Others make the opposite mistake: they assume that because mutual consent can be withdrawn before the divorce decree, the settlement itself has no legal significance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Both assumptions can be wrong.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After more than 25 years of legal practice, my experience is that the real question is not merely \u201cWhat amount of alimony should I agree to?\u201d or \u201cWho will get custody of the child?\u201d The more important question is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>\u201cHave we designed the settlement in such a way that the obligations can actually be performed, verified, and enforced after the divorce?\u201d<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction becomes particularly important after the Supreme Court&#8217;s recent decision in Dhananjay Rathi v. Ruchika Rathi, where the Court had to deal with a settlement involving substantial monetary payments, property, jewelry, and other obligations, some of which had already been performed and others of which remained outstanding.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case provides an important lesson for anyone negotiating a mutual divorce settlement in India: signing a settlement is not the same as completing the settlement.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-mutual-divorce-settlement-in-india\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Mutual_Divorce_Settlement_in_India\"><\/span>What Is a Mutual Divorce Settlement in India?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A mutual divorce settlement is an agreement through which spouses voluntarily resolve the issues arising from their separation before or alongside proceedings for divorce by mutual consent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the circumstances, it may deal with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>permanent alimony;<\/li>\n\n\n\n<li>one-time settlement;<\/li>\n\n\n\n<li>monthly maintenance;<\/li>\n\n\n\n<li>child maintenance;<\/li>\n\n\n\n<li>child custody;<\/li>\n\n\n\n<li>visitation and parenting time;<\/li>\n\n\n\n<li>residential arrangements;<\/li>\n\n\n\n<li>jointly owned property;<\/li>\n\n\n\n<li>jewelry and stridhan;<\/li>\n\n\n\n<li>bank accounts and investments;<\/li>\n\n\n\n<li>business interests;<\/li>\n\n\n\n<li>loans and liabilities;<\/li>\n\n\n\n<li>pending matrimonial litigation;<\/li>\n\n\n\n<li>civil cases;<\/li>\n\n\n\n<li>maintenance proceedings;<\/li>\n\n\n\n<li>domestic violence proceedings;<\/li>\n\n\n\n<li>criminal proceedings, where legally permissible;<\/li>\n\n\n\n<li>withdrawal or disposal of other cases.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Hindu Marriage Act, Section 13B provides the statutory mechanism for divorce by mutual consent. Section 25 deals with permanent alimony and maintenance, Section 26 concerns custody, maintenance, and education of minor children, and Section 27 concerns disposal of property presented at or about the time of marriage that may belong jointly to husband and wife.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But these provisions should not be viewed as creating one giant legal \u201csettlement button.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They deal with different legal interests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why a professionally prepared settlement should treat alimony, property, children, and litigation separately before bringing them together into one overall agreement.<\/p>\n\n\n\n<h2 id=\"h-the-first-question-can-one-spouse-withdraw-mutual-consent\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_First_Question_Can_One_Spouse_Withdraw_Mutual_Consent\"><\/span>The First Question: Can One Spouse Withdraw Mutual Consent?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Yes, in appropriate circumstances, before the divorce decree.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most misunderstood aspects of mutual divorce in India.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Sureshta Devi v. Om Prakash, the Supreme Court explained that mutual consent must continue until the decree of divorce. Merely filing a joint petition does not itself dissolve the marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if one spouse withdraws consent before the decree, the court cannot simply treat the marriage as dissolved under Section 13B merely because a settlement was signed earlier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why I strongly advise clients not to confuse a signed settlement with a completed divorce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There may be three different legal events:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Legal Event<\/th><th>What It Means<\/th><\/tr><\/thead><tbody><tr><td>Signing the settlement<\/td><td>The parties record the terms they have agreed upon.<\/td><\/tr><tr><td>Filing\/processing the mutual-consent divorce<\/td><td>The parties proceed with the divorce process based on mutual consent.<\/td><\/tr><tr><td>Obtaining the final decree<\/td><td>The court grants the decree of divorce.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">They are connected, but they are not identical.<\/p>\n\n\n\n<h2 id=\"h-then-what-happens-to-the-settlement-if-someone-withdraws\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Then_What_Happens_to_the_Settlement_If_Someone_Withdraws\"><\/span>Then What Happens to the Settlement If Someone Withdraws?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is where the law becomes more nuanced.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Suppose the spouses sign a settlement under which:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The husband agrees to pay \u20b91 crore<\/li>\n\n\n\n<li>The wife agrees to cooperate in the divorce<\/li>\n\n\n\n<li>The husband agrees to transfer a property;<\/li>\n\n\n\n<li>The parties agree upon custody;<\/li>\n\n\n\n<li>Certain cases are to be disposed of.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Later, the wife says,<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cI am withdrawing my consent to the divorce.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That does not automatically answer the separate question of whether every obligation contained in the settlement simply disappears.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legal consequences depend upon:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the wording of the settlement;<\/li>\n\n\n\n<li>whether it was mediated;<\/li>\n\n\n\n<li>whether it was authenticated;<\/li>\n\n\n\n<li>whether it was acted upon;<\/li>\n\n\n\n<li>whether it was recorded by a court;<\/li>\n\n\n\n<li>whether consideration\/performance has taken place;<\/li>\n\n\n\n<li>whether there was fraud, coercion, or undue influence;<\/li>\n\n\n\n<li>whether agreed conditions were fulfilled;<\/li>\n\n\n\n<li>the nature of the particular proceeding.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This distinction became especially significant in the Supreme Court&#8217;s 2026 decision in Dhananjay Rathi v. Ruchika Rathi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court examined a mediated settlement in which substantial obligations had already been performed while others remained outstanding. Rather than treating the settlement as an all-or-nothing document, the Court examined the actual performance and structured its final relief accordingly.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is a major lesson for matrimonial lawyers and clients alike.<\/p>\n\n\n\n<h2 id=\"h-the-supreme-court-s-2026-rathi-decision-the-lesson-for-divorce-settlements\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_Supreme_Courts_2026_Rathi_Decision_The_Lesson_for_Divorce_Settlements\"><\/span>The Supreme Court&#8217;s 2026 Rathi Decision: The Lesson for Divorce Settlements<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The dispute in Dhananjay Rathi v. too:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\"><strong>A settlement is only as informed as the financial information on which it is based.<\/strong><\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">This does not mean that every mutual divorce requires an expensive forensic investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For an ordinary case, proportionate disclosure may be sufficient.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where there is a genuine indication of hidden business interests, properties, offshore assets, or deliberate suppression of income, enhanced verification may be justified.<\/p>\n\n\n\n<h2 arise:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who is the registered owner?<\/li>\n\n\n\n<li>Is it jointly owned?<\/li>\n\n\n\n<li>Is there a home loan?<\/li>\n\n\n\n<li>Is there a mortgage?<\/li>\n\n\n\n<li>Are maintenance dues outstanding?<\/li>\n\n\n\n<li>Is the property free from encumbrances?<\/li>\n\n\n\n<li>What instrument is required?<\/li>\n\n\n\n<li>Who will bear stamp duty and registration costs?<\/li>\n\n\n\n<li>When will possession be delivered?<\/li>\n\n\n\n<li>Where are the original title documents?<\/li>\n\n\n\n<li>What happens if the transfer cannot legally be completed?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A professionally designed settlement should answer these questions before the parties reach the final stage of properly completed registered transfer instrument and corresponding delivery of possession\/documents may constitute performance, depending on the nature of the transaction.<\/p>\n\n\n\n<p class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe mother shall have permanent custody and the father shall have no future claim.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Such wording may not adequately reflect the court&#8217;s continuing concern for the child&#8217;s welfare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Indian custody jurisprudence consistently emphasizes that the welfare and best interests of the child are paramount.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, a good parenting arrangement should deal with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>primary residence;<\/li>\n\n\n\n<li>visitation;<\/li>\n\n\n\n<li>weekends;<\/li>\n\n\n\n<li>holidays;<\/li>\n\n\n\n<li>birthdays;<\/li>\n\n\n\n<li>school events;<\/li>\n\n\n\n<li>education expenses;<\/li>\n\n\n\n<li>medical expenses;<\/li>\n\n\n\n<li>emergency medical decisions;<\/li>\n\n\n\n<li>communication\/video calls;<\/li>\n\n\n\n<li>travel;<\/li>\n\n\n\n<li>passports;<\/li>\n\n\n\n<li>relocation;<\/li>\n\n\n\n<li>important educational decisions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But it should also recognize that a child&#8217;s circumstances can change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A five-year-old child and a fifteen-year-old teenager may have completely different needs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Financial finality can be strong. Parenting arrangements should be stable but capable of lawful adaptation to the child&#8217;s welfare.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is not a weakness in the settlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a protection for the child.<\/p>\n\n\n\n<h2 id=\"h-can-child-maintenance-be-permanently-waived\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_Child_Maintenance_Be_Permanently_Waived\"><\/span>Can Child Maintenance Be Permanently Waived?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This question requires particular caution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents can agree upon financial responsibilities for their child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But one should not casually draft a clause stating:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cNeither parent shall ever claim any maintenance for the child in any circumstances.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The child&#8217;s legal interests cannot simply be treated as the private property of the parents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agreement should instead specify:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>current monthly expenses;<\/li>\n\n\n\n<li>school fees;<\/li>\n\n\n\n<li>medical expenses;<\/li>\n\n\n\n<li>extraordinary expenses;<\/li>\n\n\n\n<li>insurance;<\/li>\n\n\n\n<li>extracurricular activities;<\/li>\n\n\n\n<li>future review mechanism;<\/li>\n\n\n\n<li>responsibility for major unforeseen expenditure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And it should make clear that the arrangement operates subject to applicable law and the child&#8217;s welfare.<\/p>\n\n\n\n<h2 id=\"h-what-about-jewellery-and-stridhan\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_About_Jewellery_and_Stridhan\"><\/span>What About Jewellery and Stridhan?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Jewelry should not simply be described as<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cAll jewelry has been returned.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If jewelry is being returned, prepare an itemized inventory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Item<\/th><th>Description<\/th><th>Approx. contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement should therefore contain a Litigation Closure Schedule identifying every case separately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For each case, state:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>case number;<\/li>\n\n\n\n<li>court;<\/li>\n\n\n\n<li>parties;<\/li>\n\n\n\n<li>present class=\"wp-block-paragraph\">\u201cBut during mediation he verbally promised another 500 grams of gold.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A properly drafted settlement should identify the documents and schedules forming the complete agreement and require material amendments to be recorded in writing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But such a clause should never be drafted as an attempt to legalize fraud or suppress rights that cannot lawfully be waived.<\/p>\n\n\n\n<h2 id=\"h-the-new-settlement-closing-concept\" class=\"wp-block-heading\"><span class=\"wp-block-paragraph\">The precise answer depends on the legal instrument and the ground of challenge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A party may have different rights depending upon whether the document is<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a private settlement agreement;<\/li>\n\n\n\n<li>a mediated settlement agreement;<\/li>\n\n\n\n<li>consent terms recorded by a court;<\/li>\n\n\n\n<li>a mutual-consent divorce petition;<\/li>\n\n\n\n<li>a final divorce decree;<\/li>\n\n\n\n<li>a custody order.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These must genuine consent;<\/li>\n\n\n\n<li>non-performance;<\/li>\n\n\n\n<li>breach of settlement;<\/li>\n\n\n\n<li>jurisdictional defects;<\/li>\n\n\n\n<li>statutory rights;<\/li>\n\n\n\n<li>child welfare.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But simply saying<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cI regret the settlement.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">is not automatically equivalent to establishing a legally recognized ground for setting it aside.<\/p>\n\n\n\n<h2 id=\"h-mediated-settlements-under-the-mediation-act-2023\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">The Mediation Act, 2023, has strengthened the legal framework surrounding mediated settlements.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 27 provides that an authenticated mediated settlement agreement is final and binding and enforceable in accordance with the statute, subject to the provisions of Section 28.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 28 provides a specific statutory challenge framework for a mediated settlement agreement on specified grounds, including fraud, corruption, impersonation, and mediation of disputes\/matters not fit for mediation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But there is an important caution:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not tell a client that the Mediation Act makes a divorce settlement absolutely impossible to challenge after a particular number of days.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The mediated settlement agreement, divorce decree, custody order, and other proceedings can involve different legal questions and remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A responsible lawyer must identify the particular instrument being challenged.<\/p>\n\n\n\n<h2 id=\"h-my-five-questions-before-you-sign\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" possible<\/li>\n\n\n\n<li>Integrate the settlement with the appropriate court proceedings<\/li>\n\n\n\n<li>Verify completion after the decree<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">This is not a new statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a better way of using the legal machinery that already exists.<\/p>\n\n\n\n<h2 id=\"h-why-i-believe-this-approach-is-better\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_I_Believe_This_Approach_Is_Better\"><\/span>Why I Believe This Approach Is Better<span File \u2192 Divorce \u2192 Hope everything works out.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I recommend:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Disclose \u2192 Verify \u2192 Negotiate \u2192 Stress-test \u2192 Document \u2192 Perform \u2192 Close \u2192 Verify.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That additional discipline may appear unnecessary when a divorce is simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But in a high-value matrimonial dispute involving property, children, business assets, or multiple proceedings, it can make an enormous difference.<\/p>\n\n\n\n<h2 id=\"h-when-you-should-get-legal-advice-before-signing\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_You_Should_Get_Legal_Advice_Before_Signing\"><\/span>When You Should Get Legal Advice Before Signing<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">I would strongly recommend independent legal advice before signing a settlement if your case involves any of the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>substantial alimony;<\/li>\n\n\n\n<li>jointly owned property;<\/li>\n\n\n\n<li>business interests;<\/li>\n\n\n\n<li>NRI\/foreign assets;<\/li>\n\n\n\n<li>minor children;<\/li>\n\n\n\n<li>large jewelry\/stridhan claims;<\/li>\n\n\n\n<li>multiple court proceedings;<\/li>\n\n\n\n<li>domestic violence allegations;<\/li>\n\n\n\n<li>criminal cases;<\/li>\n\n\n\n<li>disputed income;<\/li>\n\n\n\n<li>hidden-asset concerns;<\/li>\n\n\n\n<li>loans or guarantees;<\/li>\n\n\n\n<li>a settlement drafted by the other spouse&#8217;s lawyer;<\/li>\n\n\n\n<li>pressure to sign immediately.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Even if the divorce is genuinely mutual, independent legal advice is not a sign of hostility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is simply risk management.<\/p>\n\n\n\n<h2 id=\"h-a-settlement-should-be-final-but-not-artificially-unchallengeable\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_Settlement_Should_Be_Final%E2%80%94But_Not_Artificially_%E2%80%9CUnchallengeable%E2%80%9D\"><\/span>A Settlement Should Be Final\u2014But Not Artificially \u201cUnchallengeable\u201d<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is perhaps the most important message I would give a client.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Do not ask your lawyer to write:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMake this settlement impossible to challenge.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Instead ask:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cMake the settlement legally sound, fully informed, precise, performable, and enforceable, while preserving rights that the law does not permit us to waive.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is a much more realistic objective.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A truly good settlement does not attempt to defeat the law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It works with the law.<\/p>\n\n\n\n<h2 id=\"h-my-advice-to-husbands-and-wives\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"My_Advice_to_Husbands_and_Wives\"><\/span>My Advice to Husbands and Wives<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDon\u2019t negotiate your divorce to win the past.<br>Negotiate it to protect your future.\u201d \u2014 Adv. Tarun Choudhury<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If you are negotiating a mutual divorce, do not focus only on the headline number.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A \u20b91 crore settlement with an impossible property-transfer clause may be worse than a \u20b975 lakh settlement that can actually be completed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Likewise, a beautifully drafted custody clause may become useless if it does not deal with school holidays, medical emergencies, travel, and communication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And a promise to \u201cwithdraw all cases\u201d may create problems if the relevant proceedings cannot legally be terminated in the manner contemplated by the agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The real measure of a settlement is therefore not<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cDid we sign it?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">It is:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cCan both parties actually perform it, can the court implement the necessary parts, and does it continue to work after the divorce?\u201d<\/p>\n<\/blockquote>\n\n\n\n<h2 id=\"h-the-new-principle-i-recommend-agreement-is-not-completion-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is the central idea I would like clients to remember.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A settlement may say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201c\u20b950 lakh shall be paid.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is an obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A bank transfer showing \u20b950 lakh received is performance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cProperty shall be transferred.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">is an obligation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A properly completed registered transfer instrument and corresponding delivery of possession\/documents may constitute performance, depending on the nature of the transaction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This is why I recommend a settlement closing schedule.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every obligation should be classified as<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Completed\u2014Already performed.<\/li>\n\n\n\n<li>Pending\u2014Agreed but not yet performed.<\/li>\n\n\n\n<li>Conditional\u2014Dependent upon another event.<\/li>\n\n\n\n<li>Continuing\u2014Ongoing, such as child-related expenses.<\/li>\n\n\n\n<li>Court-dependent\u2014Requires an order or action by a court\/authority.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This simple classification can prevent enormous confusion later.<\/p>\n\n\n\n<h2 id=\"h-child-custody-is-not-a-property-bargain-0\" class=\"wp-block-heading\"><span class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThe mother shall have permanent custody and the father shall have no future claim.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Such wording may not adequately reflect the court&#8217;s continuing concern for the child&#8217;s welfare.<\/p>\n\n\n\n<p a good parenting arrangement should deal with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>primary residence;<\/li>\n\n\n\n<li>visitation;<\/li>\n\n\n\n<li>weekends;<\/li>\n\n\n\n<li>holidays;<\/li>\n\n\n\n<li>birthdays;<\/li>\n\n\n\n<li>school events;<\/li>\n\n\n\n<li>education expenses;<\/li>\n\n\n\n<li>medical expenses;<\/li>\n\n\n\n<li>emergency medical decisions;<\/li>\n\n\n\n<li>communication\/video calls;<\/li>\n\n\n\n<li>travel;<\/li>\n\n\n\n<li>passports;<\/li>\n\n\n\n<li>relocation;<\/li>\n\n\n\n<li>important educational decisions.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But it should also recognize that a child&#8217;s circumstances can change.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A five-year-old child and a fifteen-year-old teenager may have completely different needs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Consequently:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">Financial finality can be strong. Parenting arrangements should be stable but capable of lawful adaptation to the child&#8217;s welfare.<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is not a weakness in the settlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is a protection for the child.<\/p>\n\n\n\n<h2 id=\"h-can-child-maintenance-be-permanently-waived-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_Child_Maintenance_Be_Permanently_Waived-2\"><\/span>Can Child Maintenance Be Permanently Waived?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This question requires particular caution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parents can agree upon financial responsibilities for their child.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But one should not casually draft a clause stating:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cNeither parent shall ever claim any maintenance for the child in any circumstances.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The child&#8217;s legal interests cannot simply be treated as the private property of the parents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agreement should instead specify:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>current monthly expenses;<\/li>\n\n\n\n<li>school fees;<\/li>\n\n\n\n<li>medical expenses;<\/li>\n\n\n\n<li>extraordinary expenses;<\/li>\n\n\n\n<li>insurance;<\/li>\n\n\n\n<li>extracurricular activities;<\/li>\n\n\n\n<li>future review mechanism;<\/li>\n\n\n\n<li>responsibility for major unforeseen expenditure.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">And it should make clear that the arrangement operates subject to applicable law and the child&#8217;s welfare.<\/p>\n\n\n\n<h2 id=\"h-what-about-jewellery-and-stridhan-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_About_Jewellery_and_Stridhan-2\"><\/span>What About Jewellery and Stridhan?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Jewelry should not simply be described as<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cAll jewelry has been returned.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">If jewelry is being returned, prepare an itemized inventory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Item<\/th><th>Description<\/th><th>Approx. procedural law, and the powers of the relevant court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Similarly, domestic-violence proceedings cannot always be treated like a private civil contract.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The settlement should therefore contain a Litigation Closure Schedule identifying every case separately.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For each case, state:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>case number;<\/li>\n\n\n\n<li>court;<\/li>\n\n\n\n<li>parties;<\/li>\n\n\n\n<li>present stage;<\/li>\n\n\n\n<li>proposed action;<\/li>\n\n\n\n<li>who must file it;<\/li>\n\n\n\n<li>whether court approval is necessary;<\/li>\n\n\n\n<li>expected sequence;<\/li>\n\n\n\n<li>What happens if the court does not grant the requested relief.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is far safer than a blanket promise that \u201call cases shall be class=\"wp-block-paragraph\">The purpose is simple.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the settlement says:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cHusband will pay \u20b950 lakh and return the jewelry listed in Annexure A.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">Then later one party should not ordinarily be able to say:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cBut during mediation he verbally promised another 500 grams of gold.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">A properly drafted settlement should identify the documents and schedules forming the complete agreement and require material amendments to be recorded in writing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But such a clause should never be drafted as an attempt to legalize fraud or suppress rights that cannot lawfully be waived.<\/p>\n\n\n\n<h2 id=\"h-the-new-settlement-closing-concept-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_New_%E2%80%9CSettlement_Closing%E2%80%9D_Concept-2\"><\/span>The New \u201cSettlement Closing\u201d Concept<span changes their mind.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The precise answer depends on the legal instrument and the ground of challenge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A party may have different rights depending upon whether the document is<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a private settlement agreement;<\/li>\n\n\n\n<li>a mediated settlement agreement;<\/li>\n\n\n\n<li>consent terms recorded by a court;<\/li>\n\n\n\n<li>a mutual-consent divorce petition;<\/li>\n\n\n\n<li>a final divorce decree;<\/li>\n\n\n\n<li>a custody order.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These must not be treated as identical.<\/p>\n\n\n\n<h2 id=\"h-when-a-challenge-may-become-legally-relevant-0\" genuine consent;<\/li>\n\n\n\n<li>non-performance;<\/li>\n\n\n\n<li>breach of settlement;<\/li>\n\n\n\n<li>jurisdictional defects;<\/li>\n\n\n\n<li>statutory rights;<\/li>\n\n\n\n<li>child welfare.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">But simply saying<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cI regret the settlement.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">is not automatically equivalent to establishing a legally recognized ground for setting it aside.<\/p>\n\n\n\n<h2 id=\"h-mediated-settlements-under-the-mediation-act-2023-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"wp-block-paragraph\">Section 28 provides a specific statutory challenge framework for a mediated settlement agreement on specified grounds, including fraud, corruption, impersonation, and divorce decree, custody order, and other proceedings can involve different legal questions and remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A responsible lawyer must identify the particular instrument being challenged.<\/p>\n\n\n\n<h2 id=\"h-my-five-questions-before-you-sign-0\" class=\"wp-block-heading\"><span class=\"ez-toc-section\"
