Core Evidentiary Principles<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-3-1-fir-is-not-substantive-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"31_FIR_Is_Not_Substantive_Evidence\"><\/span>3.1 FIR Is Not Substantive Evidence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An FIR is merely the earliest information relating to a cognizable offence. It is not substantive evidence of the crime. Its primary legal purposes are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To set the criminal law in motion<\/li>\n\n\n\n<li>To capture the earliest unembellished version of the occurrence<\/li>\n\n\n\n<li>To enable prompt preservation of evidence<\/li>\n\n\n\n<li>To serve as a safeguard against subsequent fabrication, tutoring or afterthought<\/li>\n\n\n\n<li>To assist the court in testing the credibility of the informant<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-3-2-corroboration-and-contradiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"32_Corroboration_and_Contradiction\"><\/span>3.2 Corroboration and Contradiction<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">When the informant appears as a witness:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Corroboration<\/strong> \u2014 Under Section 160 BSA, the FIR may be used to corroborate the informant\u2019s testimony if it relates to the same fact and was made at or about the time of the occurrence (or before a competent authority).<\/li>\n\n\n\n<li><strong>Contradiction<\/strong> \u2014 Under Section 148 BSA, material contradictions or omissions in the FIR may be used to impeach the informant\u2019s credibility, provided the witness is properly confronted with the relevant portions during cross-examination.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-3-3-special-situations\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"33_Special_Situations\"><\/span>3.3 Special Situations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Third-party witnesses:<\/strong> An FIR can be used only to corroborate or contradict its maker. It has no evidentiary value against or in favour of other witnesses.<\/li>\n\n\n\n<li><strong>Death of the informant:<\/strong> The FIR loses its ordinary corroborative value. It becomes relevant only if it satisfies the requirements of a dying declaration under Section 26(a) BSA.<\/li>\n\n\n\n<li><strong>Accused as informant:<\/strong> Confessional portions of the FIR are inadmissible under Section 23 BSA. However, that portion of the information which distinctly relates to a fact discovered in consequence thereof is admissible (proviso to Section 23 BSA).<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-statutory-registration-under-section-173-bnss\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Statutory_Registration_Under_Section_173_BNSS\"><\/span>Statutory Registration Under Section 173 BNSS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 id=\"h-zero-fir\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Zero-FIR\"><\/span>Zero-FIR<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Information regarding a cognizable offence may be given to any police station, irrespective of territorial jurisdiction.<\/p>\n\n\n\n<h3 id=\"h-electronic-fir-e-fir\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Electronic_FIR_e-FIR\"><\/span>Electronic FIR (e-FIR)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Information may be given by electronic communication. It shall be taken on record only after it is signed by the informant within three days.<\/p>\n\n\n\n<h3 id=\"h-preliminary-enquiry\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Preliminary_Enquiry\"><\/span>Preliminary Enquiry<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 173(3), in cases of cognizable offences punishable with imprisonment of three years or more but less than seven years, the officer-in-charge may, with the prior permission of an officer not below the rank of Deputy Superintendent of Police, conduct a preliminary enquiry within fourteen days to ascertain whether a prima facie case exists (statutory recognition of the principle in Lalita Kumari v. State of U.P.).<\/p>\n\n\n\n<h2 id=\"h-practical-evidentiary-matrix\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Practical_Evidentiary_Matrix\"><\/span>Practical Evidentiary Matrix<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Scenario \/ Situation<\/th><th>Evidentiary Status &amp; Legal Significance<\/th><th>Governing Provision<\/th><\/tr><\/thead><tbody><tr><td><strong>Informant testifies at trial<\/strong><\/td><td>FIR (as a previous statement in writing) may be used to contradict the informant under proper confrontation procedure, or to corroborate the informant\u2019s oral testimony if it relates to the same fact and was made at or about the time of the occurrence (or before a competent authority).<\/td><td>Sections 148 &amp; 160 BSA<\/td><\/tr><tr><td><strong>Informant dies before trial<\/strong><\/td><td>The FIR itself is not automatically admissible as substantive evidence merely because the informant is dead. It can be relevant only if it qualifies as a dying declaration (i.e., the statement relates to the cause of the informant\u2019s death or the circumstances of the transaction resulting in death, and the cause of death is in question).<\/td><td>Section 26(a) BSA<\/td><\/tr><tr><td><strong>FIR contains material omissions<\/strong><\/td><td>Material omissions or contradictions in the FIR may be used to impeach the credibility of the informant, provided the informant is properly confronted with the relevant portions during cross-examination.<\/td><td>Section 148 BSA<\/td><\/tr><tr><td><strong>Accused previously lodged FIR<\/strong><\/td><td>Any confessional portion of the FIR lodged by the accused is inadmissible against him. However, the portion of the information that distinctly relates to a fact discovered in consequence of that information is admissible. Non-confessional portions may also be relevant as admissions in appropriate cases.<\/td><td>Section 23 BSA (including proviso)<\/td><\/tr><tr><td><strong>Delayed dispatch to Magistrate<\/strong><\/td><td>The officer-in-charge must forthwith send a report of the information to the Magistrate. Unexplained delay in dispatching the FIR\/report to the Magistrate can undermine the credibility of the prosecution case and raise a suspicion of post-facto fabrication or embellishment (though delay is not automatically fatal if satisfactorily explained).<\/td><td>Section 176 BNSS<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The FIR remains the critical starting point of every criminal investigation. While the BNS classifies the substantive offence and the BNSS regulates the police duties of registration and investigation, the BSA strictly limits the evidentiary use of the FIR to corroboration, contradiction, dying declarations, and limited discovery statements.
