The Problem Is Misallocation of Investigative Capacity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Every citizen has the right to approach the police.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A political worker has that right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A political party has that right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A journalist has that right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An activist has that right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An ordinary citizen has exactly the same right.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If information discloses a cognisable offence, the law cannot be selectively applied according to the political identity of the complainant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mistake would therefore be to frame the problem as:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cPolitical FIRs are a nuisance and should be sent somewhere else.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That formulation is both legally dangerous and politically unsustainable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The better question is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cHow should the State protect its limited investigative capacity so that the investigation of grave offences is not unnecessarily disrupted by high-volume, repetitive, politically sensitive or public-order-related litigation?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a completely different question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is also a question that can be answered without discriminating against anybody.<\/p>\n\n\n\n<h2 id=\"h-the-police-investigator-is-a-scarce-public-resource\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Police_Investigator_Is_a_Scarce_Public_Resource\"><\/span>The Police Investigator Is a Scarce Public Resource<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We often discuss police shortages by counting police officers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is another way of looking at the problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consider an investigating officer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His or her time is finite.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are only twenty-four hours in a day.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If that officer spends six hours responding to a political dispute, those six hours cannot simultaneously be spent:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>visiting a crime scene;<\/li>\n\n\n\n<li>examining CCTV footage;<\/li>\n\n\n\n<li>questioning witnesses;<\/li>\n\n\n\n<li>locating an accused;<\/li>\n\n\n\n<li>collecting forensic evidence;<\/li>\n\n\n\n<li>tracing a missing child;<\/li>\n\n\n\n<li>recording a victim&#8217;s statement;<\/li>\n\n\n\n<li>examining call records;<\/li>\n\n\n\n<li>coordinating with forensic experts.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The State, therefore, has an invisible currency:<\/p>\n\n\n\n<h3 id=\"h-investigative-time\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Investigative_Time\"><\/span>Investigative Time.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">India rarely discusses policing in these terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We should.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question should not merely be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">How many FIRs are pending?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It should also be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">How many investigative hours are being consumed, by what category of cases, and at what cost to more serious investigations?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the beginning of intelligent police administration.<\/p>\n\n\n\n<h2 id=\"h-the-supreme-court-had-already-identified-part-of-the-problem\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Court_Had_Already_Identified_Part_of_the_Problem\"><\/span>The Supreme Court Had Already Identified Part of the Problem<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">India does not need to start from zero.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Prakash Singh v. Union of India, the Supreme Court directed, among other reforms, the separation of investigation from law-and-order functions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The logic was straightforward: investigation requires specialisation, continuity and expertise, whereas law-and-order policing has a different operational character.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s concern remains remarkably relevant today.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an investigating officer is constantly pulled away from the investigation for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>political rallies;<\/li>\n\n\n\n<li>demonstrations;<\/li>\n\n\n\n<li>VIP duties;<\/li>\n\n\n\n<li>law-and-order deployment;<\/li>\n\n\n\n<li>miscellaneous administrative work;<\/li>\n\n\n\n<li>politically sensitive disputes,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Then formal separation on paper becomes meaningless.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real question is therefore not merely:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Have we separated investigation from law and order?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Have we protected investigators after separating them?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is where India&#8217;s next police reform should begin.<\/p>\n\n\n\n<h2 id=\"h-why-i-would-reject-a-political-fir-department\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_I_Would_Reject_a_%E2%80%9CPolitical_FIR_Department%E2%80%9D\"><\/span>Why I Would Reject a \u201cPolitical FIR Department\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">At first glance, the proposal sounds attractive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Create a special police department for politically motivated FIRs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Send political complaints there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let the ordinary police concentrate on serious crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The difficulty is obvious.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Who decides what is \u201cpolitical\u201d?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a BJP worker alleges assault by opposition workers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose an opposition worker alleges the same thing against BJP workers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose an RSS worker is attacked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a journalist is threatened by political activists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a political leader is genuinely murdered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a political rally becomes the scene of serious violence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Are these all \u201cpolitical cases\u201d?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And who decides?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The government of the day?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The police?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A minister?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A senior bureaucrat?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A committee?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every answer creates a possibility of manipulation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A government could classify inconvenient cases as \u201cpolitical\u201d and deprioritise them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An opposition government could do precisely the same thing in reverse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would transform police reform into political engineering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would therefore reject the concept of a political FIR department.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not because the underlying problem is imaginary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But because the proposed institutional solution is vulnerable to abuse.<\/p>\n\n\n\n<h2 id=\"h-the-better-idea-protect-the-serious-crime-investigator\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Better_Idea_Protect_the_Serious_Crime_Investigator\"><\/span>The Better Idea: Protect the Serious Crime Investigator<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Instead of creating a police department for political cases, create a system that protects investigators handling grave offences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Call it:<\/p>\n\n\n\n<h3 id=\"h-protected-serious-crime-investigation-system-pscis\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Protected_Serious_Crime_Investigation_System_%E2%80%94_PSCIS\"><\/span>Protected Serious Crime Investigation System \u2014 PSCIS<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The principle should be simple:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Once an investigator is assigned to a grave offence, that investigative capacity should ordinarily be protected from routine diversion.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The system should cover cases such as:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Serious Crime Category<\/th><th>Investigative Priority<\/th><\/tr><\/thead><tbody><tr><td>murder<\/td><td>Highest protection<\/td><\/tr><tr><td>rape<\/td><td>Highest protection<\/td><\/tr><tr><td>gang rape<\/td><td>Highest protection<\/td><\/tr><tr><td>kidnapping<\/td><td>Highest protection<\/td><\/tr><tr><td>trafficking<\/td><td>Highest protection<\/td><\/tr><tr><td>serious offences against children<\/td><td>Highest protection<\/td><\/tr><tr><td>terrorism<\/td><td>Highest protection<\/td><\/tr><tr><td>organised violent crime<\/td><td>Highest protection<\/td><\/tr><tr><td>offences involving an immediate threat to life<\/td><td>Highest protection<\/td><\/tr><tr><td>other offences specifically designated by the State<\/td><td>As designated by the State<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The exact list can be prescribed by the State after examining its crime profile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important point is that the protection attaches to the seriousness of the crime\u2014not to the political identity of the victim, accused or complainant.<\/p>\n\n\n\n<h2 id=\"h-a-murder-does-not-become-less-serious-because-politics-is-involved\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Murder_Does_Not_Become_Less_Serious_Because_Politics_Is_Involved\"><\/span>A Murder Does Not Become Less Serious Because Politics Is Involved<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This principle must be hard-wired into the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that a political worker is murdered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not a \u201cpolitical case\u201d in the sense of reduced investigative priority.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a murder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should receive the highest investigative protection.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a journalist is murdered, it is a murder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an activist is murdered, it is a murder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a police officer is murdered, it is a murder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If an ordinary citizen is murdered, it is a murder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State must investigate all of them according to the same objective principles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The system must protect offences, not identities.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That sentence should become the philosophical foundation of the reform.<\/p>\n\n\n\n<h2 id=\"h-then-what-happens-to-politically-sensitive-complaints\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Then_What_Happens_to_Politically_Sensitive_Complaints\"><\/span>Then What Happens to Politically Sensitive Complaints?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">They do not disappear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They do not lose their legal status.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They do not automatically become &#8220;frivolous&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They remain subject to the ordinary criminal law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the information discloses a cognisable offence, the statutory framework governing FIR registration must be followed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The important change comes after the legal registration decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The matter is then assessed for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>seriousness;<\/li>\n\n\n\n<li>immediate threat;<\/li>\n\n\n\n<li>victim vulnerability;<\/li>\n\n\n\n<li>risk of evidence disappearing;<\/li>\n\n\n\n<li>organised criminal activity;<\/li>\n\n\n\n<li>complexity;<\/li>\n\n\n\n<li>public-order implications;<\/li>\n\n\n\n<li>duplication;<\/li>\n\n\n\n<li>counter-complaints;<\/li>\n\n\n\n<li>investigative workload.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The political identity of the complainant should not be a priority criterion.<\/p>\n\n\n\n<h2 id=\"h-enter-the-district-investigation-management-cell\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Enter_the_District_Investigation_Management_Cell\"><\/span>Enter the District Investigation Management Cell.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I propose a small:<\/p>\n\n\n\n<h3 id=\"h-district-investigation-management-cell-dimc\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">This should not become another giant police bureaucracy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should not become another crime branch.<\/p>\n\n\n\n<p And Related Complaints<\/strong> Detect situations where several complaints arise from substantially the same incident.<\/li>\n\n\n\n<li><strong>Monitor Investigator Workload<\/strong> Identify investigators carrying unreasonable numbers of cases.<\/li>\n\n\n\n<li><strong>Monitor the Diversion<\/strong> Record when investigators are pulled away from serious investigations for other duties.<\/li>\n\n\n\n<li><strong>Escalate Problematic Cases<\/strong> Identify cases suffering from unexplained delay, repeated transfers, conflicts or unusual interference.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">That is enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The smaller the institution, the less opportunity there is for it to become another bureaucratic monster.<\/p>\n\n\n\n<h2 id=\"h-one-incident-should-not-produce-five-parallel-investigations\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">This may be one of the most practical reforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine a political confrontation.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Party A files a complaint.<\/li>\n\n\n\n<li>Party B files a counter-complaint.<\/li>\n\n\n\n<li>Three supporters submit additional complaints.<\/li>\n\n\n\n<li>Another person approaches the police with another version of the same incident.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If every complaint results in completely independent investigative work, police resources can be multiplied unnecessarily.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution is not automatically to merge every FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That could itself create legal problems.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the DIMC should create an:<\/p>\n\n\n\n<h3 id=\"h-incident-cluster\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Incident_Cluster\"><\/span>Incident Cluster<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The individual FIRs retain their legal identity where required.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But investigators can coordinate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>chronology;<\/li>\n\n\n\n<li>witnesses;<\/li>\n\n\n\n<li>CCTV;<\/li>\n\n\n\n<li>forensic evidence;<\/li>\n\n\n\n<li>location data;<\/li>\n\n\n\n<li>medical records;<\/li>\n\n\n\n<li>digital evidence.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In other words:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Cluster the investigation administratively without unlawfully merging the criminal cases.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is a much safer approach.<\/p>\n\n\n\n<h2 id=\"h-the-one-incident-one-evidence-map-principle\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_%E2%80%9COne_Incident_%E2%80%94_One_Evidence_Map%E2%80%9D_Principle\"><\/span>The \u201cOne Incident \u2014 One Evidence Map\u201d Principle<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would go one step further.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where several FIRs arise from substantially the same incident, the police should maintain a common:<\/p>\n\n\n\n<h3 id=\"h-evidence-map\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Evidence_Map\"><\/span>Evidence Map<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">It should identify:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>what happened;<\/li>\n\n\n\n<li>when it happened;<\/li>\n\n\n\n<li>where it happened;<\/li>\n\n\n\n<li>who was present;<\/li>\n\n\n\n<li>what CCTV exists;<\/li>\n\n\n\n<li>which witnesses are common;<\/li>\n\n\n\n<li>what forensic evidence exists;<\/li>\n\n\n\n<li>which allegations overlap;<\/li>\n\n\n\n<li>which allegations are materially different.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Each FIR can then be legally dealt with according to its own facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But police should not repeatedly rediscover the same evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is basic efficiency.<\/p>\n\n\n\n<h2 id=\"h-three-categories-are-enough\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Three_Categories_Are_Enough\"><\/span>Three Categories Are Enough<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The system should not become an academic scoring exercise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would use three simple investigative levels.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table These receive periodic senior review.<\/td><\/tr><tr><td><strong>GREEN<\/strong><\/td><td>Normal Investigation<\/td><td>Ordinary cases proceed through the normal system.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">The classification is not a statement about the guilt or innocence of anyone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a resource-management decision.<\/p>\n\n\n\n<h2 id=\"h-political-sensitivity-must-never-reduce-priority\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">In fact, where political involvement creates a greater threat to life or public order, the case may require greater, not lesser, investigative attention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This prevents the system from becoming a political dumping ground.<\/p>\n\n\n\n<h2 id=\"h-a-serious-crime-investigator-should-not-be-sent-to-every-political-rally\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Serious_Crime_Investigator_Should_Not_Be_Sent_to_Every_Political_Rally\"><\/span>A Serious Crime Investigator Should Not Be Sent to Every Political Rally<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Here lies one of the biggest practical gains.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose Inspector X is investigating a rape.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There is a political demonstration in the district.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are other officers available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Inspector X should not automatically be pulled away because of administrative convenience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If there is a genuine emergency requiring the officer&#8217;s deployment, that should be possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it should require:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>senior authorisation;<\/li>\n\n\n\n<li>written reason;<\/li>\n\n\n\n<li>duration;<\/li>\n\n\n\n<li>alternative investigator arrangement.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This creates what I would call:<\/p>\n\n\n\n<h3 id=\"h-investigation-assignment-lock\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Investigation_Assignment_Lock\"><\/span>Investigation Assignment Lock<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Not an absolute prohibition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A controlled exception.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is practical.<\/p>\n\n\n\n<h2 id=\"h-the-rule-should-be-simple\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Rule_Should_Be_Simple\"><\/span>The Rule Should Be Simple<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If a serious-case investigator is diverted:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The system asks:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Why?<\/li>\n\n\n\n<li>For how long?<\/li>\n\n\n\n<li>Who authorised it?<\/li>\n\n\n\n<li>Who is now investigating the serious case?<\/li>\n\n\n\n<li>What investigative task was delayed?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That creates accountability without preventing legitimate emergency deployment.<\/p>\n\n\n\n<h2 id=\"h-we-do-not-need-artificial-investigation-hour-budgets\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"We_Do_Not_Need_Artificial_%E2%80%9CInvestigation_Hour_Budgets%E2%80%9D\"><\/span>We Do Not Need Artificial \u201cInvestigation Hour Budgets\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would reject another tempting idea.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It sounds attractive to say:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Offence<\/th><th>Illustrative Investigation hours<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">But policing is not factory production.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some murders are straightforward.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some are extraordinarily complex.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some apparently minor cases become serious conspiracies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the State should not impose rigid investigative-hour quotas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, for the pilot, simply record:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How many investigator-hours are actually being consumed?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After six months, the State will have real data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is far better than guessing.<\/p>\n\n\n\n<h2 id=\"h-the-invisible-measure-india-needs-investigative-capacity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Invisible_Measure_India_Needs_Investigative_Capacity\"><\/span>The Invisible Measure India Needs: Investigative Capacity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine two districts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both have:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>100 investigators.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">District A has investigators spending 80% of their time on actual investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">District B has investigators spending 40% of their time investigating and the remaining 60% on miscellaneous duties.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Official manpower statistics might say both districts have:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>100 investigators.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Operationally, they are not equivalent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why I propose measuring:<\/p>\n\n\n\n<h3 id=\"h-protected-investigative-capacity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Protected_Investigative_Capacity\"><\/span>Protected Investigative Capacity<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">How much of the available investigative workforce is actually available for investigation?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That number should be reported every month.<\/p>\n\n\n\n<h2 id=\"h-the-district-police-dashboard\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_District_Police_Dashboard\"><\/span>The District Police Dashboard<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Every DGP, Commissioner and SP should eventually be able to see:<\/p>\n\n\n\n<h3 id=\"h-serious-crime\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Serious_Crime\"><\/span>Serious Crime<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>murders pending;<\/li>\n\n\n\n<li>rape investigations pending;<\/li>\n\n\n\n<li>kidnapping cases pending;<\/li>\n\n\n\n<li>child-protection cases pending;<\/li>\n\n\n\n<li>Organised crime investigations pending.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-investigation-capacity\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Investigation_Capacity\"><\/span>Investigation Capacity<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>investigators available;<\/li>\n\n\n\n<li>investigators protected;<\/li>\n\n\n\n<li>investigators diverted;<\/li>\n\n\n\n<li>average cases per investigator.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-political-public-order-work\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"PoliticalPublic-Order_Work\"><\/span>Political\/Public-Order Work<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>number of related complaints;<\/li>\n\n\n\n<li>counter-complaint clusters;<\/li>\n\n\n\n<li>repeated complaints;<\/li>\n\n\n\n<li>investigator-hours consumed.<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-quality\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Quality\"><\/span>Quality<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>investigation delays;<\/li>\n\n\n\n<li>forensic delays;<\/li>\n\n\n\n<li>charge-sheet timelines;<\/li>\n\n\n\n<li>cases returned for defective investigation;<\/li>\n\n\n\n<li>court-related investigation deficiencies.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The police leadership would then know not simply:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How many cases exist?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">but:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>where its investigative capacity is actually going.<\/strong><\/p>\n\n\n\n<h2 id=\"h-this-reform-should-be-politically-neutral-by-design\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"This_Reform_Should_Be_Politically_Neutral_by_Design\"><\/span>This Reform Should Be Politically Neutral by Design<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most important feature.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The police system should not create categories such as:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>BJP Case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Congress Case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>RSS Case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Bajrang Dal Case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Left Case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Activist Case.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Journalist Case.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Those labels are invitations to bias.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the system should use neutral descriptors:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>election-related;<\/li>\n\n\n\n<li>public-order related;<\/li>\n\n\n\n<li>multiple counter-complaints;<\/li>\n\n\n\n<li>mass gathering;<\/li>\n\n\n\n<li>organised group involvement;<\/li>\n\n\n\n<li>repeat complaint;<\/li>\n\n\n\n<li>related proceeding;<\/li>\n\n\n\n<li>high public sensitivity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And even these classifications should not determine guilt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are simply <strong>management flags.<\/strong><\/p>\n\n\n\n<h2 id=\"h-a-constitutional-firewall\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Constitutional_Firewall\"><\/span>A Constitutional Firewall<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The government notification creating the system should contain an explicit safeguard:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>No complaint shall be classified, delayed, downgraded or otherwise treated differently merely because of the political affiliation, ideological association, profession, public profile or identity of the complainant or accused.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And another:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>No classification under the investigative management system shall extinguish, suspend or dilute any statutory right or obligation relating to registration, investigation, victim protection, arrest, prosecution or judicial remedy.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">These provisions would make the reform considerably harder to weaponise.<\/p>\n\n\n\n<h2 id=\"h-what-about-false-and-malicious-complaints\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_About_False_and_Malicious_Complaints\"><\/span>What About False and Malicious Complaints?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This problem should also be handled neutrally.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not every failed case is a false case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not every acquittal proves malicious prosecution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A complainant may genuinely believe something happened, and yet the prosecution may ultimately fail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The criminal law already recognises consequences for making false charges with intent to injure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is therefore not to frighten people away from approaching the police.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is to identify <strong>deliberate and demonstrably malicious misuse<\/strong> through ordinary legal processes.<\/p>\n\n\n\n<h2 id=\"h-technology-should-come-later\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Technology_Should_Come_Later\"><\/span>Technology Should Come Later<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Another mistake would be to begin this reform with an expensive AI project.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first pilot can use existing systems.<\/p>\n\n\n\n<p class=\"wp-block-list\">\n<li>identify duplicate complaints;<\/li>\n\n\n\n<li>detect common names;<\/li>\n\n\n\n<li>identify related incidents;<\/li>\n\n\n\n<li>map cases;<\/li>\n\n\n\n<li>track investigator workload;<\/li>\n\n\n\n<li>identify unusual transfers;<\/li>\n\n\n\n<li>generate supervisory alerts.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">AI should never investigator handling a serious case is transferred, the system should record:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>who authorised the transfer;<\/li>\n\n\n\n<li>why;<\/li>\n\n\n\n<li>stage of investigation;<\/li>\n\n\n\n<li>pending investigative tasks;<\/li>\n\n\n\n<li>identity of replacement officer.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This does not prohibit objective is therefore not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>to keep politics out of the police station.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is impossible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The objective is:<\/p>\n\n\n\n<blockquote class=\"wp-block-paragraph\">The answer is not to tell an ordinary citizen that a politically sensitive matter will not be investigated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the answer certainly is not to create a new political police department whose composition and priorities can change with every government.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is more principled.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Register lawfully.<\/li>\n\n\n\n<li>Investigate fairly.<\/li>\n\n\n\n<li>Prioritise objectively.<\/li>\n\n\n\n<li>Protect serious investigations.<\/li>\n\n\n\n<li>Consolidate investigative effort where facts overlap.<\/li>\n\n\n\n<li>Record every diversion.<\/li>\n\n\n\n<li>Measure the workload.<\/li>\n\n\n\n<li>Audit the system.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A murder investigation should not wait because an investigator has been pulled into a political dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A rape investigation should not lose valuable time because the investigating officer has been deployed for a political demonstration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A missing child should not compete for investigative attention with a chain of repetitive counter-complaints.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And at the same time, a genuine offence committed by or against a political worker must receive exactly the same protection as an offence committed against anyone else.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not anti-politics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is pro-justice.<\/p>\n\n\n\n<h3 id=\"h-the-ultimate-test-of-police-reform\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Ultimate_Test_of_Police_Reform\"><\/span>The Ultimate Test of Police Reform<span
