The better option depends on several factors, including the wording of the contract, the nature and value of the dispute, the urgency of the relief required, where the parties and assets are located, confidentiality concerns and the likely enforcement strategy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For companies and investors, therefore, the real question is not simply <strong>\u201carbitration or litigation?\u201d<\/strong> It is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Which dispute-resolution mechanism gives the business the strongest practical and enforceable solution?<\/strong><\/p>\n\n\n\n<h2 id=\"h-the-uae-s-changing-commercial-dispute-resolution-landscape\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_UAEs_Changing_Commercial_Dispute_Resolution_Landscape\"><\/span>The UAE&#8217;s Changing Commercial Dispute Resolution Landscape<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The UAE&#8217;s dispute-resolution framework has continued to develop significantly in recent years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Court proceedings are principally governed by <strong>Federal Decree-Law No. 42 of 2022 promulgating the Civil Procedure Code<\/strong>, while arbitration is governed by <strong>Federal Law No. 6 of 2018 on Arbitration<\/strong>. The UAE has also strengthened its mediation and conciliation framework through <strong>Federal Decree-Law No. 40 of 2023 on Mediation and Conciliation in Civil and Commercial Disputes<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There have also been important procedural developments. In December 2025, the UAE introduced amendments to the Civil Procedure Code, including measures relating to specialised courts and the use of local and international experts in civil and commercial proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another significant development came in 2026 with the UAE&#8217;s new Civil Transactions Law, which modernises important areas of contractual and civil law, including pre-contractual negotiations, framework agreements and contracts of works.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means businesses should avoid relying on outdated assumptions when choosing their dispute-resolution strategy.<\/p>\n\n\n\n<h2 id=\"h-what-does-court-litigation-mean-in-the-uae\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_Court_Litigation_Mean_in_the_UAE\"><\/span>What Does Court Litigation Mean in the UAE?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Court litigation involves submitting a commercial dispute to the competent UAE judicial authority for determination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the nature of the dispute and the relevant jurisdiction, the applicable procedural and substantive laws may include the Civil Procedure Code, the Commercial Transactions Law, the Civil Transactions Law, the Evidence Law and other legislation governing the particular commercial relationship.<\/p>\n\n\n\n<h3 id=\"h-typical-commercial-court-case-process\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Typical_Commercial_Court_Case_Process\"><\/span>Typical Commercial Court Case Process<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A typical commercial court case may involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>filing a claim;<\/li>\n\n\n\n<li>service of proceedings;<\/li>\n\n\n\n<li>written submissions and supporting documents;<\/li>\n\n\n\n<li>responses from the opposing party;<\/li>\n\n\n\n<li>appointment of experts where technical or financial issues arise;<\/li>\n\n\n\n<li>hearings and procedural orders;<\/li>\n\n\n\n<li>judgement; and<\/li>\n\n\n\n<li>available avenues of appeal.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Expert evidence can be particularly important in disputes involving construction, accounting, valuation, engineering, financial transactions or complex contractual performance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The UAE&#8217;s recent procedural reforms have also placed greater emphasis on judicial efficiency, specialisation and technical expertise. The 2025 amendments to the Civil Procedure Code specifically strengthened the framework concerning specialised courts and the engagement of local or international experts.<\/p>\n\n\n\n<h3 id=\"h-when-can-court-litigation-be-attractive\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_Can_Court_Litigation_Be_Attractive\"><\/span>When Can Court Litigation Be Attractive?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Court proceedings may be particularly suitable where:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There is no valid arbitration agreement;<\/li>\n\n\n\n<li>The dispute involves straightforward debt recovery;<\/li>\n\n\n\n<li>urgent judicial intervention is required;<\/li>\n\n\n\n<li>The dispute concerns matters that cannot legally be referred to arbitration;<\/li>\n\n\n\n<li>The relevant assets are located within the UAE;<\/li>\n\n\n\n<li>the claim is relatively straightforward and document-driven; or<\/li>\n\n\n\n<li>The parties need to rely extensively on the powers of the court.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Litigation also provides access to the formal judicial enforcement system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, businesses should not assume that filing a lawsuit automatically means a quick or inexpensive resolution.
