary and not an automatic consequence of registration of an FIR<\/strong>.<\/p>\n<p>The central principle may therefore be stated simply:<\/p>\n<p><strong>An FIR authorises investigation; it does not, by itself, mandate arrest.<\/strong><\/p>\n<h2 id=\"fir-and-arrest-are-two-different-stages\"><span class=\"ez-toc-section\" id=\"FIR_And_Arrest_Are_Two_Different_Stages\"><\/span>FIR And Arrest Are Two Different Stages<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The criminal process should be understood as a sequence:<\/p>\n<p><strong>Information of cognizable offence<\/strong><br \/>\n\u2193<br \/>\n<strong>Registration of FIR<\/strong><br \/>\n\u2193<br \/>\n<strong>Investigation<\/strong><br \/>\n\u2193<br \/>\n<strong>Collection of evidence<\/strong><br \/>\n\u2193<br \/>\n<strong>Assessment of necessity of arrest<\/strong><br \/>\n\u2193<br \/>\n<strong>Arrest, if legally justified<\/strong><br \/>\n\u2193<br \/>\n<strong>Production before Magistrate, where required<\/strong><\/p>\n<p>The registration of the FIR and the decision to arrest serve different purposes.<\/p>\n<p>The FIR answers:<\/p>\n<p><strong>What information has been received concerning the alleged offence?<\/strong><\/p>\n<p>Arrest answers:<\/p>\n<p><strong>Is taking this particular person into custody legally necessary?<\/strong><\/p>\n<p>Confusing these two questions creates the danger of arbitrary arrest.<\/p>\n<h2 id=\"section-35-bnss-the-central-provision\"><span class=\"ez-toc-section\" id=\"Section_35_BNSS_The_Central_Provision\"><\/span>Section 35 BNSS: The Central Provision<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Section 35 BNSS is the principal provision governing when police may arrest without a warrant.<\/p>\n<p>For offences punishable with imprisonment that may extend to <strong>seven years<\/strong>, arrest is subject to important conditions. The officer must have reason to believe, based on the complaint, information or suspicion, that the person committed the offence and must be satisfied that arrest is <strong>necessary<\/strong> for one or more statutory purposes.<\/p>\n<p>Those purposes include:<\/p>\n<ul>\n<li>preventing further offences;<\/li>\n<li>conducting proper investigation;<\/li>\n<li>preventing disappearance or tampering with evidence;<\/li>\n<li>preventing inducement, threat or promise to persons acquainted with the facts; or<\/li>\n<li>ensuring the person&#8217;s presence before the court when required.<\/li>\n<\/ul>\n<p>The officer must record the reasons for arrest in writing.<\/p>\n<p>Equally importantly, where arrest is <strong>not required<\/strong>, the officer must record reasons for not making the arrest.<\/p>\n<h2 id=\"may-arrest-does-not-mean-must-arrest\"><span class=\"ez-toc-section\" id=\"%E2%80%9CMay_Arrest%E2%80%9D_Does_Not_Mean_%E2%80%9CMust_Arrest%E2%80%9D\"><\/span>\u201cMay Arrest\u201d Does Not Mean \u201cMust Arrest\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The wording of Section 35 is significant.<\/p>\n<p>The statute says that the police officer <strong>\u201cmay\u201d<\/strong> arrest in the circumstances specified.<\/p>\n<p>The Supreme Court has recently emphasised that the use of the word <strong>\u201cmay\u201d<\/strong> indicates that the power of arrest is discretionary and optional; Society<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>They must effectively investigate offences, protect victims and witnesses, prevent further crime and bring offenders to justice.<\/p>\n<h3 id=\"protect-liberty\"><span class=\"ez-toc-section\" id=\"Protect_Liberty\"><\/span><strong>Protect Liberty<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>They must ensure that a person is not deprived of liberty unnecessarily or arbitrarily.<\/p>\n<p>These are not competing objectives.<\/p>\n<p>A professional criminal justice system must achieve both.<\/p>\n<h2 id=\"golden-rule\"><span class=\"ez-toc-section\" id=\"The_Golden_Rule\"><\/span>The Golden Rule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The entire subject can be reduced to one principle:<\/p>\n<p><strong>\u201cArrest because it is necessary\u2014not merely because it is possible.\u201d<\/strong><\/p>\n<p>The power to arrest is an important investigative tool, but it should not become a reflex following registration of an FIR.<\/p>\n<p>Equally, non-arrest should not become a device for shielding an accused.<\/p>\n<p>The decision must be:<\/p>\n<ul>\n<li>lawful;<\/li>\n<li>objective;<\/li>\n<li>individualised;<\/li>\n<li>supported by reasons;<\/li>\n<li>proportionate to the investigative need; and<\/li>\n<li>open to judicial scrutiny.<\/li>\n<\/ul>\n<h2 id=\"key-judicial-precedents\"><span class=\"ez-toc-section\" id=\"Key_Judicial_Precedents\"><\/span>Key Judicial Precedents<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The legal principle that an FIR does not automatically mandate arrest is firmly rooted in landmark Supreme Court jurisprudence that mirrors the safeguards under Section 35 of the BNSS (formerly Sections 41 and 41A of the CrPC).<\/p>\n<p>In <strong><em>Joginder Kumar v. State of U.P. (1994)<\/em><\/strong>, the Supreme Court established the foundational rule that the existence of the <em>power<\/em> to arrest is distinct from the legal <em>justification<\/em> for exercising it. This principle was operationalized in the landmark ruling of <strong><em>Arnesh Kumar v. State of Bihar (2014)<\/em><\/strong>, where the Court mandated a strict necessity checklist for offences punishable by up to seven years, holding that arrests must not be made in a routine or mechanical manner.<\/p>\n<p>Further reinforcing these protections, the Court held in <strong><em>Siddharth v. State of U.P. (2021)<\/em><\/strong> that an accused who has cooperated throughout an investigation should not be arrested merely because a charge sheet is being submitted, while <strong><em>Satender Kumar Antil v. CBI (2022)<\/em><\/strong> reiterated that arbitrary deprivation of liberty violates Article 21 and warned investigating agencies against treating arrest as a default procedure.<\/p>\n<h2 id=\"conclusion\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The registration of an FIR marks the <strong>beginning of criminal investigation, not the automatic beginning of incarceration<\/strong>.<\/p>\n<p>Section 35 BNSS carefully structures the police power of arrest. In cases falling within its necessity-based framework, the officer must consider whether arrest is required for preventing further offences, conducting proper investigation, protecting evidence, preventing witness influence, or ensuring the accused&#8217;s presence before the court.
