Separate women\u2019s prisons can reduce these risks and provide a safer environment. Although women are sometimes housed in separate enclosures within male prison complexes for administrative convenience, independent women\u2019s prisons are generally better suited to meet their specific needs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dedicated facilities can provide better healthcare, education, counselling, childcare, vocational training, and social support. A gender-sensitive prison system can therefore promote dignity, rehabilitation, and successful reintegration into society.<\/p>\n\n\n\n<h2 id=\"h-evolution-of-women-s-prisons\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Evolution_of_Womens_Prisons\"><\/span>Evolution of Women\u2019s Prisons<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Historically, women offenders were often housed with men or managed informally within communities. Reformers such as Elizabeth Fry and Dorothea Dix in the nineteenth century advocated for humane treatment and separate facilities for women prisoners, laying the foundation for modern correctional approaches.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The development of women\u2019s prisons can broadly be traced across three stages:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Period<\/th><th>Development<\/th><\/tr><\/thead><tbody><tr><td>19th Century<\/td><td>Establishment of separate facilities for women.<\/td><\/tr><tr><td>Mid-20th Century<\/td><td>Rise of punitive systems and overcrowding.<\/td><\/tr><tr><td>21st Century<\/td><td>Shift toward gender-responsive and trauma-informed care.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In recent years, correctional policies have begun to recognise the special needs of women prisoners, focusing on trauma-informed care, mental health counselling, education, vocational training, family support, and non-custodial alternatives for non-violent offences.<\/p>\n\n\n\n<h2 id=\"h-occupancy-patterns-women-s-prisons-vs-general-prisons\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Occupancy_Patterns_Womens_Prisons_vs_General_Prisons\"><\/span>Occupancy Patterns: Women\u2019s Prisons vs. General Prisons<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">National data highlights a persistent structural imbalance. Such arrangements often fail to deliver adequate gender-responsive spaces, specialised healthcare, or trauma-informed care.<\/p>\n\n\n\n<h2 id=\"h-national-landscape-and-infrastructure\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"National_Landscape_and_Infrastructure\"><\/span>National Landscape and Infrastructure<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As of 31 December 2023, standalone women\u2019s prisons operated in only 16 states and union territories (35 women\u2019s jails in total). Key requirements include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Birth registration that does not mention the prison as the place of birth.<\/li>\n\n\n\n<li>Early childhood education through functional cr\u00e8ches and nursery schools.<\/li>\n\n\n\n<li>Health, nutrition, immunisation, clothing, and paediatric care.<\/li>\n\n\n\n<li>Structured transition planning by Child Welfare Committees when the child reaches six years of age. The forced separation of children from their mothers after the age of six is often deeply traumatic for both the mother and the child.<\/li>\n\n\n\n<li>Regular family contact and bonding opportunities.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The best interests of the child must remain the paramount consideration.<\/p>\n\n\n\n<h2 id=\"h-risks-of-housing-women-in-male-prison-complexes\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Risks_of_Housing_Women_in_Male_Prison_Complexes\"><\/span>Risks of Housing Women in Male Prison Complexes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Housing women in separate enclosures within male prison complexes creates several practical and safety concerns:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Greater risk of harassment, intimidation, or gender-based violence.<\/li>\n\n\n\n<li>Inadequate healthcare facilities for gynaecological treatment, prenatal and postnatal care, menstrual hygiene, and access to female medical professionals.<\/li>\n\n\n\n<li>Limited or uncomfortable participation in counselling, trauma recovery, addiction treatment, or rehabilitation programmes in a predominantly male environment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These concerns highlight the importance of properly designed independent facilities for women.<\/p>\n\n\n\n<h2 id=\"h-national-distribution-of-women-s-prisons\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"National_Distribution_of_Womens_Prisons\"><\/span>National Distribution of Women\u2019s Prisons<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">As of 31 December 2023, only 16 states\/UTs operated independent women\u2019s prisons (35 facilities). The remaining states and union territories rely on separate women\u2019s enclosures within general or central jails.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The limited number of dedicated facilities means the vast majority of Indian districts still lack independent women\u2019s correctional institutions.<\/p>\n\n\n\n<h2 id=\"h-financial-resource-allocation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Financial_Resource_Allocation\"><\/span>Financial Resource Allocation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For Financial Year 2023\u201324, the total budget estimate for Indian prisons was approximately \u20b910,035.6 crore. Actual expenditure was \u20b98,834.6 crore (utilisation rate of about 88%).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Direct expenditure on inmates totalled \u20b92,669.88 crore (approximately 30% of total prison expenditure). Their physical, psychological, social, and family-related needs often differ from those of male prisoners, and general prison infrastructure frequently fails to address these needs adequately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India must move toward a more gender-responsive prison system. This requires better independent women\u2019s prison infrastructure, improved healthcare and hygiene, mental health support, effective legal aid, childcare facilities, education, vocational training, and stronger rehabilitation programmes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The goal of incarceration should not be limited to confinement. A modern correctional system must protect dignity, ensure safety, address individual needs, and prepare prisoners for a meaningful return to society.
