Effective from 1 July 2024, it replaces Section 389 of the Code of Criminal Procedure (CrPC), 1973, while preserving its core substantive framework. The provision ensures that the statutory right of appeal remains meaningful by allowing appellate courts to stay the execution of a sentence so that an appellant is not forced to serve the entire term before the appeal is decided. Furthermore, by virtue of the savings clause in Section 531 BNSS, proceedings and appeals initiated prior to 1 July 2024 continue to be governed by Section 389 CrPC.<\/p><div id=\"ez-toc-container\" class=\"wp-block-paragraph\">Under Section 430(1) BNSS, the appellate court may, for reasons recorded in writing:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>suspend the execution of the sentence;<\/li>\n\n\n\n<li>release the convicted person on bail;<\/li>\n\n\n\n<li>Release the person on their own bond or bail bond.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This power is exercised during the pendency of the appeal.<\/p>\n\n\n\n<h3 id=\"h-example-victor-s-theft-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Example_Victors_Theft_Case\"><\/span>Example: Victor&#8217;s Theft Case<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Victor is convicted of theft and sentenced to two years&#8217; imprisonment. He files an appeal against his conviction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He can ask the appellate court to suspend his sentence under Section 430(1) BNSS. If the court grants the application, Victor may remain out of prison on bail while his appeal is being decided.<\/p>\n\n\n\n<h2 id=\"h-special-rule-for-serious-offences\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Special_Rule_for_Serious_Offences\"><\/span>Special Rule for Serious Offences<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The law provides additional protection before granting bail in serious cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the offense is punishable with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>death;<\/li>\n\n\n\n<li>imprisonment for life; or<\/li>\n\n\n\n<li>imprisonment for ten years or more,<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The appellate court must first give the public prosecutor an opportunity to show cause in writing against the release of the convicted person.<\/p>\n\n\n\n<h3 id=\"h-example-ragini-s-murder-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Example_Raginis_Murder_Case\"><\/span>Example: Ragini&#8217;s Murder Case<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ragini is convicted of murder and sentenced to life imprisonment. She files an appeal and asks for suspension of her sentence and release on bail.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before releasing her, the appellate court must give the public prosecutor an opportunity to submit written objections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court must then consider the objections and all other relevant circumstances before deciding whether the sentence should be suspended.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If bail has already been granted, the public prosecutor may also apply for its cancellation.<\/p>\n\n\n\n<h2 id=\"h-temporary-bail-by-the-trial-court-section-430-3-bnss\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Temporary_Bail_by_the_Trial_Court_Section_4303_BNSS\"><\/span>Temporary Bail by the Trial Court: Section 430(3) BNSS<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Section 430(3) BNSS provides limited, short-term relief granted by the convicting trial court itself to enable a person to file an appeal and approach the appellate court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, this statutory relief applies only if the person was already on bail at the time of conviction. If the person was in judicial custody during the trial, the trial court cannot grant bail under Section 430(3) BNSS; they must apply directly to the appellate court under Section 430(1) BNSS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial court may grant temporary bail under Section 430(3) BNSS only if:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The person was on bail, is sentenced to imprisonment for not more than three years, and satisfies the court that they intend to appeal; or<\/li>\n\n\n\n<li>The offense is bailable, and the person was already on bail.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Unless there are special reasons to refuse, the trial court should release the person on bail for a sufficient period to allow them to file the appeal and obtain an order from the appellate court. The sentence is treated as suspended during this interim period.<\/p>\n\n\n\n<h3 id=\"h-example-firoz-s-case\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Example_Firozs_Case\"><\/span>Example: Firoz&#8217;s Case<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Firoz was on bail throughout his trial. Upon conviction, he is sentenced to three years&#8217; imprisonment. He informs the trial court of his intent to appeal. State of U.P. He files an appeal, but the appellate court\u2019s docket is congested, and the hearing is unlikely to take place for at least three years. If Aarav\u2019s sentence is not suspended, he will complete the entire term before his appeal is even heard, making the right of appeal practically meaningless. At the same time, release after conviction is not automatic. The appellate court must examine the facts, the seriousness of the offense, the sentence, the possibility of success in the appeal, the period of custody, and other relevant circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In serious offenses, the written-objection procedure for the public prosecutor must be followed carefully.
