Under the Bharatiya Nyaya Sanhita, 2023 (BNS), read with the First Schedule to the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), offenses are defined as cognizable\/non-cognizable and bailable\/non-bailable. Police officers have no authority to alter these classifications.
