As a result, the police are neither able to proceed with the investigation nor formally close the case, leaving the matters in prolonged limbo.<\/p>\n\n\n\n<h2 id=\"h-statutory-and-constitutional-framework\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Statutory_and_Constitutional_Framework\"><\/span>Statutory and Constitutional Framework<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">High Court intervention balances the police\u2019s statutory duty to investigate cognisable offences under Section 173 BNSS with the fundamental right to personal liberty under Article 21.<\/p>\n\n\n\n<h3 id=\"h-2-1-high-court-jurisdiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"21_High_Court_Jurisdiction\"><\/span>2.1. The Only Route to Permanent Protection: Quashing of FIR<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The sole method by which a court order can permanently terminate investigation or arrest in respect of a particular incident is the formal quashing of the FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once an FIR is quashed under Section 528 BNSS, the legal foundation for investigation disappears. The power is exercised only within the strict parameters laid down in State of Haryana v. Bhajan Lal (1992):<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Allegations, even if taken at face value, do not disclose a cognisable offence;<\/li>\n\n\n\n<li>The proceedings are manifestly attended with mala fides or instituted with an ulterior motive;<\/li>\n\n\n\n<li>There exists an absolute legal bar to the institution or continuation of the proceedings.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-2-3-prohibition-on-blanket-orders-the-neeharika-principle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"23_Prohibition_on_Blanket_Orders_The_Neeharika_Principle\"><\/span>2.3. Key Precedents<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>M\/s Neeharika Infrastructure Pvt. Ltd. v. State of Maharashtra (2021):<\/strong> High Courts must not pass general or blanket orders staying investigation or directing that \u201cno coercive steps\u201d be taken while a quashing petition is pending. Such orders paralyse the statutory duty of the police to investigate cognisable offences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Sushila Aggarwal v. State (NCT of Delhi) (2020):<\/strong> Anticipatory bail under Section 482 BNSS (formerly Section 438 CrPC) may continue till the conclusion of trial, but it remains conditional liberty. It is always subject to modification, compliance with investigative processes, and cancellation upon breach of conditions.<\/p>\n\n\n\n<h2 id=\"h-nature-of-extraordinary-protective-orders\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Nature_of_Extraordinary_Protective_Orders\"><\/span>Nature of Extraordinary Protective Orders<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Orders that require prior judicial permission before registration of any future FIR are extraordinary interim measures designed to prevent immediate and apparent abuse of process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They cannot be converted into indefinite or permanent shields against the operation of criminal law. That role, however, is strictly limited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Except by quashing an existing FIR within the narrow Bhajan Lal parameters, a High Court cannot issue blanket or permanent orders restraining arrests or future FIR registrations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Interim protective measures may be granted to check executive excess, but they must remain temporary, proportionate, and ultimately subject to final adjudication.
