remarks, explicit demands tied to career advancement, or the creation of a hostile work environment\u2014strips women of their dignity and curtails their professional autonomy in ways that ordinary labor legislation was never designed to address.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s engagement with this problem at a legal level began not with Parliament but with the judiciary. The brutal gang rape and subsequent death of Bhanwari Devi, a social worker in Rajasthan who faced retaliation after trying to prevent a child marriage, prompted a public interest petition by the women&#8217;s rights group Vishaka.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s ruling in Vishaka v. State of Rajasthan, AIR 1997 SC 3011, was a landmark moment: for the first time, the Court read Article 19(1)(g)\u2014the right to practice any profession\u2014alongside Articles 14, 15, and 21 to hold that sexual harassment at the workplace constituted a violation of fundamental rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the absence of enacted legislation, the Court issued binding guidelines that required every employer to constitute a Complaints Committee, frame a prohibition policy, and sensitise employees. These guidelines operated as the de facto law for the next sixteen years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, finally gave statutory force to what the judiciary had mandated.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It introduced mandatory Internal Committees (ICs) within larger organizations, created Local Committees (LCs) at the district level for unorganized sector workers, and prescribed a detailed inquiry procedure along with penalties for non-compliance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On paper, it was a comprehensive architecture. compliance infrastructure, but compliance is not the same as culture change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In many organizations, the IC exists but has never received a complaint\u2014not because harassment does not occur, but because workers do not trust the institution or fear reprisal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act creates the skeleton of an accountability system but does not mandate the muscles of genuine institutional commitment:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trained investigators<\/li>\n\n\n\n<li>Confidentiality id=\"h-united-states-model\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"United_States_Model\"><\/span>United States Model<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In the United States, Title VII of the Civil Rights Act of 1964 and the Equal Employment Opportunity Commission (EEOC) provide a centrally administered enforcement mechanism with the power to investigate, conciliate, and litigate\u2014a stronger state role than anything the POSH Act envisages.<\/p>\n\n\n\n<h3 id=\"h-united-kingdom-model\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"United_Kingdom_Model\"><\/span>United Kingdom Model<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The UK Equality Act 2010 similarly confers a range of remedies through Employment Tribunals and provides explicit third-party harassment liability.<\/p>\n\n\n\n<h3 id=\"h-indian-model\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Indian_Model\"><\/span>Indian Model<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Indian model of internal committees, modelled partly on alternative dispute resolution philosophy, has the virtue of keeping disputes within the organization and preserving confidentiality, but its weakness is that it places accountability for adjudication in the hands of the very institution that has a structural interest in minimizing reputational damage.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Jurisdiction<\/th><th>Legal Framework<\/th><th>Key Sexual Harassment Cases in the Workplace represent another instructive model.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Code explicitly recognizes that power dynamics in the workplace complicate consent and welcomeness, and it recommends a responsive, victim-centered approach that Indian policymakers would do well to study.<\/p>\n\n\n\n<h3 id=\"h-bangladesh-and-sri-lanka\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bangladesh_and_Sri_Lanka\"><\/span>Bangladesh and Sri Lanka<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Bangladesh and Sri Lanka, India&#8217;s immediate neighbors, have enacted legislation modelled partly on Vishaka but with variations that merit attention as India considers reform.<\/p>\n\n\n\n<h2 id=\"h-towards-reform-what-the-act-needs\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Towards_Reform_What_the_Act_Needs\"><\/span>Towards Reform: What the Act Needs<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Based on the analysis above, several reforms appear necessary to bring the POSH Act&#8217;s practical reality into alignment with its normative promise.<\/p>\n\n\n\n<h3 id=\"h-first-gender-inclusive-protection\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"First_Gender-Inclusive_Protection\"><\/span>First: Gender-Inclusive Protection<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">First, the Act must be amended to extend its protective scope to all genders. This is not only constitutionally sound but practically necessary to ensure that harassment of men, transgender persons, and non-binary individuals does not go unaddressed in the workplace.<\/p>\n\n\n\n<h3 id=\"h-second-reform-the-local-committee-mechanism\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Second_Reform_the_Local_Committee_Mechanism\"><\/span>Second: Reform the Local Committee Mechanism<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Second, the Local Committee mechanism must be substantially reformed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">State governments should be required by the central government to fund, staff, and train LCs adequately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Independent audits of LC functioning should be conducted annually and placed in the public domain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The failure of LCs is, in essence, a failure of federalism and administrative will rather than a failure of legislative design.<\/p>\n\n\n\n<h3 id=\"h-third-cover-digital-and-remote-workplaces\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Third_Cover_Digital_and_Remote_Workplaces\"><\/span>Third: Cover Digital and Remote Workplaces<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Third, the Act should explicitly cover digital and remote work environments, including harassment occurring through professional communication platforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Ministry of Women and Child Development should issue guidelines clarifying how existing provisions apply to virtual workplaces, pending a formal amendment.<\/p>\n\n\n\n<h3 id=\"h-fourth-introduce-a-dedicated-anti-retaliation-provision\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fourth_Introduce_a_Dedicated_Anti-Retaliation_Provision\"><\/span>Fourth: Introduce a Dedicated Anti-Retaliation Provision<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Fourth, the statute should incorporate a dedicated anti-retaliation provision making adverse action against a complainant a separately punishable offense with a presumption in favor of the complainant where retaliation occurs within a defined period after the filing of a complaint.<\/p>\n\n\n\n<h3 id=\"h-fifth-make-posh-training-mandatory\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fifth_Make_POSH_Training_Mandatory\"><\/span>Fifth: Make POSH Training Mandatory<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Fifth, mandatory POSH training \u2014 not merely awareness display \u2014 should be required for all employees at the time of joining and at periodic intervals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ICs should be required to complete certified training before assuming office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ministry or a designated statutory authority should maintain a public registry of trained IC members and qualified external members.<\/p>\n\n\n\n<h2 id=\"h-conclusion\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span>Conclusion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The POSH Act of 2013 was a hard-won legislative achievement, the product of decades of feminist advocacy, judicial creativity, and tragic real-world events that made the need for legal protection undeniable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It created, for the first time, a dedicated statutory framework for addressing sexual harassment in the workplace\u2014one that combined prevention obligations, institutional redressal mechanisms, and employer accountability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For organized sector workers in medium- and large-sized enterprises, the Act has made a tangible difference, creating a formal channel that did not exist before.<\/p>\n\n\n\n<h3 id=\"h-continuing-gaps-in-posh-protection\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Continuing_Gaps_in_POSH_Protection\"><\/span>Continuing Gaps in POSH Protection<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Yet the law&#8217;s promise remains undelivered for the majority of India&#8217;s working women, who toil in informal arrangements beyond the reach of either ICs or functional LCs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Its gender exclusivity, its silence on digital harassment, its inadequate retaliation protections, and the compliance without commitment culture that pervades many organizations all point to a statute in need of serious legislative attention.<\/p>\n\n\n\n<h3 id=\"h-law-and-workplace-culture\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Law_and_Workplace_Culture\"><\/span>Law and Workplace Culture<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ultimately, no law, however well-crafted, can by itself transform workplace culture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Culture shifts happen through sustained organizational commitment, leadership accountability, survivor solidarity, and social norm change\u2014processes that the law can incentivize but not command.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The POSH Act must be seen as one instrument in a larger toolkit of feminist reform rather than a complete solution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With the amendments and enforcement improvements outlined in this paper, it can become a significantly more effective instrument.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Without them, it risks remaining\u2014for too many Indian women\u2014a right that exists on paper but offers little protection in practice.<\/p>\n\n\n\n<h2
