class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The woman had left her home in Odisha after forming a relationship with a man from Bangladesh who was then living in India. She accompanied him across the border into Bangladesh. When the relationship ended, she attempted to return to India without travel documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Border Security Force personnel intercepted her near the Indo-Bangladesh border and handed her over to the local police. An FIR was registered for illegal entry. After investigation, a chargesheet was filed under the Foreigners Act, 1946. Without identity papers or legal counsel, she was convicted and sentenced to imprisonment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What began as a personal decision to cross a border ended in prolonged incarceration.<\/p>\n\n\n\n<h2 id=\"h-a-life-without-identity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Life_Without_Identity\"><\/span>A Life Without Identity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">When I encountered her during a routine inspection as Inspector General of Police, Correctional Services, West Bengal, she appeared physically frail and emotionally withdrawn. She had no documents from either India or Bangladesh. No family members came forward. No address could be verified.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Convicted for unlawful entry and stay, she had no realistic prospect of release. The prison system held her, yet no authority claimed responsibility for resolving her status.<\/p>\n\n\n\n<h2 id=\"h-attempts-to-trace-her-origins\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Attempts_to_Trace_Her_Origins\"><\/span>Attempts to Trace Her Origins<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I directed the prison administration to enquire into her background. Local police in the district she mentioned were contacted, but no one recognised her. Several NGOs attempted to assist, yet the absence of any identity document rendered their efforts ineffective.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Once conviction had been recorded, the courts treated the matter as closed. Higher judicial intervention was limited by the fact that she had already been found guilty of a substantive offence under the Foreigners Act. Administrative and legal machinery simply had no category in which to place her.<\/p>\n\n\n\n<h2 id=\"h-the-psychological-impact\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Psychological_Impact\"><\/span>The Psychological Impact<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Over time her mental condition deteriorated. She became confused, unable to recall addresses or names of relatives. Clear guidelines for lower courts on handling undocumented or stateless accused persons would reduce the risk of automatic, prolonged incarceration.<\/p>\n\n\n\n<h3 id=\"h-7-3-rehabilitation-and-support\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"73_Rehabilitation_and_Support\"><\/span>7.3 Rehabilitation and Support<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Prison programmes should include vocational training, legal awareness, and structured coordination with NGOs so that release\u2014if and when it occurs\u2014does not simply transfer the person into another form of destitution.<\/p>\n\n\n\n<h3 id=\"h-7-4-diplomatic-engagement\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"74_Diplomatic_Engagement\"><\/span>7.4 Diplomatic Engagement<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Bilateral mechanisms for nationality verification and repatriation, together with engagement of the UNHCR and consular authorities, are essential when the person\u2019s claimed origin lies in another country.<\/p>\n\n\n\n<h3 id=\"h-7-5-mental-health-care\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"75_Mental_Health_Care\"><\/span>7.5 Mental Health Care<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Routine psychological assessment and access to counselling must form part of the response, particularly for long-term detainees whose incarceration stems from administrative rather than criminal factors.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The woman in Dum Dum Central Correctional Home represents a category of people the legal system is poorly equipped to handle: those without papers, without family, and without a clear national status.
