The Constitution Never Says the President Is &#8220;Above the Law&#8221;<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most common statements in this debate is that the Constitution gives the President immunity from prosecution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The text is not so simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article II, Section 4 provides for impeachment and removal of the President for treason, bribery, or other high crimes and misdemeanors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article I, Section 3 provides that even after impeachment and conviction, the person remains liable to indictment, trial, judgment, and punishment according to law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That tells us something fundamental.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The constitutional system recognizes both:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>political accountability<\/li>\n\n\n\n<li>criminal accountability<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">They are not the same thing.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Accountability System<\/th><th>Purpose<\/th><\/tr><\/thead><tbody><tr><td>Impeachment<\/td><td>Determines whether an officeholder should remain in constitutional office.<\/td><\/tr><tr><td>Criminal Prosecution<\/td><td>Determines whether an individual committed a crime and should receive the punishment prescribed by law.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Impeachment determines whether an officeholder should remain in constitutional office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Criminal prosecution determines whether an individual committed a crime and should receive the punishment prescribed by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Confusing these two systems has produced much of the confusion surrounding presidential immunity.<\/p>\n\n\n\n<h2 id=\"h-3-the-supreme-court-s-presidential-immunity-journey\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_The_Supreme_Courts_Presidential_Immunity_Journey\"><\/span>3. The Supreme Court&#8217;s Presidential Immunity Journey<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">To understand where America stands today, we have to look at how the Supreme Court arrived here.<\/p>\n\n\n\n<h3 id=\"h-united-states-v-nixon-the-president-cannot-become-judicially-invisible\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"United_States_v_Nixon_The_President_Cannot_Become_Judicially_Invisible\"><\/span>United States v. Nixon: The President Cannot Become Judicially Invisible<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Watergate era produced one of the most important constitutional principles in American history.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In United States v. Nixon, the Supreme Court rejected an absolute claim of presidential privilege against a judicial demand for evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The message was powerful:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The presidency is extraordinarily important, but the judicial process does not simply disappear when the president is involved.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That principle remains enormously important today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The president has constitutional powers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The President does not possess a constitutional magic shield against every judicial proceeding.<\/p>\n\n\n\n<h2 id=\"h-4-nixon-v-fitzgerald-official-presidential-acts-are-different\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Nixon_v_Fitzgerald_Official_Presidential_Acts_Are_Different\"><\/span>4. Nixon v. Fitzgerald: Official Presidential Acts Are Different<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Court later recognized absolute civil immunity for a president for official acts in Nixon v. Fitzgerald.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The justification was not that presidents are morally superior to other citizens.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The justification was institutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A president must be able to make difficult constitutional and policy decisions without living under the constant threat of personal civil liability for every official decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This created an important principle:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Immunity can protect the office&#8217;s constitutional functions.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That principle eventually became central to the modern criminal-immunity debate.<\/p>\n\n\n\n<h2 id=\"h-5-clinton-v-jones-the-office-does-not-erase-the-person\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_Clinton_v_Jones_The_Office_Does_Not_Erase_the_Person\"><\/span>5. Clinton v. Jones: The Office Does Not Erase the Person<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Then came Clinton v. Jones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court rejected the argument that a sitting president enjoyed blanket immunity from civil litigation involving unofficial conduct that occurred before taking office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The significance of that decision is often underestimated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court effectively recognized a distinction between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the President acting as President<\/li>\n\n\n\n<li>the individual who happens to occupy the presidency<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction should remain at the center of every serious discussion about presidential immunity.<\/p>\n\n\n\n<h2 id=\"h-6-trump-v-vance-investigation-is-not-prosecution\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"6_Trump_v_Vance_Investigation_Is_Not_Prosecution\"><\/span>6. Trump v. Vance: Investigation Is Not Prosecution<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Trump v. Vance brought criminal investigation directly into the picture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The issue involved a state grand jury subpoena for President Trump&#8217;s private financial records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court refused to recognize categorical immunity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means something very important:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A sitting president can be the subject of a criminal investigation.<\/li>\n\n\n\n<li>But that does not automatically mean that the president can be indicted, arrested, or subjected to an ordinary criminal trial while still serving.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the American system enters constitutional uncertainty.<\/p>\n\n\n\n<h2 id=\"h-7-trump-v-united-states-the-new-immunity-architecture\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_Trump_v_United_States_The_New_Immunity_Architecture\"><\/span>7. Trump v. United States: The New Immunity Architecture<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The 2024 Supreme Court decision in Trump v. United States fundamentally altered the modern landscape.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court essentially created three categories of presidential conduct.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Category<\/th><th>Presidential Conduct<\/th><th>Protection<\/th><\/tr><\/thead><tbody><tr><td>First<\/td><td>Core constitutional powers<\/td><td>These receive the strongest protection, including absolute immunity in appropriate circumstances.<\/td><\/tr><tr><td>Second<\/td><td>Other official presidential acts<\/td><td>These receive at least presumptive immunity.<\/td><\/tr><tr><td>Third<\/td><td>Unofficial acts<\/td><td>These do not receive presidential immunity merely because the individual happens to be president.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">This is an extraordinarily important development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a person becomes president.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not mean every action that person takes during those four years becomes a &#8220;presidential act.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal question is not simply<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Did this happen while he was president?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The better question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Was the conduct presidential in constitutional character?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction could determine the future of presidential criminal law.<\/p>\n\n\n\n<h2 id=\"h-8-the-real-constitutional-gap\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"8_The_Real_Constitutional_Gap\"><\/span>8. The Real Constitutional Gap<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In my view, this is where the American legal system needs serious reform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The conventional criminal process looks something like this:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Investigation \u2192 indictment \u2192 trial \u2192 judgment \u2192 punishment.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But when the suspect is a sitting president, the normal sequence becomes uncertain.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The president may be investigated.<\/li>\n\n\n\n<li>Evidence may be collected.<\/li>\n\n\n\n<li>A subpoena may be issued.<\/li>\n\n\n\n<li>But the question of indictment and prosecution becomes constitutionally complicated.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This creates what I call the:<\/p>\n\n\n\n<h3 id=\"h-presidential-accountability-gap\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Presidential_Accountability_Gap\"><\/span>Presidential Accountability Gap<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The legal system knows how to investigate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It knows how to prosecute ordinary citizens.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It knows how to impeach a president.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it does not have a comprehensive, constitutionally settled mechanism for dealing with the period between:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>credible criminal investigation<\/li>\n\n\n\n<li>lawful post-presidential criminal adjudication<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is the gap we should fix.<\/p>\n\n\n\n<h2 id=\"h-9-why-just-prosecute-the-president-is-not-the-answer\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"9_Why_%E2%80%9CJust_Prosecute_the_President%E2%80%9D_Is_Not_the_Answer\"><\/span>9. Why &#8220;Just Prosecute the President&#8221; Is Not the Answer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Some commentators understandably argue that the simplest solution is to treat the president exactly like every other citizen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I disagree.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That sounds attractive from the perspective of equality before law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But constitutional equality does not necessarily mean identical procedure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that a prosecutor in one state could force the president of the United States to spend weeks or months in court during an international crisis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine 50 states having competing criminal demands.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine a hostile prosecutor using criminal procedure to interfere with national security decisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would create another constitutional problem while attempting to solve the first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presidency is an institution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It must continue functioning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore the solution cannot be<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Ignore presidential status entirely.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">But neither can it be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Once you become president, criminal accountability stops.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Both extremes are dangerous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Also Read: <a href=\"https:\/\/www.legalserviceindia.com\/Legal-Articles\/who-controls-american-elections-trump-mail-ballot-order-supreme-court\/\" target=\"_blank\" rel=\"noopener\">Who Controls American Elections? id=\"h-the-presidential-accountability-continuum-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Presidential_Accountability_Continuum-2\"><\/span>The Presidential Accountability Continuum<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The system would have six stages:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Stage<\/th><th>Process<\/th><\/tr><\/thead><tbody><tr><td>1<\/td><td>Investigation<\/td><\/tr><tr><td>2<\/td><td>Evidence Preservation<\/td><\/tr><tr><td>3<\/td><td>Judicial Review<\/td><\/tr><tr><td>4<\/td><td>Immunity Classification<\/td><\/tr><tr><td>5<\/td><td>Constitutional Deferral, Where Necessary<\/td><\/tr><tr><td>6<\/td><td>Post-Presidential Reassessment and Ordinary Criminal Process<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">This is fundamentally different from saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Prosecute the President.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is also fundamentally different from saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Wait until the president leaves office and do nothing in the meantime.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The philosophy is<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Delay punishment when constitutionally necessary\u2014not truth-finding.<\/strong><\/p>\n\n\n\n<h2 id=\"h-stage-one-independent-investigation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stage_One_Independent_Investigation\"><\/span>Stage One: Independent Investigation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A criminal allegation against a president should not automatically trigger extraordinary federal machinery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There must first be a meaningful evidentiary threshold.<\/p>\n\n\n\n<h3 id=\"h-credible-evidence-standard\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Credible_Evidence_Standard\"><\/span>Credible Evidence Standard<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">I would call it the:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Credible Evidence Standard<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There should be identifiable evidence providing a reasonable basis to believe:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A specific criminal offense may have occurred;<\/li>\n\n\n\n<li>The President may have participated;<\/li>\n\n\n\n<li>identifiable evidence exists;<\/li>\n\n\n\n<li>The allegation is not merely political disagreement;<\/li>\n\n\n\n<li>Investigation is reasonably necessary.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A complaint alone should not be enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A partisan press conference should not be enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An opposition politician&#8217;s allegation should not be enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The system must distinguish:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>political opposition<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">from<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>evidence of criminal conduct.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is essential if the criminal law is not to become another weapon in America&#8217;s increasingly polarized political system.<\/p>\n\n\n\n<h2 id=\"h-stage-two-preserve-the-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stage_Two_Preserve_the_Evidence\"><\/span>Stage Two: Preserve the Evidence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where I believe the system should depart most clearly from conventional thinking.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question should not immediately be<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Can we put the president on trial?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The first question should be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;Can we ensure that the truth remains discoverable when the Constitution permits the case to be tried?&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Evidence can disappear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Witnesses can die.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Memories deteriorate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Electronic records can be altered or deleted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Foreign evidence can become inaccessible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, where a credible investigation exists, courts should have authority\u2014within constitutional limits\u2014to supervise preservation of relevant evidence.<\/p>\n\n\n\n<h3 id=\"h-evidence-preservation-measures\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Evidence_Preservation_Measures\"><\/span>Evidence Preservation Measures<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">That could include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>preservation orders;<\/li>\n\n\n\n<li>third-party records;<\/li>\n\n\n\n<li>digital forensic preservation;<\/li>\n\n\n\n<li>witness preservation where lawful;<\/li>\n\n\n\n<li>banking records;<\/li>\n\n\n\n<li>communications records;<\/li>\n\n\n\n<li>foreign evidence requests;<\/li>\n\n\n\n<li>chain-of-custody documentation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is not to punish the president.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is to prevent the passage of time from destroying the possibility of justice.<\/p>\n\n\n\n<h2 id=\"h-stage-three-judicial-review\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stage_Three_Judicial_Review\"><\/span>Stage Three: Judicial Review<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A president should not be subjected to extraordinary criminal process merely because a prosecutor demands it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor should a president be able to block every investigation simply by saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">&#8220;I am President.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A neutral federal judge should therefore The State Prosecutor Problem<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most difficult parts of the entire issue.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The president is the head of the national government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What happens if a local or state prosecutor wants to impose extensive criminal proceedings against the president?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If every state could freely impose unlimited criminal processes on a sitting president, presidential duties could potentially be disrupted by dozens of jurisdictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That cannot be the constitutional answer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, <em>Trump v.
