A husband facing serious or false allegations may need a carefully planned defense. Where children, maintenance, residence, or property are involved, those issues need to be considered separately rather than treated as one large matrimonial dispute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This article explains the principal legal options available to a wife or husband in India and, more importantly, how I believe a person should approach a matrimonial dispute strategically.<\/p>\n\n\n\n<h2 id=\"h-what-is-a-matrimonial-dispute\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Is_a_Matrimonial_Dispute\"><\/span>What Is a Matrimonial Dispute?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A matrimonial dispute is a disagreement between spouses that may involve one or more legal issues arising from the marriage or its breakdown.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Domestic violence<\/li>\n\n\n\n<li>Cruelty<\/li>\n\n\n\n<li>Divorce<\/li>\n\n\n\n<li>Judicial separation<\/li>\n\n\n\n<li>Maintenance<\/li>\n\n\n\n<li>Residence<\/li>\n\n\n\n<li>Child custody<\/li>\n\n\n\n<li>Child support<\/li>\n\n\n\n<li>Stridhan<\/li>\n\n\n\n<li>Jewellery and personal property<\/li>\n\n\n\n<li>Criminal allegations<\/li>\n\n\n\n<li>Financial disputes<\/li>\n\n\n\n<li>Property disputes<\/li>\n\n\n\n<li>Reconciliation<\/li>\n\n\n\n<li>Mediation<\/li>\n\n\n\n<li>Mutual-consent divorce<\/li>\n\n\n\n<li>Enforcement of previous court orders<\/li>\n\n\n\n<li>Settlement of pending cases<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The first mistake I often see is treating all these issues as though they were legally identical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>They are not.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A domestic violence proceeding, a divorce petition, a maintenance proceeding, and a criminal case have different legal purposes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is why a good matrimonial lawyer must look at the entire dispute before recommending the next step.<\/p>\n\n\n\n<h2 id=\"h-domestic-violence-and-matrimonial-disputes-what-does-indian-law-provide\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The Protection of Women from Domestic Violence Act, 2005, provides a protective legal framework for women facing domestic violence in a qualifying domestic relationship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Act recognizes different forms of abuse and provides several possible forms of relief, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Protection orders<\/li>\n\n\n\n<li>Residence orders<\/li>\n\n\n\n<li>Monetary relief<\/li>\n\n\n\n<li>Custody orders<\/li>\n\n\n\n<li>Compensation<\/li>\n\n\n\n<li>Interim and ex parte orders<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The important point is that the DV Act is not simply a law for punishing physical assault.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It can address a broader range of conduct and can provide civil-protective relief through the magistrate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, the precise relief depends upon the facts, evidence, and statutory requirements of the individual case.<\/p>\n\n\n\n<h2 id=\"h-what-can-be-treated-as-domestic-violence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Can_Be_Treated_as_Domestic_Violence\"><\/span>What Can Be Treated as Domestic Violence?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The statutory definition is wider than physical beating.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the facts, domestic violence can include conduct involving:<\/p>\n\n\n\n<h3 id=\"h-physical-abuse\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Physical_Abuse\"><\/span>Physical Abuse<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Such as assault, bodily injury, or other physically abusive conduct.<\/p>\n\n\n\n<h3 id=\"h-sexual-abuse\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Sexual_Abuse\"><\/span>Sexual Abuse<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Conduct of a sexual nature falling within the statutory definition.<\/p>\n\n\n\n<h3 class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Certain forms of humiliation, insults, threats, and other conduct can fall within the statutory framework.<\/p>\n\n\n\n<h3 id=\"h-economic-abuse\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Economic_Abuse\"><\/span>Economic Abuse<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">This can involve conduct affecting financial resources, property, or economic independence in circumstances covered by the Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if a person tells me:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cThere has been no physical assault, but my spouse has completely controlled my finances and subjected me to severe emotional abuse.&#8221;<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">I would not simply dismiss the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I would examine the actual facts against the statutory definition of domestic violence and identify what evidence exists.<\/p>\n\n\n\n<h2 id=\"h-what-legal-action-can-a-wife-take-against-domestic-violence\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Legal_Action_Can_a_Wife_Take_Against_Domestic_Violence\"><\/span>What Legal Action Can a Wife Take Against Domestic Violence?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A woman facing domestic violence may have several potential legal remedies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The appropriate combination depends on the circumstances.<\/p>\n\n\n\n<h3 id=\"h-1-seek-relief-under-the-domestic-violence-act\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_Seek_Relief_Under_the_Domestic_Violence_Act\"><\/span>1. Seek Relief Under the Domestic Violence Act<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">A woman may approach the appropriate magistrate under the DV Act and seek relief available under the statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the case, this may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Protection from further domestic violence<\/li>\n\n\n\n<li>Residence-related relief<\/li>\n\n\n\n<li>Monetary relief<\/li>\n\n\n\n<li>Temporary custody-related relief<\/li>\n\n\n\n<li>Compensation<\/li>\n\n\n\n<li>Interim or ex parte orders<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose is not necessarily to end the marriage.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A woman may seek protection even when she has not yet decided whether she wants a divorce.<\/p>\n\n\n\n<h3 id=\"h-2-seek-criminal-action-where-a-criminal-offence-is-made-out\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_Seek_Criminal_Action_Where_a_Criminal_Offence_Is_Made_Out\"><\/span>2. Seek Criminal Action Where a Criminal Offence Is Made Out<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Domestic violence and criminal offending can overlap, but they are not identical concepts.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where the facts satisfy the ingredients of a criminal offense, appropriate criminal proceedings may be available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Bharatiya Nyaya Sanhita, 2023, Sections 85 and 86 deal with cruelty by a husband or relative of the husband and define the relevant statutory concept of cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because the new criminal laws came into force on 1 July 2024, current legal articles should not simply copy the old IPC framework without considering the applicable law and transitional provisions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The correct provision depends upon the date and facts of the alleged conduct.<\/p>\n\n\n\n<h3 id=\"h-3-seek-maintenance-where-legally-available\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"3_Seek_Maintenance_Where_Legally_Available\"><\/span>3. Seek Maintenance Where Legally Available<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Financial insecurity is one of the most serious consequences of marital breakdown.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the circumstances and applicable law, maintenance may arise under different statutory frameworks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, the law may involve:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>BNSS maintenance provisions<\/li>\n\n\n\n<li>Hindu Marriage Act provisions<\/li>\n\n\n\n<li>Hindu Adoptions and Maintenance Act<\/li>\n\n\n\n<li>Domestic Violence Act monetary relief<\/li>\n\n\n\n<li>Other applicable personal or statutory laws<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s decision in Rajnesh v. Neha is particularly important when dealing with maintenance litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Court addressed issues including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Overlapping maintenance proceedings<\/li>\n\n\n\n<li>Disclosure of assets and liabilities<\/li>\n\n\n\n<li>Determination of maintenance<\/li>\n\n\n\n<li>Previous maintenance proceedings<\/li>\n\n\n\n<li>Enforcement<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This is why I advise clients not to look at maintenance as an isolated application.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawyer should first understand the client&#8217;s complete financial and litigation position.<\/p>\n\n\n\n<h3 id=\"h-4-protect-your-residence-rights\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"4_Protect_Your_Residence_Rights\"><\/span>4. Protect Your Residence Rights<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">One of the most misunderstood questions in domestic violence litigation is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cCan my husband or in-laws simply throw me out of the house?\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">The answer cannot be determined merely by looking at whose name appears on the title document.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Section 17 of the DV Act concerns the right to reside in a shared household, subject to the statutory framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court&#8217;s judgment in Satish Chander Ahuja v. Sneha Ahuja is particularly important in understanding the expression \u201cshared household.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The facts of every case must nevertheless be examined individually.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Property ownership and residence rights are related questions, but they are not automatically the same legal question.<\/p>\n\n\n\n<h3 id=\"h-5-what-about-stridhan\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_What_About_Stridhan\"><\/span>5. What About Stridhan?<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Stridhan should not be casually treated as ordinary matrimonial property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jewelry, gifts, and other property belonging to a woman may raise important ownership and entrustment questions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has repeatedly recognized the proprietary character of a woman&#8217;s stridhan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Therefore, if jewelry or other property has been retained by another documented, the easier it becomes to assess the appropriate legal remedy.<\/p>\n\n\n\n<h2 id=\"h-what-can-a-husband-do-in-a-matrimonial-dispute\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_Can_a_Husband_Do_in_a_Matrimonial_Dispute\"><\/span>What Can a Husband Do in a Matrimonial Dispute?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This question is equally important.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I want to make one point absolutely clear:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Domestic Violence Act is not a reciprocal husband-versus-wife statute.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A husband cannot simply file a DV Act case against his wife because he believes that he has suffered emotional distress or marital harassment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">His legal remedies must be identified under the laws that actually apply to his circumstances.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Depending upon the facts, a husband may consider:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Divorce on the ground of cruelty<\/li>\n\n\n\n<li>Judicial separation<\/li>\n\n\n\n<li>Defense against criminal allegations<\/li>\n\n\n\n<li>Appropriate bail remedies where necessary<\/li>\n\n\n\n<li>Discharge or quashing remedies in legally appropriate cases<\/li>\n\n\n\n<li>Child custody\/guardianship proceedings<\/li>\n\n\n\n<li>Maintenance-related legal responses<\/li>\n\n\n\n<li>Property-related remedies<\/li>\n\n\n\n<li>Appropriate civil or criminal remedies<\/li>\n\n\n\n<li>Mediation or negotiated settlement<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The exact remedy depends on the facts.<\/p>\n\n\n\n<h2 id=\"h-can-a-husband-get-divorce-because-of-cruelty\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Can_a_Husband_Get_Divorce_Because_of_Cruelty\"><\/span>Can a Husband Get Divorce Because of Cruelty?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Yes, where the applicable matrimonial law provides cruelty as a ground and the statutory requirements are satisfied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, under Section 13 of the Hindu Marriage Act, cruelty is a ground upon which either spouse may seek divorce.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But I caution clients against assuming that every unpleasant marital experience constitutes legal cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Courts examine the nature, seriousness, and circumstances of the conduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A disagreement between spouses is not automatically cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neither is every accusation automatically proof of cruelty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The evidence and surrounding circumstances matter.<\/p>\n\n\n\n<h2 id=\"h-what-if-a-husband-is-falsely-accused\" class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_If_a_Husband_Is_Falsely_Accused\"><\/span>What If a Husband Is Falsely Accused?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">This is one of the most sensitive areas of matrimonial litigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">I have seen two opposite mistakes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The first is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cEvery case filed by a wife is false.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is plainly an unsafe generalization.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The second is<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p class=\"wp-block-paragraph\">\u201cOnce a complaint has been filed, the husband is automatically guilty.\u201d<\/p>\n<\/blockquote>\n\n\n\n<p class=\"wp-block-paragraph\">That is equally wrong.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has, in appropriate cases, intervened where allegations against relatives were vague, general, or omnibus and did not disclose sufficient material against particular accused persons.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson is not that matrimonial complaints are false.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lesson is<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every allegation must be examined against the actual statutory ingredients, the specific role attributed to each person, and the available material.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If a husband or relative receives a criminal complaint, I
