The tragedy has now raised fundamental questions about unauthorised construction, structural safety, student accommodation, municipal enforcement and the constitutional responsibility of public authorities to protect life.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On September 8, the Supreme Court indicated that it would take up the matter on September 10 and consider whether proceedings pending before the Delhi High Court should be transferred to the Supreme Court. More importantly, the Court is considering whether building-safety issues arising from the tragedy should be examined on a pan-India basis.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That possibility makes Satya Niketan potentially much more than a Delhi-specific case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It could become a test of whether India&#8217;s regulatory system acts before buildings collapse, rather than merely investigating them afterwards.<\/p>\n\n\n\n<h2 id=\"h-what-happened-at-satya-niketan\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Happened_at_Satya_Niketan\"><\/span>What Happened at Satya Niketan?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The collapsed property at P-14, Satya Niketan, was reportedly being used as a boys&#8217; PG and housed students, including students associated with Delhi University.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reports indicate that the building had a basement and four floors above ground. Repair or construction work was reportedly underway when the structure collapsed. Preliminary material has also raised questions concerning basement work, waterlogging, building permissions and possible deviations from sanctioned construction. The precise technical cause remains a matter for investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That distinction is important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At this stage, neither public anger nor preliminary allegations should be substituted for a properly established finding of criminal liability.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the tragedy unquestionably raises questions that regulators must answer.<\/p>\n\n\n\n<h3 id=\"h-the-central-questions-are\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Central_Questions_Are\"><\/span>The Central Questions Are:<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Was the building constructed according to an approved plan?<\/li>\n\n\n\n<li>Was its actual use legally permitted?<\/li>\n\n\n\n<li>Were additional floors or structural alterations made?<\/li>\n\n\n\n<li>Was construction undertaken in the basement?<\/li>\n\n\n\n<li>Was the structure periodically inspected?<\/li>\n\n\n\n<li>Were complaints previously received?<\/li>\n\n\n\n<li>Did the authorities know, or ought they reasonably to have known, that the building was dangerous?<\/li>\n\n\n\n<li>Were fire and evacuation requirements satisfied?<\/li>\n\n\n\n<li>Who was responsible for monitoring compliance?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These questions go directly to the issue of preventability.<\/p>\n\n\n\n<h2 id=\"h-supreme-court-intervention-changes-the-legal-dimension\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Court_Intervention_Changes_the_Legal_Dimension\"><\/span>Supreme Court Intervention Changes the Legal Dimension<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The most important development is that the Supreme Court is not looking at Satya Niketan merely as an isolated accident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A Bench of Justices Ahsanuddin Amanullah and R. Mahadevan has indicated that it is considering transferring the matter from the Delhi High Court and examining the broader issue of building safety on a pan-India basis.
