Build an evidential bridge from Indian election law to international democratic-rights standards.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The International Court of Justice, or ICJ, is not an international Supreme Court of India. Article 34 of the Statute of the ICJ expressly provides that only states may be parties in cases before the Court. Its contentious jurisdiction depends upon the consent of states. Therefore, an individual political leader cannot file an appeal before the ICJ simply because she believes that the Supreme Court of India has wrongly decided an election dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The International Criminal Court is also not the appropriate appellate forum for an ordinary election dispute. An actual election challenge therefore has to be developed through the appropriate domestic proceedings, including compliance with statutory limitation and pleading requirements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is particularly important because the current West Bengal controversy is not merely theoretical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A 2026 election petition concerning Bhabanipur has raised allegations including voter deletion, alleged irregularities in counting and other electoral issues. The Calcutta High Court has, at the interim stage, directed preservation of CCTV footage, EVMs, control units, ballot units and VVPAT machines pending adjudication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is precisely the kind of development that demonstrates why <strong>evidence preservation must come before international advocacy<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The international case should be built from the underlying evidence\u2014not from political speeches or newspaper headlines.<\/p>\n\n\n\n<h2 id=\"h-3-the-most-important-immediate-step-create-an-electoral-evidence-dossier\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_The_Most_Important_Immediate_Step_Create_an_Electoral_Evidence_Dossier\"><\/span>3. Create A Chain Of Custody For Every Important Piece Of Evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">International credibility will depend heavily upon evidence integrity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose there is CCTV footage showing an alleged counting irregularity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should not simply be presented as:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cHere is a video proving manipulation.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the dossier should establish:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Original source \u2192 acquisition date \u2192 original file \u2192 metadata \u2192 cryptographic hash \u2192 custodian \u2192 forensic examination \u2192 independent verification \u2192 witness evidence \u2192 relevant official record \u2192 legal significance.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The same principle should apply to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>videos;<\/li>\n\n\n\n<li>photographs;<\/li>\n\n\n\n<li>electronic documents;<\/li>\n\n\n\n<li>spreadsheets;<\/li>\n\n\n\n<li>electoral-roll databases;<\/li>\n\n\n\n<li>correspondence;<\/li>\n\n\n\n<li>digital communications.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most important practical improvements I would make to the conventional political approach.<\/p>\n\n\n\n<h2 id=\"h-6-separate-evidence-from-allegation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Separate_Evidence_From_Allegation\"><\/span>6. Use the International Covenant on Civil and Political Rights.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most relevant international legal framework is the <strong>International Covenant on Civil and Political Rights, or ICCPR<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 25 protects participation in public affairs, voting and being elected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The UN Human Rights Committee has explained that genuine elections must be conducted fairly and freely and that political participation must be meaningful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provides a potentially important international legal framework for an electoral-integrity case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important limitation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India is a party to the ICCPR, but India has <strong>not accepted the First Optional Protocol<\/strong>, which provides the individual-communications mechanism through which individuals can bring complaints before the UN Human Rights Committee. Therefore, I would not advise filing an individual Article 25 complaint against India before that Committee as though it were an international appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is precisely why careful jurisdictional analysis is essential.<\/p>\n\n\n\n<h2 id=\"h-8-the-more-practical-international-route-un-special-procedures\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_The_More_Practical_International_Route_UN_Special_Procedures\"><\/span>8. The More Practical International Route: UN Special Procedures<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is, however, another international mechanism that deserves serious consideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The United Nations Human Rights Council has established <strong>Special Procedures<\/strong>, consisting of independent experts with thematic or country-specific mandates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Individuals, groups and civil-society organisations can submit information to Special Procedures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">OHCHR explains that Special Procedures may communicate directly with governments concerning alleged human rights violations within their mandates. What Should The International Submission Say?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where I would make a major strategic change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do <strong>not<\/strong> write:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe Indian Supreme Court has wrongly decided the case. Please overturn the judgement.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the submission should say, in substance:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cFollowing the completion or progression of domestic proceedings, substantial documentary, statistical and forensic evidence remains concerning specific alleged interference with electoral participation and political rights. We request examination of these allegations under applicable international human rights standards.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That formulation respects the limits of international jurisdiction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It also avoids presenting the UN as a fourth level of appeal.<\/p>\n\n\n\n<h2 id=\"h-10-build-an-article-25-evidence-matrix\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"10_Build_an_Article_25_Evidence_Matrix\"><\/span>10.
