It must be governed by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So I want to approach the Santosh Pandit case differently.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I am not interested in deciding whether Santosh Pandit is a hero, a troublemaker, an activist, an influencer or a man who sometimes crosses the line.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those are questions for public opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My question as a lawyer is much narrower\u2014and much more important:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If I were representing Santosh Pandit before the court, how would I defend him?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">My answer is simple:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would not defend every word he may have spoken. The Kothrud FIR reportedly invokes Sections 75(1)(iv), 75(3), 356(2) and 352 of the Bharatiya Nyaya Sanhita, along with Section 67 of the Information Technology Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A separate case had already been registered at Deccan Gymkhana Police Station concerning alleged remarks against Chandrakant Patil. That case reportedly invokes Sections 356, 296 and 3(5) BNS. Importantly, police had reportedly earlier served Pandit a notice asking him to cooperate with that investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Kothrud case is therefore not occurring in isolation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That chronology matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But chronology is not proof of guilt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And political controversy is not proof of police misconduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both sides must ultimately be tested against evidence.<\/p>\n\n\n\n<h2 id=\"h-my-first-principle-separate-offensive-from-criminal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_First_Principle_Separate_%E2%80%9COffensive%E2%80%9D_From_%E2%80%9CCriminal%E2%80%9D\"><\/span>My First Principle: Separate \u201cOffensive\u201d From \u201cCriminal\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If I appeared for Santosh Pandit, I would not begin by saying:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cHe is an activist.\u201d<\/li>\n\n\n\n<li>\u201cHe was criticising the government.\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And I would certainly not begin by alleging political vendetta unless evidence supported it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would begin much more quietly:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMy Lords, please separate what is offensive from what is criminal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the heart of the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A statement may be rude.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may be crude.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may be insulting.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may be politically provocative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may even be deeply unpleasant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the criminal law does not punish every unpleasant expression.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution must take the next legal step.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It must establish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What exactly was said?<\/li>\n\n\n\n<li>Who was it directed at?<\/li>\n\n\n\n<li>In what context?<\/li>\n\n\n\n<li>What did it mean?<\/li>\n\n\n\n<li>Which statutory provision is attracted?<\/li>\n\n\n\n<li>What ingredient of that provision is satisfied?<\/li>\n\n\n\n<li>What evidence proves that ingredient?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And, separately:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Why was arrest necessary?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those are the questions I would put at the centre of the defence.<\/p>\n\n\n\n<h2 id=\"h-i-would-not-make-the-mistake-of-saying-the-midnight-arrest-was-automatically-illegal\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"I_Would_Not_Make_the_Mistake_of_Saying_the_Midnight_Arrest_Was_Automatically_Illegal\"><\/span>I Would Not Make the Mistake of Saying the Midnight Arrest Was Automatically Illegal<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An arrest at 1 a.m. is visually disturbing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may raise legitimate questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the hour of arrest, by itself, does not establish illegality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor would I tell the court that failure to issue a Section 35(3) BNSS notice automatically makes every subsequent arrest void.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would be an overstatement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law is more nuanced\u2014and the nuance actually gives the defence a stronger argument.<\/p>\n\n\n\n<h2 id=\"h-the-2026-supreme-court-judgement-that-changes-the-arrest-argument\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_2026_Supreme_Court_Judgement_That_Changes_the_Arrest_Argument\"><\/span>The 2026 Supreme Court Judgement That Changes the Arrest Argument<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s January 2026 decision in Satender Kumar Antil v. Central Bureau of Investigation, 2026 INSC 115, is now one of the most important authorities for this case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court clarified the relationship between Section 35(1)(b) and Section 35(3) BNSS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For offences punishable with imprisonment up to seven years:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Notice under Section 35(3) is the rule; arrest is the exception.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that the police must first ask themselves whether arrest is actually necessary. Arrest cannot become a matter of routine or investigative convenience. The Court further held that the statutory conditions under Section 35(1)(b) must exist and that arrest must be based upon objective necessity, not merely the subjective preference of the investigating officer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is extraordinarily relevant here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reported Kothrud offences carry maximum punishments below seven years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So I would ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Where is the objective necessity for arrest?<\/li>\n<\/ul>\n\n\n\n<h3 id=\"h-notice-is-the-rule-arrest-is-the-exception\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Notice_Is_the_Rule_Arrest_Is_the_Exception\"><\/span>Notice Is the Rule. Arrest Is the Exception.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has now put considerable emphasis on this principle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The police can arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the existence of the power to arrest is not the same thing as the justification for exercising it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is fundamental.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court in Satender Kumar Antil explained that investigation can continue without arrest and that arrest is an investigative tool\u2014not an inevitable consequence of registration of an FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would not ask the prosecution merely:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhy did you arrest him?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would ask something much more precise:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Why was arrest necessary?<\/li>\n\n\n\n<li>What evidence existed before the arrest?<\/li>\n\n\n\n<li>What statutory condition under Section 35(1)(b) was satisfied?<\/li>\n\n\n\n<li>Why was a notice insufficient?<\/li>\n\n\n\n<li>Was there a genuine risk of absconding?<\/li>\n\n\n\n<li>Was there a genuine risk of evidence destruction?<\/li>\n\n\n\n<li>Was there a genuine risk of influencing witnesses?<\/li>\n\n\n\n<li>Was there a genuine risk of repetition?<\/li>\n\n\n\n<li>What investigative task could not have been performed without custody?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those questions are far more powerful than a political allegation.<\/p>\n\n\n\n<h2 id=\"h-the-digital-evidence-paradox\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Digital_Evidence_Paradox\"><\/span>The Digital Evidence Paradox<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is an interesting paradox in this case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution&#8217;s case is substantially based upon digital material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The alleged offences arise from videos uploaded to social media.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The police themselves are reportedly examining the videos, their circulation and their reach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But digital evidence has one unusual characteristic:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can often be preserved without imprisoning the person who allegedly created it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution can potentially:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>preserve URLs;<\/li>\n\n\n\n<li>download the videos;<\/li>\n\n\n\n<li>create forensic images;<\/li>\n\n\n\n<li>calculate hash values;<\/li>\n\n\n\n<li>obtain platform records;<\/li>\n\n\n\n<li>examine metadata;<\/li>\n\n\n\n<li>seize devices through lawful process;<\/li>\n\n\n\n<li>seek relevant account information;<\/li>\n\n\n\n<li>Obtain electronic records through legally recognised procedures.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would ask:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">What exactly requires Santosh Pandit&#8217;s physical custody?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not the same as saying custody can never be necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the police can demonstrate a genuine custodial investigative requirement, the court can consider it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the answer must be specific.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cInvestigation is pending\u201d is not an explanation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCustodial interrogation is required\u201d is a conclusion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence should demand the reason behind the conclusion.<\/p>\n\n\n\n<h2 id=\"h-and-there-is-a-particularly-interesting-chronology\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"And_There_Is_a_Particularly_Interesting_Chronology\"><\/span>And There Is a Particularly Interesting Chronology<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In the Deccan Gymkhana case, police reportedly served Pandit a notice to cooperate with the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then, in the later Kothrud case, he was reportedly taken from his residence around 1 a.m.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would not say:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cTherefore the second arrest was illegal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That does not follow automatically.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead I would ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What materially changed between the two cases?<\/li>\n\n\n\n<li>Did the evidence change?<\/li>\n\n\n\n<li>Did the alleged offence change?<\/li>\n\n\n\n<li>Did the accused&#8217;s conduct change?<\/li>\n\n\n\n<li>Did Pandit fail to cooperate?<\/li>\n\n\n\n<li>Was there new evidence suggesting intimidation, destruction of evidence, abscondence or repetition?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If the answer is yes, the State can explain it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the answer is no, the difference in treatment becomes relevant to the question of whether custodial arrest was genuinely necessary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is how a lawyer should use chronology.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not as rhetoric.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As evidence.<\/p>\n\n\n\n<h2 id=\"h-bns-section-75-the-most-serious-substantive-issue\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"BNS_Section_75_The_Most_Serious_Substantive_Issue\"><\/span>BNS Section 75: The Most Serious Substantive Issue<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Kothrud FIR reportedly invokes Section 75(1)(iv) read with Section 75(3) BNS concerning sexually coloured remarks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is serious.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And I would not trivialise it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But precisely because it is serious, I would demand precision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution should identify:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The exact words.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Not a description such as \u201cobscene remarks&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not a newspaper summary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not an allegation that the video was &#8220;lewd&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The actual words.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who was the target?<\/li>\n\n\n\n<li>What was the context?<\/li>\n\n\n\n<li>What did the words mean?<\/li>\n\n\n\n<li>Were they genuinely sexual in character?<\/li>\n\n\n\n<li>Were they directed at the woman corporator?<\/li>\n\n\n\n<li>Were they directed at a male politician?<\/li>\n\n\n\n<li>Were they political satire?<\/li>\n\n\n\n<li>Were they allegations?<\/li>\n\n\n\n<li>Were they merely abusive?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Those distinctions matter.<\/p>\n\n\n\n<h2 id=\"h-i-would-not-deny-an-uncomfortable-fact-if-the-video-shows-it\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"I_Would_Not_Deny_an_Uncomfortable_Fact_If_the_Video_Shows_It\"><\/span>I Would Not Deny an Uncomfortable Fact If the Video Shows It<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where responsible advocacy differs from propaganda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the original video clearly shows Santosh Pandit making an unmistakably sexualised and humiliating statement about a woman, I would not stand before the court and pretend that it was merely \u201cpolitical criticism&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That would destroy the credibility of the defence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would instead focus upon:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the precise statutory ingredients;<\/li>\n\n\n\n<li>attribution;<\/li>\n\n\n\n<li>context;<\/li>\n\n\n\n<li>intention;<\/li>\n\n\n\n<li>evidence;<\/li>\n\n\n\n<li>proportionality;<\/li>\n\n\n\n<li>arrest necessity;<\/li>\n\n\n\n<li>bail.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A lawyer&#8217;s duty is not to deny reality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is to place reality within the correct legal framework.<\/p>\n\n\n\n<h2 id=\"h-it-act-section-67-obscenity-has-a-legal-test\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"IT_Act_Section_67_Obscenity_Has_a_Legal_Test\"><\/span>IT Act Section 67: Obscenity Has a Legal Test<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution also invokes Section 67 of the Information Technology Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This provision concerns electronic publication\/transmission of material that is, among other things, lascivious, appeals to prurient interest, or tends to deprave and corrupt persons likely to see or hear it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt contains bad words\u201d is not the complete legal test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s obscenity jurisprudence is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Aveek Sarkar v. State of West Bengal, the Court adopted a contemporary community-standards approach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Apoorva Arora v. State (NCT of Delhi), the Supreme Court reaffirmed that vulgarity or profanity cannot simply be equated with obscenity and that context matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The communication must be assessed as a whole rather than through isolated words or sentences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would insist upon placing the complete video before the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not a clipped 20-second excerpt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not a screenshot.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Not an allegation in the FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The whole communication.<\/p>\n\n\n\n<h3 id=\"h-context-is-not-a-technicality-context-is-evidence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Context_Is_Not_a_Technicality_Context_Is_Evidence\"><\/span>Context Is Not a Technicality. Context Is Evidence.<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose a video contains the sentence:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis minister has behaved disgracefully.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is obviously different from:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis minister stole \u20b950 crore.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And both are different from a sexually explicit personal remark.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And all three are different again from a direct threat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet social media disputes frequently collapse all of these into one word:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cObjectionable.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The criminal law cannot operate at that level of vagueness.<\/p>\n\n\n\n<h2 id=\"h-my-digital-speech-forensic-matrix\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_Digital_Speech_Forensic_Matrix\"><\/span>My Digital Speech Forensic Matrix<span not a new legal doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a new method of organising the defence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And sometimes good litigation is not about inventing new law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is about organising existing law so clearly that the real issue becomes impossible to avoid.<\/p>\n\n\n\n<h2 id=\"h-bns-section-352-an-insult-is-not-automatically-section-352\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">Therefore, the prosecution must establish more than:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe abused someone.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s jurisprudence under the predecessor provision has emphasised that mere abuse does not automatically satisfy the offence; the statutory ingredients involving provocation and the likelihood of breach of peace must be established.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So I would ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who was provoked?<\/li>\n\n\n\n<li>How was the provocation caused?<\/li>\n\n\n\n<li>What breach of peace occurred or was likely?<\/li>\n\n\n\n<li>What evidence establishes the necessary intention or knowledge?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A democracy inevitably contains angry speech.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If every insult became Section 352, the criminal justice system would become an enormous complaints department for hurt feelings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That cannot be the legal standard.<\/p>\n\n\n\n<h2 id=\"h-criminal-defamation-requires-a-different-analysis\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Criminal_Defamation_Requires_a_Different_Analysis\"><\/span>Criminal Defamation Requires a Different Analysis<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Now we come to BNS Section 356.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is where I would be particularly careful.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Criminal defamation contains statutory exceptions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Among them are protections concerning truth where publication is for public good and good-faith opinion concerning the conduct of a public servant in discharge of public functions or matters of public concern.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is highly relevant when the subject matter involves:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>roads;<\/li>\n\n\n\n<li>potholes;<\/li>\n\n\n\n<li>civic infrastructure;<\/li>\n\n\n\n<li>public projects;<\/li>\n\n\n\n<li>elected representatives;<\/li>\n\n\n\n<li>public administration;<\/li>\n\n\n\n<li>government performance.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important qualification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Truth is not an automatic magic word.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory exception concerning truth contains the additional public-good requirement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And an allegation of fact is different from an opinion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe administration has failed the people.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">is essentially evaluative.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whereas:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe minister stole \u20b950 crore.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">is a specific factual allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence should never confuse the two.<\/p>\n\n\n\n<h2 id=\"h-the-person-aggrieved-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_%E2%80%9CPerson_Aggrieved%E2%80%9D_Question\"><\/span>The \u201cPerson Aggrieved\u201d Question<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another issue that deserves examination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reports identify Sarika Kamble as the complainant in the Kothrud matter, while the alleged targets include Chandrakant Patil and a woman corporator.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BNSS Section 222 contains a specific restriction concerning cognisance of criminal defamation and refers to a complaint by a person aggrieved.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would therefore examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who is allegedly defamed?<\/li>\n\n\n\n<li>Who filed the complaint?<\/li>\n\n\n\n<li>What personal legal interest does the complainant assert?<\/li>\n\n\n\n<li>Is the complainant the person allegedly defamed?<\/li>\n\n\n\n<li>If not, what is the statutory basis for treating her as a person aggrieved?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But again, I would not make the reckless argument that this automatically destroys the FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Why?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the FIR also contains cognisable allegations, and BNSS Section 174 contains provisions dealing with cases involving multiple offences where at least one is cognisable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore the stronger argument is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The presence of a cognisable offence in the FIR does not erase the separate statutory requirements governing criminal defamation and eventual cognisance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is critical.<\/p>\n\n\n\n<h2 id=\"h-the-special-procedure-where-a-minister-is-allegedly-defamed\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Special_Procedure_Where_a_Minister_Is_Allegedly_Defamed\"><\/span>The Special Procedure Where a Minister Is Allegedly Defamed<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BNSS Section 222 also contains a special mechanism in cases involving alleged defamation of a minister or certain public servants concerning conduct in discharge of public functions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That raises another set of questions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Was the alleged imputation about the minister personally or about his official conduct?<\/li>\n\n\n\n<li>Who initiated the complaint?<\/li>\n\n\n\n<li>At what stage is cognisance being sought?<\/li>\n\n\n\n<li>Has the special statutory procedure been followed?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This may become particularly significant at the cognisance stage.<\/p>\n\n\n\n<h2 id=\"h-an-important-safeguard-many-people-overlook-section-223-bnss\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"An_Important_Safeguard_Many_People_Overlook_Section_223_BNSS\"><\/span>An Important Safeguard Many People Overlook: Section 223 BNSS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another procedural safeguard which deserves attention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The BNSS now contains a significant provision concerning the hearing of an accused before a magistrate takes cognisance upon a complaint.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in 2026 INSC 519 has held that the first proviso to Section 223(1) BNSS\u2014which gives an accused an opportunity of being heard before cognisance\u2014is substantive in nature and forms part of the accused&#8217;s fair-trial rights under Article 21. The Court held that cognisance taken without compliance with that mandatory safeguard is void ab initio.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean Section 223 automatically applies to the present FIR investigation in the same way.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if any portion of the matter proceeds through a complaint route requiring judicial cognisance, this safeguard must be carefully examined.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why an experienced defence lawyer should think not only about today&#8217;s arrest but also about tomorrow&#8217;s cognisance proceedings.<\/p>\n\n\n\n<h2 id=\"h-the-deccan-gymkhana-fir-needs-its-own-defence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Deccan_Gymkhana_FIR_Needs_Its_Own_Defence\"><\/span>The Deccan Gymkhana FIR Needs Its Own Defence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The second FIR reportedly invokes Sections 356, 296 and 3(5) BNS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would not merge this case with the Kothrud case merely because the political subject matter overlaps.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evidence must be separated.<\/p>\n\n\n\n<h3 id=\"h-section-296-public-place-matters\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_296_Public_Place_Matters\"><\/span>Section 296: Public Place Matters<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 296 concerns obscene acts or obscene words\/songs in or near a public place to the annoyance of others.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reports say the video in the Deccan matter was shot near SNDT College on Karve Road.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A video being shot in a public location does not automatically establish every ingredient of Section 296.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution must establish the actual statutory elements.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What exactly happened?<\/li>\n\n\n\n<li>Where?<\/li>\n\n\n\n<li>Who was present?<\/li>\n\n\n\n<li>What exactly was said?<\/li>\n\n\n\n<li>Was it an act or utterance covered by the provision?<\/li>\n\n\n\n<li>Who was annoyed?<\/li>\n\n\n\n<li>How is that proved?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Again, the adjective \u201cobscene\u201d cannot substitute for the statutory test.<\/p>\n\n\n\n<h3 id=\"h-section-3-5-common-intention-is-not-guilt-by-association\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Section_35_Common_Intention_Is_Not_Guilt_by_Association\"><\/span>Section 3(5): Common Intention Is Not Guilt by Association<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If Pandit is prosecuted along with another person, Section 3(5) must not become a shortcut.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution must establish the substantive offence first and then establish the common intention necessary to attribute the act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence should ask:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What did Santosh Pandit personally do?<\/li>\n\n\n\n<li>What did the other accused personally do?<\/li>\n\n\n\n<li>What evidence establishes their common intention?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A person cannot be criminally liable merely because he knows another person or appears in the same video.<\/p>\n\n\n\n<h2 id=\"h-the-digital-evidence-question-will-become-increasingly-important\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Digital_Evidence_Question_Will_Become_Increasingly_Important\"><\/span>The Digital Evidence Question Will Become Increasingly Important<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Modern criminal litigation is increasingly becoming litigation over:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>screenshots;<\/li>\n\n\n\n<li>recordings;<\/li>\n\n\n\n<li>metadata;<\/li>\n\n\n\n<li>account ownership;<\/li>\n\n\n\n<li>editing;<\/li>\n\n\n\n<li>timestamps;<\/li>\n\n\n\n<li>authenticity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Bharatiya Sakshya Adhiniyam contains specific provisions governing electronic records, including Section 63.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recent judicial decisions have stressed that the mere production of an electronic record does not automatically establish its authenticity, integrity and reliability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the defence should preserve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>original videos;<\/li>\n\n\n\n<li>complete versions;<\/li>\n\n\n\n<li>URLs;<\/li>\n\n\n\n<li>upload dates;<\/li>\n\n\n\n<li>timestamps;<\/li>\n\n\n\n<li>screenshots;<\/li>\n\n\n\n<li>captions;<\/li>\n\n\n\n<li>thumbnails;<\/li>\n\n\n\n<li>metadata where available;<\/li>\n\n\n\n<li>original devices;<\/li>\n\n\n\n<li>forensic hash values;<\/li>\n\n\n\n<li>account ownership information.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The defence must be prepared for the possibility of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>selective clipping;<\/li>\n\n\n\n<li>editing;<\/li>\n\n\n\n<li>translation differences;<\/li>\n\n\n\n<li>misleading captions;<\/li>\n\n\n\n<li>context being removed.<\/li>\n<\/ul>\n\n\n\n<h2 id=\"h-did-santosh-actually-publish-the-content\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Did_Santosh_Actually_Publish_the_Content\"><\/span>Did Santosh Actually Publish the Content?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is another question that should not be assumed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the prosecution says:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe video was uploaded on account X.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then the prosecution must ultimately establish the connection between the accused and that account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That may be easy if Pandit admits ownership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But if disputed, the defence should examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>account control;<\/li>\n\n\n\n<li>device evidence;<\/li>\n\n\n\n<li>platform records;<\/li>\n\n\n\n<li>login information;<\/li>\n\n\n\n<li>admissions;<\/li>\n\n\n\n<li>forensic evidence;<\/li>\n\n\n\n<li>upload history.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The defence should never allow authorship to become an assumption merely because a social media account carries a particular name.<\/p>\n\n\n\n<h2 id=\"h-millions-of-views-do-not-prove-guilt\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Millions_of_Views_Do_Not_Prove_Guilt\"><\/span>Millions of Views Do Not Prove Guilt<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The complaint reportedly refers to very high view counts\u2014approximately 4.53 lakh views for one video and more than 12.16 lakh for another.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those figures may establish reach.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They do not establish:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>obscenity;<\/li>\n\n\n\n<li>sexual harassment;<\/li>\n\n\n\n<li>defamation;<\/li>\n\n\n\n<li>intention;<\/li>\n\n\n\n<li>provocation;<\/li>\n\n\n\n<li>guilt.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Virality is not a statutory ingredient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indeed, there is a strange lesson here:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact that a video was seen by millions does not make it more criminal; it makes accurate legal characterisation more important.<\/p>\n\n\n\n<h2 id=\"h-the-grounds-of-arrest-are-crucial\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Grounds_of_Arrest_Are_Crucial\"><\/span>The Grounds of Arrest Are Crucial<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would obtain the written grounds of arrest immediately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">BNSS Section 47 requires the arrested person to be informed of the particulars of the offence or the grounds for arrest, subject to the statutory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly emphasised that meaningful communication of the grounds of arrest is a constitutional safeguard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The distinction is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A document saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cArrest is required for investigation.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">is not necessarily the same thing as explaining:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Why this particular accused had to be arrested.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction can determine whether the accused had a meaningful opportunity to challenge custody.<\/p>\n\n\n\n<p necessity<\/li>\n\n\n\n<li>Remand application<\/li>\n\n\n\n<li>Magistrate&#8217;s remand order<\/li>\n\n\n\n<li>Device seizure memo<\/li>\n\n\n\n<li>Forensic examination request<\/li>\n\n\n\n<li>Medical examination report<\/li>\n\n\n\n<li>Record of intimation to family\/friend<\/li>\n\n\n\n<li>Complete original videos<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Only after examining these documents would I call the arrest legally defective.<\/p>\n\n\n\n<h2 id=\"h-the-remand-order-deserves-independent-scrutiny\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Remand_Order_Deserves_Independent_Scrutiny\"><\/span>The Remand Order Deserves Independent Scrutiny<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The arrest and remand are not the same thing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even if the original arrest survives challenge, continued police custody requires judicial consideration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The magistrate should examine:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What remains to be investigated?<\/li>\n\n\n\n<li>Why is police custody necessary?<\/li>\n\n\n\n<li>What recovery is expected?<\/li>\n\n\n\n<li>Why cannot that recovery be achieved through ordinary investigative methods?<\/li>\n\n\n\n<li>Why cannot the accused cooperate while on bail?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A remand order should not become a rubber stamp.<\/p>\n\n\n\n<h2 id=\"h-the-bnss-has-changed-the-police-custody-equation\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_BNSS_Has_Changed_the_Police-Custody_Equation\"><\/span>The BNSS Has Changed the Police-Custody Equation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is another important point that should not be overlooked.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 187 BNSS permits police custody of up to 15 days in the aggregate, but unlike the old CrPC structure, the statute permits that police custody to be taken in parts during the prescribed initial period of detention. For offences falling within the 60-day category, the relevant window is the initial 40 days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court in July 2026 also clarified that BNSS permits police custody in parts within the statutory window, subject to the overall statutory limit.<\/p>\n\n\n\n<h3 id=\"h-why-does-this-matter\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_Does_This_Matter\"><\/span>Why Does This Matter?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Because the defence must not assume:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cIf we stop police custody today, the police can never ask for it again.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Under the BNSS, the custody architecture is more complicated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if Pandit is released, the bail order should be drafted intelligently, and the defence should remain alert to any subsequent attempt to seek further custody.<\/p>\n\n\n\n<h2 id=\"h-the-60-day-default-bail-clock-must-also-be-watched\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_60-Day_Default-Bail_Clock_Must_Also_Be_Watched\"><\/span>The 60-Day Default-Bail Clock Must Also Be Watched<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For offences falling within the \u201cother offences\u201d category, Section 187(3) provides a 60-day outer period for completion of investigation before the statutory default-bail mechanism arises, subject to the conditions of the provision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is not an immediate argument, because Pandit has only recently been arrested.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But an experienced defence team should diarise it from day one.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Criminal defence is partly about winning today&#8217;s hearing and partly about not missing tomorrow&#8217;s statutory right.<\/p>\n\n\n\n<h2 id=\"h-bail-i-would-make-it-a-necessity-and-liberty-application\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bail_I_Would_Make_It_a_Necessity-and-Liberty_Application\"><\/span>Bail: I Would Make It a Necessity-and-Liberty Application<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMy client is innocent.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">At the bail stage, that is rarely enough.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would build it around:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The alleged evidence is predominantly electronic.<\/li>\n\n\n\n<li>The principal videos can be preserved independently.<\/li>\n\n\n\n<li>The accused is willing to cooperate.<\/li>\n\n\n\n<li>There is no demonstrated necessity for continued custodial interrogation.<\/li>\n\n\n\n<li>The offences carry relatively limited maximum punishments.<\/li>\n\n\n\n<li>Any legitimate concern can be addressed through conditions.<\/li>\n\n\n\n<li>The arrest must independently satisfy Section 35 BNSS.<\/li>\n\n\n\n<li>Personal liberty under Article 21 cannot become collateral damage to investigative convenience.<\/li>\n<\/ol>\n\n\n\n<h2 id=\"h-i-would-offer-strict-bail-conditions\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"I_Would_Offer_Strict_Bail_Conditions\"><\/span>I Would Offer Strict Bail Conditions<span wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMy client is prepared to cooperate.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And then put it into concrete terms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He can undertake:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to appear before the Investigating Officer when lawfully required;<\/li>\n\n\n\n<li>to preserve relevant digital material;<\/li>\n\n\n\n<li>to produce devices as legally required;<\/li>\n\n\n\n<li>not to contact complainants;<\/li>\n\n\n\n<li>not to intimidate witnesses;<\/li>\n\n\n\n<li>not to interfere with investigation;<\/li>\n\n\n\n<li>to attend court;<\/li>\n\n\n\n<li>to furnish his address;<\/li>\n\n\n\n<li>to comply with reasonable conditions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is strategically important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence is not saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDo not investigate.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is saying:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cInvestigate\u2014but show why incarceration is necessary.\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-the-most-important-advice-i-would-give-santosh-pandit-personally\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Most_Important_Advice_I_Would_Give_Santosh_Pandit_Personally\"><\/span>The Most Important Advice I Would Give Santosh Pandit Personally<span class=\"wp-block-paragraph\"><strong>Stop Talking About the Case on Social Media.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Immediately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not attack:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the complainant;<\/li>\n\n\n\n<li>the police;<\/li>\n\n\n\n<li>the Minister;<\/li>\n\n\n\n<li>witnesses;<\/li>\n\n\n\n<li>the Magistrate;<\/li>\n\n\n\n<li>the investigation.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Do not repeat disputed allegations as established facts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not upload a video accusing the government of conspiracy unless there is evidence and counsel has advised you.<\/p>\n\n\n\n<h3 id=\"h-why\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why\"><\/span>Why?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Because a single new video can create an entirely new legal problem.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A good lawyer does not merely defend yesterday&#8217;s conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A good lawyer prevents tomorrow&#8217;s evidence from being created against his own client.<\/p>\n\n\n\n<h2 id=\"h-article-19-is-important-but-it-is-not-a-magic-wand\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_19_Is_Important%E2%80%94but_It_Is_Not_a_Magic_Wand\"><\/span>Article 19 Is Important\u2014but It Is Not a Magic Wand<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Freedom of speech under Article 19(1)(a) is central to this case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I would never argue:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cArticle 19 allows him to say anything.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It does not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 19(2) permits constitutionally recognised restrictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Criminal defamation jurisprudence also demonstrates that freedom of speech must coexist with protection of reputation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would make the constitutional argument more carefully:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">The State must identify the precise legal restriction, establish the ingredients of the offence and exercise coercive criminal powers proportionately.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is the constitutional argument worth making.<\/p>\n\n\n\n<h2 id=\"h-the-santosh-pandit-case-is-not-a-referendum-on-whether-he-is-a-good-man\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" is not asked:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is Santosh Pandit a good man?<\/li>\n\n\n\n<li>Is he a responsible influencer?<\/li>\n\n\n\n<li>Does the minister like him?<\/li>\n\n\n\n<li>Does the public like his videos?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court is asked:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Has a legally recognised offence been disclosed and, where necessary, proved?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">And at the arrest stage:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Was taking away his liberty legally justified and objectively necessary?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Those are different questions.<\/p>\n\n\n\n<h2 id=\"h-the-political-vendetta-argument-use-it-carefully\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Political-Vendetta_Argument_Use_It_Carefully\"><\/span>The attempt to suppress dissent and criticism of the government. Those are political allegations, not established judicial findings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a lawyer, I would not make political motive the foundation of the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would collect objective evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>chronology of complaints;<\/li>\n\n\n\n<li>timing of arrest;<\/li>\n\n\n\n<li>previous notices;<\/li>\n\n\n\n<li>inconsistent investigative treatment;<\/li>\n\n\n\n<li>exact reasons recorded for arrest;<\/li>\n\n\n\n<li>sequence of FIRs;<\/li>\n\n\n\n<li>identity of complainants;<\/li>\n\n\n\n<li>statements by public officials;<\/li>\n\n\n\n<li>evidence concerning selective enforcement.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Then I would let the court draw its own conclusions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is far more powerful than shouting \u201cvendetta\u201d.<\/p>\n\n\n\n<h2 id=\"h-the-strongest-defence-is-not-political-it-is-forensic\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Strongest_Defence_Is_Not_Political_It_Is_Forensic\"><\/span>The Strongest Defence Is Not Political. Who is the person aggrieved?<\/td><\/tr><tr><td>\u201cIntentional insult\u201d<\/td><td>Where is the statutory provocation\/breach-of-peace nexus?<\/td><\/tr><tr><td>\u201cCustody necessary\u201d<\/td><td>What investigative act requires custody?<\/td><\/tr><tr><td>\u201cEvidence may be destroyed.&#8221;<\/td><td>Which evidence is actually vulnerable?<\/td><\/tr><tr><td>\u201cHe may repeat it.&#8221;<\/td><td>Can a reasonable bail condition address the concern?<\/td><\/tr><tr><td>\u201cHe has influence.&#8221;<\/td><td>Where is the concrete risk of interference?<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Suddenly the political temperature drops.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court is left with legal questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is where I want the case to be.<\/p>\n\n\n\n<h2 id=\"h-the-four-layer-defence-i-would-use\" class=\"wp-block-heading\"><span test.<\/p>\n\n\n\n<h2 id=\"h-the-context-envelope-technique\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_%E2%80%9CContext_Envelope%E2%80%9D_Technique\"><\/span>The I would call a context envelope.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It prevents a legally significant statement from being judged in a vacuum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Again, this is not a new statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a litigation method.<\/p>\n\n\n\n<h2 Santosh Pandit rather than notice and controlled cooperation?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those three questions go to the heart of the case.<\/p>\n\n\n\n<h2 id=\"h-what-i-would-never-do\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_I_Would_Never_Do\"><\/span>What I Would Never Do<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would never say:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u274c \u201cPoliticians have no right to reputation.\u201d<\/li>\n\n\n\n<li>\u274c \u201cEverything said about a politician is protected speech.\u201d<\/li>\n\n\n\n<li>\u274c \u201cMidnight arrest is automatically illegal.\u201d<\/li>\n\n\n\n<li>\u274c \u201cNo Section 35 notice automatically nullifies the arrest.\u201d<\/li>\n\n\n\n<li>\u274c \u201cTruth automatically defeats defamation.\u201d<\/li>\n\n\n\n<li>\u274c \u201cVulgarity can never constitute obscenity.\u201d<\/li>\n\n\n\n<li>\u274c \u201cA woman complaining does not make Section 75 applicable.\u201d<\/li>\n\n\n\n<li>\u274c \u201cThe entire FIR is void because the defamation complainant may not be the person allegedly defamed.\u201d<\/li>\n\n\n\n<li>\u274c \u201cPrevious FIRs prove nothing whatsoever.\u201d<\/li>\n\n\n\n<li>\u274c \u201cPolitical vendetta is established.\u201d<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These arguments are too broad.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And broad arguments are easy for a prosecution to destroy.<\/p>\n\n\n\n<h2 id=\"h-what-i-would-do-instead\" class=\"wp-block-heading\"><span say:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Show me the exact words.<\/li>\n\n\n\n<li>Show me the exact context.<\/li>\n\n\n\n<li>Show me the exact victim.<\/li>\n\n\n\n<li>Show me the exact statutory ingredient.<\/li>\n\n\n\n<li>Show me the evidence.<\/li>\n\n\n\n<li>Show me the necessity for arrest.<\/li>\n\n\n\n<li>Show me the necessity for custody.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And if the prosecution cannot answer those questions, I would ask the court to protect the accused&#8217;s liberty.<\/p>\n\n\n\n<h2 id=\"h-if-the-fir-itself-does-not-disclose-the-offence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_the_FIR_Itself_Does_Not_Disclose_the_Offence\"><\/span>If the FIR Itself Does appropriate cases where, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>allegations taken at face value do not constitute an offence;<\/li>\n\n\n\n<li>the allegations do not disclose the necessary ingredients;<\/li>\n\n\n\n<li>proceedings are legally barred;<\/li>\n\n\n\n<li>the allegations are inherently improbable;<\/li>\n\n\n\n<li>The proceeding amounts to abuse of process.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But disputed facts ordinarily require evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, I would divide the case into two categories.<\/p>\n\n\n\n<h3 id=\"h-category-a\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Category_A\"><\/span>Category A<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Legal defects visible from the FIR itself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These are suitable for an early quashing challenge.<\/p>\n\n\n\n<h3 id=\"h-category-b\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Category_B\"><\/span>Category B<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Factual disputes requiring examination of evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These may be better suited to trial, discharge or evidentiary proceedings depending upon the stage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction prevents the High Court petition from becoming vulnerable to the argument that the defence is asking the court to conduct a mini-trial.<\/p>\n\n\n\n<h2 id=\"h-my-strategy-for-quashing\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_Strategy_for_Quashing\"><\/span>My Strategy for Quashing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would consider a petition under the High Court&#8217;s inherent jurisdiction under Section 528 BNSS only after examining the actual FIR and evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The strongest possible grounds would be:<\/p>\n\n\n\n<h3 id=\"h-ground-1\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ground_1\"><\/span>Ground 1<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The allegations, even if accepted at face value, do not satisfy the statutory ingredients.<\/p>\n\n\n\n<h3 id=\"h-ground-2\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ground_2\"><\/span>Ground 2<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The particular section is legally inapplicable to the alleged conduct.<\/p>\n\n\n\n<h3 id=\"h-ground-3\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ground_3\"><\/span>Ground 3<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The proceeding is procedurally barred at the relevant stage.<\/p>\n\n\n\n<h3 id=\"h-ground-4\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ground_4\"><\/span>Ground 4<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution is attempting to criminalise conduct that the statute does not criminalise.<\/p>\n\n\n\n<h3 id=\"h-ground-5\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ground_5\"><\/span>Ground 5<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">There is demonstrable abuse of process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I would not file a blanket \u201ceverything is political\u201d petition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not how serious constitutional litigation is won.<\/p>\n\n\n\n<h2 id=\"h-what-about-the-april-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_About_the_April_Case\"><\/span>What About the April Case?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Reports state that Pandit had also been booked in April 2026 over allegations involving a female journalist.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would obtain that FIR.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I would not allow the prosecution to turn:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThere was an earlier FIR.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">into:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cTherefore he is guilty now.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">An FIR is an allegation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A conviction is a judicial finding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are not interchangeable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, I would not conceal the earlier case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the prosecution relies upon it, the defence should be ready with its exact procedural status.<\/p>\n\n\n\n<h2 id=\"h-the-biggest-risk-to-the-defence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Biggest_Risk_to_the_Defence\"><\/span>The Biggest Risk to the Defence<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Let me be completely honest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the original videos contain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>unmistakable sexual humiliation of a woman;<\/li>\n\n\n\n<li>explicit sexualised remarks;<\/li>\n\n\n\n<li>genuinely obscene electronic material satisfying Section 67;<\/li>\n\n\n\n<li>direct criminal threats;<\/li>\n\n\n\n<li>knowingly false factual allegations made with the requisite defamatory intent;<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Then the defence becomes significantly harder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">No experienced lawyer should pretend otherwise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But even then, the legality and necessity of arrest remain separate questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A difficult substantive case does not automatically create a right to unnecessary custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is fundamental.<\/p>\n\n\n\n<h2 id=\"h-the-most-dangerous-mistake-pandit-could-make-now\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Most_Dangerous_Mistake_Pandit_Could_Make_Now\"><\/span>The Most Dangerous Mistake Pandit Could Make Now<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The prosecution&#8217;s best friend could be Santosh Pandit&#8217;s own social media account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If, after arrest, he uploads:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cThe government is scared of me.\u201d<\/li>\n\n\n\n<li>\u201cThe minister has got me arrested because I exposed him.\u201d<\/li>\n\n\n\n<li>attacks a complainant or witness,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The defence may have to deal with fresh allegations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, my advice would be:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let the lawyers speak in court. Let the evidence speak in the case. Let Santosh remain silent about the merits of the pending investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Silence at the right moment is not weakness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a litigation strategy.<\/p>\n\n\n\n<h2 id=\"h-the-larger-question-behind-this-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Larger_Question_Behind_This_Case\"><\/span>The Larger Question Behind This Case<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is a bigger constitutional issue here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s digital public sphere has created a new class of commentator.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are not necessarily journalists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are not necessarily politicians.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are ordinary citizens with cameras and audiences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some perform valuable civic functions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some investigate genuine public grievances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some exaggerate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some sensationalise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Some cross the line.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The State must deal with genuine criminal conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the answer cannot be that every unpleasant political statement becomes a criminal investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor can the answer be that social media popularity creates immunity from criminal law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We need a principled middle ground.<\/p>\n\n\n\n<h2 id=\"h-my-proposed-reform-a-digital-speech-arrest-review\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_Proposed_Reform_A_%E2%80%9CDigital_Speech_Arrest_Review%E2%80%9D\"><\/span>My Proposed Reform: A \u201cDigital Speech Arrest Review\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This case also suggests a practical institutional reform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whenever police propose to arrest someone primarily for online expression in a case involving offences punishable up to seven years, the investigating officer should complete a structured Section 35 review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The officer should record:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Exact offence alleged.<\/li>\n\n\n\n<li>Maximum punishment.<\/li>\n\n\n\n<li>Whether Section 35(3) notice was considered.<\/li>\n\n\n\n<li>If notice was not issued, why.<\/li>\n\n\n\n<li>Which Section 35(1)(b) necessity ground exists.<\/li>\n\n\n\n<li>Evidence supporting that conclusion.<\/li>\n\n\n\n<li>Whether electronic evidence has been preserved.<\/li>\n\n\n\n<li>Whether physical custody is genuinely required.<\/li>\n\n\n\n<li>Risk of witness intimidation.<\/li>\n\n\n\n<li>Risk of evidence destruction.<\/li>\n\n\n\n<li>Risk of repetition.<\/li>\n\n\n\n<li>Risk of abscondence.<\/li>\n\n\n\n<li>Whether reasonable bail conditions can address the risks.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This would not prevent legitimate arrests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It would make unnecessary arrests harder to justify.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that is exactly what the Supreme Court&#8217;s 2026 Satender Kumar Antil judgement is trying to achieve.<\/p>\n\n\n\n<h2 id=\"h-if-i-were-standing-in-court-tomorrow\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"If_I_Were_Standing_in_Court_Tomorrow\"><\/span>If I Were Standing in Court Tomorrow<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would probably class=\"wp-block-paragraph\">\u201cI am asking the court to apply the law.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIdentify the words.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIdentify the target.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIdentify the context.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIdentify the statutory ingredient.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIdentify the evidence.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAnd then, separately, identify the necessity for arrest.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBecause the power to arrest and the necessity to arrest are not the same thing.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That, in my view, is the correct way to defend Santosh Pandit.<\/p>\n\n\n\n<h2 id=\"h-my-final-assessment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_Final_Assessment\"><\/span>My Final Assessment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">After examining the reported facts, the statutory framework and the latest Supreme Court position, I do not regard Santosh Pandit&#8217;s case as a hopeless defence case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But neither would I call it an automatic free-speech victory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The strongest immediate defence is not political.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is procedural, evidentiary and constitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defence should aggressively examine:<\/p>\n\n\n\n<h3 id=\"h-section-35-bnss\" class=\"wp-block-heading\"><span
