If State A supplies weapons to State B, and State B allegedly uses those weapons in conduct amounting to genocide, why should State A not also bear responsibility?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">International law, however, does not work on such a simple chain of reasoning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A state does not automatically become internationally responsible merely because weapons manufactured or supplied by it are later used unlawfully. Israel is accused of genocide. Therefore, is Germany responsible?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is not the legal test.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The actual legal analysis is considerably more demanding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are at least three different possibilities:<\/p>\n\n\n\n<h3 id=\"h-1-direct-responsibility-for-genocide\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Direct_Responsibility_for_Genocide\"><\/span>1. Complicity in Genocide<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Did Germany knowingly assist conduct amounting to genocide in circumstances satisfying the legal requirements for complicity?<\/p>\n\n\n\n<h3 id=\"h-3-failure-to-prevent-genocide\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Failure_to_Prevent_Genocide\"><\/span>3. Failure to Prevent Genocide<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Did Germany fail to take reasonably available measures after becoming aware, or when it should normally have become aware, of a serious risk of genocide?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These three concepts must never be treated as interchangeable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction was central to the International Court of Justice&#8217;s landmark 2007 judgement in Bosnia and Herzegovina v. Serbia and Montenegro.<\/p>\n\n\n\n<h2 id=\"h-the-first-battlefield-is-not-genocide-it-is-jurisdiction\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_Battlefield_Is_Not_Genocide_It_Is_Jurisdiction\"><\/span>The First Battlefield Is Not Genocide. It Is Jurisdiction.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most important point emerging from the present hearings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Germany is asking the ICJ to reject Nicaragua&#8217;s case on preliminary grounds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Germany&#8217;s arguments include objections concerning whether a sufficiently crystallised dispute existed when Nicaragua filed the case, the temporal scope of the Court&#8217;s jurisdiction, treaty-specific jurisdictional requirements and the significance of the legal interests of Israel, which is not a party to the proceedings. (EU Today)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That means the immediate question is not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDid Germany help commit genocide?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDoes the ICJ have jurisdiction, and is Nicaragua&#8217;s application legally admissible in the form in which it has been presented?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Only if Nicaragua survives this preliminary stage can the Court potentially proceed toward the merits.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why the current hearings matter so much.<\/p>\n\n\n\n<h2 id=\"h-the-monetary-gold-problem-can-the-court-decide-germany-s-responsibility-without-israel\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Monetary_Gold_Problem_Can_the_Court_Decide_Germanys_Responsibility_Without_Israel\"><\/span>The Monetary Gold Problem: Can the Court Decide Germany&#8217;s Responsibility Without Israel?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most difficult issues is the principle associated with the ICJ&#8217;s Monetary Gold jurisprudence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Germany argues, in substance, that determining its alleged responsibility for failing to prevent or assist genocide could require the Court to determine the legal responsibility of Israel for the underlying conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Israel is not a party to this case.<\/p>\n\n\n\n<h3 id=\"h-this-creates-a-difficult-question\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"This_Creates_a_Difficult_Question\"><\/span>This Creates a Difficult Question<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Can the ICJ determine the responsibility of one State for failing to prevent or assisting another State&#8217;s alleged wrongful conduct without making a binding determination concerning the responsibility of that absent State?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Germany&#8217;s position is that the legal interests of Israel would become central to the court&#8217;s decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nicaragua&#8217;s position is fundamentally different. Latest 5\u20134 Ruling Reignites Term Limits Debate<\/a><\/p>\n\n\n\n<h3 id=\"h-what-does-the-genocide-convention-actually-require\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Does_the_Genocide_Convention_Actually_Require\"><\/span>What Does the Genocide Convention Actually Require?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Convention on the Prevention and Punishment of the Crime of Genocide, adopted in 1948, imposes obligations concerning the prevention and punishment of genocide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two provisions are especially important to understanding the Germany\u2013Nicaragua ICJ case.<\/p>\n\n\n\n<h4 id=\"h-article-i-the-duty-to-prevent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_I_%E2%80%94_The_Duty_to_Prevent\"><\/span>Article I \u2014 The Duty to Prevent<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Article I requires states to prevent and punish genocide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ICJ gave this provision major significance in Bosnia v. Serbia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court held that the obligation to prevent genocide is distinct from responsibility for committing genocide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A state may therefore violate its duty to prevent even though it did not itself commit the genocide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The obligation is one of conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is not a guarantee that genocide will never occur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question is whether the State took measures reasonably available to it in the circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court&#8217;s 2007 judgement found Serbia responsible for violating its obligation to prevent the Srebrenica genocide.<\/p>\n\n\n\n<h4 id=\"h-article-iii-e-complicity-in-genocide\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_IIIe_Complicity_in_Genocide\"><\/span>Article III(e): Complicity in Genocide<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Article III(e) identifies complicity in genocide as a punishable act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this does not mean that every form of military or financial assistance automatically becomes complicity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ICJ&#8217;s reasoning in Bosnia v. Serbia is extremely important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court stated that conduct cannot be treated as complicity in genocide unless, at the least, the relevant actor acted knowingly and was aware of the specific intent\u2014the dolus specialis\u2014of the principal perpetrator.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This establishes a very high threshold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Weapons supplied \u2260 automatic complicity.<\/li>\n\n\n\n<li>Financial assistance \u2260 automatic complicity.<\/li>\n\n\n\n<li>Political support \u2260 automatic complicity.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The legal question is much more demanding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The relevant knowledge and the character of the assistance must be examined.<\/p>\n\n\n\n<h3 id=\"h-complicity-and-prevention-are-not-the-same-thing\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Complicity_and_Prevention_Are_Not_the_Same_Thing\"><\/span>Complicity and Prevention Are Not the Same Thing<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most important legal distinction in the entire case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine two hypothetical situations.<\/p>\n\n\n\n<h4 id=\"h-situation-one\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Situation_One\"><\/span>Situation One<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">A state knows that another state intends to destroy a protected group and knowingly provides assistance that facilitates that genocidal plan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That potentially raises the question of complicity.<\/p>\n\n\n\n<h4 id=\"h-situation-two\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Situation_Two\"><\/span>Situation Two<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">A state does not share the perpetrator&#8217;s genocidal intent but possesses information showing a serious risk of genocide and nevertheless fails to use measures reasonably available to it to prevent the crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That raises the separate question of failure to prevent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second does not automatically require the same mental element as the first.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction was central to the ICJ&#8217;s reasoning in Bosnia v. Serbia judgement also teaches another important lesson.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The duty to prevent genocide cannot be assessed in a vacuum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A state&#8217;s capacity to influence the situation matters.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Diplomatic influence;<\/li>\n\n\n\n<li>Military relationships;<\/li>\n\n\n\n<li>Economic leverage;<\/li>\n\n\n\n<li>Political influence;<\/li>\n\n\n\n<li>Dependence upon particular supplies;<\/li>\n\n\n\n<li>Ability to suspend licences;<\/li>\n\n\n\n<li>Ability to impose end-use conditions;<\/li>\n\n\n\n<li>Ability to use diplomatic pressure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Thus, the legal significance of an arms transfer cannot be measured simply by the monetary value of the transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The question may also be:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">How much influence did the exporting state possess over the recipient, and what could reasonably have been done with that influence?<\/p>\n<\/blockquote>\n\n\n\n<h3 id=\"h-article-16-and-aid-or-assistance-under-state-responsibility\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_16_and_Aid_or_Assistance_Under_State_Responsibility\"><\/span>Article 16 and Aid or Assistance Under State Responsibility<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The broader law of state responsibility provides another important framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Article 16 of the International Law Commission&#8217;s Articles on Responsibility of States for Internationally Wrongful Acts deals with aid or assistance in the commission of an internationally wrongful act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Article 16 should not simply be equated with Article III(e) of the Genocide Convention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They operate within related but distinct legal frameworks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For genocide specifically, the Genocide Convention and the ICJ&#8217;s interpretation of complicity remain indispensable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is important because legal arguments become dangerously loose when every form of assistance is labelled &#8220;complicity&#8221;.<\/p>\n\n\n\n<h3 id=\"h-what-did-the-icj-decide-in-april-2024\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" concluded that the circumstances then before it did not require the indication of provisional measures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But this was not a final merits judgement exonerating Germany.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nor was it a final determination that Nicaragua&#8217;s allegations were false.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proceedings remained alive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The present preliminary-objections phase exists because Germany subsequently challenged the legal foundation of Nicaragua&#8217;s case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ICJ&#8217;s own case record confirms that the Court&#8217;s April 2024 decision concerned provisional measures and that preliminary objections were subsequently raised by Germany.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction must be preserved throughout any serious article.<\/p>\n\n\n\n<p Germany has also emphasised its own arms-export review procedures and changes to certain export decisions. class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWe supplied weapons, and therefore nothing matters.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Its position is also that its export system takes international-law considerations into account.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That creates an important factual and legal question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">How much weight should an international court give to an exporting state&#8217;s internal risk-assessment process?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If a state can demonstrate that it systematically assessed risk, considered available evidence, imposed safeguards and reassessed its decisions as circumstances changed, that may be highly relevant to the question of due diligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But an internal procedure cannot automatically immunise a state from international responsibility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Domestic legality and international responsibility are different questions.<\/p>\n\n\n\n<h3 id=\"h-the-difference-between-domestic-law-and-international-responsibility\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Difference_Between_Domestic_Law_and_International_Responsibility\"><\/span>The Difference Between Domestic Law and International Responsibility<span question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It does not necessarily answer an international-law question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">International responsibility is governed by the international obligation allegedly breached.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the crucial question becomes:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Was the State&#8217;s conduct consistent with the international obligation binding upon it?<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction is particularly important for countries with sophisticated arms-export licensing regimes.<\/p>\n\n\n\n<h3 id=\"h-what-this-case-could-mean-for-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_This_Case_Could_Mean_for_India\"><\/span>What This Case Could Mean for India<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For India, this case deserves careful attention\u2014not because Germany&#8217;s exact jurisdictional position automatically applies to India, but because the underlying principles could influence future debates about responsible defence exports.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India is a party to the Genocide Convention.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the same time, India&#8217;s treaty reservations and declarations concerning ICJ jurisdiction are important and mean that one cannot simply assume that every dispute involving India would follow the same jurisdictional route as the Germany case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why the correct question for India is not:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cCan Nicaragua-style proceedings automatically be brought against India?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The correct question is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cHow should India structure its defence-export decisions so that they remain consistent with India&#8217;s international obligations while protecting legitimate national-security and foreign-policy interests?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much more useful question.<\/p>\n\n\n\n<h3 id=\"h-article-51-of-the-indian-constitution\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Article_51_of_the_Indian_Constitution\"><\/span>Article 51 of the Indian Constitution<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Article 51 of the Constitution directs the State to foster respect for international law and treaty obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Article 51 should not be described as if every international rule automatically becomes directly enforceable domestic law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">India&#8217;s constitutional structure distinguishes between international obligations and their domestic implementation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, the proper constitutional proposition is narrower:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian constitutional policy recognises the importance of respect for international law, while the domestic legal effect of treaty obligations depends upon the constitutional and statutory framework applicable to the particular obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is the legally safer formulation.<\/p>\n\n\n\n<h3 id=\"h-india-s-defence-export-system\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Indias_Defence-Export_System\"><\/span>India&#8217;s Defence-Export System<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">India already has a substantial system regulating defence exports, including the SCOMET framework, export authorisations, end-user requirements and statutory controls.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The practical lesson from the Germany\u2013Nicaragua ICJ case is therefore not that India necessarily needs to stop defence exports.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is that India could strengthen the quality of its legal-risk assessment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For particularly sensitive exports, India could consider a continuous due-diligence model.<\/p>\n\n\n\n<h3 id=\"h-my-proposed-model-continuous-international-humanitarian-law-due-diligence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" licence should not be treated as a one-time legal decision.<\/strong> It should be capable of being reassessed when the factual circumstances materially change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The model would contain five stages.<\/p>\n\n\n\n<h4 id=\"h-stage-one-pre-export-assessment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stage_One_%E2%80%94_Pre-Export_Assessment\"><\/span>Stage One \u2014 Pre-Export Assessment<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Before authorisation:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>assess the recipient;<\/li>\n\n\n\n<li>identify foreseeable end use;<\/li>\n\n\n\n<li>assess relevant international-law risks;<\/li>\n\n\n\n<li>examine the recipient&#8217;s conduct;<\/li>\n\n\n\n<li>Document the evidence.<\/li>\n<\/ul>\n\n\n\n<h4 id=\"h-stage-two-risk-classification\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stage_Two_%E2%80%94_Risk_Classification\"><\/span>Stage Two \u2014 Risk Classification<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Classify the transaction according to the seriousness of the identified risks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This should not become an arbitrary mathematical formula.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The classification should remain an expert legal and policy assessment.<\/p>\n\n\n\n<h4 id=\"h-stage-three-end-use-monitoring\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stage_Three_%E2%80%94_End-Use_Monitoring\"><\/span>Stage Three \u2014 End-Use Monitoring<span \u2014 Triggered Reassessment<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">A new review should occur when there is substantial new information, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>credible evidence of serious violations;<\/li>\n\n\n\n<li>diversion;<\/li>\n\n\n\n<li>material deterioration of the humanitarian situation;<\/li>\n\n\n\n<li>credible evidence of misuse;<\/li>\n\n\n\n<li>failure to comply with end-use assurances;<\/li>\n\n\n\n<li>significant changes in the recipient&#8217;s military conduct.<\/li>\n<\/ul>\n\n\n\n<h4 id=\"h-stage-five-documented-decision\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Stage_Five_%E2%80%94_Documented_Decision\"><\/span>Stage Five \u2014 Documented Decision<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The government should maintain a clear record:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Information \u2192 Legal assessment \u2192 Risk \u2192 Available options \u2192 Decision \u2192 Mitigation \u2192 Reassessment<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This would create something extremely valuable:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>An auditable due-diligence record.<\/strong><\/p>\n\n\n\n<h3 id=\"h-why-this-could-matter\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_This_Could_Matter\"><\/span>Why This Could Matter<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Imagine that many years later an international tribunal asks:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWhat did the exporting state know?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A responsible government should not have to reconstruct its answer from old newspaper reports.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It should be able to produce:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What we knew.<\/li>\n\n\n\n<li>What we considered.<\/li>\n\n\n\n<li>What legal obligations we identified.<\/li>\n\n\n\n<li>What alternatives were available.<\/li>\n\n\n\n<li>Why we made the decision.<\/li>\n\n\n\n<li>What changed later.<\/li>\n\n\n\n<li>What we did after it changed.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That is the real value of a continuing due-diligence system.<\/p>\n\n\n\n<h3 id=\"h-but-this-is-not-a-new-rule-of-international-law\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" would emphasise this point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposed model is a policy framework, not an existing ICJ doctrine.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is designed to operationalise principles already visible in international law concerning:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>prevention;<\/li>\n\n\n\n<li>due diligence;<\/li>\n\n\n\n<li>knowledge;<\/li>\n\n\n\n<li>available means;<\/li>\n\n\n\n<li>risk;<\/li>\n\n\n\n<li>State responsibility;<\/li>\n\n\n\n<li>arm-transfer controls.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It should not be presented as though the ICJ has already adopted such a five-stage model.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction keeps the argument intellectually honest.<\/p>\n\n\n\n<h3 id=\"h-a-five-question-test-for-arms-export-responsibility\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" wrongful act?<\/td><\/tr><tr><td><strong>Question 2<\/strong><\/td><td>What international obligation binds the exporting state independently of the recipient state?<\/td><\/tr><tr><td><strong>Question 3<\/strong><\/td><td>What did the exporting state know, or what should it reasonably have known, at the relevant time?<\/td><\/tr><tr><td><strong>Question 4<\/strong><\/td><td>What practical means of influence were actually available to the exporting state?<\/td><\/tr><tr><td><strong>Question 5<\/strong><\/td><td>Did the State&#8217;s conduct satisfy the specific legal requirements for the alleged breach?<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Only after these five questions are answered should one speak confidently about international responsibility.<\/p>\n\n\n\n<h3 id=\"h-what-the-germany-nicaragua-case-could-ultimately-change\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_the_Germany%E2%80%93Nicaragua_Case_Could_Ultimately_Change\"><\/span>What the Germany\u2013Nicaragua Case Could Ultimately Change<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If the case survives the preliminary objections, the implications could extend beyond Germany.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court may eventually have to consider questions surrounding:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the duty to prevent genocide;<\/li>\n\n\n\n<li>complicity;<\/li>\n\n\n\n<li>aid or assistance;<\/li>\n\n\n\n<li>arms transfers;<\/li>\n\n\n\n<li>humanitarian law;<\/li>\n\n\n\n<li>State responsibility;<\/li>\n\n\n\n<li>knowledge and risk;<\/li>\n\n\n\n<li>the legal significance of export-control procedures;<\/li>\n\n\n\n<li>the extent of a state&#8217;s influence over an assisted state;<\/li>\n\n\n\n<li>and the limits imposed by the rights of an absent third state.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But it is too early to predict the outcome.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current proceedings are still preliminary.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that is precisely why responsible legal journalism matters.<\/p>\n\n\n\n<h3 id=\"h-the-real-legal-question-is-bigger-than-germany\" class=\"wp-block-heading\"><span class=\"wp-block-paragraph\">The most interesting question arising from the Germany\u2013Nicaragua ICJ case is not whether Germany sold a particular weapon.<\/p>\n\n\n\n<p continued assistance to another State become legally indefensible because the assisting State knows, or should reasonably know, that there is a serious risk that its assistance may contribute to conduct prohibited by international law?<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That question could eventually affect not only weapons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>spare parts;<\/li>\n\n\n\n<li>military technology;<\/li>\n\n\n\n<li>training;<\/li>\n\n\n\n<li>intelligence;<\/li>\n\n\n\n<li>logistics;<\/li>\n\n\n\n<li>financial assistance;<\/li>\n\n\n\n<li>technical support;<\/li>\n\n\n\n<li>dual-use equipment.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The legal debate could therefore move beyond the traditional question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cWho pulled the trigger?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">toward a more difficult question:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cWho continued to make the conduct possible after the legal risk became apparent?\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is where the future of state responsibility may become particularly interesting.<\/p>\n\n\n\n<h3 id=\"h-ten-important-legal-safeguards\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ten_Important_Legal_Safeguards\"><\/span>Ten Important Legal Safeguards<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Any future international-law analysis of arms transfers should therefore remember:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Arms supply does not automatically equal complicity.<\/li>\n\n\n\n<li>Complicity and prevention are different legal obligations.<\/li>\n\n\n\n<li>Knowledge adversaries.<\/li>\n\n\n\n<li>Give exporters predictable rules and fast processing for low-risk transactions.<\/li>\n\n\n\n<li>Make international humanitarian law part of the decision-making process\u2014not an afterthought.<\/li>\n<\/ol>\n\n\n\n<h3 id=\"h-red-team-why-this-approach-could-still-fail\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" regulatory system is perfect.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A continuous due-diligence system could become bureaucratic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could delay legitimate defence exports.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could be influenced by politics.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Intelligence could be incomplete or wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Recipient states could provide unreliable assurances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Exporters could attempt to circumvent restrictions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And an overly cautious system could damage India&#8217;s strategic interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These objections are real.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The answer is therefore not to create a system that treats every international controversy as a reason to prohibit exports.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the system should be risk-based.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Transaction risk.<\/p>\n\n\n\n<h4 id=\"h-lock-two-during-the-relationship\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Lock_Two_%E2%80%94_During_the_Relationship\"><\/span>Lock Two \u2014 Event<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Reassess the authorisation if significant new evidence emerges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is inexpensive compared with creating an entirely new regulatory bureaucracy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More importantly, it creates a defensible decision-making trail.<\/p>\n\n\n\n<h3 id=\"h-my-legal-assessment\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_Legal_Assessment\"><\/span>My Legal Assessment<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Germany\u2013Nicaragua ICJ case should not be understood as establishing a new rule that:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cA state that supplies weapons becomes responsible for genocide.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">International law is not that simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The more accurate proposition is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A state may incur international responsibility depending on the particular obligation invoked, the nature of its conduct, what it knew or should have known, the assistance it provided, its ability to influence the situation, and whether it fulfilled the applicable legal duties.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For genocide specifically, complicity has an exceptionally demanding knowledge requirement under the ICJ&#8217;s Bosnia v Serbia jurisprudence. The Court held that assistance cannot be treated as complicity in genocide unless, at least, the assisting actor acted knowingly and was aware of the principal perpetrator&#8217;s specific genocidal intent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The duty to prevent genocide is different.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that difference may prove central to the future of international arms-transfer law.<\/p>\n\n\n\n<h2 id=\"h-conclusion-the-factory-gate-is-not-necessarily-the-end-of-legal-responsibility\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion_The_Factory_Gate_Is_Not_Necessarily_the_End_of_Legal_Responsibility\"><\/span>Conclusion: The Factory Gate Is Not Necessarily the End of Legal Responsibility<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">There is a tendency to think of international responsibility as beginning and ending with the person who commits the physical act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Modern international law presents a more complicated picture.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A state that manufactures or exports weapons does not automatically become responsible for everything the recipient later does.
