Union of India &amp; Anr., 2026 INSC 947<\/strong>, decided on 2 September 2026, the Supreme Court set aside a customs adjudication involving a penalty of \u20b9425,27,99,100, after finding that the adjudicating authority had relied upon case law that was non-existent, carried fake citations, or did not support the legal propositions attributed to it. The Court described the material as appearing to be an AI hallucination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This was not simply a warning against bad legal research.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was a warning about the integrity of adjudication itself.<\/p>\n\n\n\n<h2 id=\"h-what-happened-in-vijay-ghanshyam-gadiya\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Happened_in_Vijay_Ghanshyam_Gadiya\"><\/span>What Happened in Vijay Ghanshyam Gadiya?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Additional Commissioner of Customs, Surat, imposed the enormous penalty under Section 114 of the Customs Act, 1962, alleging misdeclaration of natural diamonds as laboratory-grown diamonds to obtain a lower tariff.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Gujarat High Court dismissed the challenge on 20 January 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When the matter reached the Supreme Court, the appellant contended that several judgments and articles relied upon in the original adjudication order had been generated using AI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court did something particularly significant.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It independently checked the authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court found that some cases were non-existent or had fake citations. It further discovered that some genuine judgments did exist, but did not lay down the propositions for which they had been cited.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court consequently found the reliance on such dubious material fatal to the sustainability of the order.<\/p>\n\n\n\n<h3 id=\"h-supreme-court-directions-in-vijay-ghanshyam-gadiya\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Court_Directions_in_Vijay_Ghanshyam_Gadiya\"><\/span>Supreme Court Directions in Vijay Ghanshyam Gadiya<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Set aside the Gujarat High Court&#8217;s order;<\/li>\n\n\n\n<li>Set aside the original customs adjudication order;<\/li>\n\n\n\n<li>Revived the proceedings for fresh adjudication;<\/li>\n\n\n\n<li>Directed that the matter be heard by another officer of the same rank; and<\/li>\n\n\n\n<li>Left it to the appointing authority to consider appropriate action against the author of the original order.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Importantly, the Supreme Court did not finally decide the underlying customs dispute. The case was remanded for a fresh decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction matters.<\/p>\n\n\n\n<h2 id=\"h-the-real-constitutional-issue-can-fiction-become-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Real_Constitutional_Issue_Can_Fiction_Become_Law\"><\/span>The Real Constitutional Issue: Can Fiction Become Law?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The deeper problem is not that a citation was incorrect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawyers have always made mistakes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The extraordinary danger presented by AI hallucinations in courts is different: an AI system can manufacture an entirely plausible legal universe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can produce:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A fictitious judgment;<\/li>\n\n\n\n<li>A real case with the wrong citation;<\/li>\n\n\n\n<li>A real judgment with a fabricated quotation;<\/li>\n\n\n\n<li>A genuine case containing a proposition it never decided;<\/li>\n\n\n\n<li>A non-existent paragraph number; or<\/li>\n\n\n\n<li>An apparently authoritative line of precedent that never existed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The output may look perfectly professional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is precisely what makes it dangerous.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A court cannot determine rights on the basis of authorities that exist only inside a machine-generated answer.<\/p>\n\n\n\n<h2 id=\"h-pooja-ramesh-singh-the-supreme-court-s-foundational-ai-judgment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Pooja_Ramesh_Singh_The_Supreme_Courts_Foundational_AI_Judgment\"><\/span>Pooja Ramesh Singh: The Supreme Court&#8217;s Foundational AI Judgment<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The latest decision must be read alongside the Supreme Court&#8217;s earlier judgment in <strong>Pooja Ramesh Singh v. Jammu &amp; Kashmir Bank Ltd., 2026 INSC 668<\/strong>, decided on 2 July 2026.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There, the Supreme Court confronted a tribunal decision relying upon non-existent, fake and hallucinated AI-generated material as precedent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court set aside the NCLT and appellate decision and made an extraordinary declaration: courts must adopt \u201czero tolerance\u201d towards producing, citing or using AI-generated precedents without verification.
