Even before a court decides whether a person is guilty or innocent, an arrest may affect reputation, family life, employment, business, and personal dignity. class=\"wp-block-paragraph\">Anticipatory bail is a form of protection granted to a person who has a genuine and reasonable apprehension that he or she may be arrested for a non-bailable offense. It allows the person to approach a court before arrest and seek a direction that, if arrested, he or she should be released on bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), anticipatory bail is governed by Section 482. It represents an important balance between two competing interests: the power of the police to investigate crime and the individual&#8217;s fundamental right to personal liberty under Article 21 of the Constitution of India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Anticipatory bail is therefore not a method of escaping the law. It is a legal safeguard against unnecessary or unjustified arrest.<\/p>\n\n\n\n<h2 id=\"h-what-is-anticipatory-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_Anticipatory_Bail\"><\/span>What Is Anticipatory Bail?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Anticipatory bail is commonly described as pre-arrest bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person does not have to wait until the police arrest him or her. If there are reasonable grounds to believe that arrest may take place in connection with a non-bailable offense, the person may approach the appropriate court and seek protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the court grants anticipatory bail, the person will be released on bail in the event of arrest, subject to the conditions imposed by the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The basic purpose of anticipatory bail is simple:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To protect personal liberty without obstructing a genuine criminal investigation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It is particularly important in situations where criminal law may be misused for harassment, revenge, pressure, or personal disputes.<\/p>\n\n\n\n<h2 id=\"h-which-court-can-grant-anticipatory-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Which_Court_Can_Grant_Anticipatory_Bail\"><\/span>Which Court Can Grant Anticipatory Bail?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), anticipatory bail may be granted only by the High Court or the Court of Session. A magistrate has no statutory power to grant anticipatory bail under this provision.<\/p>\n\n\n\n<h2 id=\"h-anticipatory-bail-is-not-an-absolute-right\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Anticipatory_Bail_Is_Not_an_Absolute_Right\"><\/span>Anticipatory Bail Is Not an Absolute Right<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although anticipatory bail protects personal liberty, it is not automatically granted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a discretionary remedy. The court examines the facts and circumstances of every case before deciding whether protection should be given.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court must ensure that the remedy is not misused by a person who genuinely needs to be taken into custody for a proper investigation. At the same time, the court must protect innocent persons from arbitrary arrest and unnecessary humiliation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, anticipatory bail requires a careful balance between:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Principle<\/th><th>Purpose<\/th><\/tr><\/thead><tbody><tr><td>Individual liberty<\/td><td>Protecting a person&#8217;s freedom from unnecessary or arbitrary arrest.<\/td><\/tr><tr><td>The interests of justice and investigation<\/td><td>Ensuring that a genuine criminal investigation is not obstructed.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 id=\"h-the-legal-foundation-section-482-bnss\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Legal_Foundation_Section_482_BNSS\"><\/span>The Legal Foundation: Section 482 BNSS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 482 of the BNSS empowers the High Court and the Court of Session to grant anticipatory bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person may apply when there are reasonable grounds to believe that he or she may be arrested on an accusation involving a non-bailable offense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While considering the application, the court examines the overall circumstances of the case. It may also impose conditions to ensure that the applicant cooperates with the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Common conditions may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Appearing before the investigating officer when required;<\/li>\n\n\n\n<li>Cooperating with the investigation;<\/li>\n\n\n\n<li>Not threatening or influencing witnesses;<\/li>\n\n\n\n<li>Not tampering with evidence;<\/li>\n\n\n\n<li>Not leaving the country without the permission of the court.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, anticipatory bail gives protection from unnecessary custody, but it does not give a person freedom to obstruct the law.<\/p>\n\n\n\n<h2 id=\"h-when-can-a-person-apply-for-anticipatory-bail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_Can_a_Person_Apply_for_Anticipatory_Bail\"><\/span>When Can a Person Apply for Anticipatory Bail?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most important requirement is a reasonable apprehension of arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A person cannot seek anticipatory bail merely because of an imaginary or vague fear. There must be some genuine basis for believing that arrest is likely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such apprehension may arise in different situations.<\/p>\n\n\n\n<h3 id=\"h-before-registration-of-an-fir\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Before_Registration_of_an_FIR\"><\/span>Before Registration of an FIR<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">An anticipatory bail application may be appropriate even before an FIR is registered if there are clear and objective circumstances showing that a criminal case is likely to be filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, there may be:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A written complaint;<\/li>\n\n\n\n<li>A documented threat to file a criminal case;<\/li>\n\n\n\n<li>A serious matrimonial dispute;<\/li>\n\n\n\n<li>A business or property dispute involving threats of criminal action.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The applicant must show more than a simple suspicion. There should be facts supporting the apprehension of arrest.<\/p>\n\n\n\n<h3 id=\"h-after-registration-of-an-fir-but-before-arrest\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"After_Registration_of_an_FIR_but_Before_Arrest\"><\/span>After Registration of an FIR but Before Arrest<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is the most common stage for seeking anticipatory bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once an FIR is registered and the person reasonably fears arrest, immediate legal action may be necessary.
