significant dispute within the Trinamool Congress (TMC), issuing notices to <strong>20 rebel TMC Members of Parliament<\/strong> after party general secretary and Lok Sabha MP <strong>Abhishek Banerjee<\/strong> approached the Court seeking an expeditious decision on their proposed disqualification.<\/p>\n\n<p>The case is important not merely because prominent names such as <strong>Yusuf Pathan, Sayani Ghosh, Rachana Banerjee and Sudip Bandyopadhyay<\/strong> are involved. At its heart lies a much larger constitutional question: <strong>how quickly should proceedings under the anti-defection law be decided, and what happens when a political party alleges that elected MPs have abandoned its political affiliation?<\/strong><\/p>\n\n<p>The matter was heard on August 25, 2026, by a Bench headed by Chief Justice of India <strong>Surya Kant<\/strong>, along with Justice Joymalya Bagchi and Justice V. Mohana. The proceedings arise from <strong>Abhishek Banerjee v. Hon&#8217;ble Speaker, Lok Sabha &amp; Ors., W.P.(C) No. 1033\/2026<\/strong>.<\/p>\n\n<p>Importantly, the Supreme Court has <strong>not disqualified these MPs<\/strong>. It has only issued notice to them and sought their response in the proceedings concerning the alleged delay in deciding the disqualification petitions pending before the Lok Sabha Speaker.<\/p>\n\n<p>That distinction is legally crucial.<\/p>\n\n<h2 id=\"what-supreme-court-has-done\"><span class=\"ez-toc-section\" id=\"What_Exactly_Has_the_Supreme_Court_Done\"><\/span>What Exactly Has the Supreme Court Done?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>The immediate development is straightforward but constitutionally significant.<\/p>\n\n<p>Abhishek Banerjee approached the Supreme Court under <strong>Article 32 of the Constitution<\/strong>, complaining that disqualification petitions against 20 rebel TMC MPs had not been decided expeditiously by the Lok Sabha Speaker.<\/p>\n\n<p>During the hearing, Solicitor General <strong>Tushar Mehta<\/strong>, appearing for the Speaker, informed the Court that notices had already been issued to the 20 MPs by the Speaker in the underlying disqualification proceedings.<\/p>\n\n<p>The Supreme Court nevertheless issued notices to the 20 MPs in Banerjee&#8217;s writ petition.<\/p>\n\n<p>The Court did <strong>not issue notice to Lok Sabha Speaker Om Birla<\/strong> at this stage. The Solicitor General stated that he would appear for the Speaker.<\/p>\n\n<p>Justice Joymalya Bagchi made an important observation: the real issue was not simply whether notices had been issued, but whether the proceedings could be <strong>concluded within a reasonable time frame<\/strong>.<\/p>\n\n<p>This observation goes to the heart of the controversy.<\/p>\n\n<p>A constitutional process cannot become meaningless merely because it has technically commenced. But legally, their celebrity status is irrelevant. The question before the constitutional machinery is the conduct attributed to them as elected Members of Parliament.<\/p>\n\n<h2 id=\"why-20-mps-received-notices\"><span class=\"ez-toc-section\" id=\"Why_Did_These_20_MPs_Receive_Notices\"><\/span>Why Did These 20 MPs Receive Notices?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>This is the most important question.<\/p>\n\n<p>The TMC&#8217;s case is that these MPs were elected to the Lok Sabha on the <strong>Trinamool Congress ticket<\/strong> but subsequently broke away from the party and aligned themselves with another political formation, identified in reports as the <strong>Nationalist Citizens Party of India (NCPI)<\/strong>.<\/p>\n\n<p>The rebel MPs have sought recognition as a separate parliamentary group.<\/p>\n\n<p>Reports indicate that the group sought recognition after breaking away from the TMC parliamentary party, and separate seating arrangements were also provided to them during the Monsoon Session.<\/p>\n\n<p>The TMC, however, argues that this conduct attracts the <strong>anti-defection provisions contained in the Tenth Schedule of the Constitution<\/strong>.<\/p>\n\n<p>Consequently, separate disqualification petitions were submitted before the Lok Sabha Speaker.<\/p>\n\n<p>The controversy then moved from the question of <strong>whether the MPs should be disqualified<\/strong> to the equally important question of <strong>when the Speaker should decide those petitions<\/strong>.<\/p>\n\n<p>That second question is what has brought the matter before the Supreme Court.<\/p>\n\n<h2 id=\"what-is-anti-defection-law\"><span class=\"ez-toc-section\" id=\"What_Is_the_Anti-Defection_Law\"><\/span>What Is the Anti-Defection Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>To understand the dispute, one must understand the purpose of the Tenth Schedule.<\/p>\n\n<p>India introduced the anti-defection law through the <strong>52nd Constitutional Amendment in 1985<\/strong>.<\/p>\n\n<p>The basic objective was simple: to prevent elected representatives from changing political allegiance after obtaining a mandate from voters under one political banner.<\/p>\n\n<p>Under the Tenth Schedule, a Member of Parliament may face disqualification in circumstances including:<\/p>\n\n<ul>\n    <li>voluntarily giving up membership of the political party;<\/li>\n    <li>voting or abstaining contrary to the party direction in circumstances covered by the Schedule; and<\/li>\n    <li>certain situations involving independent or nominated members.<\/li>\n<\/ul>\n\n<p>However, the law also contains an important <strong>merger exception<\/strong>.<\/p>\n\n<p>Therefore, the legal question is not simply:<\/p>\n\n<blockquote>\n    <p>&#8220;Did 20 MPs leave the TMC?&#8221;<\/p>\n<\/blockquote>\n\n<p>The more complicated constitutional question is:<\/p>\n\n<blockquote>\n    <p><strong>Did their conduct amount to voluntarily giving up membership of the TMC, and, if they claim a merger, does that merger satisfy the constitutional requirements of Paragraph 4 of the Tenth Schedule?<\/strong><\/p>\n<\/blockquote>\n\n<p>That distinction could become central to the proceedings.<\/p>\n\n<h2 id=\"two-thirds-issue\"><span class=\"ez-toc-section\" id=\"The_Two-Thirds_Issue_Is_a_Large_Group_Automatically_Protected\"><\/span>The Two-Thirds Issue: Is a Large Group Automatically Protected?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>This is where political arithmetic meets constitutional law.<\/p>\n\n<p>The rebel MPs have reportedly relied upon their numerical strength and sought recognition as a separate group.<\/p>\n\n<p>But the TMC&#8217;s position is that merely having a large number of MPs does not automatically protect them from disqualification.<\/p>\n\n<p>Paragraph 4 of the Tenth Schedule contains the constitutional framework relating to a <strong>merger<\/strong>.<\/p>\n\n<p>Broadly speaking, the merger exception involves the political party concerned and requires the constitutionally prescribed threshold of legislators.<\/p>\n\n<p>Therefore, the argument cannot be reduced simply to:<\/p>\n\n<blockquote>\n    <p><strong>&#8220;We are more than two-thirds, therefore there can be no disqualification.&#8221;<\/strong><\/p>\n<\/blockquote>\n\n<p>The precise legal circumstances of the alleged merger, the conduct of the MPs, the status of the original political party and the statutory requirements of the Tenth Schedule all become relevant.<\/p>\n\n<p>The TMC has specifically argued that the mere numerical strength of the rebel MPs does not by itself establish a valid constitutional merger.<\/p>\n\n<h2 id=\"why-abhishek-banerjee-approached-supreme-court\"><span class=\"ez-toc-section\" id=\"Why_Did_Abhishek_Banerjee_Approach_the_Supreme_Court\"><\/span>Why Did Abhishek Banerjee Approach the Supreme Court?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>The TMC had already approached the Lok Sabha Speaker seeking disqualification of the 20 MPs.<\/p>\n\n<p>The grievance was that the proceedings were not being decided quickly enough.<\/p>\n\n<p>That is why Abhishek Banerjee approached the Supreme Court.<\/p>\n\n<p>His petition is therefore not simply an attempt to obtain a declaration from the Supreme Court that the 20 MPs are already disqualified.<\/p>\n\n<p>Rather, the immediate grievance concerns the <strong>delay in deciding the pending disqualification proceedings<\/strong>.<\/p>\n\n<p>This is an important distinction because the constitutional scheme places the initial decision-making responsibility under the Tenth Schedule with the <strong>Speaker of the House<\/strong>.<\/p>\n\n<p>The Supreme Court is therefore dealing with the problem from the standpoint of constitutional judicial review and timely decision-making, rather than simply replacing the Speaker and itself deciding the political dispute.<\/p>\n\n<h2 id=\"why-speaker-was-not-issued-notice\"><span class=\"ez-toc-section\" id=\"Why_Was_the_Speaker_Not_Issued_Notice\"><\/span>Why Was the Speaker Not Issued Notice?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>This is another interesting feature of today&#8217;s hearing.<\/p>\n\n<p>The Speaker was named as a respondent in the petition. Nevertheless, the Court did not issue notice to him after Solicitor General Tushar Mehta stated that he would represent the Speaker and informed the Bench that notices had already been issued to the 20 MPs in the underlying proceedings.<\/p>\n\n<p>This should not be misunderstood as the Supreme Court giving the Speaker a clean chit.<\/p>\n\n<p>Nor does it mean that the Court has accepted the Speaker&#8217;s position on the merits.<\/p>\n\n<p>The Court appears to have been concerned primarily with ensuring that the constitutional proceedings move forward.<\/p>\n\n<p>Justice Bagchi&#8217;s observation is particularly significant: <strong>the concern is not merely issuing notices but concluding the proceedings within a time frame.<\/strong><\/p>\n\n<p>From a constitutional perspective, that is a very sensible distinction.<\/p>\n\n<h2 id=\"supreme-court-has-not-disqualified-mps\"><span class=\"ez-toc-section\" id=\"The_Supreme_Court_Has_Not_Disqualified_the_20_MPs\"><\/span>The Supreme Court Has Not Disqualified the 20 MPs<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>This point deserves emphasis because headlines can sometimes create confusion.<\/p>\n\n<p><strong>The Supreme Court has not held that Yusuf Pathan, Sayani Ghosh or the other 18 MPs stand disqualified.<\/strong><\/p>\n\n<p>The Court has issued notices in a writ petition challenging the alleged delay in the disqualification proceedings.<\/p>\n\n<p>The MPs will have an opportunity to respond.<\/p>\n\n<p>The final question of disqualification under the Tenth Schedule remains to be determined through the constitutionally prescribed process.<\/p>\n\n<p>Therefore, at this stage:<\/p>\n\n<blockquote>\n    <p><strong>Notice \u2260 Disqualification.<\/strong><\/p>\n<\/blockquote>\n\n<p>A notice means that the concerned parties have been called upon to respond to the allegations or legal issues raised before the Court.<\/p>\n\n<h2 id=\"what-tenth-schedule-protects\"><span class=\"ez-toc-section\" id=\"What_Does_the_Tenth_Schedule_Actually_Try_to_Protect\"><\/span>What Does the Tenth Schedule Actually Try to Protect?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>In my view, after more than two decades of practice before the Supreme Court, the larger constitutional principle deserves attention.<\/p>\n\n<p>The anti-defection law was never designed merely to punish an individual politician.<\/p>\n\n<p>It was designed to protect the <strong>integrity of the electoral mandate<\/strong>.<\/p>\n\n<p>When a voter chooses a representative belonging to a particular political party, the voter is generally making a political choice involving both the individual candidate and the party&#8217;s programme, leadership and political identity.<\/p>\n\n<p>If an elected representative subsequently abandons that political platform and changes allegiance, the question naturally arises:<\/p>\n\n<blockquote>\n    <p><strong>Can a representative retain the benefit of the original electoral mandate while abandoning the political identity under which that mandate was obtained?<\/strong><\/p>\n<\/blockquote>\n\n<p>That is precisely why the anti-defection law exists.<\/p>\n\n<p>At the same time, democracy cannot mean that every disagreement within a political party automatically becomes defection.<\/p>\n\n<p>There must remain room for legitimate political dissent.<\/p>\n\n<p>The constitutional challenge, therefore, is to strike a balance between:<\/p>\n\n<p><strong>party discipline on one side and democratic independence on the other.<\/strong><\/p>\n\n<h2 id=\"why-timing-matters-in-defection-cases\"><span class=\"ez-toc-section\" id=\"Why_Timing_Matters_So_Much_in_Defection_Cases\"><\/span>Why Timing Matters So Much in Defection Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>The present controversy raises a problem that has troubled Indian constitutional law for years.<\/p>\n\n<p>Suppose an MP faces a disqualification petition.<\/p>\n\n<p>If the proceedings are decided promptly, the constitutional consequences are clear.<\/p>\n\n<p>But suppose the proceedings remain pending for a very long time.<\/p>\n\n<p>During that period, the MP may:<\/p>\n\n<ul>\n    <li>continue participating in Parliament;<\/li>\n    <li>vote on legislation;<\/li>\n    <li>participate in political negotiations;<\/li>\n    <li>occupy parliamentary positions;<\/li>\n    <li>influence government formation or legislative arithmetic; and<\/li>\n    <li>potentially complete a substantial portion of the parliamentary term.<\/li>\n<\/ul>\n\n<p>In such a situation, <strong>delay itself can have political consequences<\/strong>.<\/p>\n\n<p>This is why the Supreme Court&#8217;s emphasis on completing proceedings within a time frame is particularly important.<\/p>\n\n<p>The effectiveness of the anti-defection law cannot depend entirely upon how long a disqualification petition remains pending.<\/p>\n\n<h2 id=\"can-supreme-court-direct-speaker\"><span class=\"ez-toc-section\" id=\"But_Can_the_Supreme_Court_Direct_the_Speaker\"><\/span>But Can the Supreme Court Direct the Speaker?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>This is where constitutional caution becomes essential.<\/p>\n\n<p>The Speaker occupies a constitutionally recognised position under the parliamentary system.<\/p>\n\n<p>The Supreme Court cannot casually assume the Speaker&#8217;s constitutional function.<\/p>\n\n<p>At the same time, constitutional authorities are not beyond judicial review.<\/p>\n\n<p>The Court has repeatedly had to balance two principles:<\/p>\n\n<p><strong>institutional autonomy<\/strong> and <strong>constitutional accountability<\/strong>.<\/p>\n\n<p>The present hearing appears to reflect that balance.<\/p>\n\n<p>The Court has not simply declared:<\/p>\n\n<blockquote>\n    <p>&#8220;The MPs are disqualified.&#8221;<\/p>\n<\/blockquote>\n\n<p>Instead, it has entered the controversy concerning delay and sought responses while taking note of the Speaker&#8217;s position.<\/p>\n\n<p>That approach respects the constitutional structure while keeping the judicial door open against unreasonable inaction.<\/p>\n\n<h2 id=\"who-owns-electoral-mandate\"><span class=\"ez-toc-section\" id=\"A_Larger_Constitutional_Question_Who_Owns_the_Mandate\"><\/span>A Larger Constitutional Question: Who Owns the Mandate?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>There is also a deeper democratic issue beneath this case.<\/p>\n\n<p>When voters elect a candidate under a political party&#8217;s symbol, who ultimately owns the political mandate?<\/p>\n\n<p>Is it entirely the candidate?<\/p>\n\n<p>Is it the political party?<\/p>\n\n<p>Or is the mandate primarily that of the voters?<\/p>\n\n<p>The anti-defection law effectively recognises that modern parliamentary democracy involves a relationship among all three.<\/p>\n\n<p>The voter chooses the representative, but political parties provide the ideological and organisational framework through which parliamentary elections are contested.<\/p>\n\n<p>That is why changing political allegiance after election can create a serious democratic problem.<\/p>\n\n<p>However, the same principle must not be stretched so far that elected representatives become mere voting machines controlled by party leadership.<\/p>\n\n<p>A healthy democracy therefore needs both:<\/p>\n\n<p><strong>electoral accountability and reasonable political freedom.<\/strong><\/p>\n\n<h2 id=\"yusuf-pathan-sayani-ghosh-factor\"><span class=\"ez-toc-section\" id=\"The_Yusuf_Pathan_and_Sayani_Ghosh_Factor\"><\/span>The Yusuf Pathan and Sayani Ghosh Factor<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>The public attention surrounding this case has understandably focused on familiar names.<\/p>\n\n<p>Yusuf Pathan entered politics after a celebrated cricket career.<\/p>\n\n<p>Sayani Ghosh and Rachana Banerjee are prominent figures from Bengal&#8217;s entertainment industry who entered electoral politics.<\/p>\n\n<p>But constitutional law does not distinguish between a former international cricketer, an actor, a veteran politician or a first-time MP.<\/p>\n\n<p>Once elected, each becomes a Member of Parliament and is subject to the same constitutional framework.<\/p>\n\n<p>The Supreme Court&#8217;s notice therefore has nothing to do with celebrity status.<\/p>\n\n<p>The legal question is identical for all 20:<\/p>\n\n<blockquote>\n    <p><strong>What exactly did each MP do after being elected, what was the nature of the alleged political departure, and does that conduct attract the Tenth Schedule?<\/strong><\/p>\n<\/blockquote>\n\n<h2 id=\"what-happens-next\"><span class=\"ez-toc-section\" id=\"What_Happens_Next\"><\/span>What Happens Next?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>The 20 MPs will now have an opportunity to respond to the Supreme Court proceedings.<\/p>\n\n<p>Meanwhile, the underlying disqualification proceedings before the Lok Sabha Speaker remain crucial.<\/p>\n\n<p>The Supreme Court&#8217;s intervention could potentially bring greater urgency to those proceedings.<\/p>\n\n<p>The matter has been listed for further hearing on <strong>August 26, 2026<\/strong>, according to reports on today&#8217;s proceedings.<\/p>\n\n<p>The eventual constitutional outcome may depend upon several questions:<\/p>\n\n<ol>\n    <li>Whether the MPs actually voluntarily gave up TMC membership.<\/li>\n    <li>Whether their alignment with another political formation constitutes defection.<\/li>\n    <li>Whether the alleged merger satisfies Paragraph 4 of the Tenth Schedule.<\/li>\n    <li>Whether the numerical strength of the rebel group has constitutional significance in the particular circumstances.<\/li>\n    <li>Whether the Speaker has acted within a reasonable period.<\/li>\n    <li>What judicial remedy is appropriate if the proceedings are unduly delayed.<\/li>\n<\/ol>\n\n<h2 id=\"legal-view-on-tmc-mp-disqualification\"><span class=\"ez-toc-section\" id=\"My_Legal_View\"><\/span>My Legal View<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>In my considered view, the most important aspect of this case is <strong>not the political fight between the TMC leadership and the rebel MPs<\/strong>.<\/p>\n\n<p>The real constitutional issue is much bigger.<\/p>\n\n<p>India&#8217;s anti-defection law can work only when there is a credible mechanism for deciding disqualification questions <strong>fairly, independently and within a meaningful period<\/strong>.<\/p>\n\n<p>A delayed decision can sometimes be almost as consequential as a wrong decision.<\/p>\n\n<p>If an MP is ultimately found to have attracted disqualification, allowing the proceedings to remain pending for months or years may permit the alleged defection to achieve its political objective before the law can respond.<\/p>\n\n<p>But the opposite danger is equally serious.<\/p>\n\n<p>A politically motivated disqualification petition cannot become a weapon for silencing legitimate dissent within a political party.<\/p>\n\n<p>The constitutional system therefore requires <strong>both speed and fairness<\/strong>.<\/p>\n\n<p>The Speaker must have adequate opportunity to examine the facts and hear the concerned MPs. But the process cannot be allowed to become an indefinite waiting room.<\/p>\n\n<p>That is why Justice Bagchi&#8217;s observation that the issue is about <strong>concluding the proceedings within a time frame<\/strong>, rather than merely issuing notices, deserves serious attention.<\/p>\n\n<h2 id=\"conclusion-anti-defection-framework\"><span class=\"ez-toc-section\" id=\"Conclusion_A_Test_for_Indias_Anti-Defection_Framework\"><\/span>Conclusion: A Test for India&#8217;s Anti-Defection Framework<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<p>The <strong>Supreme Court notice to 20 rebel TMC MPs<\/strong> is therefore much more than another political controversy.<\/p>\n\n<p>It brings into focus one of the recurring constitutional tensions in Indian parliamentary democracy:<\/p>\n\n<blockquote>\n    <p><strong>How do we prevent opportunistic defection without destroying legitimate political dissent?<\/strong><\/p>\n<\/blockquote>\n\n<p>The answer lies neither in giving political parties unlimited power nor in permitting elected representatives to change political allegiance without constitutional consequences.<\/p>\n\n<p>The answer lies in faithfully applying the <strong>Tenth Schedule<\/strong>, respecting the constitutional role of the Speaker, protecting the rights of the concerned MPs to be heard, and ensuring that disqualification proceedings are decided within a reasonable period.<\/p>\n\n<p>For Yusuf Pathan, Sayani Ghosh and the other 18 MPs, today&#8217;s notice is <strong>not a declaration of guilt or disqualification<\/strong>.<\/p>\n\n<p>It is the beginning\u2014or continuation\u2014of a constitutional process in which their position will have to be examined.<\/p>\n\n<p>But for Indian parliamentary democracy, the case raises a question far larger than the fate of 20 MPs:<\/p>\n\n<blockquote>\n    <p><strong>Can the anti-defection law remain effective if the decision-making process itself is allowed to move too slowly?<\/strong><\/p>\n<\/blockquote>\n\n<p>That is ultimately the constitutional question that the Supreme Court&#8217;s intervention has brought into sharp focus.<\/p>\n\n<h2 id=\"case-citation\"><span class=\"ez-toc-section\" id=\"Case_Citation\"><\/span>Case Citation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n<table>\n    <tbody>\n        <tr>\n            <th>Case<\/th>\n            <td><strong>Abhishek Banerjee v.
