Where a creditor or investigating authority has a legitimate concern that a person may leave the country before a claim or proceeding is resolved, the law provides mechanisms to prevent that departure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, a travel ban is not intended to be an automatic consequence of every unpaid debt or complaint. The source and status of any restriction should be verified with the appropriate authority.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-travel-ban-in-the-uae\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Travel_Ban_in_the_UAE\"><\/span>What Is a Travel Ban in the UAE?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A UAE travel ban is a legal restriction that prevents an individual from leaving the country through its ports and borders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending on the circumstances, the restriction may be ordered by or arise through:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A civil or commercial court;<\/li>\n\n\n\n<li>An execution judge;<\/li>\n\n\n\n<li>Public Prosecution;<\/li>\n\n\n\n<li>A criminal court;<\/li>\n\n\n\n<li>A personal-status or family court; or<\/li>\n\n\n\n<li>Other competent governmental authorities in circumstances permitted by law.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The legal basis is important because the procedure for challenging a civil travel ban is different from the procedure for dealing with a criminal travel ban.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, a restriction concerning a child travelling outside the UAE is not necessarily the same as a financial travel ban imposed on an adult debtor.<\/p>\n\n\n\n<h2 id=\"h-why-can-a-person-be-placed-under-a-travel-ban-in-the-uae\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_Can_a_Person_Be_Placed_Under_a_Travel_Ban_in_the_UAE\"><\/span>Why Can a Person Be Placed Under a Travel Ban in the UAE?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A travel restriction can arise for different reasons, including:<\/p>\n\n\n\n<h3 id=\"h-1-unpaid-civil-or-commercial-debts\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Unpaid_Civil_or_Commercial_Debts\"><\/span>1. Criminal Complaints or Investigations<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The public prosecution may impose a travel ban where the circumstances of a criminal case justify preventing the accused from leaving the UAE.<\/p>\n\n\n\n<h3 id=\"h-4-dishonoured-cheques\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Dishonoured_Cheques\"><\/span>4. Dishonoured Cheques<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Under the modern UAE commercial-law framework, certain dishonoured cheques can operate as enforceable instruments, allowing the beneficiary to proceed directly with execution rather than relying solely on a traditional criminal complaint. The resulting execution proceedings can, where the legal conditions are met, lead to applications for a travel ban.<\/p>\n\n\n\n<h3 id=\"h-5-family-and-child-custody-disputes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Family_and_Child-Custody_Disputes\"><\/span>5. In particular, Article 324 requires serious reasons giving rise to a fear that the debtor may flee, together with the applicable requirements concerning the debt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the question is not merely:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;Do I owe money?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more important questions are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Has a legal claim been filed?<\/li>\n\n\n\n<li>Is there an execution file?<\/li>\n\n\n\n<li>Has a travel-ban order actually been issued?<\/li>\n\n\n\n<li>Which authority issued it?<\/li>\n\n\n\n<li>What is the amount and legal nature of the debt?<\/li>\n\n\n\n<li>Is the order still legally valid?<\/li>\n\n\n\n<li>Has the underlying obligation been settled or otherwise secured?<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-travel-bans-and-company-directors-an-important-2026-development\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Travel_Bans_and_Company_Directors_An_Important_2026_Development\"><\/span>Travel Bans and Company Directors: An Important 2026 Development<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Company owners, directors and managers should pay particular attention to Article 322.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Civil Procedure Code permits certain enforcement measures against the legal representative of a private legal entity where the failure to comply with an execution obligation is personally attributable to that individual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, this does not mean that every company debt automatically becomes a personal debt of the director.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A particularly important development occurred in June 2026, when the Abu Dhabi Court of Cassation&#8217;s General Assembly addressed conflicting approaches concerning Article 322. The decision clarified the circumstances in which a company&#8217;s legal representative or another person may face personal enforcement measures, including a travel ban. The decision is particularly significant for onshore Abu Dhabi courts, although it does not govern the separate ADGM jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This development reinforces an important practical principle:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Corporate liability and personal liability should not be casually treated as the same thing.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before accepting or challenging a travel ban against a director, the precise basis on which personal responsibility is alleged should be examined.<\/p>\n\n\n\n<h2 id=\"h-travel-bans-in-criminal-cases\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Travel_Bans_in_Criminal_Cases\"><\/span>Travel Bans in Criminal Cases<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Civil travel bans and criminal travel bans operate under different legal frameworks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Article 99 of Federal Decree-Law No. 38 of 2022 on the Criminal Procedure Law, the Public Prosecutor may, depending on the circumstances, order that an accused person be prohibited from travelling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The order is circulated to the ports of the UAE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A criminal travel ban may arise during investigations involving allegations such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Fraud;<\/li>\n\n\n\n<li>Breach of trust;<\/li>\n\n\n\n<li>Forgery;<\/li>\n\n\n\n<li>Certain financial offences;<\/li>\n\n\n\n<li>Drug-related offences;<\/li>\n\n\n\n<li>Serious traffic-related offences; or<\/li>\n\n\n\n<li>Other criminal allegations where the competent authority considers the person&#8217;s presence necessary.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The actual legal position depends on the facts and procedural stage of the individual case.<\/p>\n\n\n\n<h3 id=\"h-a-criminal-travel-ban-is-not-the-same-as-arrest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Criminal_Travel_Ban_Is_Not_the_Same_as_Arrest\"><\/span>A Criminal Travel Ban Is Not the Same as Arrest<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A common misconception is that a person cannot have a travel ban unless they have been arrested.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>That is incorrect.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A travel ban is a separate procedural measure. Article 99 expressly allows the Public Prosecutor to order a travel ban against an accused person.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, an individual may be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>not physically detained;<\/li>\n\n\n\n<li>released during an investigation; or<\/li>\n\n\n\n<li>released on bail or another form of guarantee,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">and still have a travel restriction that needs to be separately addressed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, obtaining release from detention does not necessarily mean that every travel restriction has automatically disappeared.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The status of the travel ban must therefore be checked separately.<\/p>\n\n\n\n<h3 id=\"h-what-happens-when-a-criminal-case-reaches-the-enforcement-stage\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Happens_When_a_Criminal_Case_Reaches_the_Enforcement_Stage\"><\/span>What Happens When a Criminal Case Reaches the Enforcement Stage?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Travel restrictions can also become relevant after a criminal judgement, particularly where the judgement contains financial obligations such as fines, compensation or restitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise enforcement consequences depend on the judgement, the procedural stage and the decisions of the competent authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For that reason, someone who has already received a criminal judgement should not assume that completing one part of the case automatically removes every restriction connected with the proceedings.<\/p>\n\n\n\n<h2 id=\"h-child-travel-restrictions-under-the-uae-personal-status-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Child_Travel_Restrictions_Under_the_UAE_Personal_Status_Law\"><\/span>Child Travel Restrictions Under the UAE Personal Status Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Family disputes require a different approach because the central concern is often the best interests and safe return of the child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current federal personal status framework is contained in Federal Decree-Law No. 41 of 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 116 addresses travel outside the UAE by a child in custody. It provides mechanisms for travel with the relevant consent and allows the court, in appropriate circumstances, to authorise travel subject to safeguards guaranteeing the child&#8217;s return. The law also allows the court to exceed the ordinary 60-day annual limit where travel is justified by the child&#8217;s interests, medical treatment or a necessity recognised by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This means that a dispute between parents does not necessarily result in a permanent prohibition on the child&#8217;s international travel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court can examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the child&#8217;s welfare;<\/li>\n\n\n\n<li>the purpose of travel;<\/li>\n\n\n\n<li>the proposed duration;<\/li>\n\n\n\n<li>the likelihood of return;<\/li>\n\n\n\n<li>the objections raised by the other parent or guardian; and<\/li>\n\n\n\n<li>any guarantees that may adequately protect the child&#8217;s interests.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-child-passport-and-travel-documents\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Child_Passport_and_Travel_Documents\"><\/span>Child Passport and Travel Documents<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 117 of the 2024 Personal Status Law deals specifically with the passport of a child in custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The guardian may generally retain the child&#8217;s passport, but it must be handed over where travel has been authorised.
