The candidate matters. The manifesto matters. The political ideology matters. But ultimately, it is the voter who casts the decisive vote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That leads me to a simple question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>If the voter gives the mandate, why should the law primarily protect the relationship between the political party and the elected representative while giving comparatively less direct protection to the mandate given by the voter?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the question that, in my view, India must confront while reconsidering the anti-defection law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Tenth Schedule was introduced in 1985 to deal with the serious problem of political defections. Its purpose was entirely legitimate. Legislators changing political allegiance after being elected had become a serious threat to political stability and democratic government. The Supreme Court has itself recognised that the Tenth Schedule was intended to curb the practice of legislators changing allegiance after being elected on the ticket of a political party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But more than four decades after the introduction of the anti-defection framework, we should be willing to ask a more fundamental question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Has the law protected the voter as much as it has protected the political party?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My answer is not adequate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am not suggesting that the Tenth Schedule should simply be repealed. Nor am I suggesting that every disagreement between an elected representative and his or her party should result in disqualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would be equally dangerous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What I am proposing is something more precise:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The voter should remain free to elect a representative, the representative should remain free to exercise legislative judgement, but the representative should not be permitted to transfer the electoral mandate from one political identity to another without returning to the electorate for a fresh mandate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That, in my view, is the missing link in India&#8217;s anti-defection framework.<\/p>\n\n\n\n<h2 id=\"h-1-the-fundamental-question-who-owns-the-democratic-mandate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_The_Fundamental_Question_Who_Owns_the_Democratic_Mandate\"><\/span>1. The Fundamental Question: Who Owns the Democratic Mandate?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Let me begin with the basic constitutional relationship.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A political party selects a candidate.<\/li>\n\n\n\n<li>The candidate contests the election.<\/li>\n\n\n\n<li>The voter enters the polling booth.<\/li>\n\n\n\n<li>The voter chooses.<\/li>\n\n\n\n<li>The Election Commission declares the result.<\/li>\n\n\n\n<li>The elected representative enters Parliament or the Legislative Assembly.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">At that point, an important constitutional relationship is created.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The representative has not received the seat merely from the political party. The representative has received the democratic mandate through the votes of the electorate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Of course, modern elections cannot be understood without political parties. The Supreme Court has recognised the central role of political parties in India&#8217;s democratic system, and its 2023 judgement concerning the Maharashtra political crisis specifically connected the anti-defection framework to the problem of legislators shifting allegiance after being elected on a party ticket.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But recognising the importance of political parties should not lead us to the opposite conclusion\u2014that the political party effectively owns the electoral mandate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The party may provide the political vehicle. The voter provides the mandate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction should become the foundation of the next generation of electoral reform.<\/p>\n\n\n\n<h2 id=\"h-2-what-is-wrong-with-the-present-anti-defection-framework\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_What_Is_Wrong_With_the_Present_Anti-Defection_Framework\"><\/span>2. What Is Wrong With the Present Anti-Defection Framework?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The present Tenth Schedule provides for disqualification where, among other things, a member voluntarily gives up membership of the political party or votes or abstains contrary to the direction issued by the political party, subject to the provisions of the Schedule. It also treats an elected member as belonging to the political party, if any, by which the member was set up as a candidate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was designed to solve a real problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the structure creates an important imbalance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law asks:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Did the legislator violate party discipline?<\/li>\n\n\n\n<li>Did the legislator voluntarily give up membership of the party?<\/li>\n\n\n\n<li>Did the legislator vote contrary to the party direction?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But I believe we must add another question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What happened to the mandate that the voters gave that representative?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That question is not merely philosophical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It becomes extremely important when an elected representative leaves one political party and joins another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a candidate contests an election under Party A.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The candidate wins.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two years later, the representative leaves Party A and joins Party B.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Party B now gets a legislator who was elected under Party A&#8217;s political identity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the voters of that constituency were never asked whether they wanted their representative to become a representative of Party B.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The political identity has changed. The voter has not been consulted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is the precise democratic gap that I believe the law must address.<\/p>\n\n\n\n<h2 id=\"h-3-i-am-not-advocating-that-every-mla-or-mp-must-obey-every-voter\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_I_Am_Not_Advocating_That_Every_MLA_or_MP_Must_Obey_Every_Voter\"><\/span>3. I Am Not Advocating That Every MLA or MP Must Obey Every Voter<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is extremely important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If we say that &#8220;the voter is supreme&#8221; in a representative democracy, it cannot mean that an MP or MLA must conduct a referendum before every vote in the House.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would destroy representative democracy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An elected representative must have the freedom to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>debate;<\/li>\n\n\n\n<li>disagree;<\/li>\n\n\n\n<li>scrutinise legislation;<\/li>\n\n\n\n<li>oppose government policy;<\/li>\n\n\n\n<li>exercise conscience;<\/li>\n\n\n\n<li>represent local interests;<\/li>\n\n\n\n<li>change his or her position after considering new facts.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A representative is not merely a voting machine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would reject the idea that every disagreement with a party should automatically result in disqualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In fact, I believe India&#8217;s anti-defection law should become more tolerant of legitimate legislative dissent while becoming stricter against the transfer of an electoral mandate from one political party to another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That may sound contradictory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is the key to reform.<\/p>\n\n\n\n<h2 id=\"h-4-my-proposal-the-electoral-mandate-protection-principle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_My_Proposal_The_Electoral_Mandate_Protection_Principle\"><\/span>4. My Proposal: The Electoral Mandate Protection Principle<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I propose that India should adopt what I would describe as the:<\/p>\n\n\n\n<h3 id=\"h-electoral-mandate-protection-principle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Electoral_Mandate_Protection_Principle\"><\/span>Electoral Mandate Protection Principle<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Its central rule should be simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>An elected representative who voluntarily changes the political party under whose candidature the representative was elected should not be permitted to transfer that mandate to another political party without obtaining a fresh mandate from the electorate.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In plain language:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You can change your political allegiance.<\/li>\n\n\n\n<li>You can disagree with your party.<\/li>\n\n\n\n<li>You can resign from your party.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But if you want to represent another political party from the same constituency, go back to the people.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ask them again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let the voters decide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is what I mean by making the voter supreme.<\/p>\n\n\n\n<h2 id=\"h-5-the-no-transfer-of-mandate-without-voter-confirmation-rule\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_The_%E2%80%9CNo_Transfer_of_Mandate_Without_Voter_Confirmation%E2%80%9D_Rule\"><\/span>5. The \u201cNo Transfer of Mandate Without Voter Confirmation\u201d Rule<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would build the reform around one simple democratic proposition:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No elected representative should be able to transfer the political mandate received from the voters to another political party merely by changing party affiliation.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine the following situation.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Stage<\/th><th>Situation<\/th><\/tr><\/thead><tbody><tr><td>First<\/td><td>A candidate contests an election under Party A.<\/td><\/tr><tr><td>Second<\/td><td>The candidate wins.<\/td><\/tr><tr><td>Third<\/td><td>Two years later, the candidate joins Party B.<\/td><\/tr><tr><td>Fourth<\/td><td>Under my proposed system, joining Party B would trigger a mandate reconfirmation requirement.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The representative would have two principal choices.<\/p>\n\n\n\n<h3 id=\"h-first-option-resign-and-seek-a-fresh-mandate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First_Option_Resign_and_Seek_a_Fresh_Mandate\"><\/span>First Option: Resign and Seek a Fresh Mandate<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The representative resigns the seat and contests a by-election as a candidate of Party B.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the voters approve the decision:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The representative returns with a fresh mandate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the voters reject the decision:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The representative does not return.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is nothing undemocratic about this.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the contrary, it is democracy in its purest form.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The representative is not being permanently punished.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The representative is simply being told:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">You have changed the political identity under which you were elected. Now ask the people whether they agree with you.<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-6-the-representative-should-not-be-punished-for-dissent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_The_Representative_Should_Not_Be_Punished_for_Dissent\"><\/span>6. The Representative Should Not Be Punished for Dissent<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where my proposal differs from a crude anti-defection law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose an MLA belonging to Party A disagrees with the party on a social policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the MLA votes differently on an ordinary bill.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the MLA publicly criticises the party leadership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should the MLA automatically lose the seat?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>No.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would oppose such a rule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law should distinguish between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Political dissent<\/li>\n\n\n\n<li>Political defection<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">They are not the same thing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A democracy needs dissent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A parliamentary democracy needs debate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A legislature filled with representatives who simply obey every instruction of their party leadership is not necessarily a healthy legislature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the reformed anti-defection law should protect government stability without converting every legislative vote into a test of personal loyalty to the party leadership.<\/p>\n\n\n\n<h2 id=\"h-7-three-categories-of-legislative-voting\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Three_Categories_of_Legislative_Voting\"><\/span>7. Three Categories of Legislative Voting<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To achieve this, I propose that parliamentary voting be divided into three broad categories.<\/p>\n\n\n\n<h3 id=\"h-category-one-government-survival-votes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Category_One_Government-Survival_Votes\"><\/span>Category One: Government-Survival Votes<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These would include matters such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>confidence motions;<\/li>\n\n\n\n<li>no-confidence motions;<\/li>\n\n\n\n<li>votes directly determining whether the government continues in office;<\/li>\n\n\n\n<li>appropriately defined money and supply matters.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Here, party discipline has a strong constitutional justification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A government elected on a particular political programme cannot be allowed to collapse merely because individual legislators are induced to change sides.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A valid whip should therefore continue to operate strongly in this category.<\/p>\n\n\n\n<h3 id=\"h-category-two-core-electoral-mandate-votes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Category_Two_Core_Electoral_Mandate_Votes\"><\/span>Category Two: Core Electoral Mandate Votes<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">These would relate to a limited number of fundamental commitments expressly identified by the political party before the election.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important safeguard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A party should not be permitted to classify every sentence of its manifesto as a &#8220;core mandate&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Otherwise, the exception would swallow the rule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I therefore propose that political parties should identify a small and clearly defined list of core electoral commitments before the election.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those commitments could be publicly registered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This would create transparency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The voters would know what the party itself considers central to its electoral mandate.<\/p>\n\n\n\n<h3 id=\"h-category-three-ordinary-legislative-votes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Category_Three_Ordinary_Legislative_Votes\"><\/span>Category Three: Ordinary Legislative Votes<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For most ordinary legislation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>There should be greater freedom for legislators to exercise judgement.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The party may issue a political position.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The party may persuade its legislators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The party may debate internally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But an ordinary disagreement should not automatically become a constitutional disqualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This would restore a degree of legislative independence without returning India to the era of uncontrolled horse-trading.<\/p>\n\n\n\n<h2 id=\"h-8-a-new-institutional-mechanism-the-electoral-mandate-register\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_A_New_Institutional_Mechanism_The_Electoral_Mandate_Register\"><\/span>8. A New Institutional Mechanism: The Electoral Mandate Register<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another reform I believe can make this system practical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before every general election, political parties should be required to file an Electoral Mandate Statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This would be publicly available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could contain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the party manifesto;<\/li>\n\n\n\n<li>its principal policy commitments;<\/li>\n\n\n\n<li>its identified core electoral commitments;<\/li>\n\n\n\n<li>its candidate list;<\/li>\n\n\n\n<li>registered coalition arrangements;<\/li>\n\n\n\n<li>any formal pre-election alliance commitments.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not to convert every manifesto promise into a legally enforceable obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would be impractical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is simply to establish a transparent record of the political identity presented to voters at the time of election.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This would create an important democratic record:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What did the voter actually vote upon?<\/strong><\/p>\n\n\n\n<h2 id=\"h-9-the-mandate-register-should-not-become-a-political-control-register\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_The_Mandate_Register_Should_Not_Become_a_Political_Control_Register\"><\/span>9. The Mandate Register Should Not Become a Political Control Register<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This safeguard is essential.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I do not propose that government officials should decide whether a political party is &#8220;ideologically pure&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would be dangerous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Register should be factual and limited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should record:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What did the party formally present to the electorate?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It should not determine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What political opinions are permissible?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Political parties must remain free to evolve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Political circumstances change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New economic crises occur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">National security situations change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Coalitions change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Public opinion changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the law should not freeze a political party into its election manifesto for five years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Mandate Register is primarily a transparency mechanism.<\/p>\n\n\n\n<h2 id=\"h-10-the-most-important-rule-party-switching-should-trigger-a-fresh-mandate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"10_The_Most_Important_Rule_Party_Switching_Should_Trigger_a_Fresh_Mandate\"><\/span>10. The Most Important Rule: Party Switching Should Trigger a Fresh Mandate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the heart of my proposal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an elected representative:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>leaves Party A;<\/li>\n\n\n\n<li>joins Party B;<\/li>\n\n\n\n<li>and seeks to continue representing the same constituency as a member of Party B,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The law should ordinarily require:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A fresh electoral mandate.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This principle is not without international precedent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">New Zealand, for example, has legislation dealing with circumstances in which an MP ceases to be a parliamentary member of the political party for which the MP was elected. Its stated purpose includes enhancing public confidence in electoral integrity and maintaining the proportionality of political-party representation as determined by electors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India need not copy New Zealand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But we can learn from the underlying principle:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The composition of the legislature should not be disconnected from the political choice made by the electorate.<\/strong><\/p>\n\n\n\n<h2 id=\"h-11-but-what-happens-if-the-political-party-itself-changes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"11_But_What_Happens_If_the_Political_Party_Itself_Changes\"><\/span>11. But What Happens If the Political Party Itself Changes?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where a serious reform must be nuanced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a candidate is elected under Party A.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After two years, Party A itself abandons the political position on which the election was fought.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The representative says:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;I have not abandoned the mandate. The party has.&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Should the representative automatically lose the seat?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would be unfair.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I propose a narrowly defined:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Mandate Discontinuity Defence.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A representative could argue before an independent adjudicatory body that the political party itself has fundamentally altered the political identity presented to the electorate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This should not become an easy escape route.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There should be a high threshold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the law must recognise the possibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Otherwise, the reform would protect the party at the expense of the voter all over again.<\/p>\n\n\n\n<h2 id=\"h-12-the-speaker-should-not-be-the-final-arbiter-of-political-defection\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"12_The_Speaker_Should_Not_Be_the_Final_Arbiter_of_Political_Defection\"><\/span>12. The Speaker Should Not Be the Final Arbiter of Political Defection<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another major weakness in the present framework is institutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Speaker occupies an inherently political constitutional office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the question is whether a legislator has defected, the dispute can directly affect:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>government survival;<\/li>\n\n\n\n<li>party strength;<\/li>\n\n\n\n<li>leadership;<\/li>\n\n\n\n<li>coalition arithmetic.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Expecting one political actor to conclusively determine another political actor&#8217;s constitutional fate inevitably creates controversy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has subjected decisions under the Tenth Schedule to judicial review, and its jurisprudence has repeatedly addressed the constitutional role of the Speaker in defection proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I therefore propose an:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Independent Electoral Mandate Tribunal.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could consist of persons with strong constitutional and electoral expertise, with judicial leadership and transparent appointment criteria.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective would not be to remove Parliament from the process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective would be to ensure that a politically decisive constitutional dispute is determined through an independent process.<\/p>\n\n\n\n<h2 id=\"h-13-there-must-be-a-strict-time-limit\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"13_There_Must_Be_a_Strict_Time_Limit\"><\/span>13. There Must Be a Strict Time Limit<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">An anti-defection law that takes years to produce a decision defeats its own purpose.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is not merely:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who is right?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who is entitled to occupy the seat while the dispute remains unresolved?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Delay can itself alter the political balance of a House.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I propose:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>90 days as the normal outer limit.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If exceptional circumstances genuinely prevent a decision within that period, reasons should be publicly recorded and judicially reviewable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s recent jurisprudence has itself emphasised the need to prevent unreasonable delay in deciding disqualification proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A constitutional right without timely enforcement is often only a theoretical right.<\/p>\n\n\n\n<h2 id=\"h-14-my-proposal-is-not-a-general-right-of-recall\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"14_My_Proposal_Is_Not_a_General_Right_of_Recall\"><\/span>14. My Proposal Is Not a General Right of Recall<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I want to make this distinction very clear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am not proposing that voters should be able to recall their MP or MLA merely because they are unhappy with the representative&#8217;s performance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are serious practical questions surrounding a general recall mechanism.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could lead to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>political instability;<\/li>\n\n\n\n<li>repeated elections;<\/li>\n\n\n\n<li>harassment of representatives;<\/li>\n\n\n\n<li>misuse by wealthy political interests;<\/li>\n\n\n\n<li>continuous campaigning;<\/li>\n\n\n\n<li>minority pressure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">India should therefore be cautious.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My proposal is much narrower.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Poor performance?<\/strong> The voter can remove the representative at the next election.<\/li>\n\n\n\n<li><strong>Ordinary disagreement?<\/strong> The representative should be free to exercise judgement.<\/li>\n\n\n\n<li><strong>Political dissent?<\/strong> It should not automatically cause disqualification.<\/li>\n\n\n\n<li><strong>Voluntary transfer from Party A to Party B?<\/strong> Return to the voter.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is the distinction.<\/p>\n\n\n\n<h2 id=\"h-15-why-this-would-actually-strengthen-representative-democracy\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"15_Why_This_Would_Actually_Strengthen_Representative_Democracy\"><\/span>15. Why This Would Actually Strengthen Representative Democracy<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Some may argue that giving voters this power would weaken representatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I believe the opposite could happen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Today, an elected representative may face pressure from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>party leadership;<\/li>\n\n\n\n<li>political financiers;<\/li>\n\n\n\n<li>rival factions;<\/li>\n\n\n\n<li>government;<\/li>\n\n\n\n<li>opposition;<\/li>\n\n\n\n<li>constituency;<\/li>\n\n\n\n<li>ideological groups.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed system would create another important constitutional consideration:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The voters.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A representative contemplating a party switch would know:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;If I change sides, I must explain my decision to the electorate.&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That changes incentives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It discourages opportunistic defections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it does not prohibit genuine political realignment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A politician who genuinely believes that the new political party better represents the constituency can make that case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The voters then become the judge.<\/p>\n\n\n\n<h2 id=\"h-16-this-could-reduce-horse-trading\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"16_This_Could_Reduce_Horse-Trading\"><\/span>16. This Could Reduce Horse-Trading<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The anti-defection law was originally introduced because defections could destabilise governments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But political incentives matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If switching parties automatically means risking a by-election, the political calculation changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A legislator cannot simply calculate:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;If I move to the other side, what position will I receive?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The calculation becomes:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;If I move to the other side, will the people send me back?&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a powerful democratic deterrent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reform therefore attacks the incentive structure rather than merely increasing punishment.<\/p>\n\n\n\n<h2 id=\"h-17-the-real-innovation-is-not-technology\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"17_The_Real_Innovation_Is_Not_Technology\"><\/span>17. The Real Innovation Is Not Technology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There will inevitably be discussion about creating digital systems, databases and online mandate registers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those tools are useful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But they are not the real innovation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real innovation is conceptual.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The existing anti-defection framework essentially asks:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Did the legislator remain loyal to the political party?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">My proposed framework asks:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Did the legislator remain within the mandate for which the electorate elected him or her?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a fundamental change in perspective.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The party remains important.<\/li>\n\n\n\n<li>The representative remains important.<\/li>\n\n\n\n<li>But the voter becomes the constitutional reference point.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-18-a-constitutional-amendment-could-state-the-principle-clearly\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"18_A_Constitutional_Amendment_Could_State_the_Principle_Clearly\"><\/span>18. The Difference Between a Representative and a Delegate<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another constitutional balance that must never be forgotten.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An MP or MLA is a representative, not merely a delegate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A delegate must vote exactly as instructed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A representative is expected to exercise judgement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, making the voter supreme cannot mean eliminating the representative&#8217;s discretion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct balance is:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The voter chooses the representative.<\/li>\n\n\n\n<li>The representative exercises judgement.<\/li>\n\n\n\n<li>The political party provides the political platform.<\/li>\n\n\n\n<li>The legislature provides the forum for debate.<\/li>\n\n\n\n<li>But if the representative fundamentally changes the political vehicle through which the electorate elected him or her, the electorate should have the final word.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is the balance I propose.<\/p>\n\n\n\n<h2 id=\"h-27-from-anti-defection-law-to-electoral-mandate-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"27_From_Anti-Defection_Law_to_Electoral_Mandate_Law\"><\/span>27. From Anti-Defection Law to Electoral Mandate Law<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps the time has come to change the way we even describe this legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Calling it simply the &#8220;Anti-Defection Law&#8221; keeps the focus on preventing politicians from changing sides.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I believe the larger constitutional objective should be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Protection of the Electoral Mandate.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Defection is only one problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deeper problem is the possibility that a political mandate can be transferred without the consent of the electorate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, India&#8217;s next generation of reform should move from:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Anti-Defection<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">to<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Mandate Protection.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a more democratic framework.<\/p>\n\n\n\n<h2 id=\"h-28-the-reform-i-am-proposing-in-one-example\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"28_The_Reform_I_Am_Proposing_in_One_Example\"><\/span>28. The Larger Constitutional Principle<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The debate over anti-defection law is ultimately not just about politicians changing parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is about the relationship between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the voter,<\/li>\n\n\n\n<li>the representative and<\/li>\n\n\n\n<li>the political party.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">My proposal attempts to restore the constitutional balance among all three.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I do not want to weaken political parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs political parties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I do not want to weaken elected representatives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs representatives capable of independent thought.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I do not want governments to become unstable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs stable governments capable of governing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I also do not want the voter to disappear from the legal equation after the election result is declared.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The voter cannot become constitutionally invisible for five years.<\/p>\n\n\n\n<h2 id=\"h-31-my-proposed-democratic-formula\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"31_My_Proposed_Democratic_Formula\"><\/span>31. My Proposed Democratic Formula<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would therefore reduce the entire reform to five principles:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>First<\/strong> \u2014 The voter gives the mandate.<\/li>\n\n\n\n<li><strong>Second<\/strong> \u2014 The representative exercises the mandate.<\/li>\n\n\n\n<li><strong>Third<\/strong> \u2014 The party provides the political platform.<\/li>\n\n\n\n<li><strong>Fourth<\/strong> \u2014 Ordinary legislative dissent should remain protected.<\/li>\n\n\n\n<li><strong>Fifth<\/strong> \u2014 A representative who changes political parties should seek a fresh mandate before carrying the constituency to the new party.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">This, in my view, is the middle path India needs.<\/p>\n\n\n\n<h2 id=\"h-32-conclusion-let-the-people-decide\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"32_Conclusion_Let_the_People_Decide\"><\/span>32. Conclusion: Let the People Decide<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India does not need an anti-defection law that merely asks whether a politician has remained loyal to a political party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India needs an electoral system that asks a deeper question:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Has the mandate given by the people been respected?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Tenth Schedule was an important constitutional response to a serious political problem. But constitutional systems must evolve with experience. The Law Commission continues to identify electoral reform as an important area of legal reform, and the Supreme Court&#8217;s continuing jurisprudence demonstrates that the anti-defection framework remains a live constitutional issue.<\/p>\n\n\n\n<h3 id=\"h-rebalancing-the-anti-defection-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rebalancing_the_Anti-Defection_Law\"><\/span>Rebalancing the Anti-Defection Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">My proposal is therefore not to destroy the anti-defection law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is to rebalance it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should protect governments from horse-trading.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should protect political parties from opportunistic defections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should protect representatives who genuinely exercise legislative judgement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But above all, we should protect the voter from having his or her electoral mandate transferred without consent.<\/p>\n\n\n\n<h3 id=\"h-go-back-to-the-people\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Go_Back_to_the_People\"><\/span>Go Back to the People<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If a politician believes that another political party is better for the constituency, there should be no prohibition against making that political choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there should be one democratic condition:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Go back to the people.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tell them why you changed sides.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tell them why your new political position is better.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Stand before them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ask for their vote again.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If they agree, return to the House with a fresh mandate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If they disagree, accept the verdict.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not political punishment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>That is democracy.<\/strong><\/p>\n\n\n\n<h3 id=\"h-the-mandate-belongs-to-the-people\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Mandate_Belongs_to_the_People\"><\/span>The Mandate Belongs to the People<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The principle I am proposing is therefore very simple:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cThe representative may change sides, but the mandate cannot change hands without the people.\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And if we genuinely believe that sovereignty in a democracy ultimately rests with the people, then the law should ensure that the voter is not merely supreme on polling Constitutional Law > The Voter Must Be Supreme: Rethinking India\u2019s Anti-Defection Lawday but remains the ultimate source of legitimacy whenever an elected representative seeks to fundamentally change the political mandate under which he or she was elected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The seat may be occupied by the representative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The party may provide the symbol.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the mandate belongs to the people.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>And the law should say so.<\/strong><\/p>\n\n\n\n<h2 id=\"h-need-legal-guidance-speak-with-an-experienced-supreme-court-advocate\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Need_Legal_Guidance_Speak_With_an_Experienced_Supreme_Court_Advocate\"><\/span>Need Legal Guidance?
