with dignity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This article traces that journey, situates Article 21 within India&#8217;s constitutional history, and reflects on how the judiciary transformed a bare procedural guarantee into the bedrock of a dignified life for every person within Indian territory, citizen and non-citizen alike.<\/p>\n\n\n\n<h2 id=\"h-textual-foundation-and-early-restrictive-interpretation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Textual_Foundation_and_Early_Restrictive_Interpretation\"><\/span>Textual Foundation and Early Restrictive Interpretation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The framers of the Constitution deliberately chose the phrase <em>&#8216;procedure established by law&#8217;<\/em> over the American formulation of <em>&#8216;due process of law&#8217;<\/em>, wary of vesting excessive interpretive power in the judiciary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This choice was tested almost immediately in <em>A.K. Gopalan v. State of <\/em>Madras [ii], where the Supreme Court adopted a liberal approach to interpretation and a compartmentalised reading of the fundamental rights chapter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that Article 21 merely required that any procedure enacted by the legislature, however unfair, be followed. The substantive fairness of that procedure was not open to judicial scrutiny, and Articles 19, 21 and 22 were treated as mutually exclusive ones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For nearly three decades, this narrow view left personal liberty vulnerable to legislative and executive overreach, so long as some semblance of procedure existed on paper.<\/p>\n\n\n\n<h3 id=\"h-a-k-gopalan-and-the-narrow-reading-of-article-21\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"AK_Gopalan_And_The_Narrow_Reading_Of_Article_21\"><\/span>A.K. Union Territory of <\/em>Delhi [iv] declared that the right to life is not confined to mere animal existence; it includes <em>&#8216;the right to live with human dignity&#8217;<\/em>, encompassing adequate nutrition, clothing, shelter, and facilities for reading, writing, and freely expressing oneself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, in <em>Bandhua Mukti Morcha v. Puttaswamy v.
